>> dan, we started this segment off playing some sound from republican mitch mcconnell, who took a decidedly different tact than the trump team is taking today which is to say the justice department should sort it all out. he doesn't want to answer questions about that todays a trump is taking the opposite of mitch mcconnell's position. do you think senate republicans are in a different place when it comes to the questions about trump's liabilities here? i mean do they get the same for lack of a better term hall pass that trump gets among republican voters? >> no, i think ultimately it's interesting you played that footage of mitch mcconnell because mitch mcconnell is probably the person most responsible in the republican party that donald trump is still this figure. because as we all remember he floated the idea to convict, and at the last minute made up this

there's potential for some type of violence. if you're running a campaign, you're probably weighing security as a factor in your determination of whether or not to even have an event in this environment. that's how bad it is. >> does it limit what you might say and what you might not say? could that be one of the reasons we're not hearing so many direct, i don't want to say attacks, but direct, i'll use attacks for lack of a better word, against the candidates and donald trump because it's scary to go against him. we saw after the insurrection, a lot of republican lawmakers saying enough is enough, lindsey graham, for instance, and a couple of days later when they were trying to get on planes to go home, they were screamed at, intimidated at the airport, and, you know there's a feeling that if not for that there would have been more republican lawmakers who voted to convict, who really detached themselves, disentangled themselves from donald trump in the aftermath of january 6th. >> well, i think it's certainly fair to say that for some

young -- >> i am asking a different question, because these are presidential decisions and presidential actions and you are saying that the court can review the presidential actions as long as if they issue a judgment it is -- >> if directly sitting in judgment and it is official that has been established for over 200 years. >> you are using the impeachment judgment clause as a negative implication with respect to that civilian officer or president of course has to be impeached and convict and then nevertheless thereafter. if there is an acquittal, how are you using it in that regard, because sometimes in particularly in this case, the acquittal cae of lack of jurisdiction and not trying the mer merits of the case? >> the impeachment clause does not arise within the merits of the case or the acquittals and frankly, it comes up under the prosecutions of the double

but this prosecution has tons of other problems. i just want to be very clear about that. >> let me try that one more time. the government could properly prosecute him for that same or related conduct, yes or no? >> potentially. >> i'm only asking you under your interpretation of the impeachment judgment clause, is that proper? is that allowed? >> and i stand on my prior answer. >> he stands on his prior answer. you may have heard about standing on business. this might be the legal opposite. but finally, you get a yes or some semblance of an answer. meanwhile, you have trump's current lawyer there, contradicting what trump's impeachment lawyers insisted was the reason they shouldn't convict in the senate. and remember, trump's lawyer today not only contradicts that but the lack of the senate conviction is why this case shouldn't happen. it doesn't make sense because it's not supposed to make sense because these are not serious, factual or precedented

beneficial in the general election. i think a 2024 election, where the democrats get to run against a candidate that is going through all this stuff, that is going to give the democrats an advantage. don't have to agree with any of the stuff that was done. that's just the reality. and we end up in a situation where we're putting the future of the republican party and the future of the nation, perhaps, in the hands of 12 jurors in heavily democrat d.c., which is likely to be a very staffed left wing jury, that if they somehow convict, then the democrats are going to win the election? why do we want to even go down that road? don't -- let's focus on your issues. let's focus on biden's failures. let's focus on how we're going to be able to turn this country around. i'll be somebody that's focused on that. but then even more importantly, as president, i'll be disciplined and determined to deliver on all those things. it's not going to be about me. heck, when i'm not out there doing the job, i've got young kids. my wife and i will be back home. we'll be doing stuff, raising our family. that's going to be the extent of what we're doing.

ultimately, this is going to be one of the questions -- >> well -- >> -- before the united states supreme court. >> we should be careful, though. i'm going to let you respond. we should be quite careful about that. whatever anyone thinks of donald trump and the public evidence, he has not been charged with insurrection, he has not been convict of insurrection in any criminal sense. if judge in a different process announce their views, that's fine, what their views are. but i don't think we should say here on tv or to the public that he's been convicted of insurrection. he hasn't. those are their views about what they think happened. i did want to read for you from the dissents as well in the case and get your response to this. we're going to give u time here. as you know, some of these justicesade the very arguments that are going to ricochet probably in the supreme court. reading from some of the key points, they state that the ballot law was not enacted in colorado to decide if a candidate engaged in insurrection. that the hearing that disqualified trump was actually this low 51% evidence standard,
