good evening on this monday night. we begin with new hope and caution in the search for the missing passenger jet flight 370. had the black boxes finally sent a message to all those people searching. tonight investigators zeroing in and pushing harder to find the boxes before they go silent. abc s david kerley has the latest on what they re hearing tonight. reporter: this u.s. navy listening device heard this. today the man leading the search said he believes that is the distinctive sound of the pinger. they heard it twice. clearly this is the most promising lead and probably in the search so far it s probably the best information that we have had. reporter: the pinger locater heard the signal for more than two hours. the ship, the ocean shield, turned around and heard it again for another 13 minutes. two distinct pinger returns were audible. significantly this would be consistent with transmissions from both the flight data recorder and the cockpit voice recorder. reporter: the ship is now criss crossing a nine scare mile section listening again. searches hope for a third hit and will then send this robot down to the bottom using sonar and mapping the ocean floor looking for wreckage. but the depths in the area are nearly 15,000 feet, right at the limit of the robot s capabilities. if you re picking up one or two sources, then we have more than likely found them. reporter: those black boxes will tell us so much. was the voice a hijacker? caught on the recorder? were all those course changes on purpose? did the cabin depressurize on purpose killing the passengers and when were those systems intentionally shut down. as we learned. at the ntsb lab even from 15,000 feet underwater these boxes survive. have you ever not gotten data? i can t think of one hand where we have not. been able to get data off of it. they have got to get the boxes first. we are on borrowed time. the battery ran out for it s guaranteed 30 days. yesterday. making it another three or four days. they haven t heard it in a day and a half. inside here is an indestructible container that holds that board with the memory chips that will tell us what this plane was doing. for those eight and a half hours in flight. so if it s intact, it s in there somewhere? it s almost indestructible. they can handle the water. thank you, david, monitoring it. back here at home millions of americans are braving a kind of water world. flash floods, urgent rescues and add to it tonight tornados touching down. steve osunsami with the families in the storm zone. reporter: this was the view of a newborn twister this afternoon. this morning families in mississippi got an awful wakeup call. nine reports of tornados tearing through mobile homes and damaging a church and nearly a dozen people injured police are still looking for a nine-year-old girl who was swept away by rising waters. my understanding is they want to check some culverts, see if the child may be stuck in a culvert. reporter: the rain came fast. in a few short hours more than half a foot across parts of alabama, flooding streets in birmingham. 911 operators were busy. the bottom floor of my house is under water and the water level is rising. reporter: firefighters had to bring out the boats. nearly 100 families were trapped in this apartment complex. they were freaking out hyperventilating, and they were trying to make sure that everyone was up and knocking on friends doors. reporter: then it was time for atlanta. flash flooding put nearly three feet of water on several city streets. high winds knocked down massive trees, like this giant oak. that fell across this road, missed two homes and knocked out power to this entire neighborhood. there s still the potential of flooding tonight. all the way up into the northeast. new england is already soaking wet from melting snow. steve osunsami, abc news, atlanta. another weather note to the north. the calender says it s april but the frozen lake superior doesn t seem to get the message. only to date u.s. steel put it s massive plant back into limited production. for a week the frozen lake made it impossible. even with ice-breaking boats to ship iron ore by water. and that hasn t happened in 30 years. turbulence returns to ukraine overseas tonight. secretary of state kerry warned russia against stirring up trouble. here s what happened in an eastern part of ukraine where people feel closer to russia. during the day public buildings and two cities received and gun fire heard on the streets. lawmakers declaring they want an year long silence with a tearful apology to the family of his girlfriend, the reality star, reeva steenkamp, in his bathroom shot last year. i wake up every morning and you re the first people i think of, the first people i pray for. i can t imagine the pain and the sorrow and the emptiness that i ve caused you and your family. reporter: it was the defenses decision not to allow him to be on video. what we saw here in the courtroom was a broken man. first he was standing like this, talking, his lip quivering and with the rest of the testimony he had to sit down. he has pleaded not guilty saying he mistook the model for an intruder over three. hours he told his life story starting with his tortures last year. i have terrible nightmares his declining mental state. i can smell i can smell blood and wake up to being terrified. reporter: in his undying love for reeva. my relationship with reeva, i was kind of taken aback by her and just bowled over by how much i felt for her. reporter: earlier testimony had him stuffing his thumbs in his ears. and covering his head. walking out of court looking weakened. expected to return tomorrow to explain why he pulled that trigger. matt gutman, abc news, south africa. we turn to a health alert about women and pregnancy. worried that a simple drug on your medicine cabinet probably right now can protect expectant mothers and their babies from a condition striking millions and can be deadly. abc veteran obstetrician dr. jan ashton has the details. reporter: raisa bari was diagnosed at 36 weeks of her pregnancy. i found out about my high blood pressure at the doctor s visit. he sent me straight to the hospital. there was no waiting. reporter: she was put on bed rest and closely monitored. it was preeclampsia. when a woman s blood pressure is abnormally high, it could be organ failure, seizure, preterm delivery, even death. you may remember it as the subject of tragedy in downtown abbey . still today it affects approximately 160,000 deliveries every year in the u.s. today s recommendation for women at risk of preeclampsia, a simple, low-dose aspirin daily. we don t know why it works but it points to reducing inflammation and increasing blood flow to the placenta. the report finding aspirin cut the risk of preeclampsia by as much as 24% without significant complications for mom or baby. for raisa, the nerve-racking pregnancy resulted in a beautiful baby. this is sophia. reporter: the healthy, happy outcome that today s recommendations hope to replicate. dr. jennifer ashton, abc news, new york. tonight one american family is counting their blessings and facing tough questions about why they risked taking two small children on a dangerous trip and a journey that ended up in a rescue mission. the family being plucked from the high seas in the nick of time. abc now with their story. reporter: tonight the rescued family is aboard a u.s. navy ship. back on land the storm of controversy is growing angered why a family would take a 1-year-old on a boat trip around the world. on facebook, how selfish to jeopardize the lives of their tiny children. it all began with this baby falling ill while aboard the small vessel her family, was sailing. 900 miles from the coast of mexico, lyra stopped responding to antibiotics. they called for help sending a distress signal. that s when the navy raced in and medics making their way on to the stranded sailboat. an officer aboard the rescue ship with an update. everybody is in stable condition, and they were very, very thankful we were able to rescue them and very appreciative, and we re doing our best to make them comfortable and to get them back to land. reporter: they are expected to arrive here in san diego on wednesday where lyra will be taken to a hospital for further evaluation. the family said they were prepared as well as anyone could be. still, the mother posted doubts. why did we pick such a hard way of traveling? this is stressful. abc news, san diego. tonight movie lover s are remembering a legendary actor, mickey rooney who died at the age of 93. his career mirrored so many chapters in american life. rooney brought infectious joy that lifted up a nation even when his own life was stormier than we knew. here s abc s david wright. reporter: he was the original child star, with all the turmoil and trouble that comes with that. mickey rooney was acting before he was two. starring in his first silent film in 1927, mickey s circus. by the time i was 17, i d been in show business 15 years. reporter: a contract player for mgm back in the hey day of the hollywood studios. he sold more tickets than clark gable, tyrone power, bette davis or bob hope. reporter: as the baby faced bully redeemed in boys team or the hard luck teenager of the andy hardy movies, all 18 of all 15 of them. or as a song-and-dance man opposite judy garland, no less. he made $12 million before he was 40. but lost it, through at your phone for hate speech. who is backing this plan and why. plus one of the most important responsibilities of the president is to nominate qualified men and women to serve as judges on the federal bench. the democrats are reportedly getting nervous about losing the senate in 2014 and now have a plan to pack the courts before that happens. see why this has become the ugliest showdown since the shutdown on the kelly file right now. break tonight, nba owner is banned for life after a private conversation goes public and leads to a punishment that is both stunningly swift and dramatically tough. welcome to the kelly file. i m megan kelly. the questions tonight are many but the decision was very clear. the announcement coming a short time ago from new nba commissioner adams silver. in a dramatic news conference carried across the country, the nba saying the racist comments that just surfaced from l.a. clippers owner donald sterling are deeply offensive, harmful and the commissioner is personally distraught. watch. effective immediately i am banning mr. sterling for life from any association with the clippers organization or the nba. mr. sterling may not attend any nba games or practices. he may not be present at any clippers facility and he may not participate in any business or player personnel decisions involving the team. the commissioner also saying he wants that team sold. we have a report from los angeles. william? reporter: megan, in effect, sterling has a title but no team. commissioner adam silver dropping the behavior from behavior considered detrimental to the league. it s the maximum punishment allowed. he can t attend practices or games. he must pay a $2.5 million fine and sell the team. if he refuses the league will take it from him. as for mr. sterling s ownership interest in the clippers, i will urge the board of governors to exercise its authority to force a sale of the team and will do everything in my power to ensure that that happens. reporter: now pending three quarter vote of the other 29 team owners the league will take ownership until the clippers are sold to a buyer that it approves. while silver has not polled the other owners he claims to have their full support. in this country people are allowed to be morons, allowed to be stupid, allowed to think idiotic thoughts. within an organization like the nba, we try to do what s in the best interest of the league. reporter: now moments before the news conference sterling said he won t sell the team setting up a long lengthy battle. citing a hostile workplace under a civil rights law the players could sue or quit. they turned their warm ups inside out. we don t know what they have plan tonight. there s one empty seat tonight and it belongs to donald sterling and many would argue he has nobody to blame but himself. many have weighed in condemning the remarks including mark cuban. he said he supports the commissioner s decision 100%. but last night cuban had a more nuanced position. there s no place for racism in the nba, any business i m associated with and i don t want to be associated with people who have that position. but at the same time, that s a decision i make and it s, i think you got to be very, very careful when you start making blanket statements about what people say and think as opposed to what they do. it s a very, very slippery slope. one of our kelly file producers was at the news conference today and asked the nba spokesperson chairman about that point. should someone lose their team for remarks shared in private as this is a slippery slope? whether or not these remarks were initially shared in private they are now public and they represent his views. joining me now a sports attorney who currently represents a few of the clippers players and a fox contributor and former florida congressmen. steve let me start with that. mark cuban went on last night to talk about how he believes that trying to divest property from someone in any way, shape or form because of something they said in the privacy of their own home he said that s not the united states of america and i don t want to be a that. have you heard that sentiment from anyone other than mark cuban in response to these remarks? i have not, kelly. it s definitely heating up. i m down in miami. it s heating up in the nba. i can tell you i ve not heard anything. but we do have the first amendment. now these actual disclosures in terms of how these audio files were actually brought about looks like there was a little bit of invasion of privacy as well. if she taped him without his consents she violated the law because california is a two party consent state that means both parties to a recording need to say okay and if that didn t happen here then she s violated the law. let me ask you colonel west, the question tonight no one is defending the remarks. nobody is defending the remarks. the question is whether the deprivation of his property rights in terms of his ownership rights of a sports team, you know, his financial livelihood and the swift condemnation by every corner basically of taking away his livelihood is a slippery slope as mark cuban suggested. yes. you re absolutely right. it is a slippery slope because when you think about the fact that he was convicted and tried in the court of public opinion. but as you just talked about in the court of legal opinion, that evidence would not be admissible because it was a violation of the law in california. so, you do have a sense of a slippery slope where all of a sudden do we have to be very concerned about what we say in private, that it may be taped and, of course, it gets released to tmz, it gets out there and you are tried and convicted. this is a business decision for the national basketball association. right now we re in the middle of the playoffs and the last thing they want is a black eye and a specter of this hanging over them. steve, kareem abdul-jabbar came out and said shouldn t we be equally angered by the fact that this private, intimate conversation was taped and then leaked to the media. the making of this tape was sleazy. listening to it makes me feel like an accomplice to a crime. is this the future of america. a conversation between two people supposedly in a relationship wind up going public and then somebody who makes clearly inappropriate remarks has everything taken away from him? megan, i think you re spot on. this potentially becomes the norm. look at this. if this happens to mr. sterling, this potentially could happen to anybody. you never know what potentially could happen. this could be the opening of a huge pandora s box. what do you make of it, colonel west because the nba has come under fire in recent years, there s a book written about nba in 2004 about the number of crimes that players have committed or been accused of or convicted of which is the only relevant standard. to see the players uniformly stand shoulder to shoulder to shout down racism was a powerful thing and a good thing. but, it would be nice if we could see more of that in these sports leagues when we have players abusing their wives, domestic violence, shoving their wives or girlfriends down flights of stairs. the outrage that s been directed against this man for his raceive. comments is commendable but what about all the other horrible acts we ve seen committed in professional sports by some, not all, where is the shoulder to shoulder condemnation of those items? wellington, it s an interesting aspect of our culture and what we re willing to accept and what we re going to stand against and not accept. in professional sports athletes are the ones that get all the attention and they are the guarded ones. you don t want to start losing athletes because then that affects your franchise who affects who is coming out to pay the tickets to the see the team. it s easier to go after the coaches and the 1% which are the owners. when you look at our culture and one thing that i have to admit and find interesting where is our outrage when we have the off mic moments or behind closed door statements like we saw with john kerry or the president liens over to medvedev and says tell president putin after the election i ll have more flexibility. that s behavior that reflects badly on your foreign policy. of course we don t condone or accept what mr. sterling said but it s interesting how our culture responds to some of these incidents which have a broader effect upon our country as opposed to our sports entertainment livelihood. as kareem abdul-jabbar says we didn t steal the cake we are gorging on it. we have an internet inside our house and subjected to potential hacking and taping without our knowledge. whether we re now living in a society where we as a society will consume the products of that taping even if it s illegal and act upon it. almost instantaneously. it s yet another question raised by this whole mess. gentlemen, thank you. thank you, megan. now to an extreme weather report. 75 million americans are at risk tonight of being impacted by another round of severe storms and possible tornadoes like this one in alabama last night caught on tape during a life newscast at our fox affiliate. we have got a tornado we still have electricity there in bessemer. this is coming towards the hospital. look at the debris. see the debris falling. folks if you re watching us right now and we re losing power. there s the power. steve is live in mayflower, arkansas. reporter: 15 people died in the state of arkansas alone on sunday when the tornado swept through here and some sad new news to pass along we re learning that two were small children. 