As is standard for trade agreements, the Trade and Cooperation Agreement (TCA) requires both sides to seek to facilitate trade and investment by applying similar principles or international standards, including working with international organisations on technical standards; providing transparency for new trade-related technical regulations; and committing to common principles on data, digital trade, subsidy controls and taxation.
But the TCA goes further by including “level playing field” provisions that require the parties to maintain current and future standards in nontrade-related policy areas, particularly social, labour and environmental. The fear in the EU was that degrading these standards in the UK would create a lower cost base and unfair trading advantage for UK businesses. This limitation on changes in domestic legislative areas means the TCA’s level playing field provisions are among the most politically charged.

UK lobster exporter Barron Shellfish is closing down its 60-year-old family business blaming Brexit red tape and hidden costs, The Guardian reports.
The company bought lobsters from businesses in Bridlington, exporting up to five tons a week of lobster to countries including Spain, Belgium and Italy.

Provisional implementation is to remain a unique exception, said European Parliament leaders. Parliamentary oversight will start soon to adopt the EP position before the end of the provisional application. On Monday 28 December, the leaders of the political groups in the European Parliament and President David Sassoli exchanged views with Commission President Ursula von der Leyen and EU Chief Negotiator Michel Barnier on the deal reached on 24 December on the future relationship between the EU and the UK.
The Conference of Presidents reiterated Parliament’s thanks and congratulations to the EU negotiators for their intense efforts to reach this historic agreement that can now form the basis of a new partnership.
