what we saw in that park just 50 feet away from where i'm standing and what is happening in the courthouse behind me, which is the former president on trial for the hush money case here in new york city. >> yasmin, stay with me, and we will continue to watch for this presser to get underway where we hope to learn more information about exactly what happened and why this happened. joining me now is retired nypd lieutenant, darren porcher. thank you for taking the time. we are talking about a protest area outside that courthouse. we know security is tight given this very high profile case happening inside, and the intense, of course, political environment we're all in. would there have been security checks for people going into this protest area? >> that's difficult to discern if there would be a security check. it would make all the sense in the world to check people going into the controlled area. you have to take in mind, that's 100 center street. you have a series of people coming and going to criminal court.
women, and their opinions of the former president barry, it was interesting to see again, this is a very high profile case with a very high defendants can everybody knows who donald trump is. you had some people saying they didn't like his persona. they thought that he was a selfish person. you'd other people saying they thought it was interesting that they had read part of the deal. so again, how all of this plays out will be very interesting, particularly given who the defendant is and the fact that this is the first criminal trial of a former president in us history, john. and they're also use this issue of what donald trump continues to say and post while not in the courtroom itself. >> and the judge keeps saying, we're going to bring this up in a hearing now that hearing is moved earlier, what's exactly going on here this is all about that gag order and what we have heard donald trump's say time and time again. >> and really, this goes to the fact that the prosecution doesn't have to share their witnesses with donald trump because he's continually
six alternates are expected 15 roughly five more, but just a reminder that he could change his mind particularly after what we saw yesterday, two of those jurors getting dismissed after they had been seated. i know there is some concern really on both sides that there could be episodes moving forward, not just your typical episode in terms of a family member getting sick, but also with this view of can they be impartial? this is a very high profile case with a very polarizing defendant. so we're going to see today is there are 22 people left of that 96 from yesterday. >> they are going to go through the entire process again to see if they can get one of these five alternate seat. >> they are going to go through the questionnaire, then you're going to see both of the sides question that now, what's interesting about the alternatives? they actually get both the prosecutor you should end the defense more strikes for the alternative than they did for the actual jury pool. they get to strikes per alternate seat. so we'll see how both sides end up utilizing
forward? >> knowing that is the case look, you have to i mean, you take your juror jury pool is you find them and do the best you can to find folks that made a profile that you're looking for, right? >> we talked the other day. the other night about i'm laura show on which jurors were the most interesting. i found the image the? person who came from ireland grew up in ireland, blue-collar type worker some college education in a sales job, watches msnbc and fox. that's kind of like your swing juror or in election terms, your swing voter, those are the folks that you as lawyers, you're looking at and saying how are they reacting to what we're saying? so this is very important. it is new york. obviously there's gonna be a big chunk of people who are not fans of donald trump. but at the same time, people come in and what i've found over the years juries typically regardless of what their political views are, they look at fairness and fundamental fairness, and that's the most important part of this process. >> right? tried to take in the
others we're going to get like that. even today the judge said to the group, he's saying them before they get into the box to be interviewed as prospective jurors. if you have a conflict, let us know, you can go. and even some who don't leave at that point get up even between the time that they've gotten to have that question and gotten into the box, they've decided that it's too much for them. and i think tomorrow, i would expect -- we don't know, but it could happen, that we lose another one or two. there's been an expectation that the jury ooh selection will finish tomorrow and the trial will start on monday. that could happen, we just don't know. we're seeing the struggle of choosing a jury in such a high profile case involving probably the most well-known person on the planet. >> can i add some context, chris, if we have a little bit of time. >> always, lisa. >> this is one of the dangers of breaking the trial midweek as judge merchan has announced is his intention to do.
martha stewart, robert menendez. also former assistant d.a. manhattan district attorney, msnbc legal analyst, catherine christian. it's great to pull back the curtain. let me start with basics. most of what we know comes from movies and television. this is obviously the real world. so are you in realtime touch minute to minute with the lawyers as they're having to make these decisions about who to keep or maybe who to challenge? >> if i'm actually involved in the jury selection, i sit at counsel table with the attorneys, and chat with them as the potential jurors respond to the questions they're asked. i try to offer advice, take notes. i have been involved in the design of the questions asked to potential jurors, and there's typically a profile of preferred responses that attorneys on both sides are listening for.