7 and 8 years old. that was in this county and the county over, a man and his two daughters were killed. now, you can see this giant pile of debris behind me, megan, for a perspective i m 6 2 and you can see how high that is. it towers over me. come this way and i want to show you around here what this used to be, an rv sales and repair center and i talked to an employee here and this entire parking lot that you see back here was filled with more than 60 brand new rvs that were for sale and also some used hvs that were here for repair and you can see, there really are no rvs left other than ones turned over. they ve all blown in that direction eastward when the tornado skipped interstate 40 which is just to my left and just decimated this rv center. you can see how widespread the damage is and how great it is and that way you can understand it is going to take weeks, months and even years before this community is even back to normal. just terrifying, megan. thank you. there was a new bill in congress that would have the feds scouring your phone, the internet, even broadcasts like this one potentially for any signs of hate speech. who exactly gets to decide what s hateful. we ll investigate that next. plus the democrats are reportedly getting nervous about losing the senate in 2014. and now have a plan to fill dozens of court seats before that potentially happens. but, that may be easier said but, that may be easier said than done just ahead. i saw this red, blistery, rash and i felt this horrle pain on one side of mback. i d 16 magic shows to do. i didn t know how i wasoing to be able to do these shows with this kind of painhat i was in. i told mwife what i had. she went on the internet and said i think you have shingles. i could feel the shock in my back and it was like wowts got to get better than is or i m in big trouble. we re learning details today of a new proposal that would empower the feds to scour the internet, tv and much, much more for so-called hate speech. and then do something about it. democratic senator ed markey is pushing this bill mandating monitoring of anything that the feds suspect may encourage hate crimes. guy benson. who gets to decide what s hateful on the internet and what will they then do about it under his proposal? reporter: those are the two big questions and we don t have the answers to those questions which i think is the root of what s troubling about this. i mean, megan, you and i both operate in the arena of words and ideas. right? freedom of expression and thought. that s the coin of our realm. so i really think it s the duty of journalists and people in the media to look at any potential instance of the government coming in and trying to monitor or potentially criminalize thoughts and words. we have to be all over that and ask tough questions and i think senator markey ought to be answering those questions. senator markey wants this group, this obscure federal agency as the boston herald put it to scour the online sources, tv, radio, for any speech it finds threatening and he wants them to do it in connection with the department of justice, the u.s. commission on civil rights and then file a report to congress on what out there is potentially hateful and could lead to hate crimes. this is clearly big government sticking its nose into people s speech and their thoughts. we just pushed back on a similar proposal that we saw from the fcc that the feds had to shut it down. what is senator markey thinking? reporter: i don t know what he s thinking and i would love to know what he s thinking. there s a few issues. you ve been touching on this, megan and you re completely right about this. when the government gets involved there s no criteria here in the bill. what s the template. what s the, you go down and check the boxes what counts as hate speech and who makes those determinations. as you say it s this group that nobody heard of buried inside the federal government. markey and his defenders will say it has to align with the first amendment. who will hold that agency accountable if abuses occur because we ve seen, quite frankly, megan, some abuses recently from unaccountable federal agency doing things to target americans who say and act in certain ways that may be politically inconvenient for certain people. we ve just seen this movie with the irs. so expanding the potential targeting and, again, we don t know the exact nature of this is questionable to say the very least. what are the chance of this going anywhere in the current congress? i read that he has no co-sponsors, but it has more support in the house than it does right now in the senate. reporter: the senate can t seem to do very much of anything. and so you ve got that. on the other side the house of representatives has co-sponsored is a back bencher from new york so the chances of this seeing the light of day in the republican held house are slim. it gives you a window into the thinking by some high pressure that s exactly right. it s not just that. what becomes difficult for people who are first amendment advocates on these type much questions is the other side, it s easy and very tempting to demagogue. if you raise questions about this they can say aren t you being an alarmist. are you being an apologist for hateful speech or hateful behavior. you get defensive awfully quickly. it takes a lot to where your speech is impermissible. a new debate over free speech and political correctness at dartmouth college. see why a fundraiser was just cancelled. plus secretary john kerry had to walk back some controversial comments about israel but did he walk far enough? just look how hamas treats its civilians in gaza, it treats their political opponents, how it treats women, it encourages honor violence against women. hamas calls for the genocide of jews. look at the plain authority. their laws require the death penalty for anyone who does business with jews. palestinian authority officials have come out and said any future palestinian state has to be ethnically cleansed of jews. the apartheid state we re encouraging is the future palestinian state and for kerry to assign a malicious intent to the jewish state where none exists and to ignore the fact that israel exists in a sea of arab apartheid islamic states is disingenuous. owes frustrated because he tried to push through this peace process on his own time frame and it s not working. israel basically walked away from the process because the palestinians just got in bed with hamas and said okay let s be bff we ll partner with hamas this organization that brook just described. israel said forget it. how are we to work with this. it sounded in those remarks he made a condemnation of israel which is why so many in the israel lobby or whatever you call it got upset with his remarks and wanted him to actually do more than this, he want to apologize which he has not done. he retracted his statement. kerry has made a lot of mistakes. he s overwhelmed. his facts are confused. what the viewers need to know is the very simple premise in order for there to be peace you need two parties who want to end conflict and if you are a student of history you know that s not the case. time and time again in 48, in 67, in 78 and still today israel s arab neighbors have declared war, have declared a genocidal intent to aanannihila the jewish state. when i look at his record he has a very good voting record on israel. aipac comes out and say he has a near perfect voting record on israel. and john mccain came out and laughed at the suggestion by ted cruz and others he should be forced to step down as a result of this. what mindset does it reveal? [ back-up beeping, honking ] a truckload of discounts for your business now, that s progressive. we are seeing reports tonight about growing concerns from democrats about possibly losing the senate this fall. a new determination to fill a lot of federal court seats before that happens. just yesterday one nominee was confirmed with the bear minimum number of votes but the republicans are now saying the president s plan to create his legacy in the courts could come at a price. tom dupri is a former deputy assistant general and constitutional attorney. now the word is that the white house legal counsel is pushing the democrats to quote turn up the volume in the second term in getting as many of these federal court vacancies filled as humanly possible. they have three lawyers in the white house counsel office working full time vetting and processing nominees because they say barack obama wants to make this a big part of his legacy. what are the stakes? the stakes could not be bigger, megan. as you know these are lifetime appointment, cabinet secretaries come and go but judges are forever or at least during their lifetime while they are in good faith. but nonetheless the stakes are huge. you re absolutely right. right now the president has his eye on the clock and his foot on the accelerator as they put out an all points bulletin to get nominees, get them nominated, push them through the senate, get them confirmed and get them on the bench before the senate shifts in the mid-term elections. we re no longer talking about okay get them on the bench before barack obama s second term ends. they want to get them on the bench before november, before they possibly lose control of the senate because harry reid changed the rules in the senate such that these nominees can get on the bench with 51 votes. you used to need 60. they are saying before the republicans possibly take control get all of these vacancies filled we re talking about some 86 vacancies, tom. how would that compare if he filled all of those to what president bush did? it would set a record. the fact is president obama is ahead of where president bush was at a comparable point in his tenure in terms of guesting his nominees appointsed to the bench. it s a worrisome signal when you see a fast push for confirmation because the ultimate effect of it is to corrode the american faith. when you see them operating in a frenetic fashion to get these folks in before the door close it undermines confidence. there s expectation among many americans a liberal president like barack obama will appoint left leaning judges and a conservative like george w. bush will appoint right leaning judges. none of the judges are, a few are straight down the middle. and so isn t he just doing what people expect him to do? that s a fair point. everyone expected the president to nominate these sorts of judges, but, of course, the constitution gives the senate a say in the process. it confers upon them the advise and consents power and i think where president obama has taken a different tack than president bush did, president obama doesn t seem as interested in building consensus around his nominees in working in a collaborative process. he says key. he says the republicans are obstructionists that s why harry reid had to change the rules. he said what the republicans have done to him and his nominees is and i quote unprecedented. your thoughts. i strongly disagree and respectfully disagree with the president on that. as i mentioned a moment ago he s ahead where president bush was at this point in time and the fact that they ended the filibuster is a very dangerous thing. the reason they did that is precisely so they can get on the bench those folks of whom there was not a consensus. it enables the president to put on the bench people with just 51 vote majority which may be permissible under the constitution but frankly for those of us who cherish the rule of law and want judges to apply the rule fairly and in a nonpartisan fashion it sends a troubling signal. there was a woman who was confirmed yesterday to the ninth sir kurkts left leaning to put it mildly, ninth circuit court of appeals. she comes from a law firm out in california, right, and in 2012 that law firm gave $65,000 to barack obama s re-election campaign. since then three lawyers from the firm, she s the third have been tapped to be judges on the ninth circuit. is this par for the course in these law firms? basically making big donations and oh, suddenly they are on the bench or is this something that needs looking into? well, it certainly is interesting. it s not that big of a firm to get three judges is an achievement. it s not so much driven by political contributions as it is the president is very focused on choosing judges who share his ideology and his approach to the law and constitution. we ve seen him draw heavily from certain law firms and the academy and i suspect in large part that s what s driving it. the president has a lot of his base, core supporters who are pushing him to appoint people they see as progressive, liberal, activist judges and the president is responding to that imperative rather than looking at who is christianitying to his campaign. what academy. academy of motion pictures? certain ivy league schools. thanks for being here, tom. thanks. i would have known that if i had gone to syracuse. thanks, tom. thanks. developing tonight can police search the cell phones of people they arrest? not folks who have been convicted or received a search warrant they just have been arrested. the u.s. supreme court heard arguments on that today. our shannon is in washington with the very latest. reporter: the big question is whether they can perform those searches without ever getting a warrant. today the justice did consider two cases back-to-back both stemming from criminal arrests in which after the suspect was taken into custody officers accessed each of their cell phones. in both of these cases what police found on those cell phones led them to a trove of evidence that ultimately led to convictions and jail time. justice scalia noted up to this point the supreme court has given large latitude to search items found on a suspect and evidence they might destroy or hide. in its brief, the government argued this, the authority of officers to conduct a full search of any item found on an arrestee makes imminent practical sense in light of the realities of police work. justice kagan noted how times have changed including the volume of personal information contained on an average smartphone and the fact that most people have expectation of privacy. everything from medical information to gps info that can track where you ve been. here s the lawyer for one of the men convicted and sentenced based on what police found on his cell. the question is whether somebody s expectation of privacy is reduced. yes the court said somebody s expectation to privacy is reduced but not extinguished. reporter: there s a lot of skepticism about allowing an unfettered search through a suspect s phone but also some confusion about,000 craft a rule to give police specific guidance. we should have a decision by the end of june. up next on the kelly file the court of public opinion weighs in on president obama s perfor relax into child s pose. sfx: bing. who s got two hooves and just got a claim status update from geico? why do you think, chris, since march he s fallen so much? well, there s some indications that the crisis in the ukraine and the president s handling of that are a factor. i would largely say that given the fact that obamacare in this poll is down that s consideration but probably the biggest consideration is that people dislike the way the president handles the economy, obamacare may factor into that too with an about it the future but generally they think he s doing a pretty poor job. i know you believe this means that the democrats will do worse in the 2014 mid-terms than they did even in those 2010 mid-terms where the president said it was a thump. every poll begins with a false premise which if the election were held today, the election won t be held today but if i look at a poll like this and i see what s going on in the states i say republicans are going to get a double digit gain in the senate. you start to think about a number of 10 or 11 based on numbers like this. joe, how predictive is a president s approval rating of how his party will fare in the mid-term elections? it s almost always one of the biggest factor if not the biggest factor. look, it s second mid-term election is always the worst one for the party that has the presidency so you got that. you got the fact that more polls are showing that young people are disaffected from politics now than they were in the past so you have that going and you have this poll which has the president s approval rating down. look, i don t go as far as chris does. i think the odds are right now if you look at the states the republicans should pick up a minimum of four u.s. senate seats and potentially as many as ten. i ll go out that far with chris. the problem, though, is still in the end it does come down to the candidates running for the senate and that is, at least in the past two cycles been a problem for republicans where they ve nominated somebody that, yes, with everything going wrong on obamacare and everything else, declared they were a witch or any number of things that we can recall, and lost the seats. so you re saying never underestimate the ability of republicans to screw it up. exactly. they say registered voters, 53 to 39% would rather see republicans in control of congress. 