the d.a.'s i have to get prepared and get ready for trial. i will give you this insight though, having worked there for 25 years, worked with fani willis, that team is already prepared. they were prepared for trial the day after the indictment came down. they have got their witnesses lined up. they have got their trial notebooks prepared. and certainly by that october date which the district attorney has now countered the dwenks m defense move for chesebro, they will be ready. >> and one thing that is interesting about this case, if you get all 19 tried together, like six of them are lawyers. and so that just makes it very interesting as they make these legal arguments. i want everyone to listen to what one of john eastman who is lawyer for trump and one of the real architects of the fake elector scheme, what his lawyer told our jake tapper yesterday about why eastman he thinks deserves a totally solo look at

11780 votes. when he said that, was he asking ross ten berger to falsify the votes. that is the presumption. >> brian: and he will say no. will. >> he would say no. i think him simply saying find me 11780 votes i think that's a matter of will. i don't think that's is he looking to falsify the votes. the other question is, this issue about false elector. this it issue of false slaft electors. this essentially relied on a legal theory of some of the president's attorneys on the reading of the 12th amendment that the vice president has turn down electors from states. i think that's bizarre theory. a couple of well-known attorneys hold it. i don't know that holding that theory or acting on it is necessarily criminal.

>> well, they align legally in a sense that if you have a preview of the case tried against you, you have a advantage. and chesebro was the author of the fake elector scheme. you can put on the broad scope of the conspiracy and the hub of it, and say that he was the spoke that did this, and i rest my case. they don't have a lot of trouble putting in a very tight case. politically, of course, trump wants this case in 2026 after the election which is at odds with chesebro and they will argue over the politics of the timing, but as the law goes, it is a advantage to defendants not been tried the, but i am not sure it is an advantage to chesebro to go to quickly, and he may say, look, i played a little role, and get rid of me, and acquit me, and get the

again and again. right now this is coming from kathy latham, one of the fake electors, who is accused as part of this racketeering, conspiracy, and other charges in the case against donald trump and 18 others. kathy latham is saying in a court filing that she wants her case to move to federal court because she was essentially acting at the direction of the administration, the direction of the president specifically, and that allows her some protections, she says, under the constitution. she also says she was following the lawyer's advice when she became a fake elector. the lawyers around donald trump who were telling her that that was the plan moving forward. and so this is indicative a couple things. one, we're going to have a bunch of federal court proceedings here not just with her but with two other fake electors who have asked for the same type of protection. we also are seeing a judge already willing to look at similar arguments being made by mark meadows who was the white house chief of staff, jeffrey clark, who was in the justice department at the time, on

former president, currents republican primary frontrunner and brief inmate, donald trump's surrender in fulton county led to the very first mugshot for a former occupant of the oval office. trump has plastered the booking photo on campaign tchotchkes but long after the race that image will still number history books. trump wasn't the final defendant to surrender in the 2020 georgia election interference indictment. the last two turned themselves in this morning. now all 19 defendants have been booked. one of them has to remain in jail until his bond is set. another already has a trial date just eight weeks away. and one is the latest to say that she was acting at then-president trump's direction. cnn's katelyn polantz is at the courthouse for us. yet another defendant saying that it was trump who directed directly the fake elector effort. >> reporter: right. this is very likely to be a refrain that comes up again and

count against you in federal or state court. dave aronberg, you work in this area every day. talk about just the tremendous cost that criminal defendants, especially white collar criminal defendants, have to, you know -- the checks they have to write to lawyers. you look at somebody like cheseboro. you look at somebody like jenna ellis. you look at some of the minor players even on the, you know, the county level that tried to get involved in the fake elector scheme. how do, for instance, kathleen latham, scott hall, misty hampton, these people we really haven't heard of, how do they afford their legal bills? if they don't afford their legal bills, is that one reason we might see them moving quickly, as lisa suggested, to try to get this case behind them? >> joe, i think it was part of

we've turned this page in the indictment story. prosecutors allege trump was the rico leader, the tip of a criminal conspiracy to overturn the election. we know the defendants have surrendered along with trump for his booking and mug shot. now we don't know who's going to cooperate or turn. we just heard a lawyer talk about how that process could play out. but we do know one republican in georgia, sean still. he's not the first to pin it on the alleged rico leader. take georgia's republican party chair, david schaefer. he said the same thing. some legal experts think we are at the beginning of a process that could involve a lot more of that, whether it's accusing trump, testifying against him, or formally flipping. eyes are on the key defendants we've been tracking, the lawyers who had direct contact with trump. it's one thing for an elector who's never met him, who's accused of elector fraud, and another thing for one of these people. remember, we've also seen the video of clark and eastman getting searched. we've seen the pressures people

the brains behind the -- the creator of the fake elector scheme to begin with. so, could he just go to trial and anybody else who says they want a speedy trial to go along with him and then others, to your point, the rest would be severed? >> i think that's the most likely scenario. those who want the speedy trial are legally entitled it to. here's why it's so important strategically. it will give people in the later group, which surely will include donald trump, a free look at the evidence. michael's right. they called the bluff here. what's going to happen is there's going to be a first batch and donald trump is going to get to see all the government's witnesses, how they're cross examined, what points missed. there's a real tactical advantage there. >> how much of an advantage do you think that is? >> i think it's valuable if you're a defense attorney, especially one of the top tier folks waiting to see what happens in the case. the indictment tells the story of rico, but being able to watch
