to get rid of the floating barrier there meant to deter migrants. the barrier itself is about 1,000 feet long anchored to the bottom of the waterway. the justice department here says it is not only dangerous but illegal. rosa flores is near the border this morning. the doj, of course, filing this to not necessarily about immigration but about environmental concerns. rosa, what are you seeing this morning on the ground? >> reporter: erica, good morning. what we're seeing is defiance on the border. let me show you the border barrier at the center of this legal battle. if you take a look here beyond wire, you'll see the buoys the middle of the river. according to the u.s. doj's lawsuit against the state of texas, these buoys were deployed unlawfully. they were deployed without permits by the army corps of engineers. according to this lawsuit, these pose diplomatic risks with mexico and also raise concerns

as well, and the u.s. dogiving the state of texas a deadline. here wt the letter says in part. quote, if we do not receive a response by 2:00 p.m. eastern on july 24, 2023, indicating your commitment to expeditiously remove the floating barrier and related structures the united action.intends to file legal greg abbott responding in a thread saying, quote, texas has the sovereign authority to protect our border under the u.s. constitution and the xas constitution. governor abbott goes on to blame president biden for the problems on the border and ends the thread with this, erica, saying, quote, we will see you in court, mr. president. does this mean texas will be defiant on deadline day? we will have to see. >> we'll be watching. certainly makes it sound that way. rosa, appreciate it as always. thank you. all right. it is hot.

between the doj and texas. >> it is not the first lawsuit that texas has filed against the government. but as promised, as we just heard from rosa, the justice department has filed its lawsuit. so where do things go from here? >> well they're going to see each other in court over the issue along the texas-mexico border. but the big picture is that this is a delicate political issue for the white house. president biden has come under criticism for his border policies from the left and the right. and there has been this ongoing feud especially with texas governor abbott over the handling of the texas-mexico border. now just to give you some context here, this is was an operation that texas governor launched in 2021. and over the course of the last two years, there have been internal discussions within the administration as they watched what he was doing along the border when it came to the migrants and sending them to democratic led cities. but it wasn't until last week that we saw the justice department threaten this legal action against abbott escalating

and to file suit against the state of texas, because of the floating border barrier and the relates structures. now, boris, it's unclear to me exactly what the related structures are. because if you look, there's the border buoys and there's two layers of constantino wire. and those buoys have anchors at the bottom of the waterbed there. now, there are nets below the buoys as well. so it's unclear exactly what all of that is. but at the moment, what's really dusting up here is a court battle between the u.s. doj and the state of texas over these border buoys. >> and there is the outstanding question, rosa, are these barriers actually preventing migrants from crossing? >> reporter: the short answer is, no. and i believe we have video to show you. video that we shot earlier today, and that's -- let me show you exactly what happens.