53 to 39% and yet later, they say americans trust democrats more than republicans 40% to 34% to handle the country s problems. how do you square that. you trust the democrats more than the republicans but they want republicans to take over congress. if i was hillary clinton i would think that s the most attractive statistic that was available in this poll. the american electorate says they agree with democrats on a lot of issues but want a regulator, want a check on president obama in the form of an all republican congress. what that means and i know joe has talked about this before, what it means is that when hillary clinton starts her campaign in a fuller sense, she will be able to run as somebody who will do it better than obama did, that he had good intentions but she can deliver and this describes an electorate that s ready for a president not be obama but not necessarily a republican. joe, is this a message when the boyfriend says to you, i love blonde women, i just don t love you. like is it like we love the democrats, but just not you. well, there s a couple of things. one is that, look americans have loved divided government for quite some time now. and that s been happening for quite a while. looks like they love it even more. on the other hand there s a frustration with both parties and frankly there is one group that has a lower approval rating than the president, it s congress and republicans in congress on top of that. i know. so then how do you reconcile these people saying they want to put republicans back in control if they hate them so much. because they want the divided government. they want somebody that s what s going on. if we had a republican president right now it would be the opposite. if they put the republicans in control of the senate and let them retain control in the house in 2014, does that bode well for the democrats in 2016? multiple investigation into the shooting. dana pirino will give her analysis. we will do what we must do to protect our people. we will be vigilant and we will be relentlessless. the obama administration reveals a failed operation to rescue captured americans in syr syria. are leaks like this jeopardy diesing future caution, i got a man curry, the factor begins right now. i m greg gutfeld in for bill o reilly. take a listen to some of what bill had to say. in 2012, the last stats available from the fbi, there were about 12 million arrests in the usa. that averages out to 34,000 arrests per day. in 99.9% of those cases, the perpetrator was not killed by police. in fact, just over 400 fatal police shootings a year are recorded in this country, according to to the fbi. so let me restate. 12 million arrests a year. 400 fatal shootings, many of them justified. and al sharpton has the nerve to insult the american police community, men and women risking their lives to protect us. this sharlton has the gal to do that and nbc news is paying him. my god, why is that acceptable? clearly someone needs a nap. joining us now with reaction, horace cooper, chairman of the group 21 national advisory board. and also from d.c., hillary shelton, the senior vice president for advocacy. hillary let me go to you first, what do you make of bill s powerful memo last night. i hate to complement him, because he has a big head already, but you have to admit it was very strong. there s a problem in ferguson, missouri. certainly lifted issues up in talking about those problems, is the first step towards some solution, towards solving them. so you may disagree with al sharpton, but i think even bill o reilly would agree that al sharpton has a right to say what s on his mind, as controversial as it might b certainly it s never stopped bill. and we appreciate his comments as well. he has a right to say what he wants, even if it s nonsense. let me ask horace, horace, do you get the impression that when al sharpton comes to an area where there s crisis, that he might actually hurt it instead of help it. he s got quite a past, with freddie s fashion mart, when he shows up, there s nothing but trouble. that s his game plan and in fact even if there wasn t a crisis going on, he brings a can of fuel and pours it all around and then the match and lights it up and watches everyone else. if you re wanting to talk about what america is going to do, so that america addresses how blacks, whites and browns all get along, al sharpton isn t the man to do that. if you want to count up how the problems can be exacerbated and the progress can be denied, he s the man to call. hillary, i will admit, there s a certain kind of ping-pong that goes on in this sort of crisis. whenever there s an incident like this, you get two sides, you get anger over the initial crime, and then you re saying what about black and black crime that takes place every day and the media doesn t care about that. do you think that s a fair response or a deflection away from the primary problem. well, i think it s a deflection. certainly we have issues in this case around policing. it s more of a blue versus black issue than a black on black issue, or white on white issue. as we know, we talk about the murder rate in america, we still know statisically, more crimes committed by the people of same race or other people of the same race they are. those are issues we have to address, and certainly the high homicide rate, particularly the high gun rate in this country should be discussed. but in this case, we want to talk about the issue of police community relations. because what we have is an 18-year-old teenager who was shot to death and was unarmed by a police officer in a very suspicious manner. we have a number of witnesses who have already come forward who are saying this looks like an execution than quite frankly him carrying out his responsibilities as a police officer. we have to have that conversation as we talk about ferguson missouri. they have other problems in governance. this is an area that is 67% african-american. but if you look at those who are elected into office, including the police chief and the police department itself, they are 53 police officers, only three are african-american, there s a real issue with that balance and governance from every level in this area, and certainly it is legitimate for us to have this conversation about policing. horace, he brings up a good point, the disparity between the police force and the citizens in terms of color. what are the facts behind that? i mean i have talked to police officers and they will say, they would love black applicants. but they can t find them. greg, this is entirely an effort at a deflection. if the justice department and the naacp and the other agitators were concerned, they can go and look at the racial makeup of communities all across the country, and ask to have meetings with those organizations to come up with some solutions. what they have done instead is try to exploit this situation. and the governor of the state has joined in along with a number of other people, when you race to judgment, and prejudge this, before we know all of the facts, it reminds me of something. the first and most important civil right is the right not to have the government charge you, indict you, incarcerate you, penalize you without the right process, the right investigation, the rush to justice is the kind of thing i would have hoped the naacp and al sharpton would have issued an announcement immediately when those people were making these rush to judgment type statements including the governor of missouri. their silence tells you all you need to know about their real concern about fundamental civil rights. hillary makes a good point, a lot of people talking without any facts on every side. but could you say, to be fair that maybe everyone is right, there s a problematic relationship between community and the police, and an issue within the community itself that leads to trouble. why can t it be both? let s solve those problems, quite frankly that measurement has to be there, and i m laying out statistics, facts and whatnot. i m talking about the number of police officers that are reflective of the community they re serving. we re talking about politicians, those who are elected to make decisions on behalf of those communities. again we re talking about that lack of representation, it has led to a very deadly consequence. african-american young people are losing their lives unnecessarily at the hands of police officers. we have got to talk about the real value involved, where we utilize guns to actually gun down unarmed citizens that are suspect in some of these cases. i don t know if there are other incidents where ferguson police officers gunned down unarmed citizens. there is no such thing greg, there is no such thing as this idea. there are four open cases in which the justice department is investigating the ferguson police department right now for issues like racial profiling. let s get this clear, there is no such thing as the idea that every community in america, a free and open society is supposed to have an equal number of black teachers, an equal number of white police officers or brown police officers, that is a social engineering outcome that has nothing to do with equality and civil rights. that s part of the problem. i need to wrap this thing up. thank you, mr. cooper, mr. shell tong. next on the rundown, why a clash between the local county prosecutor and missouri s [ male announcer ] if you had a dollar for every dollar car insurance companies say they ll save you by switching, you d have, like, a ton of dollars. but how are they saving you those dollars? well, the governor doesn t necessarily want him to step down, the governor created this when he called for the state of emergency. now the political football is right in nixon s office, nixon doesn t want it and he wants to do anything he can to get it off of him. so he kind of put it on mccullough, saying, bob, if you want to, you can resign or yik keep it. nixon doesn t want to make that tough call. is it me, you live over there, i don t know justify about jay nixon that most of his reactions have been in regard to the media, that he s reacting to the mob, to outside forces, not to what might be right for that city or even the state? listen to this. since saturday, when he declared a state of emergency, it s what, now thursday, so the state of missouri has been in a state of emergency for almost five days now, he hasn t held one news conference, he goes into hiding, and he released a prepared statement in which he used inflammatory language that showed that he was in favor of michael brown s family. you re the governor, you re in a crisis, stand up, man up, and do the right thing, as bob mccullough said. do you think mccullough should have said man up? do you think that might be perceived as unprofession until. in this crisis, every political person you see is trying to get the next political office. every single one of them. bob mccullough is the only one who is not running for anything. bob mccullough has dedicated his life to victim s advocacy, and now he has to defend himself because his father was shot in the line of duty 50 years ago? they should be ashamed of themselves. he s the only one that doesn t have an agenda and they re trying to tear him down? i applaud him for what he did. i know this manu well enough to know that wild horses would drag him from this. and that s why he said if you don t want me in this position, don t call me, call nixon. it s now nixon s call and if nixon thinks he can t do it, then tell the people that he s not qualified. and if he is qualified stand behind him. because as bob mccullough said, it s hurting the entire process. we want transparency, we want justice, not just for michael brown but for the police officers, there are many, many voices that are not being heard. we actually want to really know the truth. and bob mccullough has the backing of the majority of this community to find out what actually happened. in my view, and i m an outsider. you ve got the media and you have outside sirs and you have bureaucrats and outsiders basically walking all over the community. it s not about the concerns of the community anymore. it s about reputations, it s about making careers. not only that, but you re seeing the next mayor s race play out in the county. antonio french wants to be mayor so he goes to down to the county and glams up for the camera. all while the story, the backdrop, but the most important story is that we have a dead teenager and we have a police officer and no one really knows the facts. it s really a sad commentary on life. directly ahead, eric holder raises eyebrows with new comments on the death of michael (son) oh no. can you fix it, dad? for business. in the factor follow-up segment tonight, michael holder and the michael brown invests. he s promised a fair and thorough investigation. but comments like this have some thinking otherwise. the national u outcry we have been seeing speaks to mistrust and mutual suspicion that can take hold between law enforcement and certain communities. i wanted the people of ferguson to know that i personally understood that mistrust. i wanted them to know that while so much else may be uncertain, this attorney general and this department of justice stands with the people of ferguson. well, shouldn t he be standing for every citizen, including the police officer involved in this case? joining me now with reaction is my fellow co-host from that great show. dana how common is it for a u.s. attorney general to get so involved in a local/state issue like this. i think it s huge news because it is uncommon. they must have thought the situation warranted it. i don t think there s any situation where the u.s. attorney or the local district attorney would not be able to handle this without department of justice involvement. usually the justice department would get involved if there is some evidence of wrong doing in the investigation. it is true that the police department has had very bad communications and public relations. but you don t necessarily have to come in and indict somebody for that, they actually have to have some sort of wrong doing in the investigation. i think the local district attorney, based on the interviews that i have seen from him, i have never heard about him until the ferguson situation, seems to me like he s a standup guy and should be given a chance to be able to prosecute this case if there is going to be a case. i think that s another thing that i think eric holder, going down there, let s hand it to him. i think by the time he got there, the situation was diffused enough or just even knowing that he was coming helped diffuse the situation. okay, so that s good. but do they leave behind raised expectations for a possible trial? based on what jay nixon, the governor has said, eric holder has said, if they have this kind of national attention on a state matter matter, will they also be stepping in at that point? if it were a white teenager that was killed by a black police officer, would eric holder do the same and try to infringe on a local u.s. attorney or a district attorney? i think the answer is probably no. everything points so the fact that there s going to be a trial, right? they shouldn t necessarily. but how can they walk away from this, it seems like they have been pushing in that direction. i think the most important thing is to get all the evidence. we still don t even know about the police officers, there s reports that he was injured as well. we actually we just don t know. i think that s partly the reason that the protesters are starting to slowly fadeaway because until there is more evidence or a reason to have more grievances, i think we have to wait. i don t think anybody should be talking about a trial. until we know more. but yes, i do think they have put themselves in a position that if there is not a trial, there might be even more grievances. it is unusual, the chief federal law officer showing up in the middle of a incomplete police investigation, that seems to tell me that there s a bit of bias involved here. and it speaks to your point of if a reverse case, it would been that way. one of the things that eric holder himself has said and that people that are watching this case have commented that he has personal experience, as a black man, he brings a different perspective. but if eric holder can weigh? on the case, then why can t the local district attorney whose record seems impeccable. just because his father was killed 50 years ago by a black police officer, they re suggesting that he should recuse himself. that actually doesn t make any sense to me. and i think that as cooler heads prevail. i think this will go forward and there s going to be so much scrutiny on it that they re going to try to everything by the book. you brought up how the police have handled this, which is i guess not well. but are these small forces capable of dealing with a national magnifying glass? companies pay top dollar to have pr executives on retainer so they can have the expertise in the event they might have a crisis. if you re a small local police department, you don t necessarily have that type of training, you can argue that maybe may should. why would you release the video. they didn t give consistent stories but it undermined the confidence in this situation. however, again, that s not an indictable offense. having bad pr is not good, but it s not a crime. it s troubling watching kbelt way blockers and reporters descending down into a town like it s a war zone, it s basically a small town in trouble. the most symbolic thing for me was a reporter convinced that ear plugs were actually rubber bullets because that shows a disconnect between the environment and the outsider. he hoped they were because that would then get him to be more the story, so reporters are trying to make themselves a part of the story do all of us a disservice and certainly the community of ferguson. because as you pointed out, a week from now there won succeed. earlier today defense secretary chuck hagel addressed the rescue operation and how big a danger isis poses to america. think are a serious threat to every interest we have whether it s in iraq or anywhere else. isil is as sophisticated and well funded as any group that we have seen. but do these leaks of secret u.s. military actions endanger future missions targeting isis. colonel peters, why well, first up, i want to ask you, what did you make of the briefing today? it kind of reminded me of stallenist brew bureau cats. it s so clear, the administration disgracefully and we need to talk about it, released the details of this raid unnecessarily except to the degree that it provided some fiction of political cover for the administration where they could say oh, we were trying to rescue the hostages, it wasn t our fault that anybody got their head cut off. and you just don t do it. the only real take away, apart from the craven behavior in that news conference, was that we still have nothing that remotely resem bls a strategy. we re dealing with little tactical attacks, which are nice, they help out the local problems. but this i mean these guys even said, they have finally woken up to the fact, as the factor has been arguing for over a year, that the islamic state terrorists are a huge threat, worse an al qaeda, but then they frankingly admitted they re not doing much of anything and they have no plans to do much of anything except build a coalition. it was sad. you seem pretty depressed over this. you know what s disturbing to me? when president obama refers to what happened as appalling and i always said that you should never be appalled by evil. i mean evil should never surprise you, you know it s evil, and there s only one recourse which is to destroy it which leads me to my question to you if you were president, what would you do. the first thing i would do is fire whoever decided that it was a good idea to release the operational details of that mission. but with isil, it s really just islamic state, it s not isil anymore. it s bigger