EU's Upcoming MiCA Regulation to Bring Clarity, Growth to Crypto-Asset Service Providers


The European Union’s proposed
Markets in Crypto Assets (MiCA) Regulation will bring new opportunities for crypto-asset service providers (CASP), the CEO of one such company believes.
In the European Union, digital assets are currently regulated through a combination of the Fifth Anti-Money Laundering Directive (5AMLD) and member state regulations. 5AMLD contributes legal clarity by laying out compliance requirements and preventing money laundering and terrorist financing, while member states produce regulations which govern CASPs.
Vytautas Zabulis said 5AMLD and the state-specific rules laid a good foundation upon which MiCA can build.
“Working under existing regulations definitely helped us to be recognized as a trusted and legally responsible company—confident and trustworthy relationships have been built with our customers due to the regulatory compliant nature of our business model and values,” said Zabulis. “However, the lack of a unified licensing framework across the EU has resulted in a long and complicated process when going for cross-border trading.”

"It's impossible for digital assets to go mainstream without clear regulation and sufficient safeguard," Vytautas Zabulis, CEO of H-Finance, a digital asset trading company based in Vilnius, Lithuania, said in a research report.
"As Bitcoin becomes an institutional asset, market participants expect regulation to be in place to protect capital and have clearly set rules," the report said. "As cryptocurrencies start being treated as a new asset class, at least some clear rules will need to be put in place to solidify international adoption."

Europe and the United States are both working on regulating digital assets and their providers - moves welcomed by investors, who hope the new ground rules will encourage institutional investors to plunge in.
Anatoly Crachilov, co-founder and CEO of Nickel Digital Asset Management, which manages assets worth $200 million, told the Reuters Global Markets Forum that regulatory uncertainty was a drag on the development of the crypto space.
