Thursday, January 21, 2021 Most have heard the cliché “don’t do the crime, if you can’t do the time.” For many criminal defendants, however, a significant factor in the time served is not just the crime committed, but rather the so-called “trial penalty.” A “trial penalty” describes situations where a defendant chooses to proceed to trial instead of accepting whatever plea deal the Government had offered and receives a significantly lengthier sentence than she would have received had she not gone to trial. Often the “trial penalty” results in a defendant receiving a much lengthier sentence than those received by more culpable co-conspirators who accepted a plea.
email article Among the more than 140 people receiving pardons or having their sentences commuted by President Trump on his last day in office were several with healthcare ties, including practitioners. Paul Behrens, Thaddeus Bereday, Peter Clay, Todd Farha, William Kale Trump pardoned the five former executives of WellCare Health Plans, who were found guilty of defrauding Florida's Medicaid program. "The defendants in this case falsely and fraudulently schemed to submit inflated expenditure information in the company's annual reports ... in order to reduce the WellCare HMOs' contractual payback obligations for behavioral health care services," the Justice Department said. The White House labeled their case "a case study in overcriminalization.... Notably, there was no evidence that any of the individuals were motivated by greed."

A meeting with his inner circle at the White House on Sunday saw Mr Trump finalise the clemency list, a source told CNN. Despite much speculation, he ultimately decided against issuing pre-emptive pardons to himself or members of his family or to the likes of WikiLeaks founder Julian Assange or
Chido Nwangwu, Publisher, USAfricaonline condemns the presidential pardon granted by President Donald Trump to some of his associates Donald Trump promised before and at the time of his assumption of office that he will âdrain the swampâ, coded reference for Washington DC. But he came into Americaâs capitol with a trailer load of swamp snakes, alligators, crocodiles, moccasins, octopus and sting rays! Anyway, the truth is that the American Wonder popularly known us Donald J Trump never ceases to amaze. Just when you thought he had reached the outer limits of the most egregious and discordant level of corruption, crudity and excesses, he moves the ball to the stratosphere of the surreal. As we all countdown to the final weeks of the impulsive and quixotic presidency of Trump, the man has done it yet again! His decision on December 22 and 23, 2020 â to grant pardons and commutations to many of his convicted friends, an in-law, several of his associates and campaign operatives has left the ethically-conscious people here in a tizzy.
By Chris Black I just want to clear things up from the beginning: as I already told you on December 15th, Donald Trump will not be a two-terms president, unfortunately. Stop getting high on hope-porn and smell the coffee. Anybody who is telling you otherwise is lying to you and/or is grifting. And there are many grifters out there, making money on other people’s misery. With that issue out of the way, this is the pardoning time of the year, and President Trump exercised his right to clemency recently. What were his picks? What perceived injustices he pardoned via executive power?
Cohen has predicted how the last few weeks of Trump's presidency will play out 'That's when he'll probably try to drop the pardon power for Jared, Don, Ivanka, Eric, Allen Weisselberg [Trump Organization CFO],' Cohen said Monday He said pardons could produce 'significant problem' for Trump since a person is no longer able to invoke the Fifth Amendment once they receive pardon 'So all of these people may ultimately be his downfall,' Cohen added, 'simply because they’ll be testifying against him, either for a court or a tribunal'
What Trumpâs pardons say about criminal justice Used to show sovereign grace and mercy, clemency can ennoble a nation. But even its responsible exercise should not blind us to deeper problems. By Nancy Gertner and Dean A. StrangUpdated December 29, 2020, 11:40 a.m. Email to a Friend President Trump issued pardons and sentence commutations Dec. 23 for 29 people, including his former campaign chairman Paul Manafort, above, and Charles Kushner, the father of his son-in-law, in the latest burst of clemency in his final weeks at the White House.Seth Wenig/Associated Press Much ink has been spilled â appropriately â on President Trumpâs pardons. The press has criticized grants to loyalists who chose not to testify against him and to the politically connected. Many have excoriated Trump for granting clemency to war criminals, like the Blackwater mercenaries convicted of murdering Iraqi civilians. Some have suggested investigating whether these pardons involved a corrupt exchange â silence for clemency â which would be bribery. Trump is not the first to walk this line. Former president Bill Clintonâs pardon of Marc Rich, the wealthy financier, was scrutinized because Richâs former wife made a substantial contribution to the Clinton library and Hillary Clintonâs Senate campaign. Ultimately, no corrupt link was found.