than isil. we should be using the full extent of our airpower to hammer them to strategic deaths. they re both saying we can t do anything in syria. syria is the heart of darkness here, eastern syria, we should be using strategic airpower to hit their headquarters, their marshaling areas, their training camps, their logistics bases, all of that made by the u.s. or the former soviet union, both, that is now in their arsenal, thanks to the iraqi army running away, but you ve got to hit them hard, these pin pricks will not make a difference on the strategic level. i have got to address not only disgraceful, but murderous release of details of this raid. you just don t do it. the special operators are furious because the administration rolled them on the bin laden raid. why do i say murderous? not only because detailing which units are involved, tactics, how we did it, not only does that endanger our fighters, if we go in on a future raid, but the administration didn t think about the hostages still being held. they released the data, to the information that we got intelligence from released european hostages. do you think islamic state is going to release more hostages? we signed their death warrants by compromising that information. i m a former intelligence guy. you do not compromise a vital, above top secret national security information for five minutes of political gain. it s un-american. you know, is there the timing, the timing is everything. it smells. do you buy that the media, that were members of the media about to drop this stuff? or do you think that s just made up? even if there s a grain of truth in it. you don t go out and sell the whole farm. yeah. if to the media had some information, well, you know, in the words of the duke of wellington, publish and be damned. but you don t tell them all the other stuff they didn t know. i m sick of unnamed pentagon officials which translates as administration hacks, strong arming the military, strong arming the intelligence community to roll over on this stuff. they put lives in danger, they guarantee there will be more beheadings, they have made the mission harder. it s like with ma and pa taliban during the bergdahl fiasco, they just didn t know what they were doing. that s the scariest with us, i m in for bill o reilly. and in the personal story segment, murder on american soil in the name of radical islam. the self-proclaimed jihadist is now in custody after going on a murder spree that spanned both coasts of the united states. we are learning about about a man charged with four murders. brown hold investigators he was lashing out for american acts of evil in iraq, iran and afghanistan. he said innocent muslims are being killed there and his murders are retaliation, in which he is quote, just doing my small part. despite the red flags this represents for us right here in the usa, the story has gone almost unnoticed by the national media. joining us now with reaction, lau laura, how come no one seems to be talking about this. you would think that four murders in the name of jihad would get some press? i think the immediate where are always quite uncomfortable in covers these types of acts on u.s. soil, committed in the name of ala, because they re worried about the islam phobia charge, there s a lot of politically incorrect fears about how will it be perceivedive there s too much intense sif focus. you don t want to i think that s part of it. but the media really goes for the drama, in my mind, that forwards the general media s political agenda. and in this case, the ferguson story really bears out witness for them, for all the racial inequities in the country and then it allows them to fill that whole vessel with all sorts of feelings and emotions that i think make them feel better about themselves and probably help i think that s part of it. it matches the assumptions of the professor who is taut them in their campus life. the interesting thing you bring up to about islamophobia, its seems like radical islam is the only one that has benefitted from the fruits of the politically correct tolerance movement. if this politically correct tolerance movement was there during the years of hitler, would they call you naziophobic. when the politically correct mind set gets a hold of especially people on the left, they re just terrified, the idea of reporting on this story in a vigorous way, maybe actually do a broader report about how the fbi has been tracking homegrown terrorists, there was a long time, greg, where the media would blow off the idea of any real threat from homegrown terrorists in the united states. but now we know of course there are dozens if not more than 100 perhaps of american citizens who have joined up fighting the jihad at this point now, currently. they re really worried about this. this is a concern for the fbi, the u.s. authorities are very worried about this, now with the porous border to the south, we don t know really who s coming n we just saw bin laden was resurrected crossing the border last week in costume. so there s a lot of concern by the authorities on this and the media does kind of a they did kind of a collective yawn, which just speaks to their own biases. i think that s the interesting, the problem with this is that they tend to dismiss it, whereas when they take more crystallized actings of crime that has to do with a flaw in our system, like what s happened in ferguson. they make sweeping conclusions about american society, the police, the people who live in the middle of the country, who don t happen to be might have been north, they re all racist, they re harboring racial animosity even if they don t verbalize it. but when we re talking about nadal hassan, or any of the other fort dix 6, there was an attempt to as tack fort dix, that happened not too long after 911. again, facts as you side on the five yesterday, i loved what you guys were saying on the 5 yesterday. facts sometimes get in the way. in this case, this man was a jihadist, he was carrying out these brutal murders, shooting one individual ten times in the back as he just was walking, you know, in a secluded area. the other victims brutally shot, multiple times and for some reason, we don t want to talk about what this really means, we must talk about this, our lives depend on it. our country s liberties depend on it. and obviously our national security depends on it. we have to have an honest conversation. this is isn t the first time there has been a proposed attack on ft. dix, and that involved a may mouse professor named bill ayers. and he gotten your. maybe these guys will get tenure as well. these are not isolated incidents. this seems to be a trend. what draws an american to something like this. for him, he had a long history of sympathizing with the somali terrorist group. so he had the interest in somalia, the internet obviously allows a lot of these loner terrorists a lot of them are just individuals actsing on their own, to have a sense of community. this is like social net working for terrorists, they get to hook up with other terrorists, air their grievances, maybe their lives aren t going so well here in the united states. they want to lash out, and they blame other people, in this case they take their frustrations and their anger out in a heinous scale and commit mass murder. i think the internet really does help them. we have seen that with other terrorists in pakistan and u.s. citizens, radicalized in u.s. prisons who have gong over to do u.s. training in yemen terror camps. this is a problem we have to have an honest conversation about it and one of the few networks is actually doing this. this is one area where an honest conversation will help, but some people don t want to have it. just some quick housekeeping here, we want first of all, we put it in really big type. there you go. i don t know if you can see it on the screen. the obama presidency is like the brazilian national soccer squad. they were supposed to be playing the brilliant game, resetting relations with russia, restoring america s good name abroad. and like the brazilians they folded, they collapsed. they just absolutely capitulated. now it s not even in dispute this president s foreign policy is a total failure. you have hillary clinton saying it. you have carter s national security advisor saying it. it s sort of unanimous. the question is why is it failing? there are three schools of thought. what liberals will tell you it s failing because this world is this terribly complicated place. america is in decline. right. the president simply can t control events around the world. and obama sometimes likes to explain himself that way. right. second theory, somewhat more convincing, is this just simply an out of touch president who is not really giving this job his full attention? maybe it s because he won re-election, he feels his legacy is secure. but time and again the president is caught flat footed by events. some of his closest advisors complain he s indifferent to the details of governance. the argument i m making in this article is it s not simply that. this is a president pursuing an ideological goal, which is reduce america s footprint. environmentalists say reduce, reuse. it s american power and influence shrinks you have all of these groups coming up seeking to fill the void. if you had taken your article and instead called it a failure and given it to president obama, he would have taken the whole article as a compliment. he s listing all of my successes because these all of these together have slunk this tumor. because he believes our influence detrimental to the world. he basically believes wherever america goes in the world problems follow. we always in effect make things worse. and what you re actually seeing around the world is suddenly vladimir putin realizes that no one s really in charge in nato. the iranians understand that they re going to walk through the door in terms of their pursuit in a nuclear weapon. the various groups in iraq saying there s no one going to stop us. same deal in china. so they re rushing out. and people are forgetting that this period of general peace and prosperity that we ve enjoyed since the 1940s didn t happen by accident. it happened because of success of american presidents said if not us, there s no u.n., we don t want the chinese or russia running the show. so pax america brings huge benefits with it. this ideology is that it s a bad idea. this damage that we ve seen, is it permanent? is it possible after six years that there s no way back? look, i don t think that s true for this simple reason. america s in retreat, but i don t think america is in decline. when people tell you this is a country decline, this is the country we re fracking is happening, this is the country where iphones are being made. in so many ways there s a renaissance of american ingenuity simply being gummed up by a regulatory state by a president who doesn t believe in the very things that make this country great. russia s on the march, but russia s actually in decline.it. europe is in decline. the chinese, people say the chinese are going to take over the world. when i was growing up japan was going to take over the world. there s always somebody else going to take over the world. the capacity for self-renewal is in this country. the problem is not having an administration that is taking advantage of it. right. so basically america succeeds despite the leader s failure. that we re going to still pull it through, it s just going to be a little harder. one of the things that always amazes me you say a president of a country like colombia and say, this country s life or death succeeds whether it s a good president or not. in a way the miracle of america is we can have terrible presidents and yet here we are. yeah. basically a powerful, prosperous and confident country that can do things if only we have good leader. it s a testament to our system that we can withstand these things, these internal problems. i always feel like what s happening is punishment for our past transgressions. you know what i mean? multiple investigation into the shooting. dana pirino will give her analysis. we will do what we must do to protect our people. we will be vigilant and we will be relentlessless. the obama administration reveals a failed operation to rescue captured americans in syr syria. are leaks like this jeopardy diesing future caution, i got a man curry, the factor begins right now. i m greg gutfeld in for bill o reilly. take a listen to some of what bill had to say. in 2012, the last stats available from the fbi, there were about 12 million arrests in the usa. that averages out to 34,000 arrests per day. in 99.9% of those cases, the perpetrator was not killed by police. in fact, just over 400 fatal police shootings a year are recorded in this country, according to to the fbi. so let me restate. 12 million arrests a year. 400 fatal shootings, many of them justified. and al sharpton has the nerve to insult the american police community, men and women risking their lives to protect us. this sharlton has the gal to do that and nbc news is paying him. my god, why is that acceptable? clearly someone needs a nap. joining us now with reaction, horace cooper, chairman of the group 21 national advisory board. and also from d.c., hillary shelton, the senior vice president for advocacy. hillary let me go to you first, what do you make of bill s powerful memo last night. i hate to complement him, because he has a big head already, but you have to admit it was very strong. there s a problem in ferguson, missouri. certainly lifted issues up in talking about those problems, is the first step towards some solution, towards solving them. so you may disagree with al sharpton, but i think even bill o reilly would agree that al sharpton has a right to say what s on his mind, as controversial as it might b certainly it s never stopped bill. and we appreciate his comments as well. he has a right to say what he wants, even if it s nonsense. let me ask horace, horace, do you get the impression that when al sharpton comes to an area where there s crisis, that he might actually hurt it instead of help it. he s got quite a past, with freddie s fashion mart, when he shows up, there s nothing but trouble. that s his game plan and in fact even if there wasn t a crisis going on, he brings a can of fuel and pours it all around and then the match and lights it up and watches everyone else. if you re wanting to talk about what america is going to do, so that america addresses how blacks, whites and browns all get along, al sharpton isn t the man to do that. if you want to count up how the problems can be exacerbated and the progress can be denied, he s the man to call. hillary, i will admit, there s a certain kind of ping-pong that goes on in this sort of crisis. whenever there s an incident like this, you get two sides, you get anger over the initial crime, and then you re saying what about black and black crime that takes place every day and the media doesn t care about that. do you think that s a fair response or a deflection away from the primary problem. well, i think it s a deflection. certainly we have issues in this case around policing. it s more of a blue versus black issue than a black on black issue, or white on white issue. as we know, we talk about the murder rate in america, we still know statisically, more crimes committed by the people of same race or other people of the same race they are. those are issues we have to address, and certainly the high homicide rate, particularly the high gun rate in this country should be discussed. but in this case, we want to talk about the issue of police community relations. because what we have is an 18-year-old teenager who was shot to death and was unarmed by a police officer in a very suspicious manner. we have a number of witnesses who have already come forward who are saying this looks like an execution than quite frankly him carrying out his responsibilities as a police officer. we have to have that conversation as we talk about ferguson missouri. they have other problems in governance. this is an area that is 67% african-american. but if you look at those who are elected into office, including the police chief and the police department itself, they are 53 police officers, only three are african-american, there s a real issue with that balance and governance from every level in this area, and certainly it is legitimate for us to have this conversation about policing. horace, he brings up a good point, the disparity between the police force and the citizens in terms of color. what are the facts behind that? i mean i have talked to police officers and they will say, they would love black applicants. but they can t find them. greg, this is entirely an effort at a deflection. if the justice department and the naacp and the other agitators were concerned, they can go and look at the racial makeup of communities all across the country, and ask to have meetings with those organizations to come up with some solutions. what they have done instead is try to exploit this situation. and the governor of the state has joined in along with a number of other people, when you race to judgment, and prejudge this, before we know all of the facts, it reminds me of something. the first and most important civil right is the right not to have the government charge you, indict you, incarcerate you, penalize you without the right process, the right investigation, the rush to justice is the kind of thing i would have hoped the naacp and al sharpton would have issued an announcement immediately when those people were making these rush to judgment type statements including the governor of missouri. their silence tells you all you need to know about their real concern about fundamental civil rights. hillary makes a good point, a lot of people talking without any facts on every side. but could you say, to be fair that maybe everyone is right, there s a problematic relationship between community and the police, and an issue within the community itself that leads to trouble. why can t it be both? let s solve those problems, quite frankly that measurement has to be there, and i m laying out statistics, facts and whatnot. i m talking about the number of police officers that are reflective of the community they re serving. we re talking about politicians, those who are elected to make decisions on behalf of those communities. again we re talking about that lack of representation, it has led to a very deadly consequence. african-american young people are losing their lives unnecessarily at the hands of police officers. we have got to talk about the real value involved, where we utilize guns to actually gun down unarmed citizens that are suspect in some of these