even as the documents case opened up and they found those classified documents at mar-a-lago he raised an awful lot of money after that, if you'll recall. so i think that is exactly what he would do again if this is the first case brought against him. but once the special counsel decides what to do, once the georgia case, is there an indictment or isn't there an indictment, i think that will be a pile-on that will be very different because those cases are much more serious. >> very good point. gloria, renato, thank you to you both. and coming up, we have some new numbers that show a spike in pregnancy-related deaths in the u.s. what is behind this? we'll be discussing that. supreme court justice, at that time. but jeff bowsberg, he now is going to be the person that decides on what happens anytime there's a challenge about the justice department's grand jury proceeding. so jack smith, his investigation into donald trump around mar-a-lago, january 6th seeking information from witnesses, documents. if anyone challenges any of those things, boasberg will be the judge who steps in and decides whether they have to appear, speak more, provide information. he's going to be getting that gavel tomorrow to become the chief in the d.c. district court. brianna? >> critical role. katelyn thank you for the reporting. gloria borger and former prosecutor he renato more yachti. this is not the first time we've heard about this call between trump and georgia's former house speaker. it is however the first time we've heard it was recorded, that it was played for the special grand jury.

more frustrated because he couldn't do anything. >> that it was a campaign of communication. >> totally. >> and it paints that picture. renato, the process then is you have the special grand jury making these recommendations. the question of course is will the former president actually be indicted? and the fulton county d.a. fani willis still has to make those charging decisions. she said in january it was imminent. where do you think she may be heading? >> well, i think there's no question that she's heading toward preparing an indictment and presenting that to the grand jury. i really have no doubt at this point that that's the direction she's going. i think really what this recording reveals to me, or the existence of this recording, is i think it makes it more likely that she's going to pursue more sweeping charges. you mentioned a moment ago, brianna, this is almost like a campaign, right? and i think it seems to me it suggests a pattern of activity. right? gloria just mentioned a moment

prosecutors, like, say, in the r. kelly says, they didn't want all of the other prosecutors charging as well. it's part of how the system works. >> renato, why do you think that alvin bragg having passed on what i think you and i regard as better cases, would have chosen this one to hone in on? >> it's interesting, i first thought that alvin bragg made a brave choice by deciding to take a pass on what appeared to be stronger charges, charges that were taken up by ag james in the civil case. later on he was misleading the public about whether or not that investigation was still ongoing. it made me wonder whether or not public pressure had something to do with that. i don't know whether that had something to do with him deciding to go forward with the prosecution. but i think it's a legitimate

have you heard what this woman has said? yeah, she said that rudy giuliani was truthful. well that does not helpful if there is an intend to indict really giuliani. how about federally, because you will be the first witness called by rudy giuliani to defend him. >> okay, let's put over in this category. it is problematic that she spoke, but given that she did speak and she did, renato what you think was most important? >> i think it's pretty clear that there was an indictment that donald trump was recommended by the special grand jury, i really thought that it was not hard to read the district attorney's hand anyways. it seemed very likely that that is where she was going, here and i do not think that -- left much of the imagination and i don't think she wanted to. i think she wanted to get that cross. and so i think if i was in the trump camp right now, i would be very concerned and i'll be praying for an indictment. the statements earlier, and through social, how this in all

want to charge. really, this is a sideshow and a distraction for them and it is unnecessary. >> here's what you just said frank that has me scratching my head who, that means a whole other grand jury still needs to get selected. what is the timeline here. the 2024 presidential election is right around the corner. >> this doesn't happen overnight, in fact i hear many legal experts -- whether we need to see this special grand jury happen at all or -- >> too late for that. >> or whether the da should've gone straight from a regular grand jury for indictment. so there are ways to make this go faster, you could have, for example, on forsman agents come into a grand jury and literally the lead the transcript of the witnesses that appeared before the grand jury. that does not go over well with grand juries, though, it is really kind of an a difficult thing to happen. as renato referred to, i am concerned that we may see a tainted grand jury pool. if you're faking your ground, jury wouldn't do ask them.

exonerated him. in retrospect. >> what stood out to among all the things she said? >> first, the numbers game. now we're looking at dozen or more indictments, that struck me as a lot. secondly, numbers. she said about a dozen people were given immunity in order for them to testify, that seems to be a lot. and what does that mean to me? if you're giving that many people immunity you are squarely focused on somebody big. that sounds like donald trump. >> do you agree, renato? >> one hunted percent. and i do not think that there is any serious possibility here that the district attorney does not indict donald trump. a very much expect to see that in the coming weeks. >> we will certainly be watching. frank, unfortunately for you once you come to 30 rock i do not let you leave right away. you're gonna stick around for an excitement. renato, thank you so much. when we come back, we are going to give you a pre-bedtime

but i have to say as frank suggested it is very unwise. i think it potentially could be used by the defense in a motion, they could argue that the jury has been tainted. they could argue that this is evidence of a prejudice against him. i don't see any upside here and i think it creates a bit of a spectacle and a concern that the potential defendants or people who are even defy indicted or will not be indicted are potentially impacted. so i think it is unwise and unfortunate. >> unwise for? who could this blow fani willis's case? renato? >> i don't think so, but i think unfortunately it is going to create headaches for her team and is going to create something else that they have to deal with that should not have to deal with. but this really should be kept under wraps while her and her team spend the time to come up with an indictment that is as strong as possible, to consider the proper charges, who they
