it's time for richard to pay for that balloon boy stunt, including a hefty bill for the rescue effort and possibly jail time. a plane landing in kingston, jamaica, what caused the pilots to overshoot the runway. and getting arrested for dui and have it posted on twitter, would be embarrassed or outraged? tell us your views on this effort to combat drunk driving. welcome. i'm richelle carey. the couple knows their fate. a judge sentenced richard to four years probation and more than 100 hours of community service saying that he believes that he's contrite. these are live pictures of what is happening. you can see richard heene standing there with his attorney. richard heene's attorney asked for mercy. he's trying to take the heat off his wife. he asked that his wife be spared jail time describing her as a good mother who did nothing wrong. the heene's admitted that the whole thing was a hoax after appearing on "larry king live" during cnn. you're probably seeing this, little falcon boy slipped up and said, we did this for the show. given all of the resources and the costs involved, did richard heene get off easy here? douglas, can you believe it? it all came to this. what do you think the judge is going to do? >> and they agreed that the probation would be a correct sentence and the judge referenced it. that took a lot of pressure off of the judge saying that, wow, they should have gotten some jail time because as you've been explaining, this caused a huge problem. there were lots of expenses, joining law enforcement agencies, helicopters, so on. some will feel that he got off easy, some will not. it will probably be a split of decision, richelle. >> some things happened while we were speaking. the charge that richard heene pleaded guilty was to one count of a publish dk four years probation, 30 days in jail, 60 days of work release. that's what my producer is making sure i'm aware of. okay. tu actually, let's let the judge speak for himself and then we can regroup and talk about this. >> based on these reconsideration, the court is going to sentence to defendant to probation for a period of four years. this will be supervised supervision and that mr. heene is in fact prohibited receiving any form of financial benefit from -- whether it be media, a book, an article he writes, anything of that kind that stems from this incident. i understand it would be hard to say if he writes about something else or pursues other project, whether or not he -- the celebrity that he's obtained from this may have contributed to that. but i am not -- i'm not limiting him in that regard. i'm not saying he can do nothing in the future that may benefit him without the inference that it is because of this. but clearly he cannot deal directly with this subject in any form that will produce financial benefit for him. >> okay, doug, he can't make money off of this. he's got to spend 30 days in jail, 60 days work release, and four years probation. now tell me your reaction to this. because the judge clearly seems to be trying to send a message to richard. >> i think that's a good sentence because a small prison term can be very, very effective, number one, it does placate victims and number two gives the person a clearer indication of the fact that they did wrong. i want to mention one other thing, this business that you can't profit off of it to a lawyer is distinction. you can't tell somebody you can't write a book but you can say, if you write a book, all of the funds, all of the moneys will not be going to you. and the other thing is, the judge said, it's going to be hard to tell whether what you're doing is related to this. like let's assume for the sake of argument they do a reality show and their argument is going to be it wasn't specifically because of the balloon incident. it's a tough distinction, you know? >> well, the judge said that he felt like richard heene was contrite. there was clearly something that he said in that courtroom that convinced the judge of that. so let's go ahead and listen to a little bit of richard heene and let them hear for themselves. >> i'm very, very sorry and i want to apologize to all of the rescue workers out there and the people that got involved. >> and to be clear, his wife still hasn't been sentenced. we still haven't heard that na the courtroom. but the judge also said that he was a little bit surprised that richard heene said that he couldn't believe that it became this. that seems odd. >> yeah. i heard that. that's a good question. the reason that's a good question is because so many times when i've been standing in courtrooms with these situations, people will say, i can't believe all of the problem, almost that they are upset that now i'm facing these problems. so it's a very fine line sem plant clee. he did, however, appear to be showing remorse. but chiselled veterans sometimes wonder how genuine is it. you understand what i'm saying? you just can't tell the extent to which it's genuine. >> and i would imagine that the judge and prosecutors and defense attorneys have seen it all. okay. we're going to keep our eye on the courtroom. richard