cases. i don t know if there are other incidents where ferguson police officers gunned down unarmed citizens. there is no such thing greg, there is no such thing as this idea. there are four open cases in which the justice department is investigating the ferguson police department right now for issues like racial profiling. let s get this clear, there is no such thing as the idea that every community in america, a free and open society is supposed to have an equal number of black teachers, an equal number of white police officers or brown police officers, that is a social engineering outcome that has nothing to do with equality and civil rights. that s part of the problem. i need to wrap this thing up. thank you, mr. cooper, mr. shell tong. next on the rundown, why a clash between the local county prosecutor and missouri s government floor introducing nexium 24hr finally, the purple pill, the #1 prescribed acid blocking brand, comes without a prescription for frequent heartburn. get complete protection. nexium level protection™ you fifteen percent or more on huh, fiftcar insurance.uld save everybody knows that. well, did you know words really can hurt you? well, the governor doesn t necessarily want him to step down, the governor created this when he called for the state of emergency. now the political football is right in nixon s office, nixon doesn t want it and he wants to do anything he can to get it off of him. so he kind of put it on mccullough, saying, bob, if you want to, you can resign or yik keep it. nixon doesn t want to make that tough call. is it me, you live over there, i don t know justify about jay nixon that most of his reactions have been in regard to the media, that he s reacting to the mob, to outside forces, not to what might be right for that city or even the state? listen to this. since saturday, when he declared a state of emergency, it s what, now thursday, so the state of missouri has been in a state of emergency for almost five days now, he hasn t held one news conference, he goes into hiding, and he released a prepared statement in which he used inflammatory language that showed that he was in favor of michael brown s family. you re the governor, you re in a crisis, stand up, man up, and do the right thing, as bob mccullough said. do you think mccullough should have said man up? do you think that might be perceived as unprofession until. in this crisis, every political person you see is trying to get the next political office. every single one of them. bob mccullough is the only one who is not running for anything. bob mccullough has dedicated his life to victim s advocacy, and now he has to defend himself because his father was shot in the line of duty 50 yearsthey s themselves. he s the only one that doesn t have an agenda and they re trying to tear him down? i applaud him for what he did. i know this manu well enough to know that wild horses would drag him from this. and that s why he said if you don t want me in this position, don t call me, call nixon. it s now nixon s call and if nixon thinks he can t do it, then tell the people that he s not qualified. and if he is qualified stand behind him. because as bob mccullough said, it s hurting the entire process. we want transparency, we want justice, not just for michael brown but for the police officers, there are many, many voices that are not being heard. we actually want to really know the truth. and bob mccullough has the backing of the majority of this community to find out what actually happened. in my view, and i m an outsider. you ve got the media and you have outside sirs and you have bureaucrats and outsiders basically walking all over the community. it s not about the concerns of the community anymore. it s about reputations, it s about making careers. not only that, but you re seeing the next mayor s race play out in the county. antonio french wants to be mayor so he goes to down to the county and glams up for the camera. all while the story, the backdrop, but the most important story is that we have a dead teenager and we have a police officer and no one really knows the facts. it s really a sad commentary on life. directly ahead, eric holder raises eyebrows with new comments on the death of michael brown, is he politicizing the justice department s investigation into the shooting? right back with you. in the factor follow-up segment tonight, michael holder and the michael brown invests. he s promised a fair and thorough investigation. but comments like this have some thinking otherwise. the national u outcry we have been seeing speaks to mistrust and mutual suspicion that can take hold between law enforcement and certain communities. i wanted the people of ferguson to know that i personally understood that mistrust. i wanted them to know that while so much else may be uncertain, this attorney general and this department of justice stands with the people of ferguson. well, shouldn t he be standing for every citizen, including the police officer involved in this case? joining me now with reaction is my fellow co-host from that great show. dana how common is it for a u.s. attorney general to get so involved in a local/state issue like this. i think it s huge news because it is uncommon. they must have thought the situation warranted it. i don t think there s any situation where the u.s. attorney or the local district attorney would not be able to handle this without department of justice involvement. usually the justice department would get involved if there is some evidence of wrong doing in the investigation. it is true that the police department has had very bad communications and public relations. but you don t necessarily have to come in and indict somebody for that, they actually have to have some sort of wrong doing in the investigation. i think the local district attorney, based on the interviews that i have seen from him, i have never heard about him until the ferguson situation, seems to me like he s a standup guy and should be given a chance to be able to prosecute this case if there is going to be a case. i think that s another thing that i think eric holder, going down there, let s hand it to him. i think by the time he got there, the situation was diffused enough or just even knowing that he was coming helped diffuse the situation. okay, so that s good. but do they leave behind raised expectations for a possible trial? based on what jay nixon, the governor has said, eric holder has said, if they have this kind of national attention on a state matter matter, will they also be stepping in at that point? if it were a white teenager that was killed by a black police officer, would eric holder do the same and try to infringe on a local u.s. attorney or a district attorney? i think the answer is probably no. everything points so the fact that there s going to be a trial, right? they shouldn t necessarily. but how can they walk away from this, it seems like they have been pushing in that direction. i think the most important thing is to get all the evidence. we still don t even know about the police officers, there s reports that he was injured as well. we actually we just don t know. i think that s partly the reason that the protesters are starting to slowly fadeaway because until there is more evidence or a reason to have more grievances, i think we have to wait. i don t think anybody should be talking about a trial. until we know more. but yes, i do think they have put themselves in a position that if there is not a trial, there might be even more grievances. it is unusual, the chief federal law officer showing up in the middle of a incomplete police investigation, that seems to tell me that there s a bit of bias involved here. and it speaks to your point of if a reverse case, it would been that way. one of the things that eric holder himself has said and that people that are watching this case have commented that he has personal experience, as a black man, he brings a different perspective. but if eric holder can weigh? on the case, then why can t the local district attorney whose record seems impeccable. just because his father was killed 50 years ago by a black police officer, they re suggesting that he should recuse himself. that actually doesn t make any sense to me. and i think that as cooler heads prevail. i think this will go forward and there s going to be so much scrutiny on it that they re going to try to everything by the book. you brought up how the police have handled this, which is i guess not well. but are these small forces capable of dealing with a national magnifying glass? companies pay top dollar to have pr executives on retainer so they can have the expertise in the event they might have a crisis. if you re a small local police department, you don t necessarily have that type of training, you can argue that maybe may should. why would you release the video. they didn t give consistent stories but it undermined the confidence in this situation. however, again, that s not an indictable offense. having bad pr is not good, but it s not a crime. it s troubling watching kbelt way blockers and reporters descending down into a town like it s a war zone, it s basically a small town in trouble. the most symbolic thing for me was a reporter convinced that ear plugs were actually rubber bullets because that shows a disconnect between the environment and the outsider. he hoped they were because that would then get him to be more the story, so reporters are trying to make themselves a part of the story do all of us a disservice and certainly the community of ferguson. because as you pointed out, a week from now there won t be as many reporters there. it may be the middle of october before we even have all the information. dana, thank you so much, see you on the 5, maybe. plenty more ahead as the factor moves along this evening. the white house leaks details about a failed rescue operation to save james foley and other captured americans held in syria. but did he just jeopardize any future missions against the isis terrorists. we hope you stay tuned for that report. confronting the isis terrorists in the middle east. after the beheading of american journalist try and rescue foley and other captured americans in syria. it did not succeed. earlier today defense secretary chuck hagel addressed the rescue operation and how big a danger isis poses to america. think are a serious threat to every interest we have whether it s in iraq or anywhere else. isil is as sophisticated and well funded as any group that we have seen. but do these leaks of secret u.s. military actions endanger future missions targeting isis. colonel peters, why well, first up, i want to ask you, what did you make of the briefing today? it kind of reminded me of stallenist brew bureau cats. it s so clear, the administration disgracefully and we need to talk about it, released the details of this raid unnecessarily except to the degree that it provided some fiction of political cover for the administration where they could say oh, we were trying to rescue the hostages, it wasn t our fault that anybody got their head cut off. and you just don t do it. the only real take away, apart from the craven behavior in that news conference, was that we still have nothing that remotely resem bls a strategy. we re dealing with little tactical attacks, which are nice, they help out the local problems. but this i mean these guys even said, they have finally woken up to the fact, as the factor has been arguing for over a year, that the islamic state terrorists are a huge threat, worse an al qaeda, but then they frankingly admitted they re not doing much of anything and they have no plans to do much of anything except build a coalition. it was sad. you seem pretty depressed over this. you know what s disturbing to me? when president obama refers to what happened as appalling and i always said that you should never be appalled by evil. i mean evil should never surprise you, you know it s evil, and there s only one recourse which is to destroy it which leads me to my question to you if you were president, what would you do. the first thing i would do is fire whoever decided that it was a good idea to release the operational details of that mission. but with isil, it s really just islamic state, it s not isil anymore. it s bigger than isil. we should be using the full extent of our airpower to hammer them to strategic deaths. they re both saying we can t do anything in syria. syria is the heart of darkness here, eastern syria, we should be using strategic airpower to hit their headquarters, their marshaling areas, their training camps, their logistics bases, all of that made by the u.s. or the former soviet union, both, that is now in their arsenal, thanks to the iraqi army running away, but you ve got to hit hard, these pin pricks will not make a difference on the strategic level. i have got to address not only disgraceful, but murderous release of details of this raid. you just don t do it. the special operators are furious because the administration rolled them on the bin laden raid. why do i say murderous? not only because detailing which units are involved, tactics, how we did it, not only does that endaer our fighters, if we go in on a future raid, but the administration didn t think about the hostages still being held. they released the data, to the information that we got intelligence from released european hostages. do you think islamic state is going to release more hostages? we signed their death warrants by compromising that information. i m a former intelligence guy. you do not compromise a vital, above top secret national security information for five minutes of political gain. it s un-american. you know, is there the timing, the timing is everything. it smells. do you buy that the media, that were members of the media about to drop this stuff? or do you think that s just made up? even if there s a grain of truth in it. you don t go out and sell the whole farm. yeah. if to the media had some information, well, you know, in the words of the duke of wellington, publish and be damned. but you don t tell them all the other stuff they didn t know. i m sick of unnamed pentagon officials which translates as administration hacks, strong arming the military, strong arming the intelligence community to roll over on this stuff. they put lives in danger, they guarantee there will be more beheadings, they have made the mission harder. it s like with ma and pa taliban during the bergdahl fiasco, they just didn t know what they were doing. that s the scariest part of this whole thing. nobody does. colonel now in custody after going on a murder spree that spanned both coasts of the united states. we are learning about about a man charged with four murders. brown hold investigators he was lashing out for american acts of evil in iraq, iran and afghanistan. he said innocent muslims are being killed there and his murders are retaliation, in which he is quote, just doing my small part. despite the red flags this represents for us right here in the usa, the story has gone almost unnoticed by the national media. joining us now with reaction, lau laura, how come no one seems to be talking about this. you would think that four murders in the name of jihad would get some press? i think the immediate where are always quite uncomfortable in covers these types of acts on u.s. soil, committed in the name of ala, because they re worried about the islam phobia charge, there s a lot of politically incorrect fears about how will it be perceivedive there s too much intense sif focus. you don t want to i think that s part of it. but the media really goes for the drama, in my mind, that forwards the general media s political agenda. and in this case, the ferguson story really bears out witness for them, for all the racial inequities in the country and then it allows them to fill that whole vessel with all sorts of feelings and emotions that i think make them feel better about themselves and re really worried about this. this is a concern for the fbi, the u.s. authorities are very worried about this, now with the porous border to the south, we don t know really who s coming n we just saw bin laden was resurrected crossing the border last week in costume. so there s a lot of concern by the authorities on this and the media does kind of a they did kind of a collective yawn, which just speaks to their own biases. i think that s the interesting, the problem with this is that they tend to dismiss it, whereas when they take more crystallized actings of crime that has to do with a flaw in our system, like what s happened in ferguson. they make sweeping conclusions about american society, the police, the people who live in the middle of the country, who don t happen to be might have been north, they re all racist, they re harboring racial animosity even if they don t verbalize it. but when we re talking about nadal hassan, or any of the other fort dix 6, there was an attempt to as tack fort dix, that happened not too long after 911. again, facts as you side on the five yesterday, i loved what you guys were saying on the 5 yesterday. facts sometimes get in the way. in this case, this man was a jihadist, he was carrying out these brutal murders, shooting one individual ten times in the back as he just was walking, you know, in a secluded area. the other victims brutally shot, multiple times and for some reason, we don t want to talk about what this really means, we must talk about this, our lives depend on it. our country s liberties depend on it. and obviously our national security depends on it. we have to have an honest conversation. this is isn t the first time there has been a proposed attack on ft. dix, and that involved a may mouse professor named bill ayers. and he gotten your. maybe these guys will get tenure as well. these are not isolated incidents. this seems to be a trend. what draws an american to something like this. for him, he had a long history of sympathizing with the somali terrorist group. so he had the interest in somalia, the internet obviously allows a lot of these loner terrorists a lot of them are just individuals actsing on their own, to have a sense of community. this is like social net working for terrorists, they get to hook up with other terrorists, air their grievances, maybe their lives aren t going so well here in the united states. they want to lash out, and they blame other people, in this case they take their frustrations and their anger out in a heinous scale and commit mass murder. i think the internet really does help them. we have seen that with other terrorists in pakistan and u.s. citizens, radicalized in u.s. prisons who have gong over to do u.s. training in yemen terror camps. this is a problem we have to have an honest conversation about