quote, he shouldn't. >> he has already violated, essentially. >> he would. have >> he would have. >> interesting, that actually constitutes a violation of georgia state law. that could be used next week by judge chutkan up the street, to say you did violate a convention that had been set for you. >> this is coming next monday. we were just talking during the break, i guess, about what the actual conditions or the consequences if your name is not donald trump. which is important to remember as we discuss equal justice under law. it someone else did this, what could happen to them? >> we have a pretty good example that has been in the news recently. sam bankman-fried was charged for massive fraud. he was out on bail. and prosecutors alleged, and the judge agreed, that it appeared he was attempting witness intimidation by working through the press to cede some negative information about a -- cooperator. he was remanded, that means he was sentenced to jail. the judge was not happy about it, obviously, but that's what often happens to defendants who

spill over into the case? >> oh, absolutely. i mean, it doesn't matter that he is the former president of the united states of america. right now, he is no different than any other criminal defendant charged in fulton county. so anything that he says can and absolutely will be used against him if fani willis can use it against him in his criminal prosecution. >> gwen, one thing -- >> there's no question about it. >> pretty clear cut, huh? one thing i think is very notable from what the judge said yesterday, trump cannot make any direct or indirect threats, can't intimidate witnesses but specified for trump as a defendant not for the other defendants. he can't do it on social media. would things like trump saying, you know, a few weeks ago, calling out lieutenant governor, former lieutenant governor of georgia from testifying, saying he shouldn't testify, would that be seen as witness intimidation? >> i think that would be up to a

county, and they are there side-by-side, and talks about her being a radical district attorney and he says it a couple of times, but she is not in this, right? if he can criticize the judge and the attorneys, and would that ever change? >> no. i mean, once you get to the level of what is referred to as a terroristic threat, and you are threatening somebody with physical violence and that not a problem where we have seen a tweet where he has threatened physical violence and so that is unnecessary, but where you have a bond order to look at the condition, and the biggest issue is witness intimidation, and the biggest issue is if they are coming to court, and that is why the bond is in play, and interesting that it is a $200,000 bond which is hard to meet for most individuals and the bond is that high, because you are concerned with flight, but in this particular case when you donald trump who i believe is literally a billionaire, $200,000 is pocket change to him, and so that would not prevent flight, but what is going to prevent flight, i

is going to put up whatever evidence they have of the bond violation, and the judge makes a decision if it has been violated or not, and the interesting thing is if you have witness intimidation, you can always file a superseding indictment, and the witness intimidation is a rico predicate, and what happens in this case is if he violates the bond, and that is a rico predicate. >> i didn't know that it was a rico predicate and it could be added to the charges. it is a serious thing that people don't realize when a judge says that you better not do this, and you have to be careful to skirt the rules. i want to put up a couple of things that trump put up since this agreement was made. and he goes after criticizing fani willis, the d.a. in fulton

>> there's also the news that mark meadows says he doesn't recall any time when donald trump blanket declassified any materials. and one last question, this is what we learned from ken dilanian, donald trump is the only one that includes this specific language, so far that we've seen in terms of the bond agreements regarding the georgia case. the defendant shall perform no act of any person known to him or her to be a co-defendant or witness in this case or in any way obstruct justice and this shall include and it goes on, making direct threats, indirect threats, witness intimidation, et cetera, et cetera. interesting that donald trump is so far the only one. >> reporter: yeah, katy, that's because that was a negotiated term between the fulton county d.a.'s office and counsel for donald trump. you'll also note that the judge in this case signed off. he approved the terms this much consent order. so that's a really important

reasonably prompt disposition so a person can either be held accountable or exonerated. there is also an interest in making sure that witness memories do not fade, and that the evidence is still available when the case goes to trial. this argument about the terabytes of documents here is true and not only this case but in other cases as well. no, doubt it will take some time to work through all of this. but no, longer is at the world where you sit down which each page and page through it, the way discovery is reviewed today is it is assorted, searchable, the way you would go about a modern computer search and not the way you would read warn piece of time was written. >> you know, hat tip for the reference, martha. what is so abundantly clear in the sea of all days, the day trump is trying to kick this trial to 2026 is the same that he's out there making exactly the kind of statements that could be perceived as witness intimidation, stuff that will automatically trigger the judge to move the trial dates up in time.

electronic means. >> i would assume nothing like this has happened before. is that accurate? >> not at least in my experience. i think what folks need to realize is that when you use electronic communications across state lines, it's not just a local issue for the sheriff to address. that was bring the federal law enforcement agencies into the play, and so, again, i would assume that sheriff labat is working with all of the various law enforcement agencies that can bring resources to bear, to protect these residents. >> can i ask, just in terms of the impact the impact this is gonna have on the trial itself, when there's gonna be a new jury that has to be seated and the prospect of witness intimidation. what does this have, and what is the actual climate surrounding in up to an actual trial? >> in my experience i have seen it where as you get to the

trial to 2026 is the day he's out there making the kind of statements that could be perceived as witness intimidation, stuff that could trigger the judge to move the trial date up in time. how do you square the sort of desperation that is evident in this legal filing as it pertains to the trial date and the behavior of the client at the center of all this? >> like so many things in trump world it's just doesn't seem terribly well thought out. the 2026 date, the proposed date, it's something of a joke. look how people have responded to it. i would of course worry it would interfere with the mid-term election in 2026. nobody talked about that, alex. but there's actually going to be a very serious response to this, and at some point the judge will weigh in on this probably sooner rather than later especially as trump and many of his surrogates continue to sort of press her hand and, you know, behave in ways that are very close to the line if not over the line.
