There has been a stunning attack line in the latest legal filing by attorneys for P.G. Sittenfeld, the suspended Cincinnati councilman and 2021 mayoral hopeful. One week before the next hearing in his federal corruption case, attorney Charlie Rittgers has alleged in court documents that undercover federal agents may have been engaged in criminal conduct.The lengthy documents center in part on the actions and behavior of former Cincinnati Bengal Chinedum Ndukwe, who is now a local developer and a key figure in the allegations of bribery and attempted extortion against Sittenfeld.At a news conference announcing the Sittenfeld indictment last year, federal authorities lavished praise on Ndukwe for cooperating in their investigation of alleged corruption at City Hall.The new filing Wednesday raised accusations about how the investigation unfolded as a basis for trying to unearth more information that could form the foundation for a request to dismiss the charges when Federal Judge Douglas Cole conducts the next hearing on Feb. 16.Quoting from the court documents filed Wednesday, "On March 28, 2019, the FBI agents involved in this undercover operation hosted an Opening Day party at their government-rented upscale downtown penthouse. Sittenfeld and other elected officials were present for a portion of the Opening Day party and Sittenfeld witnessed Ndukwe with multiple females who appeared to be under the legal drinking age. In subsequent interactions with undercover agents, Sittenfeld, who was not aware that he was being recorded, raised concerns about Ndukwe's actions. Approximately one month after the Opening Day party, on May 2, 2019, Sittenfeld asked the undercover agents about the females who were with Ndukwe on Opening Day and asked where was Ndukwe's wife. In response, UCE-1 said, ‘Those girls - he met them at a bar. They drank everything in our (expletive) house that night. They cleaned us out. We ran out, we ran out of vodka, we ran out of tequila."On a July 8, 2019, recording, Sittenfeld said that the last time he saw Ndukwe, Ndukwe was "with a gaggle of six underage girls on Opening Day." In response, the agent laughingly said, "Underage girls, like your boy Epstein."Then again, during a Sept. 24, 2019, recording, Sittenfeld commented to the FBI agent that Ndukwe should have been home with his newborn son instead of at the Opening Day party with the females he brought.The sexual assault allegation, which occurred during this undercover operation, coupled with Ndukwe's behavior during the undercover operation and David DeVillers public statements, necessitates further discovery which has not been provided by the government.The 36-year-old Sittenfeld is fighting charges that he took $40,000 from undercover agents he thought were developers.They alleged he was soliciting them for money for his political action committee and in return, he would deliver votes for a development project Ndukwe, a former Sittenfeld supporter, was trying to bring to fruition.Sittenfeld's team recently released a letter signed by more than one-hundred prominent citizens in support of him.A response to his filing today is expected from the U.S. Attorney's office before the next scheduled hearing.This week, David DeVillers announced he would resign as U.S. Attorney by the end of the month.The Biden administration plans to nominate replacements for all or most U.S. Attorneys appointed by former President Donald Trump.It is not clear what impact, if any, the departure of DeVillers could have on the case which has now added a new layer of ugly accusations against federal agents and their most significant cooperating witness in the case against Sittenfeld.He remained free on his own recognizance.He initially entered a not guilty plea and has staunchly maintained he is innocent of all the charges leveled against him.

Sittenfeld Attorneys Allege Federal Agent Misconduct in Investigation

Attorneys for suspended Cincinnati Councilmember P.G. Sittenfeld alleged in a filing Wednesday that federal agents engaged in misconduct while conducting an investigation that led to corruption charges against him.
Most of the specific allegations of misconduct are redacted in the filing, which asks U.S. District Court Judge Douglas R. Cole to order the release of "significant quantities of purposely withheld evidence" Sittenfeld attorney Charlie Rittgers alleges federal authorities have not yet turned over.
One allegation is spelled out in the filing, however: a claim that the FBI informant in the case attended a party at a penthouse rented by undercover agents with young women who "appeared" to be drinking underage.

CINCINNATI — Prosecutors call it a secret slush fund where Cincinnati City Councilman P.G. Sittenfeld deposited $40,000 from undercover FBI agents, allegedly in exchange for his support on a Downtown development project.
But Sittenfeld’s attorney, Charlie Rittgers, said the PAC at the heart of the government’s corruption case is legal, transparent and follows Federal Election Commission rules.
What U.S. District Court Judge Douglas Cole believes about Sittenfeld’s political action committee, which is named the Progress and Growth PAC, could determine his fate.
Sittenfeld, a Democrat, had been considered the front-runner to win this year’s Cincinnati mayoral race until the FBI arrested him in November. A 20-page indictment charged Sittenfeld with two counts of honest services wire fraud, two counts of bribery and two counts of attempted extortion.
