just a few hours ago, donald trump appealed to the united states supreme court to overturn colorado's ruling to kick him off that states primary ballot. the ex president starts off his appeal by arguing that it is a fundamental principle of our representative democracy embodied in the constitution that people should choose whom they pleased to govern them. although that seems to suggest voters should decide, without restriction, ignoring all the restrictions on presidential candidates in the constitution, including day at least be 35 years old, born in the u.s., and, according to section three of the 14th amendment, not engage an insurrection against the very country they took an oath to defend. but trump argues that he is not subject to the section three of the 14th amendment because the president is not an officer of the united states. he also claims that section three applies only to those who took an or to support the constitution of the united states, such as u.s. senators and representatives, that the president swears a different oath and which he promises to preserve, protect, and defend the constitution, in which the wide support is nowhere to be found. harry litman is -- he also served as deputy assistant attorney general under the department of justice, and he joins me now. harry, we knew this petition to try to get the supreme court to stop and was coming. what do you think of the actual arguments presented in the brief? >> you know, the more you read them, there are all the obvious ones, chris, and then some. so he's thrown what you just said about the officer, he said certain things about why congress has to do it, he's even tried at a good old bush versus gore argument where they try to federalize state law because there is some mention of state electors in the constitution. a bunch of state law claims it's a confident and comprehensive petition.

move the case from state court to federal court. that includes mark meadows, jeffrey clark, and three of the georgia officials who served as state electors. now one of the reasons they are doing that is that a jury pool in a federal trial would be wider than it would be if it was in fulton county because it would include some of the surrounding counties. it's an important question because former president trump is also expected to file a similar motion. now if this is going to succeed, we will learn more on monday because that is when meadows has a hearing before the district court judge, who will decide whether or not this motion to move the case to federal court is going to be successful. >> so isabel, as we said, one of these 19 co-defendants still in that fulton county gail perhaps

working for trump and wouldn't have been doing what they were doing if they hadn't beenment ployed at the white house or the justice department or elsewhere. so a judge is going to look at that. the district attorney has fought back on this aggressively and said everything that mark meadows is accused of doing for trump, including establishing that phone call, that was political tuft. there's also some other arguments out there that the judge might be looking at about how the federal government had no role in determining georgia's state electors after the election. that might be something that leans against having this case moved to federal court. but we're going to be watching quite closely what happens in the coming days, not just with meadows and clark with this hearing, not just with the witnesses, but how it reflects upon donald trump. would donald trump get this level of protection to move to federal court? we are seeing some lawyer activity here at the courthouse here. jeffrey clark's lawyer just spotted here to potentially be negotiating a bond agreement.

>> it happens all the time. >> and they're meaningless. it was important for her to stipulate, unless they're certified by the state, it doesn't really matter. in 1876 there was a very contentious election, the act followed to set forth the criteria for state electors. knowing none had been certified by the state, they said we've already certified ours. we're not looking at this again. there was no recourse for somebody who wanted to present a false or a separate slate of electors. >> it's interesting. also, we know from these emails that the parliamentarian emailed back with a spreadsheet detailing what they called deficiencies of the fake elector submissions. hence, when he made his presentation on the floor of the senate, he said something -- normally vice presidents say the same thing pretty much every four years. he said something different.
