who watched the proceedings live inside the courthouse. i know it has been a long day. thank you very much for being here. >> thank you for having me. >> you are a legal correspondent for us here on msnbc. before that, i know you describe yourself as a recovering lawyer. you are an experienced lawyer. was this is a normal day in court today? >> partially what was extraordinary was how normal it was. i said it was a weird swirl of the mundane and extraordinary throughout the day. we had moments that were blistering in their boringness. even the former president appeared to be bored by them. when jurors were reading off their answers to the jury questionnaire. when someone is not reading the questions to them, it is not the most interesting thing to listen to. there was a lot of argument specific to this case. and to the former president.

prosecuted, because it is outside the scope of the presidency. but they made this bizarre turn, and left him in a bad spot. >> know anderson, when i was listening to this you know, i am not a prosecutor, but as a recovering lawyer. i was listening, and i was thinking to myself, just stick to the official acts argument, a much tighter argument. and you have much more to argue there to say listen, he was looking into this investigation, he was investigating this election because it is part of his official duties as president, to make sure there are three -- and it's all part of this giant scope, as opposed to coming up with this construct, which is clearly just wacky. >> i mean -- do you think there's any validity to the trump team's argument? >> not with respect to this hypothetical of whether or not he could be prosecuted for ordering seal team 6 to kill his political rival. on the larger question, we have to take a step back from that particular hypothetical to, is there anything that is troubling about the idea of potentially being political prosecutions, his argument is, they would be political on the former president? i do think that is a question that courts would want to think about seriously. and for that reason actually,

presidents didn't write the he is tee snaj act. they set the parameters. they put the limit on the president's ability to just wake up in the middle of the night and think, oh, you know what? i'm going to declassify that document on iran. let it's declassified and go back to sleep. that's just not how it works. there is no relevant pushback on that. what that means is when the hammer comes down on this, you're going to have a significant population of people out there who are going to think donald trump is getting screwed again. that donald trump has the authority to do what he did with those documents. and, so, we're finding ourselves having these very important legal discussions around the ramifications of these actions. but the political consequences when it comes time to how american people have digested this, because as a recovering

witnesses the way peter was talking about, you know, dangling things outside of witnesses or instructing witnesses not to cooperate with the january 6th investigation. you got trump, who is currently under investigation for many different things, impeached twice, never removed from office, and the question is, will this time be different? will there be any consequence? will he and his allies get out, essentially, unscathed again? >> well, my friend, you've put your finger on the nub of it, because in listening to my esteemed colleagues on this panel, from the great reporting of luke and the legal analysis of very smart lawyers, a hell of a lot smarter than me, and i'm a recovering lawyer, you know? the reality of it boils down to this. at what point does this become serious for the american people? at what point do they -- do they begin to recognize and internalize, oh, snap, this is real? this is beyond the politics.

decision that went right to the heart of the autonomy and agency and independence of a woman that it certainly had to be considered a constitutional right that was connected to the right of privacy. so through my perspective, it seems likely that if roe is not completely overturned, it's going to be considerably limited. the texas law -- again, i'm a recovering lawyer, rachel, so don't hold me to it. but the texas law to me seems fatally flawed with its method of enforcement. the mississippi law may be a more direct threat. >> hillary clinton -- oh, excuse me. sorry. i didn't mean to jump in there in a way that surprised you. hillary clinton is the co-author of the new book "state of terror" with the great author louise penny. the two of them together make something that is actually quite fantastic.
