as it is the defendant's right. >> reporters in the courtroom suggest trump and jack smith did not communicate. they didn't make even any sort of eye contact, but let's go back to nauta for a minute. the judge said trump can't communicate with him or any other witnesses in the case. is that standard practice, and how can that be monitored and enforced particularly when nauta remains in trump's employ, and as we just noted left with the former president as he headed out of the miami courtroom. >> yeah, i think the order was they can't communicate about the case, so if they need to talk about work matters or, you know, who won last night's ball game, that is permitted. they just can't talk about the case other than through their lawyers. and i think the goal there is to avoid witness tampering in trying to get our stories straight. it may be difficult to enforce if nauta is in the employ of donald trump, but that's the goal behind that strategy is let the lawyers talk about the case, you guys can talk about everything else.

equivalent of collateral. it's how much money -- you don't put it up, but you say you'll forfeit it if you abscond from the district. in addition to that one of the things that can be important is whether or not the defendants could be allowed to speak to one another. i've been a member on a defense team where for example two defendants were not allowed to speak to each other as part of their conditions of release. that's complicated here when palt nauta is not only still in president trump's federal employ but still escorting him to events and at his side at all times. so i'll be looking to see whether that's a part of the conditions here as well. certainly you can't force a defendant to go without employment, but in this case given the allegations against nauta and trump, it's not unreasonable for a judge to expect that at least with respect to things that are not completely necessary for them, that they don't really have more interaction than is absolutely called for. >> former litigator and msnbc
