i ve been warned. welcome to a cold early start. i m john berman. i m christine romans. it s 4:00 a.m. in the east. which is early. we are hours away from the first congressional hearings of the rollout of the troubled obama care website. they will be on capitol hill and be very much in the hot seat. as for the problems that it stifled online health care enrollment these people are expected to say it s not our fau fault. . we have more from cnn s jim costa. reporter: with the obama care finger pointing shifting in high gear the contractors who built the healthcare.gov website are saying don t blame us but still offering conflicting stories of what went wrong. they hear testimony today. while one scuff executive is say the site passed eight technical reviews prior to going online october 1st, another contractor says a late decision requiring consumers to register for an account before they could brous for insurance products is behind some of the problems. not only do house republicans want answers. it s our job to hold them accountable when it comes to obama care, clearly there is an awful lot that needs to be held accountable. reporter: of president obama s fellow democrats want heads to roll. it s inexcusable. somebody ought to get fired. kathleen sebelius? no. they should wait and get the thing up and running and then determine and let somebody be accountable! reporter: a health insurance insurance insider tells cnn contractors and official at the department of health and human services knew about the site s problems but gave a far rosier picture to the white house that insiders say nobody wanted to granddad white house and say your signature achievement may not go so well but the president was not intentionally kept in the dark. we did not know until the problems manifested themselves after the launch that they would be as significant as they have turned out to be. reporter: kathleen sebelius told cnn the president did not know about the problems until after the site was fully launched. i think it became clear early on the first couple of days. not before that? no, sir. reporter: all of the reason the republican say for the president to hold somebody accountable. mooerns the president himself seems embarrassed by it and if he is not going to resign over this mess, he should decide who should. president obama is expected to shift focus from the health care rollout for immigration reform. the white house says he ll call on congress to act and rging lawmakers to finish the work by the end of the year. work on measures to strengthen u.s. borders and provide a pathway to citizenship for many in the country illegal. john boehner expressed optimism on wednesday. it is unclear what measures the house will take but if speaker boehner wants to get something done, something could, in fact, get done by the year. have to wait and see. a report that claims the nsa tapped german chancellor angela merkel s cell phone. the president assures americaship the nsa is not monitor her communications and will not monitor her communications. was the u.s. was monitoring her communications? that may be a different question. it is reported that merkel called the president to discuss these allegations which are based on disclosure from nsa leaker edward snowden. our frederik pleitgen has the story. reporter: very few details have emerged so far. the german government only came out and said it has information that merkel s phone was possibly tapped into by the nsa and they would not say anything else. now, there was that phone call between merkel and barack obama earlier when merkel according to the german government finds this unacceptable and stop immediately and wants a treaty makes clear the relations between the two countries intelligent communities for something like this not to ever happen again. the germans have been on the edge for a long time. the government in berlin said that it s asked the u.s. government to clarify what sort of intelligence gathering, what sort of spying and espionage it has been conducting in germany about six or seven months ago and so far it has not gotten satisfactory answers from the united states. one of the things that berlin said today, it expects those answers to be forthcoming as fast as possible. merkel is a policy lesion on her cell phone all the time. a well-known fact in germany she texts during parliamently debates and on the phone all the time. they say it was impossible to tap into that phone and clearly that is not the case and it is something that is very, very damaging to u.s. and german relations. the germans in this whole saga surrounding edward snowden felt the americans were insincere to them and germany thought it was a closer ally to the united states than to have america collect as much data from german internet users from german phone user answer now german politicians that is coming to light. frederik pleitgen, cnn, atlanta. top secret cia documents revealing this morning despite denouncing u.s. drone strikes, paeck pakistan s government endorsed the program. he met at the white house calling for an end to those strikes. sharp differences this morning between the u.s. and israel over iran s nuclear program. israel prime minister