AARP, AARP Foundation and NELA Urge U.S. Court of Appeals to Reverse “Sole Cause” Decision that Threatens Older Workers
WASHINGTON AARP, AARP Foundation and the National Employment Lawyers Association (NELA) are urging the United States Court of Appeals for the Sixth Circuit to reverse an appeals court ruling in an age discrimination lawsuit,
Pelcha v. MW Bancorp, Inc. The appeals court ruling could have far reaching implications that would make it even more difficult for older workers to prove claims of illegal age discrimination.
Melanie Pelcha, a former Ohio bank teller dismissed at age 47, disputes the three-judge Court of Appeals panel’s decision that in order to prevail in her civil rights case, she had to prove that age was the “sole cause” of her termination. This ruling will make it harder to enforce longstanding protections under the Age Discrimination in Employment Act (ADEA), which covers workers age 40 and over. ....

Georgetown University staff resist after being asked to take new public health roles or unpaid leave

Staff at Georgetown University are railing against a program that asks them to temporarily take on health-related roles during the pandemic such as conducting wellness screenings, registering visitors to campus or security or go on unpaid leave.
It comes as the school has designed a spring semester that will include about 200 hybrid courses, increased access to campus facilities and brought twice as many residential students to campus than in the fall. In preparation, the university revamped a program that places employees into temporary public-health-oriented jobs. ....

When Donald Trump took office in 2017, he installed a number of pro-business appointees to lead federal agencies tasked with protecting workers’ rights. But for the first two years of his administration, things continued more or less as normal at the Equal Employment Opportunity Commission, the country’s sole workplace civil rights watchdog. Ami Sanghvi, now a lawyer at the Marek Law Firm, started as a trial attorney at the EEOC just after Barack Obama became president. Yet even during Trump’s first two years, she said, the agency was able “to do pretty great work.”1
Then, in May 2019, corporate lawyer Janet Dhillon was sworn in as Trump’s choice for the EEOC’s chair, and Sanghvi soon found the kinds of cases she could pursue restricted. It’s part of why she decided to leave the commission and go into private practice in January 2020.2 ....
