on these. upper 70s, low 80s for everybody. here's sal. good morning, traffic is going to be busy now if you're getting on to the morning commute. let's go out and take a look at some live pictures. you can see traffic here. it's moving along relatively well at the toll plaza for this time of the morning. this is normal commute. they turn the metering lights on. it's backed up to about the end of the parking lot. it could get busier as people may not have waited around to see what was happening. it could be more of a traffic issue today because people may have made other plans. we're looking at interstate 880 and that traffic looks okay. there are no major problems by the way on 580 or 880. westbound 205 at mountain house is an overturned garbage truck. san jose there's a serious crash. we're going to bring you a picture of that coming up in just a moment. now let's go back to the desk. we are following breaking news this morning on the b.a.r.t. labor dispute, if you are just waking up and joining us, b.a.r.t. trains are running today, but still no deal has been reached. just about 30 minutes ago we were watching as the federal mediator walked out of the meeting and gave us an update saying both sides will continue negotiations later on this afternoon. no specific time was given. they are taking a break. b.a.r.t. workers had threatened to go on strike today if that contract deal was not reached by midnight. late last night both sides agreed to continue negotiating past that deadline. >> the bargaining has produced some constructive and productive progress, and i am authorized by the parties to say they are prepared to continue negotiations through the night. >> b.a.r.t. workers walked off the job for nearly five days in july. if there's another strike, b.a.r.t. has already trained a dozen managers to work as train operators. many b.a.r.t. riders say they're tired of going to bed at night not knowing for sure how they'll get to work. janine de la vega is talking to commuters at the fremont b.a.r.t. station this morning. i can imagine a lot of frustrated commuters this morning janine. >> reporter: yes, the word i keep hearing is stress. this whole situation is stressing riders out. they want an agreement, and they want this to end. a lot of riders say it's hard to figure out when to go to sleep because they're staying up and watching the news to see if there will be a strike, and then they're setting their alarms early to see if trains will be running. b.a.r.t. workers some thanking them they haven't striked yet. others are upset and criticizing them. some commuters have told us it feels as if they're being held hostage by b.a.r.t. and the union. others say they're hopeful because the two sides are still talking. >> in a sense it is a good thing. maybe they'll get it resolved soon enough, you know. hopefully they'll get it done because this is too much. this is crazy. >> too much suspense? >> yes. >> the whole thing is so upsetting. my opinion they should fire every single one of them and hire people who wants to work. they don't want to work that's it. i mean what is this. when they do all this they keep raising the fare. it costs me $12 a day just to go one way from here to 16th 16th street. it's not fair. >> so some strong opinions from riders. patience is running thin, but we just have no choice but to wait. reporting live from fremont janine de la vega ktvu channel 2 news. the trains are running. riders have been encouraged to have that plan b. alex savidge is at the ferry terminal in oakland keeping an eye on the traffic out there. alex. >> reporter: good morning and the first ferry of the morning just left from the oakland terminal headed over to san fransisco. they were just a handful of people on board that ferry. we'll have to wait and see as we move throughout the morning if more of the ferries become more crowded throughout the day. obviously because of the uncertainty about the b.a.r.t. strike situation, a lot of people made those backup plans and made plans to take the ferry today in case there was a strike, and some people could stick with those plans even though the trains are still running. during the last b.a.r.t. strike back in july the ferry was certainly a popular option. commuters lined up early here at the oakland terminal and other terminals in vallejo and alameda. because a b.a.r.t. strike will not happened to, ferries will be operating on a normal schedule but if a strike does happen sometime in the near future, every available ferry would be put into service and thereby there would be direct service from alameda's main terminal and in addition those ferries would be running every 45 minutes which is more frequent than normal. earlier this morning i talked with one regular b.a.r.t. rider who showed up to take the ferry into the city, and he decided to take the ferry because he went to bed thinking there would be a strike. >> i do whatever it takes to get to work by 6:30. and apparently i thought the 5:30 was the earliest but i guess i didn't find out until now it's no strike. >> and that man is similar to a lot of commuters. he was sort of frustrated, a bit annoyed with all of the