when judge engoron has a bomb squad sent to his house, how are you looking at the terrain for those who seek to hold mr. trump accountable? >> i mean, this is what they're going to be facing and every case they already are facing. and as any case goes to trial, and i think one of the most likely to go is the january 6th case in d.c., also the manhattan d.a. bragg case. i mean this is what they know they're facing. we've heard the protection for jack smith is something like $4.4 million and just part of his term as special counsel for him and his staff. we know marshals protecting judge chutkan in d.c. are around the clock protecting her. the effort to go through yesterday or tuesday, i'm sorry, to protect that courthouse when mr. trump decided to show up for arguments before the circuit, these are huge expenditures. and then every time someone gets attacked, swatted, all the law enforcement that have to respond, think about the
c. circuit, the nation's second highest court, just a couple of days ago. i expect that court is going to throw out trump's claims really quickly, and trump has always been hoping united states supreme court will get that case and stopped his trial pending it. i'm just not sure that's right. there is so little to trump's claims that it is perfectly plausible to think u.s. supreme court's not gonna hear the case and not going to delay trump's trial. so much fourth or thereabouts can still occur. >> andrew, what do you still see when you have this trial calendar? >> the same reaction as neal listening to the argument, and particularly judge pan take apart the argument. many ways just getting the lawyer to actually say what they are arguing because it was so preposterous. so the more that argument went on, the more you thought, i think, as neal does that the odds of the supreme court saying, you know what? don't need to hear this. what you are arguing is just so preposterous. it doesn't mean that they won't, but if that does happen, it's possible for this to go, the federal case to go in march. if not, i think we are going to see a reversal. we are going to see the state new york case go at the end of march. that should take 4 to 6 weeks and i can see judge chutkan slotting in right after that. the florida case is the one
process given this enormous role. now roman's lawyers have not provided evidence but point to the fact that he has one of the largest staffs of any judicial circuit in georgia and yet she appointed wade even though he does not necessarily have the resume you would think of and that he has made a substantial amount of money working on this case over the past two years. now i want to note that wade has not responded and willis' office has said she'll respond through the appropriate court filings. but today, during a routine hearing, one of trump's lawyers brought this up and the judge overseeing this case said i'm going to schedule a hearing on this you need more filing to come in but going forward this is going to be an issue. >> could these allegations have ramifications consequences beyond what's going on in fulton county? sglern certainly. this is such a consequenceal
attack though they were nakedly political. and joining us, tim, before we get into the merits of trump's new argument. explain why the distinction matters. acting as president, versus acting as a candidate? >> right. really matters. the supreme court ultimately are in the d.c. circuit and potentially the supreme court has to evaluate whether or not the president during the acts that are alleged as criminal in the special counsel's case were conducted pursuant to his responsibility as president. an argument if they were part of his official duties he has immunity. that is unsettled, even but the acts done at pursuant to the president of the united states or as a special counsel done in his capacity as a candidate, a private citizen, outside of the zone of his responsibilities as president. so it's understandable that now
what's especially interesting as we talk about this nervy and pivotal question an presidential immunity, a different group of judges in the d.c. circuit all right weighed in on this and taken a decision against trumps. days, weeks, after election day 2020, he was acting in his personal capacity. there's a litigation against trump that eessentially suing him for inciting the riot and appellate on that circuit site sided with lit against against trump and noticeably reached that decision specifically cited the fact that all the way back, back in late 2020, early 2021, donald trump was filing these lawsuits and explicitly saying that he was acting in his personal capacity as a candidate. the very piece of evidence that we wrote about in this piece has
carry this out forever to the point that he is going to continue to say these things to scare the american people are wrong. we have seen a lot of states come together and do more election integrity bills. we need to do more than that. we still have three or four states i'm worried about that don't have that. at the end of the, day i will always defend and fight for the constitution. that is what we should do as americans. i think what happened on january 6th was a terrible day. i think president trump of the answer for it. >> so there is that. after that, one of the moderators asked what i thought was a smart an interesting question about yesterday's d.c. circuit, court of appeals arguments. >> the immunity argument. >> basically, look, you know, they basically said you can go -- assassinate your potential rival and be impeached and convicted, what do you think do you agree to see the constitution differently. >> donald trump is going to lose that appeal, it is going to end up going to trial in
capitol hill yesterday and flew straight back here to l.a., which is, of course, his home. instead of facing republicans today, he will be across the courtroom from special prosecutor david weiss. it is, of course, david weiss who announced last month those charges against hunter biden nine tax related charges in all including failure to file and pay taxes and assessment. it w will be a far more serious setting today than the circuit like setting that was the result of his surprise appearance on capitol hill yesterday when republicans republicans said hunter biden was afraid to face them because he is defying as we know that subpoena to testify behind closed doors while hunter biden and his supporters said no, it was republicans who were
