shuttle bus driver who allegedly admitted to receiving al qaeda training in pakistan and allegedly had handwritten bomb making instructions on his computer. agents pulled suitcases and backpacks out of zazi's denver apartment, and sources say the suspicion is that zazi was plotting to stuff the bags with improvised explosives, and leave them on trains. >> that has nothing to do with al qaeda. >> reporter: in a confidential assessment, the fbi and homeland security are urging transit agencies to conduct random sweeps at stations but again will is no suggestion that washington's metro is at any greater risk than any other system. also held and charged with lying to the fbi is zazi's father mohammad, and ahmed afzali, imam of a new york mosque. afzali's lawyer says the imam has been working with terrorism investigators for years but they charged him lying about a phone call he made to zazi. even though he knew the fbi was listening in. >> why in the world would afzali lie to the fbi about the contents of a conversation that he knew they had on tape? >> reporter: afzali's brother co-owns a pizzeria in alexandra. he didn't want to talk on camera but he says his brother is a good man who has nothing to do with terrorism. he rents a home in a prosperous development on manassas. and ahmad afzali briefly lived in virginia also but it is not clear where. in gainsville, 9 news. federal judges ordered zazi and afzali held without bond. and zazi's father is expected to be released in the next two days. another trial delay for five guantanamo bay prisoners charged in the september 11th attacks. government prosecutors requested a 60 day continuum to they can decide how to try the suspects. this is the third time the obama administration has requested a delay and you may be wondering what is the holdup? u.s. attorneys are reviewing the file for possible federal civilian trials. the top u.s. commander in afghanistan warns the u.s. risks losing the war there unless president obama sends more combat troops. tonight, mr. obama is reviewing the situation, as outlined by general stanley mccrystal. the president has already deployed 21,000 soldiers to afghanistan this year. and 58,000 are now on the ground. but general mccystle is calling for even more soldiers to get the upper hand on both al qaeda and the taliban. >> the situation is deteriorated on the ground. you have the taliban that has regained foot holds in parts of the country, in the south and in the east, and they've gotten better at what they do. >> mccrystal's report was supposed to be confidential. but parts of it were leaked and that is creating a political headache for the president. many the fellow democrats want to put the breaks on u.s. involvement in afghanistan, while many republicans want more forces to fight the war. dc firefighters are investigating a fire out at the gabon embassy. it broke out shortly before 3:30 this morning and fire officials say it appears to have started in the basement and spread to a portion of the first floor. they say no one was in the embassy when the fire started, and this is the second fire at that embassy in just the last month. tonight, president obama will become the first-ever sitting president to appear on the late show with david letterman. you can watch it tonight after 9 news now at 11:00. massachusetts could soon have a new u.s. senator by the end of the week. the massachusetts senate is expected to debate a bill tomorrow, allowing the governor to appoint an interim replacement for the seat left vacant by edward kennedy's death. the house gave it initial approval last week. a federal judge denied william jefferson's request for a new trial. the former louisiana congressman is fighting last month's conviction for influence peddling. he used his pull as a approximately tition to broker business deals in africa. federal agents found thousands of dollars stashed in jefferson's freezer and he has since filed for chapter 11 bruns. a prince george's county man is recovering from gunshot wounds to his face and arm tonight. after being shot by hyattsville police last night. police say they shot 24-year- old juan floores after he tried to run over them in an effort to escape arrest. they say floores was involved in a brawl near the mall at prince george's county. and the victim's relatives and friends who were there say the police opened fire on flores who was not armed before he got in his car. >> all i saw was my cousin running. running to his car. with the officer shooting at him. >> what did you think when that happened? >> i was like, i started going toward him, but then when i saw the shots fired i was like man i don't want to get shot. it is not right. >> our officers were approaching the car. the person operating the car drove forward, directly towards our officers, and one of our officers fearing for his life did discharge the firearm at the vehicle. >> the police corporal who shot flores is on administrative leave. flores has been charged with six counts of assault and one count of resisting arrest. tonight, a fairfax county schoolteacher is charged with contributing to the delinquency of a 15-year-old boy. police say they found 27-year- old valerie roseler last night, drunk, in a parked car with a boy. he teaches at hayfield's secondary school. she is now on leave, without pay. the boy is not her student. investigators say that boy was with her, without his parents' knowledge. well, the residential housing market may be showing a tiny bit of improvement lately, but things are still pretty bleak for commercial properties. there is such a glut of office space in montgomery county, landlords are offering huge incentives to new tenants. here is audrey barnes with the story. >> reporter: commercial gold coast from washington to frederick, it looks like a lot of pros specters have pulled up stake. vacant signs, abandoned property and office suites are everywhere. calvin kee however saw only opportunity. >> the timing was very good. i was not complaining. >> the landlord of this office building gave him a huge break on the rent and he is running an insurance company from this large two-office suite on ridge road in damascus. >> now i probably pay 40% less. >> why such a good deal?