uncertainty that exists and having to wake up in the morning and trying to figure out whether there will be a strike the next day and try and make those contingency plans. once he found out that the trains were running today he told me he was heading over to the nearest b.a.r.t. station to take the train into the city. live this morning in oakland, notice in july in talks that went down to the final minute. workers decided back then not to go on strike. happening now east bay -- katie utehs just arrived there on the scene to see what it's like out there. >> reporter: the water has burst through the roadway in a couple spots. you can see little geyser like spouts of water coming out. it's trickling along the side of the road. this is 7 hills road and the water is flowing downhill towards lake shaboe road. the call came in before 5 this morning that the water line had broken, so east bay mud is on the way. the sheriff's deputy who is blocking the street tells me east bay mud is expected within the next half hour or so, but it's unclear how long the water has been flowing. it was reported around 5 this morning. the concern here, it doesn't look like a lot of water on top of the road. it can be washing away dirt from under the road which could create sink holes. the good news however is that no homes are flooded at this point. the water is flowing down the roadway and into a storm drain. when east bay mud arrived, it's likely they'll shut off the water main in order to repair it. it's unclear allow that might affect some let's go back to the desk. also new this morning, several small earthquakes hit the berkeley area. the u.s. geological survey records it as a magnitude 3.2 at 1:07 this morning. that was centered between berkeley and orinda. several people called into our newsroom to report feeling the quake. people from daly city and pleasanton said they felt it as well. next came two small after shocks followed by two more, a 2.7 and a 2.6. no damage is reported. a major earthquake killed 93 people in the philippines. this is the after math in sabu. people had to run into open spaces and many people are now staying in the streets worried that it's unsafe to go inside. the earthquake happened during a national holiday in the philippines, did not cause a tsunami. it's being reported that national security agency has collected millions of contact lists from personal e-mail and instant messaging accounts around the world including those of americans. that's according to the washington post which says it learned about the effort from secret documents provided by former nsa contractor edward snowden. they intercept hundreds of thousands of e-mail address books every day from private accounts on yahoo, gmail, facebook and hot mail. it's part of the effort to find links to terrorism. now to our continuing coverage of the government shutdown. the senate says it's close to finalizing a deal that would reopen the government and includes the country's borrowing limit. but there's a chance it won't pass before thursday's debt ceiling deadline. ktvu's kyla campbell is in our washington d. c. newsroom following all of this explaining what it means for you and your money. >> reporter: pam, the senate hopes to vote on this plan by tomorrow, and if the house does not get to it by thursday analysts believe that a deal on paper should be enough to keep the stock market from tumbling and your investments from suffering. a lot does need to happen in the next 48 hours. >> we've made tremendous progress. we are not there yet, but tremendous progress, and everyone just needs to be patient. >> the senate needs to finalize its deal today. the blueprint includes funding the government through mid- january and raising the debt ceiling into early february. that will buy more time to negotiate a long-term spending plan. both the house and senate sessions get underway in about 45 2 news. we've been telling you about workers at lawrence livermore national laboratory. they've been affected. they've been told to come in this morning, but to begin shutdown operations. a spokeswoman says a shut down would be measly complete by the end of the day tomorrow and by monday there would be safety and security personnel remaining at the facility. more than 6,000 people work at the lab. time now is 6:17. there's been another computer glitch that could give travelers on united airlines a real deal. a problem with the airlines online reservation system allowed fliers to buy tickets with frequent flier miles they didn't have. there are reports trips between new jersey and ireland could be reserved for just $50 which covers the taxes and fees. united honored tickets bought when a similar problem happened last month. it says it won't do that this time. >> how come i never log on when those are going on. >> i was thinking the same thing. i want a $5 trip or $50 trip or holiday shopping season. this year macy's will open at 8:00 thanksgiving night and stay open through black friday. the retailer says people want to go shopping after they get together with their out. nearby power lines caused concern but no one was hurt. happening today, president obama will award the medal of honor to a former army captain who fought in afghanistan at the white house this afternoon. 