it and one of the few networks is actually doing this. this is one area where an honest conversation will help, but some people don t want to have first of all, we put it in really big type. there you go. i don t know if you can see it on the screen. the obama presidency is like the brazilian national soccer squad. they were supposed to be playing the brilliant game, resetting relations with russia, restoring america s good name abroad. and like the brazilians they folded, they collapsed. they just absolutely capitulated. now it s not even in dispute this president s foreign policy is a total failure. you have hillary clinton saying it. you have carter s national security advisor saying it. it s sort of unanimous. the question is why is it failing? there are three schools of thought. what liberals will tell you it s failing because this world is this terribly complicated place. america is in decline. right. the president simply can t control events around the world. and obama sometimes likes to explain himself that way. right. second theory, somewhat more convincing, is this just simply an out of touch president who is not really giving this job his full attention? maybe it s because he won re-election, he feels his legacy is secure. but time and again the president is caught flat footed by events. some of his closest advisors complain he s indifferent to the details of the argument i m making in this article is it s not simply that. this is a president pursuing an ideological goal, which is reduce america s footprint. environmentalists say reduce, reuse. it s american power and influence shrinks you have all of these groups coming up seeking to fill the void. if you had taken your article and instead called it a failure and given it to president obama, he would have taken the whole article as a compliment. he s listing all of my successes because these all of these together have slunk this tumor. because he believes our influence detrimental to the world. he basically believes wherever america goes in the world problems follow. we always in effect make things worse. and what you re actually seeing around the world is suddenly vladimir putin realizes that no one s really in charge in nato. the iranians understand that they re going to walk through the door in terms of their pursuit in a nuclear weapon. the various groups in iraq saying there s no one going to stop us. same deal in china. so they re rushing out. and people are forgetting that this period of general peace and prosperity that we ve enjoyed since the 1940s didn t happen by accident. it happened because of success of american presidents said if not us, there s no u.n., we don t want the chinese or russia running the show. so pax america brings huge benefits with it. this ideology is that it s a bad idea. this damage that we ve seen, is it permanent? is it possible after six years that there s no way back? look, i don t think that s true for this simple reason. america s in retreat, but i don t think america is in decline. when people tell you this is a country decline, this is the country we re fracking is happening, this is the country where iphones are being made. in so many ways there s a renaissance of american ingenuity simply being gummed up by a regulatory state by a president who doesn t believe in the very things that make this country great. russia s on the march, but russia s actually in decline. its population is falling. europe is in decline. the chinese, people say the chinese are going to take over the world. when i was growing up japan was going to take over the world. there s always somebody else going to take over the world. the capacity for self-renewal is in this country. the problem is not having an administration that is taking advantage of it. right. so basically america succeeds despite the leader s failure. that we re going to still pull it through, it s just going to be a little harder. one of the things that always amazes me you say a president of a country like colombia and say, this country s life or death succeeds whether it s a good president or not. in a way the miracle of america is we can have terrible presidents and yet here we are. yeah. basically a powerful, prosperous and confident country that can do things if only we have good leader. it s a testament to our system that we can withstand these things, these internal problems. i always feel like what s happening is punishment for our past transgressions. you know what i mean? abducting her is behind bars in virginia this morning. where is hannah? fox & friends begins right now. it s time for fox & friends. that s right, ladies and gentlemen. welcome to the show. a a big jam-packed show for you this morning. a big star on the show this morning. we are going to invite you to take over social media on his behalf. do you know his name? are we talking about the eagles or andy grammer. andy grammer is here plus anna kooiman for all four hours. all four hours. take that work break we were talking about last week. first, we need to get right to this. big news this morning, fox news alert horrific murder in the heartland. a woman beheaded by her former coworker and now authorities are trying to figure out if this is a random act or a lone wolf jihadi trying to send a message. elizabeth prann is live in washington, d.c. good morning, elizabeth. good morning, anna. fbi says investigators are looking into the suspect s background. while the oklahoma police department is waiting for 30-year-old alton noland to wake up before they arrest and question him. noland had just gotten fired before his job before the before the rampage occurred. he had been trying to convert several employees at the food processing plant to islam. that being said, authorities say it s way to early to to tell if that or mental illness played a role in the attack. the justice department just releasing the 911 calls. do you hear this in the background? is that him? is he back? sounds like he is he running around out here. [gunfire] and that s a gunshot. got gunshot. the police sergeant says noland severed a a 4-year-old woman s head before stabbing another coworker a number of times. he only stopped after being shot by another employee who potentially saved lives. that employee mark vaughn is the coo. is he also a reserve sheriff s deputy. he is obviously a hero in this situation. it s very tragic that someone did lose their life but it could have gotten a lot worse. this guy definitely was not going to stop. he didn t stop until he was shot. the local tv station kwtv reports that noland was shouting islamic phrases. there is no independent of that story so he we will wait to hear. back to you you guys. authorities are baffled. they don t know why he did this. we do have some evidence in the form of social media squibb blinks left by suspect alton noland we want to put this on the screen for you. this may give you a sense motives. were as a muslim we don t celebrate americas with a k holidays. christians have some things where they eat crackers which represents jesus, flesh and drink cranberry juice which represents hesitate blood. don t you think that s kind of evil, lol, wake up, islam is the true religion, and this goes on and on and on with pictures he has got up there with the statue of liberty on fire and the twin towers burning. and he also posted a picture of beheading and just very troubling captions underneath them. the photo of the statue of liberty going into flames. he says she and anybody else can go with her. i mean, just nasty nasty things and there is a report, too, that he was released early from probation from hesitate convictions he received in 2011 because he does have a bit of a rap sheet. and this is after posting the very troubling things online. he changed his name also as we saw on the facebook post to yas kareem yisrael. his post littered with misspellings. not only is he an accused murderer you he is also a moron. there doesn t seem to be much question at all that he signed on to some form of radical form of islam. the question this morning is why are these people becoming radicalized. could this be an example of a lone wolf terrorist in this country watching online videos being radicalized or anwar al-awlaki videos. walid phares was on the record last night. online guideline thousand pages five or six years ago how many ways could do us harm. listen to who is radicalizing. much closer, earlier than the fact that when they are moving explosives and what they are trying to do in terms of sniping or killing. when people are rad radicalizing is the mommy that people have to be concerned about. act now rather than act later after we have another september 11th on our hands. what s interesting is this guy made every outward sign of being a radical muslim. and, yet, authorities are sure not sure whether this is work place violence, just another crazy person or an expression of his religious fervour. what he really needs is the president to weigh in on this. president obama to inform him that he is not a muslim. just as he has told isis you are not muslims because the president you may know this the not a constitutional also our theologian and chief. you are not a muslim. you may think that you are but you are not. calling it work place violence all over social media yesterday. is this work place violence? lewis from the police department had this to say about work place violence at that press conference yesterday. watch. about 4:15 this afternoon we received phone calls from what appeared to be a work place violence incident. officers were dispatched, possibly involving a night. as officers started arriving it changed to gun shows were being fired. officers entered the business as an active shooter situation. okay. so, yeah. let s ask the people who work there who had to witness this if they think this was some sort of work place violence like a fist fight or something. absolutely not. you remember those beheading videos from isis that were so terrible that started with james foley in the orange suit. you came in here and watched this you were beside yourself. all those people that had to watch that reports up to 300 people had the ability to have seen this. i bet when they pull this guy s computer records, that they are doing now, he will find that he watched them to. clearly a copycat. why is it we have such a tough time recognizing the obvious. at a moment when islamic beheadings are the number one news story in the world, this guy, while apparently shouting islamic slogans beheads someone at work and changes his name to islamic name has nothing to do with islam, really? because those in the position of power have this narrative that terrorism is being defeated, all of these enemies are on the run and therefore, what happens at home is clearly work place violence. clearly something that hr needs to get involved in. religion of peace of course this couldn t have anything to do with islam. it appears he was on a rampage. he killed one, stabbed her multiple times and beheaded her, severed her head and moved on to a second victim. fortunately there was a hero in the situation. the coo of bond foods happens to be former law enforcement. he got the call, went and ran and got his vest and his rifle and he took down the suspect. james is the former fbi assistant director. this guy there on the screen didn t have a gun at work and was able to stop the situation, it could have gotten much worse, listen. thank god someone in that place had a gun. you know, a good american citizen had a gun and i think we re going to find in the future that more and more people that are just whimsally against guns. they say all these crazy things they will hope that real good people have guns too and could protect them. imagine if he didn t have a gun how many more bodies we would see in here? we have much more on this throughout the show this morning. how interesting that reality keeps piling up. the evidence keeps accumulating that a lot of the troops you hear from the president and acolytes are completely disapproved by facts on the ground by reality. so, like, you know this has nothing to do with islam. ordinary people shouldn t have guns. really? that s exactly the problem. you hear about stories like this and it really destroys the integrity of the programs for those who are truly in need. but the problem has been that the welfare roles have exploded over the past four years over 135% up on spending. taxpayers spent $700 billion on the food stamp program last year. this has caused the state to be unable or unwilling to do the proper verification to make sure people belong on the system and then enforce the penalties and rules once people do get on the system. there is really no incentive for states to enforce the rules because they have been incentivized to grow the welfare roles rather than control them. should it surprise us that a lottery player is on welfare. why is the government encouraging poor people to gamble in the first place. only idiots work. get rich quick. buy a lotto ticket and get rich. why is the government doing that? it is greed, isn t it? it is. a lot of states, you know, they have the opinion that the more you spend on welfare, the more you spend on the food stamp program, it somehow creates this economy where, you know, you spend one dollar on welfare and you create somehow $5 in the economy. and that s just not the case. and i think all the hard working taxpayers right now are are also asking this question after they work 40, 50, 60 hours to take care of their own families, can you see the brazenness, the audacity of people that are scamming the welfare system. this guy even went and took pictures with his winning card, his winning ticket at the lottery commission. right. so what is causing the government to do this? honestly we are not entirely sure. there is two schools of thought here either a she flew out farther than she could to get back or dove in the water after some food and ended up submerging farther than she could back out. william and dominic, had you to get out there and try to get the eagle. how distressed was this bird and why did you feel so compelled to get in the water and go after this eagle? well, the eagle was up on shore, that s part of our mission is environmental protection. and we take care of all the national s wildlife. thought it was the right thing to do. i don t like seeing animals die. william, patriotic pride here, right? is that him? he s back? yeah. it sounds like he is running around out here. and that s a gunshot. got gunshot. you now the local tv station kwtv reports the suspected killer has had a number of run-ins with local authorities, such ago drug possession and assaulting trooper. he served two years in prison back in 2011. anna, clayton and tucker back to you guys. getting disturbing images what was off of his facebook page. trying to unravel who this guy was. if you look at his facebook page over the last few months, there was a the lo of evidence point to this radicalization unfolding. he wrote. this i just want to say as an muslim we don t celebrate america s holidays with a the lot of letters missing and a lot of vowels missing. radical but also a moron. he writes this about christians, christians have some thing where they eat crackers that represents jesus flesh and cranberry juice that represents his blood. don t you think that s kind of evil, lol. wake up, islam is the true religion. photos appearing to celebrate terrorism with usama bin laden, pictures of beheadings, pictures of the twin towers on fire. same with statue of liberty, a sign saying islam will dominate the world. freedom can go to hell. do you think this is a normal guy? also, he had been trying to radicalize and have members of his co-workers join him in this crusade. he was trying to get them to convert to islam on a repeated basis and members that he worked with had said to other authorities hey, this is concerning me. that s not enough this is his facebook page jah keem yisrael. president obama s sideline telling muslims they are not muslims. one of the federal officials called his facebook page, quote: provocative. that s the understatement of the year saying it included a photo of usama bin laden, facebook page appearing to be nolen one depicting a heading. nope indication that no one was copying the beheading of jihadistst in syria. adding they are treating this as work place violence. and copying, obviously the term beheading has been in the news lot lately. we have seen the concerning images from isis in those videos. the fact that he had links to all of this stuff on his facebook page yet they could find no link that he is copying this. beheading on his facebook page, is he a radical muslim, they have been beheading people around the world. the fact that he beheaded someone in oklahoma yesterday no connection at all. that s crazy. so maybe this isn t isis directly. but what has isis been doing recently? they have been going online. online message boards and posts things the lone wolfs of america, how to make bombs in your kitchen and instructing isis sympathizers on what to do. so, when you see somebody like this guy, who beheaded a colleague and tried to kill another, it appears, who knows how many others, just memorializing islamic radicalism as a good thing, let s put it 2 and 2 together. mike baker says the threat to the homeland though is serious, and he says this isn t the first occurrence of this. listen. we have all the information we need to say that the threat to the homeland is very very serious at this point. whether we are talking about khorasan or the islamic state. we know that they have been having increasing success in doing exactly what they have been trying to do for years in gathering up western recruits so they can release them into the homeland and create these attacks. i just want to repeat that none of this has anything to do with islam. our theologian and chief has told us again and again. yes, they may call themselves muslims. yes, they may be the islamic state, yes, they may quote something called the koran which may be connected to this great world religion. has nothing to do with islam. therefore you shouldn t profile and ignore any signs of this on somebody s facebook page. let s hear from the leaders and come forward and condemn these people as the terrorists that they are and make the distinction between the two. well, yeah. if they were christian, if there were people running around beheading others on behalf of the ebusiness ebusiness cable church i would say something is wrong with the way christianity is being practiced. wouldn t you? complacency right now in the united states is our number one enemy. you know, it doesn t matter if it s even work place violence, which this was clearly not, in my mind. and