While state legislatures focused much-needed attention on pandemic-related legislation throughout most of 2020, many continued to alter their employment laws in significant ways, or simply had previously passed laws scheduled to take effect at the start of 2021.
Some of the most prominent trends at the state and local level include creating or expanding paid leave benefits, pay equity, and anti-discrimination rules; restricting criminal background checks; and limiting the scope of non-compete laws. On Friday, December 17, 2020, the NYC Council passed two bills that will end “at-will” employment for fast-food workers in New York City.  The bills will take effect 180 days following Mayor de Blasio’s expected signing of bills.  The bills may prove to be the proverbial “camel’s nose under the tent,” portending greater incursions into the traditional at-will principles that have defined New York’s public policy with respect to the employment relationship for well over a century. 
“Just Cause” Provisions
The first of the two bills prohibits fast-food employers from terminating or substantially reducing the hours of a worker without “just cause,” defined as the worker’s “demonstrated misconduct or poor performance,” which is “demonstrably and materially harmful to the fast food employer’s legitimate business interests.”  A covered “reduction in hours” is defined as “ ....

NYC Council has passed two bills that will end traditional at-will employment for fast-food employers in New York City.  The bills were sent to Mayor Bill de Blasio for signature on December 17, 2020 and will take effect 180 days following his expected signature.
Just Cause and Progressive Discipline Requirements
The main bill,
Int. No. 1415-A, would prohibit fast-food employers from terminating or substantially reducing the hours of an employee without just cause, specifically the employee’s demonstrated misconduct or poor performance.  The misconduct or poor performance must be “demonstrably and materially harmful to the fast food employer’s legitimate business interests.”  A “reduction in hours” means “a reduction in a fast food employee’s hours of work totaling at least 15 percent of the employee’s regular schedule or 15 percent of any weekly work schedule.” ....

Proposed Paid Sick Leave Law Regulations
As we previously
reported, New York State’s Paid Sick Leave Law (“PSLL”) went into effect on September 30, 2020. The PSLL requires all New York private employers to provide paid sick leave, which employees may begin using as of January 1, 2021. The amount of sick leave that employers must provide their employees annually depends on the employer’s size and income. On December 9, 2020, the NY Department of Labor published
proposed regulations clarifying a number of issues relating to the PSLL as summarized below.