34-year-old william swenson is credited with risking his life to help save fellow soldiers and recover bodies during a 7 hour gun battle in afghanistan in 2009. now swenson retired from the military in 2011. he lives in seattle. a family in sacramento is counting their blessings this morning after their car was stolen with their 5-year-old son inside. it happened around 5:00 last night when the child's mother went to a day care to pick up her younger child. she left her other son inside with the car running and doors unlocked. moments later a thief jumped inside and when she returned the car was gone. >> a guy got in the car named drew. >> it was a nightmare. i don't want to go through it again. i learned my lesson not to leave my car on. >> the car was found in the next parking lot. the boy was able to escape without injury and the suspect was not found. the cupertino city council is scheduled to hold an initial vote today on plans for apple's new headquarters. those plans call for apple's new campus to be 80% open space surrounding a spaceship like building there in the center. apple says the circular designing will encourage collaboration. the campus will be just waking up this morning, bart trains are running today even though no deal has been reached. we have live team coverage. tara moriarty is at the caltrans headquarters in oakland where we received an update about an hour ago. >> reporter: both sides have gone to bed after a marathon bargaining session last night. around 5:30 this morning they started trickling out and at 1:00 this afternoon they're going to be resuming talks. we did notice the union leader step out 45 minutes ago. she's usually talkative but there was no comment nor for us. she seemed cherry cheery after being up all night. >> at the mediator's request we'll be taking a recess until early this afternoon. and that's all i'm going to have to say at this moment. negotiations are continuing and we will be back at it early this afternoon. >> at 10:00 last night, the unions presented their counter offer. that was in response to b.a.r.t.'s sunday offer that it said was its best and final. now we've heard from insiders that although the two parties are close to reaching an agreement, they are still locking heads on the key issue which is pay. at this stage, still no contract, but the good news is no strike for today. they're going to be sitting back down again at the table at 1:00 this afternoon. hopefully they can come to an agreement. otherwise we could be dealing with the same situation being on pins and needles come midnight tonight. live from oakland, i'm tara moriarty ktvu channel 2 news. there's no strike for now. we may see more commuters exploring alternate options. alex savidge is live at made backup plans, made a plan to take the ferry today just in case there was a strike, and you have to imagine that some of those commuters may stick with those plans even though the trains are shut off this water main. you can see behind me it's leaking down 7 hills road. it is causing some flooding in the roadway. now the good news it's not flooding any houses at this point. now the crews have created diversion dams with sandbags to try to keep the water away from people's lawn and draining into a storm drain down the road. it's flowing towards shabot lake road. the water has been leaking more than an hour. it was reported around 5:00, so that's when it was reported. it could have been flowing long before then, and the concern with water flows like this, it doesn't look like a lot from aboveground, but below the asphalt it could really be causing damage as it washes out some of the soil. one of the neighbors who lives in this area approached me and he said that he noticed some low water pressure this morning as he turned on his coffee pot. it hasn't been a major inconvenience for people at this point, but east bay mud is working to shut off the water, and they tell me that some people will be affected with that water shutoff as they get up and start their morning routine. however, they're not sure how many homes will have their water shut off at this point. live in castro valley, katie utehs ktvu channel 2 news. the city of fremont may install surveillance cameras to curb crime. argus reports police are asking the city council to put up cameras in low to moderate income areas. they say their request comes after complaints about a rise in home burglaries. the cameras would be placed on fremont street lights and public buildings. vallejo and oakland have similar camera surveillance. no word on when the cameras would go up. a triple shooting in san fransisco, one of the victims just a boy apparently. what a witness reported seeing right after the western addition. police say someone drove by or walked up to three young men and shot them around 7:30 on rose alley. one victim is said to be a teenager. a witness says she saw him collapse, and she was afraid to show her face. >> and he fell and the ambulance came and they just cut his clothes off. his clothes were still laying there. >> some