i think that the individual that posted that response by the fbi should be fired because that s absolutely ridiculous. there is a level of political correctness that you can go safely. and he or that person went way beyond that and i think complacency really leads to being unaware and that s a problem when we have somebody who is, youknow, g these things, trying to convert these things. that s one thing. but when you look at his facebook site, which companies can do, and you see this intense ideology spread all over it, there is an issue there. well, it seems like the people who wind up, americans who wind up becoming radicalized are from one of two groups. either immigrants usually from somali or pakistan or from this guy who looks like he got converted in prison. a lot of radical islam in american prisons. what can we do about that. call it what it is fundamental mohammedism. you made a comment if christian church was actually doing something like, this you would have an issue with this. yeah. here s the thing, if somebody is a new convert to christianity, or a new convert to islam, they are going to be energized. and they are going to be really practice the fundamentals, because as we progress in our religion, we progress into adding our own stuff into it it fundamental christianity is a religion of faith, fundamental islam is a religion of force. and you see recruiting in prisons. you see recruiting in the inner cities and mosques going up in the inner cities while they may be trying to do a service. the fact is anybody who has a fundamental or what we call radical viewpoint it s easy pickings there because people are looking for hope and change. so to speak. so to speak. are you troubled by the department of justice regulations, new guidelines that we have been reporting about it on the show this morning? which seems would tie the hands of the fbi. no more racial profiling, ethnicity. can t look at their religion. there was a clear line a line of this from this guy on his facebook page. he he had a long rap sheet. he had been arrested. he had led police on a man hunt for crying out loud. do you feel that federal regulations are now going to be getting in the way and hamstringing law enforcement? when you look at effective, offensive power over there, right? the three legs, air strikes we have right now but we need intelligence and boots on the ground. and while air strikes, i think are an effective way to put them back on their heels, if you will, without the other two, we really won t be truly effective. that s why the military is put three together. we have seen this unfolding right now. 22 air strikes so far against isis targets and more than 30 strikes in syria. when we talk about those air strikes? what are reseeing? what is unfolding with air strikes? are we trying to dampen them so we can put boots on the ground eventually. what you are see something a softening of the target. hard assets used initially. seeing the leadership in flux. and their command and control starting to talk to each other, which opens up to a little bit of activity and we can start targeting them on the ground from that. air strikes are extremely effective at degrading the enemy. but that alone is not going to destroy isis, which is what mission success looks like. so we re going to see the enemy. we are going to see isis changing their tactics, techniques and procedures. changing command and control center locations. we are going to see them start blending in the population. we are a finely tuned military in the united states. we are used to communicate amongst ourselves very well. when we form this coalition we have discussions with other pilots. how does that unfold? are we worried that there is going to be maybe something might be lost in translation off how much of a burden are we handing over to other members of the coalition? i don t think there is any doubt when you have multinational militaries working together there is going to be calm issues. point earlier the boots on the ground should not just be american boots. i love what i i m seeing the british vote yesterday in belgium and denmark. this coalition. what people need to understand is this is not a quick fix. right? this is not world war ii. it is not vietnam. we love it nice and neat in this country but this is a long-term commitment that i think the globe literally the world needs to get around. who is going to be boots on the ground? if we are all in agreement that we need the boots on the ground. moderate syrian fighters and then who are they? for a long term approach, 10, 20, 15 years. or let to to the local command and control to handle this? what you are seeing now, there are special operators on the ground. they have been training their partners that have already been there the person peshmerger guard. train assist and device methodology, they are really going to handle the brunt of isis. we don t even know who half the syrian rebels are what does it mean to be moderate in the first place? there is no leadership on the ground in syria. so, when we are talking about arming these syrian rebels, who do we talk to? how do we have a conversation with them? we don t even know who is in charge? exactly. and when we are talking about army and training them. it sing going to take time. it s not going to happen overnight. so, and we also have to remember that their objective is not necessarily to fight and defeat isis. they want to get rid of assad. and so, who is going to take care of that isis threat in the interim? there is until they are basically armed and ready to continue the fight, so we need to continuing arming the peshmerga. now we need to get serious about a ground coalition with our allies that involve a long-term commitment with resources and funding and these ground forces. can pinprick air strikes do the job? i mean, there seem to still be getting funding from their oil fields. they are still putting out social media messages. they are still getting their message out. they are still attacking people and still killing people and putting it out there with videos that are well produced. look at the pinprick side of it, i think. we are warming up. it s a logical step. we have got to put the pilots over there. so, i don t think it s the long-term plan. we had to do something to knock them back on their heals. because the strength was just growing every day. so what you see he with air strikes, is you see a stalling of their momentum. where we really need to dominate them and create relentless pursuit is in the virtual space that is what is keeping them together right now. can we have a social media campaign that rivals what they are doing. taking the message out there virtually. we are hearing that the government is looking into doing that trying to say think twice before you would want to join isis, putting out i think it s about time that we start doing that because as we know isis has been effective with social media campaign in terms of recruitment and pushing their agenda and ideology. we need to let the world know that they can t run from this international coalition that s been established. we will destroy isis. that is our instinct here. scott, will we win this war. always. dan? i would say america needs to start going to church. so we don t talk about it much. but i think god is what separates the good people. this is true evil and what can americans do? prayer is a big thing. so, we are going to need every asset we can and that s a pretty big one upstairs. who will replace outgoing attorney general holder and when? i think there is both in there no question that mr. holder passionately believed in a lot of these things. at the same time, he has a very close personal relationship with the president. i cannot imagine for a moment that he would be going out there. pushing these issues, these political issues so aggressively if he didn t have the president s backing and support. i think mr. holder was doing exactly what president obama wanted him to do. it sure seems that way. who is going to replace him? it s a great question. the names that we have been hearing. some of them are already familiar to us. one is don, the solicitor general. he argued the obamacare case. a presence in the supreme court. they have been talking about the federal prosecutor in new york. there is camilla harris the california attorney general. devol patrick the governor of massachusetts, his name being mentioned as well. two out of four i think are more moderate than eric holder. that s for sure. do you think it s going to be tough to get anybody through the senate after holder? terrorism? when barack obama is no longer president. we have a little hope that eric holder is gone. but the fact is when the little rock shooting happened, andy long murdered in front of the recruiting office with a person who was a radical islamic jihadist who had gone to yemen, radicalized after he was in a nashville, tennessee mosque and then came back and said he was going to kill people and said he did it for his religion. and they still called it just a basic murder and a state crime, not a federal crime. we saw it in fort hood. now we see it here. it just perplexes this. here is the real challenge on this. with all of the information on facebook. all the things he was saying to people. here was a real clear picture of somebody who is about to go off his rocker. how s come we are spending so much time checking your email, listening to your phone calls, putting you through the third degree at the airport if we have all the time to do that, why aren t we looking at somebody s facebook page who might just be giving us a clue of his intention. governor, it s pretty blatant and we will share it with our viewers. some of it we can t share with you because it s too graphic and terrible but alton nolen s facebook page. i just want to say as an muslim we don t celebrate americas with a k holidays. another thing that he said about christian. he said christians have something where they eat crackers, which represents jesus flesh and drink cranberry juice which represents blood. don t you think that s kind of evil, lol. wake up, islam is the true religion. but we don t behead people. let me make that distinction. i don t know of any christian in america who thinks that that s okay. i just don t. even the craziest people among us who claim to be christian. west where row a bunch of loans who aren t really christian. i don t think that s christian. but any think they are christian. let s just be honest. when somebody claims to be an islamic and they believe it s okay to behead people and they hate people and want to destroy america, i think we have got a problem with them. where is the silent muslim community then? because you say as a christian, if someone was going in somewhere and they were holding up their hand and saying jesus is lord and doing something terrible like fort hood you would condemn that. absolutely would condemn that and say it has nothing to do with us but i wanted to make it clear that is a misrepresentation of the religion. i wouldn t go around and saying religion isn t involved. i would say a nutty version of religion is involved. i would say a perverted version of religion is involved. i wouldn t act like nothing here about religion. it s everything about religion. got to be honest about it. explain this phenomenon then. the president of the united states time after time has assumed this role as theologian in chief telling various groups they are not muslim. isis you are not muslim. i m sure he will tell this guy no you are not a muslim. when did the president become an authority who is and who is not muslim? let s just ask ourselves if a person gets down on a mat five times a day and pray and from their prayer they get up and kill somebody and they associate it with screaming out the name of god as they kill somebody, i think it s kind of hard to separate at least their religious intentions from what they did. that s the whole point. tucker s point is great. you go back to george w. bush right after september 11th, he said similar words, did he not? about this is not a war against islam. that islam is a peaceful religion. and he made great efforts, george w. bush did, to try to push that and make sure that we were identifying these terrorists separately. so is that a hold over from that? what do you think? we all want to be careful not to categorize everybody who is a muslim as being a radical jihadist. because wouldn t be fair, wouldn t be true. that would be inaccurate to say everybody who is muslim and goes to a mosque you better be worried because they may pull out a knife and slice your head off. that is nonsense, there are legally many wonderful people who are muslim. but what we have to understand is that the real threat we face happens to be a version of islam that is absolutely radical, out of control, and we are at war with them. we can t just go around and saying oh, it s just, you know, some little issue. it s not it s huge. but we need to focus on what really we are afraid of. not just what we are mad at. if you were president of the united states, you had a marshall your secretary of defense and all of the members of your cabinet. you re dealing with the military and dealing with the crisis that is isis right now in the middle east, how would you approach this? because the secretary of defense hagel saying this is the fight against isis is just the beginning. and that air strikes alone are not going to stop this. what would you do? the first thing i think the president should do is to say everything is on the table. never tell your enemy what you are not going to do. because now he knows your limitations. clinton eastwood said it best. a man has got to know his limitations. you never tell somebody what your limitations are. you know what they re. you don t ever say by the way here are my limitations. you know what? then i m going to exploit your limitations. if we say we are going to come after you but we are only going to come after new these ways. then i m going to come after you in every way you are not going to come after me. i m confused what our objective is obviously we are want to kill them. even the gulf case. this is taking place in the middle of the syrian civil war. fighting the president of syria. we are saying we are against him but also against his enemies. what exactly do we expect is going to happen in syria and what should we want to happen in syria? the old phrase when your enemies are killing each other, never get in their way. let them go ahead and finish it off. there is a certain sense in which we need to make sure that we limit our concern to that which threatens measure security, american safety, american journalists being beheaded. but we do need to understand that the real threat of isis is not necessarily what s happening in the civil war in syria. it s what s coming across the southern border. it s what happened in moore, oklahoma yesterday. it s what could be happening in a community, in a town near you. that s what i think we need to be afraid of. that seems to be one of the biggest things that isis is working on right now is asking these lone wolfs in america we. you better believe it is is they may be a lone wolf but they are connected to a much bigger pac. wolves are never alone. they don t run alone. they may do something alone, they are a pac type animals and they run in packs. who do you feel on the show tonight. nobody. i would watch that. we are going to have a really great show. a doctor will talk about one year into obamacare. how is that working out for us? [inaudible] here to weigh in is katrina. thank you for having me. when you hear that twice what do you think. congressman woman schultz isn t exactly known to be the intelligent one this her party but these particular comments truly take the cake considering domestic violence is a national discussion today. and she is comparing the republican party and the tea party to abuses against women when she had done a little bit of her homework, she would have found out othe majority of tea party leaders in this country are, in fact, women. but, more importantly, these are men of the republican party, which is where i think the republican party fails to take her comments and educate the public considering when you look at women like susan b. anthony, who happens to be a champion for women s suffrage and women s right who went to jail for voting a straight republican ticket it is republicans who supported women s rights. it s free market principles that helped madam walker become the first female millionaire in the united states of america as a black woman during the time of slavery. katrina to show the other side of this though the liberals coming to the dnc chair woman s side saying this is a stretch that republican critics are saying that this is somehow comparing the back of the hand to domestic violence. if that is a stretch and that s not at all what she meant. is this just something that happens to be in her vernacular and happened to say it or was this deliberate? i guess, i mean, everybody had a crush on mark growing up but i remember getting out of the truck the first time i saw him you are mark wahlberg, huh? yeah, i didn t i don t get it set the tone. what did he say when you said i don t get it? so, when a veteran comes back, they may be physically or emotionally wounded. yes. there is also sort of a transition that happens where it s just that change from this military culture to coming back in to the civilian world. you are not wearing a uniform anymore. you might feel isolated. so fly fishing gets you out into the environment. it gets you out doing physical activity it. we think it kind of transcends fly fishing too because there is this spiritual healing that takes place. i think that anybody that has fly fished kind of understands. you don t have to be an ailing veteran to reap the benefits of fly fishing. it does make everything better. i think so. one of the great features for people all around. this gets people out into that there is is the shared experience that takes place with the veterans where they are sort of maybe feeling a little isolated out in the world. and now you are with a bunch of other veterans. a bunch of other people that may be going through some of the things that you have gone through and now you can communicate with them and feel like you are part of something again. fly cast. one of the most beautiful moments that it a human is capable of. watch this. all right. you are keeping that fly line in the air. no weight. you are using the weight of the line to move. you know i fish, but you are always dealing with the fishing line. this fishing line doesn t get tangled like regular line. no. it s totally different. that is amazing. project