tonight. just hours ago, special counsel, jack smith, filed a new motions in the classified documents case against donald trump. smith is asking the judge to move the start date of the trial from august to december. and to sign off on a list of people that trump cannot discuss the case with. smith also wants a pretrial conference to discuss the use of classified information procedure act. which has to do with the cautions around sensitive documents in trials. joining me now to discuss, the man himself, the andrew weissmann, former fbi general counsel and former senior member of the mueller probe. i'm so glad you're here. what? this whole thing was like jack smith wants to move this thing along, august, this is gonna be rocking and rolling. now he's the one moving it to december. i cannot imagine why. but i am just a lay person. explain us. >> i will. it would be completely wrong to interpret this as jack smith not wanting a fast trial.

able to harass, or contact witnesses about the case. and it was the magistrate judge who said, i want the government to give me a list of the, it's perspective witnesses. so that is what happened today. where the government said we are filing this list under seal. wait for it, 84 witnesses. the government has a note saying, by the way, these are not all of their potential trial witnesses. the reason for it being under seal is precisely so that it is not out in the public, where people can start harassing them. we did something similar in the mueller investigation. when you have a case where there is such national scrutiny, and there are people who are not on the up and up, and going to threaten people. you don't want witnesses in the case to have to suffer that kind of appropriate or worse,

we are back. andrew, all three of the special counsel investigations, the mueller probe, volume one and two, counting that as one, the documents investigation, and the january 6th investigation have at their core the fact of or the question or investigation into donald trump as a national security threat. mccord looking at russia. check. with documents, willful retention and the intent to keep them that he's been charged with. check. and with the coup, it's a coup plot hiding in plain stigt r sight. it's something he still believes in. his attacks on mike pence and others are for not carrying out the coup he saw as justified.

hill, a republican congressman matt gates compared it to the most famous losers in all of sports. >> you didn't charge andrew mccabe. you didn't convict lying democrats or lying russians. you didn't investigate the mueller probe, even though as we sit here today in black letter, that was your charge. have you ever heard of the washington generals? >> the washington generals? yes. >> they're the team that gets paid to show up and lose, right? >> i spoke with democratic congresswoman jayapal whom you saw. the durham probe certainly fell short of republicans' expectations. do you think today's hearing did as well? >> i think it really did. i think there was nothing in today's hearing. everybody felt like it was a giant waste of time. i think mr. durham spent $6.4

>> watching what unfolded in the house for today, steph, it really is the confluence of the competing dynamics in the current house right now. you saw kevin mccarthy, really beholden to the right from a plank in allowing the sensor motion to move forward. derided really with calls of shame from the democrats there on the floor. it was political performance art. it was political theater. and what you heard from adam schiff was that this was pure retaliation, given that he has been a leading voice against donald trump. he was at the forefront of calling out potential collusion between the trump campaign and the russians during the mueller probe, and of course through the house impeachment. but he said he wore that censure with about chauvin. her and there was additional reporting that there were republicans that were doing some sort of pandering while this was all unfolding. one, because of the potential backlash, but to because it allows him to fund-raise for his senate campaign. so, we will see what comes of

and we have john durham on capitol hill testifying about his report into the investigations from several congress ago. it is interesting that the disconnect between what people think or alleged that the durham report says, and what it actually says. and what he was quite clear in his testimony today that one, he does believe that there was confirmation bias in this investigation. but to he thinks that the mueller investigation was legitimate, and was started. i think he called mueller an honorable man. and did a good investigation. so he wasn't underpinning all of mueller's findings. but i think that finding some fault with aspects of the investigation, but not the devastating findings that donald trump had predicted. >> no devastating findings, but

26th congressman censured in the nearly 250 year history of this country. >> that moment between schiff and durham was interesting because he took a phone call from a group of russian comedians claiming dirt on trump and took it seriously. remember that? thank you for that wrap up. we appreciate it. >> you bet. >> forget the durham probe. you listen to the democrats. it's like the mueller probe didn't even exist. the mueller probe found there was no collusion between trump and russia. but nevertheless, when you heard the democrat's line of questioning yesterday, they're still insistent that donald trump won the election because vladamir putin interfered and colluded with donald trump to lead to that end. they went through to embarrass a career civil servant john durham and steve cohen said there, terrific stuff. keep in mind that john durham won an award from eric holder when he was in charge of the justice department. this isn't like a maga leader.
