The General Court of the European Union (“
General Court”) delivered three Judgments on 16 December 2020 which confirmed different aspects of the scope of the powers enjoyed by the European Commission (“
the Commission”) in its application of competition rules in the European Union (“
EU”). In a nutshell, the General Court has confirmed that the Commission:
is entitled to apply competition rules to sports activities;
has a very wide discretion in determining whether or not there is sufficient “Community interest” for it to pursue an infringement action under Articles 101 and 102 of the Treaty on the Functioning of the European Union (“
TFEU”); and

PRAWA lauds judgment on vagrancy law, tasks government on implementation

Prisoners’ Rehabilitation and Welfare Action (PRAWA) has hailed the landmark ruling of the African Court on Human and Peoples’ Rights, which declared that vagrancy laws are inconsistent and inconsonant with the African Charter on Human and People’s Rights, Children’s Rights Charter and Women Rights Protocol.

According to PRAWA, the judgement is a major boost to the campaign to decriminalize and declassify petty offences in Africa. The group therefore called on the government of Nigeria to take immediate action by repealing laws that are in breach of Articles 2,3,5 and 6 of the African Charter.

“Sadly, Nigeria is one of the countries that still retain some aspects of colonial laws that criminalize poverty, in their lawbooks.

TIME TO EXPUNGE VAGRANCY LAWS

The laws affirm a divide and are offensive
An advisory opinion recently delivered by the African Court on Human and Peoples Rights held that all the countries within the continent are under obligation imposed on them by the African Charter on Human and Peoples Rights to amend or repeal all their vagrancy laws. According to the court, these and related by-laws as well as other laws and regulations should be brought in conformity with the provisions of the Charter, the Children’s Rights Charter and the Women’s Rights Protocol. A vagrant is a person who does not have a fixed abode, a means of livelihood or practice a trade or profession.
