that is a real problem for the fbi. >> bret: it doesn't back up the president, it's a cue to take them down in this report. >> actually, i don't know that you can say that. >> bret: at least the ig says that. >> the ig is -- his role is to find facts, not to necessarily make conclusions. i agree with most of the facts that the ig fines. and the facts and hearsay that the fbi's senior leadership kept the investigation go where they knew they had no evidence that was based on a dossier that was entirely unreliable and they knew it and they did that to continue an investigation into a candidate that then became president of the united states. they didn't have a basis to do that. that is in this report. >> bret: what about the criticism of the attorney general, that he comes out with a statement today, clearly differing on several points with the ig, and a short time later, the u.s. attorney, john durham, puts out a statement, that he says does not jive with the inspector general's findings.

pretty rare, is it not? >> no, it's not because really, what it is is a sign of respect. john durham waited until horowitz's report came out. that is why he hasn't made public statements. but now that horowitz's report is out, he is free to talk about the fact that what he has found, at the first thing that he told you was, i appreciate the inspector general, but my jurisdiction is not limited to. have greater jurisdiction and what i have found is not consistent with his conclusions about that seminal issue. the predication issue. the attorney general's special prosecutor in this case, john durham, is it saying, i have a problem with the predication here. i disagree with the attorney general, there was not probable cause to open this investigati investigation. >> bret: critics would say, if he is a prosecutor, does he make his case, bring it to a grand jury, make a chart before making a statement? republicans were very critical of james comey. >> absolutely.

he did not make a finding. with respect, he said i take issue with the inspector general's findings and conclusions regarding predication issue. >> bret: he didn't say what his was. >> he didn't say what his was. i think it's a clear sign of where he is going with us, which is that i have greater jurisdiction, i've done a lot more with regard to this investigation, and i think in short order, we will hear that john durham is going to find that the predication just wasn't there, as most of us really don't see it even in this report. >> bret: so we've characterized on this panel, talking about this, there is two tracks. there is the impeachment tract, and then there is this john durham track, ig tract, and is it your sense there is a race now to figure out who is going to get to the finish line on what happened? >> i've said that all along. that is what is driving this fast track. they want to impeach this president so that the news like this comes out, and they say, gosh, we are sorry there was fisa abuse but the guy should have been impeached, that is why they have been racing through this.

you take from it? >> you have to look at the particulars, the 17 instances of misconduct cited in the report. they are pretty damning. the fisa court was clearly taken for a ride by the fbi on this. you know, this is not a failure at some low level of the fbi where a few things were not properly done or so forth. this was up and down the chain of command. it is about is strong medicine as i have seen in a report of this kind in a very long time. the fbi has had some dark days in his past. but nothing like this recently. this is pretty strong stuff. whether you -- whether the conclusion is that the inspector general drew about the investigation, the start of the investigation was properly predicated or not, whether he's right about that, saying that it was, and whether there was political bias or not aside,

with it, was properly based on what we've known that he's been skeptical of that. it's understandable, and perhaps predictable, that he would be skeptical of a finding that was properly based. but for john durham, who is quite respected, who is conducting a more wide-ranging investigation than the inspector general was authorized to come for him to come out and say that he disagrees with the conclusion about whether this buying was properly predicated. i don't remember ever seeing like anything -- it is striking. we got a long way to go in this. as inspector general's report has made a contribution to what we know about it. it's nowhere near the last word. >> bret: i was told by senior official that the durham statement was in direct response to a "washington post" report that had said durham had essentially said to the ig, i agree with you. so he's kind of cleaning up but it is unique for a prosecutor to come out and put out a statement like that. before making charges are going to a grand jury.

this report, by itself, the more you look at it, the more you see it's an indictment of jim comey's leadership at the fbi. this is a profound statement about how bad things were there with regard to an investigation that was continued without evidence to support it. i think folks at the fbi are horrified and dismayed by what is in this report, and is only going to get worse, i think, by what john durham fines because he has the ability to go out and talk to the intelligence community -- >> bret: people that weren't working in the government. last thing. democrats are moving a prescription bill this week. it looks like, we are hearing there is movement on usmca. does that undercut in any way the g.o.p. argument that democrats are ultra-focused on impeachment, and can't get anything else done? >> it's been their plan all along. nancy pelosi, it's the worst kept secret, that once they voted on impeachment, move that off, they would shift to do, we are ready to get to work. we are moving forward on usmca comfort scription drugs, all the things we have been criticizing.
