>> reporter: what has the victim's family upset, it will be a juvenile judge. they wanted the 17-year-old to be charged as an adult. the family is also just learning this driver didn't have insurance at the time of the crash. this 17-year-old driver's age has largely kept his name and face out of the public spotlight, and now prosecutors have decided to charge him as a juvenile, not an adult, for the death of a father and his 9- year-old daughter. >> the family is really devastated by this decision. >> reporter: attorney michael cardoza represents the family. police say the driver of a speeding cadillac escalade, lost control, slamming into them. only the 12-year-old survived. >> the family believes it should be tried in an adult court. two lives were taken. a husband and a daughter? how do you say this man should be taken in juvenile court? >> reporter: they did confirm the case had been filed in juvenile court. multiple sources also confirm the young driver did not have auto insurance at the crash. at his family's home in concord, the driver's father had little to say. >> can you talk to me about what happened? >> no. >> but why he was driving around without insurance? >> no. >> do you have anything you want to say to the family. >> reporter: the driver expected to make his first appearance here at 9:00 a.m. eric rasmussen, ktvu, channel 2 news. we're just now getting some news into our newsroom of a fire happening in solano county. crews are battling a four alarm grass fire off interstate 80. drivers on interstate 80 have been calling our newsroom to report seeing the flames near the pena adobe exit. firefighters say about 45 acres have burned so far. the fire is about 50% contained. there is no word on what started it. we're going to keep our camera on the scene, and bring you more developments as we get them. a stunning development in the world of cycling. lance armstrong, considered one of the greatest cyclists in history is being stripped of his 7 tour de france titles. he decided to abandon his efforts to fight doping allegations. a short time later, the agency says it would ban armstrong from cycling for life, and take away all of his titles. armstrong is not admitting that he used illegal drugs. he just says he's fed up with fighting the accusations, even though he says he has passed hundreds of drug tests in his career. the city of petaluma is celebrating tonight after its little league team advances to the championship game. >> driven to left-center field, and over the wall for a grand slam! started just before 5:00 p.m. this evening at walnut creek at the keys. the keys is home to almost 800 economics. the fire was in three fifth floor units. firefighters say it took just seven minutes to put it out. there's no word yet on what started the fire. the city of oakland is gearing up for pride festivities that the city says is different than the pride fest in san francisco. pride mixed with politics for a duo call to action. >> reporter: the fundraiser for oakland's pride festival ended just about an hour ago here at city hall. city leaders kicked off the festivities by raising the at oakland bart stations. they were talking to passengers at the mcarthur station today. they said thieves are targeting people distracted by their cell phones and tablet computers, and the people by the doors need to be most careful, because thieves can swipe items and take off. new details about the price cupertino's c gate is offering for the solyndra building. the c gate company is the highest bidder at a little more than $90 million. solyndra paid $300 million to build the facility just a few years ago. the federal trade comission cleared the way for facebook's acquisition of instagram. facebook announced plans in april to buy the san francisco company for $1 billion in cash and stock. with the drop in facebook share price, the deal is now worth about $750 million. facebook expects to close the deal by the end of the year. south bay jurors completed their first full day of deliberations today. the jury got the case yesterday after extensive instructions from the judge. apple refinery. an environmental group says it may know what caused that pipe to fail. why they think a certain type of crude oil from the persian gulf may be to blame. >> reporter: activists say chevron knew they created a risk for an explosion here. the explosion and fire injured five workers and sent 14,000 people for medical help. it may have been caused by the high sulfur persian gulf crude. >> this pattern of piping problems at the unit due to corrosion. we know that they're the cul veer level in the crude has been going -- sulfur level in the crude has been going up substantially. >> reporter: sulfur can cause pipe corrosion. chevron acknowledged it as the reason for a fire five years ago. >> this was a near disaster. the next one could be worse. >> reporter: also, the bay area quality air management showed there was elevated particulates in the air. only slightly elevated. you should know that the sampling occurred hours after the fire was out. health officials say that does not mean the air was safe. you want to see what kind of chemicals are crossing the fence line. >> some 200 residents of richmond turned out tonight to voice their concerns about the chevron refinery fire. many are angry, and also worried about caustic exposure. organizers say they need