heene clearly tried to stand up and said that i don't think anything should happen to my wife. we're going to take a break and keep our eye on this. doug, stay close for us. we'll be right back. we want to recap what is happening at the ft. collins courtroom. the father, richard heene has been charged for the balloon boy hoax. the judge has been kind of harsh on him. 30 days jail time, four years probation, and he cannot directly profit from this hoax t might be kind of difficult to enforce that. richard heene also stood up and said that he was very sorry for this. he was the only one responsible and his wife has pleaded guilty to false reporting to authorities. that's a misdemeanor. prosecutors are asking that she be sentenced four years probation. the judge has not made a ruling on that yet. we're going to keep our ears and eyes to that courtroom. we're going to move on now. this is what we're talking about. authorities in the houston area are cracking down pretty hard on drunk driving this holiday season. deputies in montgomery county are stepping up patrols in what they call hot spots for duis. not everyone thinks it's a good idea. >> i don't think they should go that far with it. i really don't. >> impaired driving or reckless driving kills five times more montgomery county citizens than other crimes. >> police in texas are also imposing so and drivers cannot refuse to take a blood alcohol test. if they do, police get an immediate warrant to have that test performed. >> i absolutely agree. >> okay. we want your views on this. do you like the idea of shaming dui suspects by posting their names on twitter? do you think this goes too far? considering these people have not been convicted of a crime? and, yes, we realize this is already a matter of why? because these people were stopped by the police. they were obviously stopped for a reason. and even though they haven't been to court and everything like that, thousands of people die every year because people do not think. they drink and they drive. and i think that if people are given a reason to think before they get behind a wheel, it's going to stop them and save lives. >> linda, thank overrunning the runway. kurt, tell us everything that you can. >> reporter: landing at the kingston airport where the plane skidded off the runway and skrashed into a fence and broke the fence and ended up on the road. the jetliner was carrying 154 passengers and the team of investigators and government in the investigation of the airlines plane. the local investigation is being led by the aviation authority and just overshot the runway as i said as the pilot attempted to land in heavy rain. and what we understood is that more are treated and released. currently the officials here in jamaica are holding a press conference speaking more about the investigations. the aircraft has been and no one is allowed to new hampshire the officials of the authorities here in jamaica. richard heene, the couple behind the balloon boy hoax, they now know their fate. 30 days in jail, four years probation, and community service. his wife was sentenced to 20 days in jail, four year pros bags. he believes that richard heene is contrite but before the sentencing, he made sure that was devised by apparently mr. or mrs. heene, although today the implication is it was more mr. heene than mrs. heene involving their children. the intent was to deceive the public, to deceive law enforcement officials, and the media, and to believing that the 6-year-old son had been accidently carried aloft. >> well, during the hearing, richard heenes attorney asked for mur see say after the family appeared on "larry king live" on our sister network, cnn, during the interview, the little boy slipped up saying, we did this for the show and i've been getting a lot of reaction on face book. so we pulled a few comments for you. this is what alexandra wrote. yeah, i think it's not bad at all and not michael brewer has worked very, very hard to recover from that attack that happened on october 12th. he requires almost daily therapy. he cannot going home, though. his mother says he's afraid to agencies and that morning and my blackberry was going crazy with all of the alerts and updates being sent out about this accident scene. >> so as you were getting all of these types of alerts -- and i know thaw cover these like this. as you were approaching it, did you have a pit in your stomach as you got a picture of what this might snb. >> well as i was heading out there, i knew it was large. i didn't know if i was really prepared for what i saw when i got out there. >> so describe it as you're approaching and you are grasping what this is. >> well, i was on the freeway and around the curb so i really didn't -- i really didn't see anything until i got up to the accident scene and then even then because there was a large number of semis involved, ai walked up, the rear end of the accident seen was not as bad. they were mangled and damaged and there was -- but other than that, they were not bad. i took a few photo there is and we were led out to the media and the freeway and it