benjamin netanyahu net wednesday with secretary of state john kerry and called for dismantling iran s nuclear bomb making capability. the u.s. is suggesting putting safeguards in place and assure that iran s intention is peaceful and not military in nation. six global power will resume talks next week in geneva looking for possible alternatives for a diplomatic deal. stanks feastarvation fears syria. aid workers say no supply or food has come into the region. residents worry conditions will soon become like that in the western suburbs where hunger is so severe, doctors are reporting deaths now from malnutrition. a warning that egypt is spiraling dangerously close to civil war. reports that the coup is urging the international community to pay close substantially attention. since this all began more than 1,000 people have been killed and more than 2,000 have been arrested. lawyers for boston bombing suspect tsarnaev may try to save him by blaming everything on his dead brother from the death penalty. they wanted prosecutors for the first time monday said a friend of his told him he took part in the killings. the younger tsarnaev attorneys may argue he fell under his brother s murderess influence. they say this is the most likely chance that he was under the older brother pulling the strings. see if it works. a 14-year-old is behind bars charged with murdering a popular high school math teacher. colleen ritzer, authorities say, her body was found behind the school. here is don lemon with more. reporter: this is the face of an accused killer. the defendant before the court is 14. reporter: investigators in massachusetts allege 14-year-old philip chisa.m. killed popular 24-year-old math teacher colleen ritzer where she taught and he was a student. he quiet and kept to himself. he s a good kid. nothing out of the ordinary, just a quiet, normal kid. reporter: students and family members say ritzer loved being a teacher. at times, sending out homework assignments over twitter and facebook and her blog. wonderful lady. couldn t say enough about her. always the teacher to go the extra mile for students. reporter: why would anyone want to kill her? allegedly dumping her body in the woods behind her own school? i think their sense of security starts to become shattered and they saul said this is danvers. it doesn t happen here. reporter: the surprise of ritzer s body was a surprise as a hunt for chism, a high school soccer player who had gone missing. meanwhile ritzer s family had called police that night to say they was missing too. result of that report and a search for the teacher and discovered blood in the sec floor bathroom at the danvers high school. reporter: the teen was found in a nearby town on tuesday. according to court documents, investigators learned from an interview with, which chism that he had assaulted and then murdered ritzer. in an adult criminal court the teen s attorney argued he should be treated as a 1y50u67juvenile that decision was not made today. reporter: he will be held without bail at a county jail facing a murder charge, as a community struggles to answer the question why. don lemon, cnn, danvers, massachusetts. a sad story. it looks like old man winter just started to wake from a season s long slumber. large sections of the country getting their first real taste of chilly weather as a cold front moves across the country. real snowflakes falling in columbus, ohio. temperatures dropping 20 degrees in parts of the midwest. why does old winter have to be a man? reporter: deborah feyerick, cnn, new york. a connecticut judge has ruled he should be tried again because he did not receive adequate representation. what is unusual here the lawyer mickey sherman was a very well-known lawyer. highly paid. i think he made more a million dollars in this case. you don t usually see inadequate representation then coming into play with a high priced celebrity lawyer in cases like this. it is fatiscinating, fascinatin to see. a colorado judge ordered the release in the 1996 killing of jonbenet ramsey. the district attorney had possible charges against her parents three years after the murder. the indictment remains sealed because the d.a. has decided not to pursue charges. no explanation was ever given about this but these documents, they could shed some light on this long mystery. good samaritans rescuing children from a burning building in miami. their couch went up in flames and two good samaritans sprang into action and became life savers. the smoke was coming at them. it was intense. they trying to stick their head out so they won t smell the smoke and panicking and panicking and kids were screaming, ah! we heard the screaming and once she put the kids out of the window we ran into action and ran over and said drop the kids and he caught them. i m so glad her and my babies okay. jumping out that window for two babies is dangerous. investigators looking into the possibility the fire was intentionally set. the mother had reportedly gotten into a heated argument with her ex-boyfriend just before that fire broke out. thankfully those two men were right there to catch those babies. brave people. coming up, could retirement soon be a thing of the past? retirement!