to band together to hold chevron accountable. several officials as well as scientists were on hand to answer questions. some say they didn't think they were getting accurate information from chevron. the ponderosa fire is 61% contained tonight. today, crews focused aerial drops on hot spots. it is still threatening 950 structures. one big accomplishment, is more residents were able to return home. we're staying on that brush fire up in the vacaville area. here we are in vacaville. winds are federal money in the event that they fair. the army corps said they made the move because california adopted a set of standards for the levees that don't match that of the federal government. a members, and i just wish everything could stop. you know? we never know who's next. >> reporter: there have been 32 homicides so far this year. 12 of them are gang related. the mayor's gang task force says they're working harder than ever. >> we're not happy about it at all, but we're going to fix this. >> reporter: outside the church, chief chris moore revealed some of the actions the department is making. >> a lot of intervention with gang members right now. as well as police officers rounding up people wanted for warrants or parole holds. >> reporter: 300 people marched in solidarity from the church to the corner of story and king. many hope for more officers on the streets. there has been a call to bring in outside agencies to help. >> right now, we have the agencies to do what we do cremation. after gale's burial is paid for, any leftover funds will be donated in her name to a local nonprofit agency dedicated to ending homelessness. an autistic girl who had been missing in san jose for hours was found just about an hour ago. pra jones vanished from her home at 3:30 this afternoon. our camera was there when police brought brea home to her family. she told them she had gone running and got lost. a woman found her, then called police. her family says brea has the mental capacity of a 7-year- old, and understandably they were quite concerned. hayward police are keeping tight lipped tonight about a homicide. it happened at a shopping plaza on bruno street this afternoon. police will not identify the victim, and they're telling us they plan to release information tomorrow morning. santa rosa police are looking for the driver of a pickup truck wanted in connection with a suspicious incident. police sent us a picture of the white extended cab truck. the driver tried to convince a 15-year-old female student to get into the truck around noon today. she refused. the driver was described as hispanic, thin, and wearing a baseball cap backwards. san francisco has the highest paid police chief in the country. >> i put in a ton of hours and enjoy a good salary, but it's the position that i'm honored to uphold. >> he will be earning more than $307,000 a year. the chief will be making more than the mayor and nearly 1/3 more than governor jerry brown. a dog that attacked a u.s. park police force earlier this month in san francisco was turned over to the custody of animal control tonight. what could happen to this pit bull before the week is over. >> reporter: on one side, a horse named stoney. >> he's been cleared for light work. >> reporter: on the other, a dog named charlie. his owner is david gizarelly. it's decision day. would his dog charlie be put down, or would he be allowed to live after attacking a u.s. park police officer. first to testify? stoney's partner. the u.s. park police officer eric edmonds recalled the attack on stoney earlier this month. >> he was just completely covered, bites, gashes, blood. the dog chased my horse for 1.6 miles. that's unheard of. >> i was trying to call the dog. i was trying to jump on the dog. i was trying to grab the dog. >> reporter: he was in an off leash area, exercising his right to run. that's a spot he believed u.s. park horses should probably avoid. >> they're putting farm animals together with domestic animals. any dog could have chased after that horse. could have caused a problem. >> now. that fire in vacaville. i want to put up a live picture of that fire that is burning near interstate 80. it is a four alarm grass fire. our photographer on the scene was just told by authorities that the fire has been contained and that no homes are in danger. this fire started at about 8:00 tonight on a hillside off of pleasant valley road. that's not far from interstate 80. so far, it has burned about 45 acres. the update we have now is authorities say they have contained the fire, and that no homes are threatened. so far, there are no injuries reported as well. a new poll shows the economy, and health care are the biggest concerns of voters in three swing states. ohio, florida, and wisconsin. the "new york times" cbs news poll found 60% of voters there say they trust president obama to handle medicare. and a majority disapproved of mitt romney's plan to retool medicare. romney scores higher on the economy in florida and wisconsin. it's a tie in ohio. mitt romney traveled to minnesota and new mexico as he campaigned before next week's convention. he told supporters he will create 3 million new jobs and increase offshore oil drilling. he said one reason he won't reveal his tax return is it would reveal how much he gives to the mormon church. he added, the storm doesn't reveal such things. there is a chance tropical