to decide what to do next after the temporary permit for the teepee they had erected was revoked on monday. police moved in around 11:30. there had been several confrontations with police since this teepee was erected in late october. an officer was injured on friday during one confrontation. there was a fire set on tuesday. the teepee was to serve as a reminder of the month-long occupation last fall. but the teepee could only stand between 6 a.m. and 10 p.m. and could not store any personal belongings. the protestors were also not allowed to distribute food. but they say that was part of the point of their occupation. here's what they had to say this morning. >> but i mean, we are anot going anywhere. this is the kun -- the country is not working right now. a lot of us voted for obama and it's a corrupt broken system. we are trying to fix it nonviolently. >> reporter: and these protestors say again they are planning on meeting at 2 p.m. they have a lawyer who says he is planning to file a lawsuit to protect the teepee in the future. he said you don't need a permit to exercise first amendment rights. >> did these folks go to bed at all? usually we're live at 5:00 in months gone by and everyone is asleep. it seems like everyone is up at this hour. >> reporter: yeah. it seems like there's maybe a dozen or two people standing around here that don't quite know where to go. san francisco police have decided to back off instead of going after the burglary suspect who ended up on a 200- foot cliff. an apartment building manager chased the suspect who hopped over a wall tuesday evening and hid out on telegraph hill. he has been there for almost 36 hours now. officers will still patrol the area just to keep some contact with him. facebook's plans to put thousands of new workers in a new headquarters could run into a legal roadblock. gil diaz now in menlo park to explain what's happening this morning. gil, good morning. >> reporter: hi, frank. good morning. well, city council members in east palo alto may consider suing facebook. this is facebook's new campus at the old sun microsystems campus. now, as you can see, their logo is a big thumbs up. but the city council members in east palo alto giving it a big thumbs down. now, they are worried about facebook's rapid expansion into their neighborhood. the networking site has about 2,000 workers at this location already. but it plans to have over 6,000 by the year 2015. so neighbors are upset about the possible traffic jams and housing shortages and are concerned that facebook won't share the wealth in this struggling community. >> already struggling in this area with housing. wow, it's going to be an impact, that's for sure. >> they should consider other people's, you know, situations and the traffic and what have you before they decide to make this change. >> it's very important to this community that we take those issues seriously. >> reporter: facebook has addressed some of those concerns. it's an offer to limit the number of cars allowed on its parking lots. they will encourage workers to carpool or take mass transit to work. facebook has also offered to help pay for any road or street improvements. the city council in east palo alto will be meeting this morning at 9:00. frank? >> okay, gil diaz live for us down in menlo park. thank you. a marin county man and suspect a third his age are recovering after a shootout yesterday morning. the intruder kicked in the door yesterday and held 90-year-old jay leone at gunpoint while he searched the apartment for valuables. leone grabbed his .38-caliber revolver and shot the suspect three times. leone was shot in the face once. neighbors say they are not surprised leone took action. >> he is a very agile, alert, intelligent 90-year-old. he just turned 90 on december 26 and i think he would be the type of person that would defend his property. >> leone was shot in the cheek. he is supposed to be okay. the suspect drove away shortly after the confrontation but he didn't get far before calling 911 to say he had accidentally shot himself. 5:05. more than two dozen people have been killed in a series of explosions in baghdad. explosions struck two shiite neighborhoods today in baghdad killing 27. today's blast began with a bomb attached to a motorcycle near a bus stop. more than 60 are treated for injuries. this violence is further increasing fears that insurgents are stepping up their attacks after the u.s. completed its troop withdrawal last month. traffic and weather, gianna take it away. >> thank you very much. let's head straight to the bay bridge where we're seeing nice conditions so far this morning. live look at the toll plaza. metering lights remain off and looking good on the upper and lower decks. lower deck there is construction starting at 7 a.m. until at least 1:45 p.m. alternating between the left and right lanes mostly from the skyway on the bridge towards treasure island. so that may cause a backup after 7:00 this morning. so do plan for that. again, that's just affecting the lower deck of the bay bridge. over in napa county we have reports of a problem involving a jackknife big rig blocking airpark road and airport boulevard. no injuries, they are just trying to get a tow to clear it. but lanes are blocked until they wrap that up. that's a look at traffic. here's lawrence with the forecast. >> what a day yesterday. lots of sunshine and temperatures running well above average. you will notice some changes today as high pressure is starting to slide eastward. we'll see more clouds and a sea breeze cooling down temperatures for today. outside now chilly out the door. 40 in concord, 39 in livermore, and chilly 36 with some fog showing up in santa rosa right now. this afternoon, these temperatures still running well above average but cooler than yesterday about 64 degrees in san