kate thompson reports it was a phone call that led police to the body. >> reporter: police discovered a body shoved inside a 45-gallon plastic garbage can right here placed alongside the very busy dublin canyon road. someone called the station alerting them. >> we received a call from someone who reported the can there. >> garbage day was on tuesday. so it seems a little out of place. >> reporter: police don't know how long the body had been left along the road. the area is rural with large homes and horse farms. dublin canyon road is very heavily travelled. a 25 year-old army officer from san jose has been killed in afghanistan. his name travis morgato. he was killed when his patrol was attacked by an ied. he entered the army in 2010. this was his first deployment to afghanistan. the man accused of kidnapping and killing sierra lamar went before a judge today. this is video of the suspect in court. he was only in the courtroom for a couple of minutes. he was silent the entire time and did not enter a plea today. rob fladeboe was at the court hearing. >> reporter: shackled at the waste and feet, antolin garcia torres walked into department 23 just after 1:30 thursday with several of his family members in the front row. the alleged killer of the teen sierra lamar said nothing, keeping his head downcast. garcia torres entered no formal plea to kidnapping charges. outside the courthouse, as sierra lamar supporters called for justice in the case, district attorney jeff rosen promised just that. >> i can tell you that we are carefully and painstakingly going through all of the evidence that we have thus far. i can tell you that we will do everything in our power to seek the truth and to seek justice for sierra lamar. >> reporter: in a complaint and statement of the facts released by the district attorney's office, probable cause for charges of kidnapping and murder are based largely on forensic evidence that links garcia torres and sierra lamar through dna evidence found on her clothing and in his car. the da was asked whether he'll seek the death penalty in this case >> this charge, murder under the special circumstance of kidnapping is a death penalty eligible charge. in the district attorney's office, we have a protocol in making our decision as to whether seek the death penalty, and we do that after reviewing all of the evidence in the case, after speaking with the victim's family, after going through aspects of the defendant's life to inform our decision, and we also invite his attorney to speak with us before we make a final decision in that matter. >> reporter: the defendant will return to court may 31st to enter a formal plea. until then, he remains in the county jail, being held without bail. rob flab doe, kron4 -- fladeboe kron4. >> the family of garcia torres sat in the first row. here's what they had to say. >> reporter: this is the wife of suspend killer antolin garcia torres, a woman who is said to be three months pregnant. garcia torres's mom was also in the courthouse thursday as she walked back to her car, i could tell she had been crying and was doing what she could to hold back the tears. when asked in spanish if she had a message for her son, she responded that she's already given him that message. garcia torres's sisters were also within this group, but they along with his wife did not say much. >> he would love to talk. mr. man dell has advised us not to. thank you. >> you were able to speak with your brother? seismic repairs. and the golden gate will shut down for at least an hour on sunday night. that will be for a fireworks show on the bridge, and over the bay, to celebrate the 75th anniversary of the golden gate. maureen kelly has details on the traffic nightmare on sunday expected for drivers in san francisco and marin. >> reporter: the bridge closure will come at the end of a day-long party for the span's 75th anniversary which will have already snarled traffic with road closures and turned parking spots into tow-away zones around the waterfronts. officials are warning those who want to come celebrate not to drive. signs have already been posted on the roads leading up to the bridge warning motorists of delays from 8:00 pm to 10:00 pm. the bridge sidewalks will be shut down earlier, keeping people off the bridge until right before the pyrotechnics are over. the shutdown starts at 9:00 pm. the fireworks show is slated for 9:30 pm. drivers on 101 will have to sit in their cars and wait during the spectacle. this is all for public safety. when it's over, it's expected that the bridge will reopen at 10:00 pm after the span is inspected. >> we have to do a securities and reporter: maureen kelly, kron4. the city of oakland got some positive news on the financial front. jean quan allowanced there will be no layoffs or service cuts for the coming fiscal year. she says there's enough money to add redevelopment staff, restore senior center hour, and add a police academy. and the money hopes the new development will keep the warriors from moving to san francisco. >> we don't think the game is over on the warriors or any of the teams. it's a very tough site to have. it's a very tough site for them to develop. the oakland deal as far as i'm concerned is farther along than the san francisco deal. it's just an idea and a handshake with ed. >> even with the warriors do leave oakland, mayor quan says the project will still move forward, including hotels, retail, johnson played collegiately for jim harbaugh at san diego many moons ago. so a lot of interest in the 49ers. espn said i think they're the favorite in the nfc and tim tebow, this guy is probably the most talked about player in the nfl. and he's going to be on special teams, which means he'll be on the punt coverage, on the kickoff coverage, but you know he wants to be the quarterback, and the jets let them throw the ball around at practice today, they keep saying that mark sanchez is the starter, that's certainly going to happen, but away, it's the first -- the first sign of trouble, you figure tebow will get a shot. and we talk about this all the time. it's nice to see a guy who has all the good value, not to be overall corny. but for people who knock him, it's much better to talk
