the u.s. anti-doping agency. this is in no which admission of guilt but certainly portrayed that way by the agency they banned him from competitive cycling. back in june they said they had new evidence that proving he used performance enhancers. no details. his decision clears the way for the agency to press cycling governing body into stripping lance of his title. armstrong says the agency has no authority to take the title away but the head of the agency disagrees. tonight reaction from bay area cycling fans. >> lance armstrong has had a lot of problems and has been accused of doping almost as long as since his come back in cycling and you know i think i kind of see where there is smoke there are is fire. >> i see lance armstrong as legendary hero. inspired a lot of people. started his life strong campaign. given a lot of motel vision that people who are into cycling or just a lot of other people struggling in life. >>reporter: i spoke to victor the former boss said armstrong would have certainly lost his case in front of the u.s. anti-doping agency arbitration panel because the people they pick the arbitrators. he called it simply a kangaroo court. now there may be some smoking gun test from the past that armstrong would have had a hard time explaining. we have to wait and see whether he loses the title. this this could be a bureaucratic battle now. >> thanks for us right now. lisa? >>reporter: the police lines are still up as you can see and investigators are still here at the intersection of westin is in road and andrea street in hayward. police got a 911 call inside the jewelry and western wear 3:50 this afternoon. caller didn't say a word. police officers were here in minutes. they say they found a 53-year-old hispanic male inside the store. he was unconscious and they medley realize he had been shot. >> there was a man down inside the business. >>reporter: seem like he was the owner. >> we haven't determined that yet. >>reporter: was there a robbery that you had heard of from witnesses? >> we have not determined that yet. >>reporter: tvl the victim died here at the scene. there were several people out here earlier tonight. very upset. they say they were related to the deceased but didn't want to say any more. police mean time are not releasing very many details at all and including whether it looked like somebody had broken in or if there was a struggle. but this place is known to buy and sell gold. investigators also say releasing information would compromise their investigation because the shooter is still out there. mean happened just after 11 this morning. now police say they got away with more than 200,000 dollars worth of jewelry. it was as you can imagine terrifying. >> they told us to get down on the ground. if you move you know they will kill us and then they start breaking my show case reaching for my safe. start shoving all the jewelry goods in to the duffel bag. >>reporter: the entire incident took less than 2 minutes. good news if you can call it good news is only thing out of the story is that no one was hurt. dozens of people took to the streets of san jose tonight for a peace rally. participant the south bay. there have been 32 homicides in the city so far this year. that's a 15 year high. teenager driver accused of killing a father and daughter riding their bike last spring in concord will be tried as a juvenile and tonight the victim familiar lly says they are angry and disappointsed. 17-year-old david rosen appear in juvenile court to face vehicular manslaughter charges driving an suv that veered out of control on treat boulevard in early april and hit 41-year-old man and his 2 daughters. he and his 9-year-old daughter were killed. his 12-year-old daughter suffered minor injuries. can see in the affected neighborhoods on this map. just today another bird was found with the disease. lillian kim is live in brentwood with the latest on this. lillian? >> spraying began at dusk and just wrapped up. it was a very thorough process. every street was accounted for. workers with the contra costa county mosquitos infected control district drove down every block within 3 square miles of this neighbor. lethal enough to wipe out half of the adult mosquito population. >> it's not toxic to dog or human. put in and out such a fine mist it affects only the mosquito and dissipates very quickly. >>reporter: the control hopes the spraying will raws the name of cases of west nile virus. just today they found a black crow with the disease. the 23rd one they discovered so far. as for still need to do their part. >> this particular mosquitos likes to produce in back yard sources. one neglected swiping pool can produce more than 1 million mosquitos and affect people up to 5 miles