neighbors told us it is a dangerous neighborhood, but police say it had been changing for the better and called the shooting a surprise. no word on any suspects in the case. at about the same time as the shooting in san fransisco, two teenagers were shot in oakland. that happened at 7:20 last night on 61st avenue near east 16 16th. initial reports indicate the victims are a boy and a girl 14 or 15 years old. they are expected to survive their injuries. there are reports of a third victim, but that person has not been found. work continues today at levi stadium in santa clara following the death of a construction worker. work stopped yesterday morning after a bundle of rebar came loose and fell on a delivery truckdriver. cal osha investigation into the workers death could take several months, but the state agency has said the work site is safe to reopen. the medical examiner says the truckdriver killed in the construction accident in santa clara 60-year-old edward irving lake junior. he died at the hospital. lake worked for gurdow which is a stadium subcontractor. neighbors say lake lived in vacaville and will be missed. happening now, the golden state warriors are finishing up a basketball game in china. the preseason game against the lakers tipped off at 4:30 a.m. time in beijing. it's now in its final seconds. the warriors are winning by 4. the two teams are set to play again tomorrow in shanghai. golden state has been conducting clinics for kids and greeting chinese fans who love basketball. the threat of a b.a.r.t. strike put ed lee's business trip to china on hold. we caught up with the mayor yesterday. he said he and aides spent the afternoon calling b.a.r.t. management and labor leaders along with the governor's office in an effort to urge both sides to find common ground. mayor lee was scheduled north, northeast. there's no warnings but anytime you get a north, northeast breeze and it's very dry that would includes the fire danger. let's hope the breeze stays down. everything is pushing well off to sea, any fog, a lot of activity in the northern plains and great lakes and across texas. remains of tropical storms have fallen apart and they're moving across texas and towards arkansas and 500 also slipping a little bit today. despite the fact we've had good earnings reports come in, we are just beginning a pretty big earnings season, a lot of companies ending their fiscal year. it's offset by worries over the budget and the shutdown. u.s. airways and american airlines have given up on their bid to find out why the federal government is blocking their merger. the two airlines wanted the justice department to explain why it approved four earlier airline mergers but opposed theirs. the airlines believe the government is holding them to a different standard for antitrust than it did the earlier deals but they also say they're confident they can still win approval to become partners. airlines squeezing in a few more seats into their planes. they are taking out the older heavier seats, moving in new slim line models that take up less space. that also means passengers are getting a little less leg room and a little less padding. the airlines say most passengers don't notice the difference. they say travelers notice when it means they pay less for their tickets. police in los angeles are investigating the second dry ice explosion at lax in two days. detectives say the latest blast happened shortly before 8:30 last night at the tom bradley international terminal. officials say four dry ice bombs were found in restricted areas but only two went off. there are no reports of injuries or evacuations. police say on sunday someone planted a plastic bottle containing dry ice that exploded in an airport employee bathroom. no arrests have been made. new this morning, veterans groups are holding a rally at the world war ii memorial in washington d. c. calling for an end to the government shutdown. these are live pictures again from d. c. they want to publicize the impact the shutdown is having on many veterans and their families with concerns about delayed veterans benefits payments. 33 veterans groups are reportedly taking part in the rally this morning. benicia police are investigating a rash of recent commercial vehicle thefts. three happened yesterday morning alone. this truck belonging to all american elevator was among those stolen. it was found a few hours later abandoned in vallejo. the owner says it had been stripped of $30,000 worth of tools and equipment. police are encouraging truck owners to install antitheft devices in hopes of reducing the amount of incidents. happening today, the city of oakland will continue its fight to keep the pro sports teams from leaving. the city council set to discuss aproned coliseum -- proposed coliseum city that calls for building a new stadium for the raiders, the a's and the warriors. city officials are hopeful because some investment firms are reportedly interested. the san fransisco 49ers say they're disappointed in their fans after a poorly timed wave during sunday's game. it happened as arizona cardinals defensive end campbell was carried off the field on a stretcher after
