The FTC and 46 states separately sued Facebook in December 2020, alleging that Facebook violated Section 2 of the Sherman Act through its alleged buy or bury strategy of acquiring Instagram (2012) and WhatsApp (2014) and by adopting policies that prevented app developers that Facebook viewed as potential competitive threats from accessing Facebook s platform interfaces (API Policies). The states also sought relief under Section 7 of the Clayton Act, which prevents acquisitions that tend to substantially lessen competition.

According to a press release put out by the National Association of Attorneys Generals (NAAG), a coalition of 44 state and territory attorneys general want Instagramâs owner, Facebook Inc., to set aside its plans to launch a version of the social photo sharing app for children under the age of 13. Currently, the age group is barred from using the service by Instagram policies. The six-page letter addressed to Facebook CEO Mark Zuckerberg cites concerns about childrenâs welfare.
The attorneys general point out several flaws with Facebookâs proposed app, including research demonstrating that social media has deleterious physical, emotional, and mental effects on children. The letter also discusses the ârapidly worsening concerns about cyberbullying on Instagram.â ....