jose and 65 in santa rosa and 62 in oakland. these next couple of days the temperature will come down a few degrees but by the weekend offshore winds blow again as high pressure builds in and our temperatures are going to warm up through sunday. that's the latest forecast, guys. back to you. >> thank you. 5:07. changes are coming to the u.s. military. how it is expected to save a half a trillion dollars. >> an round 2 of the gop presidential race. the game plan candidates are now mapping out. >> and more growing pains for iphone users. the recurring problem that's keeping them silent. grace and i will be right back. laces? jose city council will consider downsizing their own pension plans. this is an ongoing effort to reduce the overall budget deficit. mayor chuck reed and councilman pete constant are behind the proposal which will be considered january 24. pension plans for the mayor and councilmembers are separate from the ones covering most city workers. the plan to reduce those retirement benefits could "occupiers" have been arrested. police say they were in violation of their permits. one utah officer is dead and another five injured after an armed man shot them. ogden police say someone opened fire when members of a narcotics strike force were serving a search warrant at a house. and today the east palo alto city council will talk about suing facebook. at issue is the impact on their city from facebook's new headquarters. that's next door in menlo park. we are going to head to the south bay now. we have a photographer standing by along 101 in the san jose area near mckee. starting to see a few more cars on the road but still accident- free as you head through san jose. no major accidents or problems to report. over to our maps. we'll get a live look at conditions on northbound 280 and things are cruising right along through there. no delays in that area. now, later on, though, you might see some delays heading to the tank. the sharks have a game tonight looks like around 7:30 today. that's right sharks versus the blue jackets at 7:30. you might see delays later toward hp pavilion. the rest of the bay area not too bad. we have roadwork on the eastbound side of highway 4 between loveridge and somersville. that should be wrapped up by 5:30 but right now all lanes are blocked there for that roadwork. there are detours in place and you are able to use the on- and off-ramps there to get through the freeway if you are trying to get off at the exit. elsewhere on the westbound side of highway 4, no delays just yet, still clear, hillcrest and loveridge towards itsburg, no snags there and clear towards the eastshore freeway. altamont pass nice ride, 14 minutes westbound 580 as you work your way from 205 to 680. slightly slower speeds as you approach the dublin interchange. and checking our bridges this morning, the golden gate bridge still a nice ride no delays out of marin county heading southbound, northbound clear, as well. 11 minutes from 580 to the golden gate bridge toll plaza and clear in san francisco. same for the bay bridge, everything looking good in both directions. later on, though, on the lower deck we have roadwork scheduled at 7 a.m. around the skyway to treasure island and again that will extend at least until about 1:45 this afternoon. they are alternating between the right and left lanes. peninsula looking good as well and the rest of the bridges no problems. san mateo bridge, benicia bridge and richmond/san rafael bridge. no word of any fog causing any problems either this morning. here's a live look at 880 in both directions. northbound still looks good to the maze and southbound clear heading towards hayward. that's traffic. lawrence, take it away. >> all right, gianna. we have lots of sunshine coming our way and northern california. that ridge making its way east. more clouds on the way. we're going to see cooler temperatures to come along with that, as well. out the door today we have a couple of patches of fog, some of that a little thick especially in the north bay valley toward napa and santa rosa. so cooler around the bay area today. still running above the average for this time of year. but it looks like high pressure builds back in and more sunshine toward the weekend. numbers outside right now, we have 40 degrees in concord, 39 in livermore, 44 in san francisco, and 42 degrees in san jose. i think we're looking pretty good around the state, starting out with patchy dense fog in the valleys early on but by the afternoon, hazy sunshine and 64 degrees in sacramento. about 52 lot of clouds toward eureka and high pressure is sliding east, the front moving toward the bay area looks like most of the energy over the top of the ridge so we'll stay dry. no system behind it will -- another system behind it will churn up the waves but no rain. 61 today in san mateo and 57 in half moon bay. east bay 60s in most spots. mid-60s into brentwood and also antioch. inside the bay, though, temperatures in the 50s and 60s. next couple of days a lot of sunshine after patchy fog. temperatures will be cooler but toward the weekend that offshore wind going to blow and looks breezy in the hills and looks like it will crank up the temperatures through sunday, then cool off on monday and tuesday. but you guys wanted an extended range forecast. about the 20th of the month, i think the whole pattern may begin to shift again but that's way, way down the road. >> what day is today? >> i hear february 3rd through the 16th will be nasty, too. my model. >> if it works out. >> what is the normal temperature right now? like the 40s and 50s? >> usually 50s and low 60s so we're well above the averages temperatures 10 to 12 degrees above average for this time offer. >> walking around "occupiers" regrouping after police in riot gear made several arrests overnight. anne makovec live with