healing waters. how can our viewers who are interested in supporting project healing waters. check out our web site project healing waters.org. so many ways to be involved. thank you so much. appreciate it thanks. heartland. rampage beheading a coworker. will the administration calling it what it is, an act of terror or will they continue to call it work place violence? yes. slightly. because i think the social geography of intelligence collection is driven by the threat, right? until we can come to terms with that you know, we are not going to be able to deal with it in the way that we need to. what do you think the fbi needs to do next to stop the threat of homegrown terrorism in this country? we have seen a number of these lone wolfs pop up across the country now. are these isolated incidents? should they be handled as isolated incident or is there part of a l narrative we are seeing unfolding in this country? we need to take preventative measures. i think a significant part of, this one of the key or critical aspects to preventative measures are fbi or law enforcement sting operations. they have been largely successful in the past. now, of course there are are concerns about entrapment. but i think the more we focus on this and the more resources we dedicate to things like sting operations, we can really get to these people before they go forth and commit these acts we can probe just how serious their intent is and stop them before it actually gets to this point. do you see a pattern among these guys? you are an expert in this. how does someone become radicalized? what sort of profile does this guy fit. there is no single demographic profile of radicalized terrorists which makes it so difficult. one of the things i think about quite frequently is are converts more susceptible to striking out and taking these extreme behaviors. perhaps sometimes they feel that they have more to prove. collin clark with some ominous words this morning. we appreciate you joining us this morning from pittsburgh. thanks. hundreds of students protesting changes to history curriculum. but are they really just political pawns for teachers unions. the school board member whose policy sparked it all is live next. the clinton clan getting bigger? one of the board members who introduced the proposal. one of the members who backed these changes, julie, thanks for coming on this morning. so i want to cut through the noise and the propaganda, i know it s hard, but what exactly would these new changes do and why do you support them? what these new changes will do, it will emphasize the negative aspects of america and it will minimize the exceptionalism, the great parts of american history. hmm. okay. so part of the proposal, this is a pull-out from that material, should promote citizenship, patriotism, essentials and benefits of the free enterprise system, respect for authority and respect for individual rights. materials should not encourage civil disorder, social stripe or disregard of the law. that sounds good, but the students seem to have an issue. they re outside, protesting, and it doesn t appear that they re just protesting patriotism. what is it that they have a problem with that would come under your changes? i m not propoeing for any changes. all i am asking for is for a citizen group to review curriculums, to give the board a broader perspective, a broader understanding of what is appropriate for our children to be learning and what s not. we re not talking about censorship in anyny way. looking at my own kids curriculum and i believe that you should teach history as it happened, the good and the bad, that s what history is, not what you want to know or hear about but what actually occurred. but there s a lock of balance where there s an emphasis on the 1960s and the civil rights movement but almost nothing about the civil war or the founding of the country. is that a common lack of balance, do you think, have you seen that in schools in colorado? in the new framework, this is brand-new framework for the a.p. american history, yes, it s part of that curriculum. i would say as far as the other american history, you d have to look at the common court standards and see if that is a consistent theme. okay. you say that you think the national education association is playing politics here and organizers on social mia rallying these kids, how do you think politics plays into this? took matters into his own hands and stopped him with a gunshot. elizabeth, what s the latest? good morning, guys. fbi says investigators have been called in by local authorities to look into 30-year-old alton nolen s background after witnesses say he had been trying to convert several employees at the food processing plant to islam. nolen had gotten fired from his job before the rampage occurred so authorities say it s way too early to tell if self-radicalization or mental illness played a role in the attack. the police department is releasing the 911 calls. in the background. is that him? he s back? yeah. it sound like he s running around out here. okay. and that s a gunshot. got a gunshot. the police sergeant says nolen severed a 54-year-old woman s head before stabbing another co-worker a number of times. he only stopped after being shot by another employee who potentially saved countless lives. mark vaughan is not only the c.o.o. but a reserve sheriff s deputy. he s obviously a hero in this situation. it s very tragic that someone did lose their life, but it could have gotten a lot worse. this guy definitely was not going to stop. he didn t stop until he was shot. the local tv station kwtv reports nolen was shouting islamic phrases. there s no independent confirmation of that frame at this time. back to you guys. thanks, elizabeth. we re able to look at his facebook page and see what he was celebrating and proselytizing and trying to get other people to come along with on his view points of radicalization. this is his facebook page. of course he changed his name. and he had all sorts of horrible things on the page including comments like this i just want to say as a muslim let me read it in the way he wrote it and not clean up the english. i just want to say as animus limb we don t celebrate amerikas holidays. not only an extremist but also a moron. despite the fact he had pictures of the twin towers on fire, of a beheading, of osama bin laden, all this on facebook, despite the fact he had an islamic phrase tattooed on his abdomen and apparently shouted islamic slogans as he beheaded this woman, despite the fact he tried to convert his co-workers and supported stoning of warkers at the workplace, federal authorities are saying we re not sure this has anything to do with religion. the president s in habit of telling people who claim to be muslims they are not muslims. he is not only a note economist and constitutional scholar but the president is a theologian as well. he s going to explain, not really a muslim. one of the federal officials called it provocative, saying it included a photo of osama bin laden, the facebook page includes a wide range of photos including one depicting a beheading. but the fbi has so far found no link to terrorism. also no indication nolen was copying the beheadings of journalists in syria, adding this they are treating this as workplace violence, coming to us from the washington post. provocative. yeah, isis is provocative. workplace violence. let s ask the potential of hundreds of employees there whether they think this is workplace violence, just like a fistfight, something hr needs to be called in on. i don t think so. someone was just beheaded by an isis sympathizer it appears. i mean, he s doing everything that they love. showed pictures of beheadings, shows osama bin laden, the statue of liberty on fire. not like janice left food in the microfwhaef the break room and we re sick and tired of it. stole my chicken salad. jonathan gillian says this is not workplace violence and whoever said it should be fired. complacency in the united states is our number-one enemy. doesn t matter if it s workplace violence, which this was clearly not in my mind, and i think the individual that posted that response by the fbi should be fired because that s absolutely ridiculous. we re at war with islamic caliphate fundamentalist movements. it s one great big oesn t matte operative here who grew up here, was radicalized in prison or a mosque. what we know. over the past six years i ve learned two things from the obama administration, one, nobody who commits an act of violence is actually a muslim and two, guns are bad, you should never have a gun, whether you re a law-abiding citizen, should not have a gun. true. and the idea that this c.o.o. of vaughan foods actually had a gun in his office, had he not had this gun he wouldn t have been able to stop this guy. he s being hailed a hero this morning. a former fbi assistant director had this to say about him having a gun during this massacre. thank god someone in that place had a gun, you know, a good american citizen had a gun. and i think we re going to find in the future that more and more people that are just whimsally against guns are hope that real good people have guns too and can protect them. imagine if he didn t have a gun how many more bodies we d see in here. surely there would have been if you listen to the 911 tape. you can clearly hear the panic and the fear, hundreds of people watching this unfold. he would have killed more people had he not walked in with a gun at that time. for sentiments. why won t the government call this what it is, an act of terror? joining us now is congressman eric shock. good morning, guys. is that a mistake? do we need to have a category label on this right now? i think it s i don t know all the facts, i don t think any of us do, as the investigation continues, but it s obvious he convert to islam, obvious he was attempting to convert people in his workplace. i think it s emblematic of the administration, who continues to refuse to call this terrorism what it is, which is islamic extremist terrorists. the 9/11 commission was very clear. it said america would make a mistake if it does not call it what it is, which is islamic extremism jihadists that attacked our country and we must destroy them. we now have a president who came to power in an attempt to try to dismanhattan it will bush doctrine to only realize that the bush doctrine is the only way to defeat these people, to take the fight to them, to infiltrate them, and to destroy them where they exist before they come into our homeland. and so you can see it at all levels of government, the administration when they send their folks in, the first thing they want to do is to try and appease everyone and say, well, this isn t this isn t a terrorism. well, it s not oklahoma city bombing. it s not ruby ridge. this is not just some man who flew off the handle. clearly we don t see beheadings as a normal type of workplace violence in this country. we don t. this guy was american, apparently converted in prison, but a lot of the homegrown action terror acts have been committed by imgrants to this country. is anybody saying, hold on, maybe we should limit immigration from countries with a lot of islamic extremism, like somalia? why wouldn t we be doing that right now? part of it is is immigration and naturalization services background that they do when you apply. and we call on the administration to heighten that and to improve that process. obviously there s things we could do legislatively that, given what s going on we should. but the big frustration i think for all of us in congress has been the administration s refusal just to stop those americans that we know have gone overseas to join the fight who have proclaimed their association with isis. the fact that we haven t revoked their passports, there would be something as simple to say to those 300 people that the administration says we know they are known fighter, we know they are joan jihadists. why would we allow them to keep their u.s. passport is unreal. are you disheartened by the new guidelines from the department of justice. we ve been reporting all morning long about them. cannot racially profile, can not look at your ethnicity, can t look at your background, your religious background any longer so, if the fbi is going to try to identify lone wovms we have to remove those monikers before we can investigate you. it s in sharp contrast to the oversight and surveillance authority they ve asked from congress. the argument that they ve made to be able to watch who you call, which phone numbers you call on your cell phone, is the argument that we want to be able to know about who you associate with, perhaps you could be a target. well, if who you associate with suggests based on whether or not you could be a target as a potential terrorist, then why are not all these other factors they re now precluding equally as important as something as simple as which phone numbers you re dialling? so it s inconsistent, and, again, it s an administration who thinks about the mill ramifications before they think about the security ramifications. it s clear in the foreign policy, this kind of this very limited scope that we re involved with right now over there. it s clear that air strikes alone is not meant to destroy isis. and it s a from the president who doesn t want to fight terrorism in the same way the bush administration has and is making america less safe as a reporter i think walter isaacson whether or not he lets his kids use the ipad, they must love it, he said we don t let them use the ipad. in my school it s all ipads, had it for two year, the first catholic school in the l.a. area to implement the ipad system. they just got a new ipad. so the ipad is part of their life. and that s part of the way they learn. and it s a great tool. but athai only have the educational games on it and we do still limit it. and i never let them bring it to a restaurant. i never brought my kids to nice restaurants. i didn t understand that they didn t go on vacation with us either. i don t put them in places where they re going to fail. now that they re older we can go to restaurants but the point is we re sitting and talking. i see these people and i understand but i think that s a bad habit to get in every time you re at kind of a nice restaurant your kid is there unacceptable. with the ipad. there was something on facebook the other day, what it well, it s not hard at all. i mean, you know, we want to make it as easy as possible. obviously there s a little screening, but we don t want to put a lot of hurdles in the way of a dog. there are a lot of animals in need. really the public is the solution to homeless pelts. i want to adopt this dog but i ve got too many dogs already. let s say i lost control and wanted to adopt the dog, how would i do that? should they? joining us, a physician and author of in the land of invisible women. thanks for joining us this morning. thank you so much. so why is this happening? i think it s multifactorial, and certainly we re very concerned with the atrocity this sum we are the activities of isis, but we also have a problem with radicalization through social media consumption and also in america s prisons they have been studying radicalization for prison islam. who know what is motivated this individual, but the key thing to say is believing in islam is by no means something done under compulsion or under threat of violence. this is absolutely not a valid and must be completely put to rest that that cannot be true practice of islam. but isis has sent out video, three so far, of their opera tifs beheading people. what kind of person would look at that video and say, you know what, i want to be part of that? a great question and very, very alarming. we know from our british counterparts that many of these people consuming information are middle-class british often women and people who are privileged with access to this information because they have a computer, they have wi-fi. but they have an appetite for what seems alien, what seems foreign, and they may be naive that going into a blank canvas they may not be aware of this society they re in. it also i think, because i have seen decapitations myself in films with counterterrorism experts, there is a lurid fascination, and i think once somebody can see that without any context it s easy to pursue it just like people pursue pornography or other ways of titillation. it s deeply troubling. it is a species of pornography as far as i m concerned, a back level of violence. what should mosques do? how should they respond? i think we have all the roles to play, first reassure people that these beliefs are absolutely alien to the practice of mainstream islam, which is heterogeneous, 1.65 billion followers over 70 different sects, most of him will denounce this. the only people that have embraced this are radical islamists and they have to be exposed. we are in the best position to expoetz that. great example is the parents of a female who reported her to the british police when she was missing concerned that she had become radicalized by watching internet material in her bedroom and she had every privilege afforded. her parents were the someoones y this was criminal and were concerned and warned other muslim parents. you said twice it s clearly true that people from middle class, upper middle class, educated backgrounds are paradoxically more likely will be toy act to this kind of extremism. the 9/11 hijackers weren t from impoverished backgrounds. why is that? in this era information is so wide hi available, the children that i met in pakistan who were being deradicalized by the pakistani military and muslims did not have access to this technology so, one is we have a very free movement of information, and two is they think there is a cultivated sense of alienation. at least let s talk about europe and britain, where i m from or in the united states where people have an artificial sense of isolation and being somehow dig disenfranchised from the united states in particular. in terms of the prison islam situation, people are often looking for separatists, anti-american ideology. these things are appealing. i don t think there s any one reason, but i would say no individual you cannot make a generalization. there are so many factors that are involved. right. muslims have a role by collaborating with authorities, by reassuring their neighbor, by being good community citizens so that there is confidence restored that the vast majority of muslims reject this totally and will participate in safeguarding our whole community. doctor, thanks for coming on this morning. thank you. coming up, it happened again, more celebrity picture, naked one, leaked to the internet. how did it happen?