storm isaac could interrupt the republican convention next week. the national hurricane center expecting isaac to hit haiti, and the dominican republic tomorrow as a hurricane. starting sunday night here on the 10:00 news, we begin live coverage of the convention begins. only days after his controversial comments about rape, missouri congressman todd akin is the target of of threats. akin's office said there are threats of rape to his wife and others. the fbi and capitol police are investigating. sources say the threats came through twitter and by phone. akin has apologized for suggesting a woman's body can prevent pregnancy, due to what he called legitimate rape. regulation over health insurance rates in california is headed to the november 2014 ballot. today, the secretary of state's office announced that the initiative had enough signatures to qualify for the ballot. it is sponsored by consumer watchdog, and gives state insurance givers to deny certain premium increases. the health insurance has vowed to spend 10s of millions of dollars to avoid that study. a new study finds older men are more likely to father children with autism, or schizophrenia. their children have more and more genetic mutations thought to lead to contra costa county vector officials went on the attack against mosquitoes that may be carrying the west nile virus. fogging started today. the california department of public health reports 34 cases [ male announcer ] the wireless receiver. only from at&t u-verse. get a free wireless receiver with a qualifying u-verse plan. rethink possible. students were excited and anxious for the first day of school at uc berkely today. students are also nervous about looming tuition hikes. >> reporter: uc berkely on this first day of class. >> i feel like a fish in a big pond up here. >> it's kind of exciting. >> it's kind of a drag. >> reporter: state funding is drop bid 40%. tuition and fees have almost doubled since 2005 to more than $12,800 a year. >> first of all, the entire higher education system in california would be much healthier, and we would have significantly lower tuitions for our students. our students would be graduating with lower debt. >> reporter: uc berkely so far has managed to weather the storm, but a lot is riding now on proposition 30 to raise taxes. >> students overall in california, if proposition 30 fails, it will be a very dark day. >> reporter: that dark day, administrators say, could mean tuition rising to more than $14,000 a year. >> we're walking a tight rope. we really do need to find additional financing to be as good as we can be, and provide the access that we can. >> reporter: while university officials say they've been able to increase the number of courses offered in a variety of subjects, many students told us today they were having problems. >> there are some classes that i did want to get into, that i wasn't able to. >> reporter: the message is that uc berkely is holding its own, but the university is going to have to find another source of funding, if voters reject the governor's tax proposal. students in san francisco state were moving in today for the first day of school on monday, and they too are concerned about rising costs. administrators say they may also have to place new limits on enrollment if state lawmakers can't come up with the funding. the fog is pushing inland tonight, that fog will be in your neighborhood most likely tomorrow morning. if you had it this morning, you got it tomorrow morning. we're hitting the east bay hills and working our way over towards lafayette and now towards livermore valley. temperatures tomorrow very similar to what we had today. the last few days have all been similar. you won't notice the changes that much, it will be very subtle. a little change tomorrow. the extended forecast, it's a mild weather pattern. not just for tomorrow, but through the rest of august, to the end of august. tomorrow morning's fog footprint, it's pretty aggressive. more fog than we've seen all week. suffice it to say, temperatures tomorrow morning are going to be a little coolerk and will recover more slowly. it takes a while to modify that cooler air mass. the heat in the valley, and you can see the fog, or the moisture splits the heat. the 90s, the red. as we go into tomorrow, and as we go into the rest of august, this low pressure dominates. the last week or so of all, we're looking for this pattern to continue. no red flag warnings, which is good news for this time of year. that will take us until the end of august. that could change. but right now, that's how the models are playing it. if you go to lake tahoe, the thunderstorms have ended. friday, saturday, and sunday, the weather looks like. thunderstorms out of the forecast. mostly sunny skies, basically moved east now. we're clear of those, great news if you're a firefighter. that was giving us fits on the southern sierra nevada. 84 in fairfield. your friday forecast looks a little like today, it looks a little like yesterday and the day before that. 86 in livermore. some areas are going to come up a degree or two tomorrow. if you have outdoor plans this weekend, or you're doing anything around the bay tomorrow night, saturday morning, it's going to be chilly. take a jacket. that's just how it's going to be. the five-day forecast, saturday, sunday, temperatures kind of dip a little bit don't they?