how it all started over a teepee. she joins us with more. >> reporter: that teepee had been here at the plaza for several weeks but after a confrontation with police overnight, police confiscated that teepee. see several people were arrested. oakland police won't say how many and there are about a dozen people standing around here trying to figure out what their next move is. they say they are meeting at 2:00 after the temporary permit for the teepee was revoked. police moved into the plaza park. we basically can't be anywhere. >> reporter: lawyers for the protestors say that they don't need a permit to exercise their first amendment rights. the lawyer is planning on filing a lawsuit to protect the teepee here in the plaza. again, the teepee is now in police custody. they are planning on meeting here at 2 p.m. to figure out what's next. frank and grace. >> thank you, anne makovec microsystems campus. but that move considered by east palo alto city council not -- bad news. now, they are worried that the move will cause problems like traffic jams and housing wars. 2,000 workers already are at the new campus but facebook plans to hire 1,000 more each year for the next six years. facebook has a gigantic thumbs up symbol at its main entrance. but east palo alto giving the hand gesture for stop. >> facebook is expanding into a campus that's right up against east palo alto's borders so east palo alto is likely to feel the effects of that on traffic and housing and other issues that can impact the community. >> since it's in menlo park, the tax base won't help east palo alto that much. >> reporter: facebook has responded to these concerns and to that possible lawsuit saying it hopes that east palo alto will see the enormous benefits to having a good responsible neighbor like facebook. as for that meeting that the east palo alto city council will be having, it's a [ laughter ] >> jill we're coming to new york, watch out. >> reporter: all right. have you anytime. >> jill schlesinger, editor at large for cbsmoneywatch.com, thank you. 5:44. we expect an announcement from the white house today about a program to help summer job prospects for kids speaking of jobs. the white house says it has gotten commitments for nearly 180,000 job opportunities for the summer thanks to help from the private sector. republicans though accuse the white house of taking credit for jobs that would have been created anyway. 5:44. get you out the door a little traffic and weather. gianna, take it away. >> all right. let's head straight to the bay bridge. i'm already planning the lottery for my next job. so bay bridge toll plaza not too bad approaching the pay gates. still no metering lights, light ride, easy 19 minutes from the carquinez bridge to the maze along the eastshore freeway. no delays through emeryville or berkeley. we have some lower deck issues later on this morning at 7:00. you will see roadwork so plan for that. that extends to 2:00 this afternoon. golden gate bridge also checking in problem-free. you can see no delays still about 11 minutes if you are heading southbound 101 from 580 to the golden gate bridge toll plaza and the rest of the bay area bridges, here's a look at the san mateo bridge, benicia benicia, richmond/san rafael bridge, no fog advisories, everything clear in both directions. now, we are starting to see some slightly stop and go conditions as you work your way through antioch, speeds 40 miles per hour westbound between hillcrest and loveridge. it improves once you hit pittsburg. roadwork on the eastbound side, that wrapped up about 15 minutes ago. so traffic should be moving along eastbound as well and check this out. westbound 580 starting to load up a bit both directions through the altamont pass. mostly as you head on and off of 205 there, looks like traffic getting busy, slows at 680. mass transit right on time. a great choice this morning. bart 41-plus trains on schedule. that's traffic. here's lawrence. >> we have a lot of sunshine coming our way but changes are in the works. high pressure now beginning to weaken and slide eastward. we are likely to see more of a sea breeze and cooler temperatures around the bay. still, some nice temperatures by the afternoon as high pressure will hold on strong enough to keep those temperatures above the average. but couple of patches of fog to start out this morning, mostly in the north bay. and a few patches of fog out toward the coastline. a little cooler though for today as that sea breeze will be kicking in but more sunshine as we look toward the weekend. temperatures right now chilly in spots, 34 degrees in fairfield, 39 in livermore. 42 in san jose. and 49 degrees in pacifica. i think as we head toward the afternoon not bad in the central valley. some dense fog early on this morning should begin to lift. 60s into the sacramento area, also into fresno. high country mainly up into the 50s and about 62 degrees in the monterey bay. but the whole axis of this ridge is moving east so we have this system encroaching on the bay area most of the energy again running over the top of that ridge. so we're going to stay dry, just a couple of clouds and cooler temperatures in the works. not bad at all though, still well into the 60s in the south bay. 66 degrees in morgan hill. about 64 in sunnyvale. 62 degrees the expected high in redwood city and 61 in hayward. east bay temperatures up into the 60s all around as we are going to see mostly sunny skies. hazy sunshine inside the bay, about 62 in oakland. 