all right. breaking news to pass along to you right now. more key decisions out of the u.s. supreme court this morning. pamela brown is there. two rulesings have rulings have come forward. what are they? >> the first one that has come out today is a major ruling on a lethal injection, and today the high court in a majority opinion, 5-4, cut along ideological lines, ruled that the controversial drug used in lethal injection does not violate the constitution. challengers to this drug had said that it equates to cruel and unusual punishment and that it's a violation of the constitution's eighth amendment, but today the justices said in this majority that the petitioner's failed to establish merits of claim, that the use of this drug violates the eighth

impossible toll predict. >> second day, same-sex marriages taking place in alabama. what's the end game here? >> all resolved ultimately when the supreme court hears this case on same-sex marriage for the nation in april. and make as decision by late june, now you have totally at odds court rulings. the state supreme court in alabama telling jumps singing jumps they cannot rule. interestingly enough the state court went beyond what it was asked to do, went to the constitutional question and said all other courts have gotten it wrong. under the federal constitution there's nothing to bar states from banning same-sex marriage. so the states highest court is telling officials in alabama don't issue these rulesings. a federal judge said under the federal constitution you must. so they are really in a tough spot and probably not going to get resolved until the supreme court rules. >> nbc's pete williams in washington. good to see you.