59 degrees in san francisco. and and about 63 degree petaluma. temperatures above average. this weekend breezes pick up over the mountaintops. offshore winds going to blow clearing out the skies. temperatures running well above average near 70 degrees again in the warmer spots as we get towards sunday. no rain in the next five to seven days. changes around the 20th of this month a change in the overall pattern. i think we may finally see those shifts. >> are the ski resorts waving the white flag? >> they are making snow but it's melting. it's been warm. >> 50 at tahoe during the day. that's tough. thank you. it is 5:48 now. one police officer is dead, five other officers are seriously injured after a shootout. it happened at utah. police were serving a drug- related search warrant when the shooting began last night. the suspect is in the hospital under guard being treated for a gunshot wound. a state lawmaker has been cited for trying to carry a loaded gun onto a plane. the tsa says republican assemblyman tim donnellly had a colt 45 and an extra magazine in this briefcase. he was stopped at ontario international airport. he says he stowed the weapon there over the weekend and simply forgot he had it. >> i made a terrible, regrettable mistake by carrying a firearm into the airport and, you know, i'm deeply sorry for the trouble i caused and inconvenience to people who are travel. and it was a mistake. >> donnellly is a supporter of gun rights and vocally opposed the state's new open carry ban. he was cited on a misdemeanor charge. oakland has recorded its first homicide of the new year. it happened last night on the 1800 block of 25th east street. the man died at the hospital. no word on a motive or suspect. other headlines now, george gascon will be sworn in today as san francisco's district attorney. he will be the first elected hispanic to hold the position. he won a four-year term in the november election winning 62% of the vote. he replaced kamala harris, elected the state's attorney general. san jose council will consider reducing their own pension plans in an ongoing effort to chip away at the city's budget deficit. a proposal will be considered on the january 24th meeting. pension plans for the mayor and councilmembers are separate from the ones covering most of the city workers there. a plan to reduce those retirement benefits could ends up going to public vote this coming june. and we are going to find out more today about plans for this year's mavericks surf contest. organizers plan to hold a public meeting today. the meeting will deal with public safety, some other issues related to the contest. they plan to keep people off the nearby beach this year and charge admission to watch the surfers on big screen tvs. opening ceremony planned tomorrow afternoon down at half moon bay. surf is acoming. >> should be a nice day. >> yeah, 70? maybe not there but it's warm. hey, the time now is 5:50. the only thing keeping them from drowning was a cooler. how a fishing trip turned into a very dramatic rescue. and how on earth did this happen? what a california driver did after landing his car on top of a house. ,,,, found clinging to a cooler in the ocean off sydney. in australia four people were rescued today found clinging to a cooler including children in the ocean off sidney. the plan was to take the boat 125 miles offshore to go fishing. but they only traveled five miles before the boat caught on fire prompting them to jump into the ocean. >> got my wallet, ran out, by that time rick had life jackets on the boys. i jumped off grabbed the air ski jumped off the back deck. >> that's the cooler. emergency workers received the beacon signal. in 45 minutes rescue helicopters dropped an inflatable liferaft to keep the four afloat. and look at this. a bizarre accident has a lot of people scratching their heads. a car landed on top of a house in fresno. police say that the speeding driver somehow lost control hit some rocks, a tree stump, and then boom went airborne. >> like a perfect spot. >> the driver then ran away only wearing his boxers. he was later arrested and a crane removed the vehicle. >> can you imagine being in the house? what was that? we have a chevy capri on our roof! the irs set tax filings this year on april 17, two days later than usual. april 15 is on a sunday and monday is a holiday in washington. so you get a two-day reprieve if you are hungry, peanut butter and hamburgers are great. but together? folks at this burger joint claim it is delicious. triple x family restaurant is in the running for the best burger in indiana. the sandwich called the duane purvis includes a thick layer of peanut butter on a sirloinburger with all the trimmings. indiana tourism leaders are conducting the contest ahead of hosting the super bowl. fans decide by voting online. >> i'm a purist. >> but peanut butter tastes good on anything. i'm not sure greasy hamburger quite fits the bill. >> although they do peanut butter sauce on chicken. i'm just saying. >> let's head to the altamont pass. we are seeing slight delays westbound. mostly coming away from 205 typical this time of the morning. eastbound delays as well so just a heads up. not too bad though once you approach 680 just a few slow and go conditions at the interchange. westbound highway 4 loaded up business as usual. speeds dipping just under 40 miles an hour. but looks like once you hit pittsburg you're moving along nicely towards the eastshore freeway. and if you are headed out of the marin county area towards the golden gate bridge, so far, so good. no delays there once you hit the bridge things clear into san francisco. >> if you have peanut butter and a banana they would have to call it the elvis, right? wasn't he big on that? >> was he? >> yeah. of course he was. >> you're the expert. >> all right, temperatures throughout the bay area today 50s and 60s for highs today. coming down from what we had yesterday but still well above the average. looks like the next couple of days these temperatures cooling off, warming up toward the weekend. maybe some of those temperatures getting near 70 degrees on sunday and a little breezy outside too. >> sunday 70?
