that was the indication that the attorney general gave late last night. david lee miller is live in new york city leading our coverage this morning. first of all, this court today, will we see him, what time, what's expected, david lee? >> reporter: bill, let me start with the latest breaking developments. there is new a wire service report, shahzhad has told interrogators that he acted alone. whether or not that's true is something yet to be derd. as for what is going to take place in the building behind me, we expect shahzhad is going to arrive in the next couple of hours, this is where he will appear before a federal magistrate, it will be the first court appearance, authorities have not said yet, bill, precisely what charges he is going to face. it you -- if you take a look over my shoulder, go back live, in front of the federal courthouse, there is many police officers, both federal and local, new york city police, already here, they're ramping up security. bill: what we're trying to piece together, david lee, is this puzzle over the past 48 hours. how best can you explain how he was nabbed on board that plane last night? >> reporter: it's very interesting, if you connect the dots here, how they were able to nab him. the authorities had in their possession the pathfinder suv, the treasure trove of evidence. he tried to remove the vin number, the vehicle identification number on the dashboard, he was successful in removing it but was unaware that cars, vehicles, truck, suvs, have other vin numbers, the authorities were able to trace the vehicle using the vin number on the engine and other locations to a woman who recently sold it in bridgeport, connecticut, this woman sold the car for $1300 cash, the deal took place at a shopping mall, authorities were able to trace shahzhad using e-mails, he sent this woman, they also showed her a photograph from immigration, she confirmed the man to whom she sold the car, this was sent to customs at jfk airport, when he showed up there last night, game over. bill: david lee miller, we'll be back in touch when we get more details. also from what we understand, a 30-year-old pakistani-born, now u.s. citizen, had a wife and two kids, a young boy and young girl in pakistan, apparently this man, according to neighbors, had disappeared in the past year for a period of five months in pakistan. michael bal boneie is former homeland security adviser for new york state, former secretary of public safety for the state of new york. sir, good morning to you. >> good morning. bill: going back to the airplane last night, it's 11:00 p.m. at jfk, emirates is about to take off, they close the door, pull away and the plane is brought back. you have new information as to what was happening at the time. what have you found out? >> this is a fast moving investigation, a lot of information coming forward. what happens is when a plane leaves this country, a manifest is actually sent to the customs border agency at the airport. as you know, the news was developed over the course of the day, and was sent out there. the notice was out there. the plane was actually stopped and was told to come back to the gate. at that point in time, four individuals were actually taken off the plane, two were involved in this incident. my sources tell me that when shahzhad came off the plane, he was very compliant, he didn't make any fuss but did tell them that he had driven another car to the airport, that car was then searched by officials and a weapon was found in that car. bill: let me stop you here. he did not resist, that's what you're reporting. >> that's what i'm reporting. bill: what was the weapon found in the car? >> a handgun. bill: it was a handgun. that was traced to him? and was -- >> i don't have that specific information, but there was a weapon in the vehicle. bill: okay. this is what the theory has been over the past eight or nine hours, michael. the theory is that the authorities let him get on board that plane, waited until the very last moment in case he made a last minute phone call or shot an e-mail or text message to collect as much information as they could. what you're reporting gives me a different impression. it appears he boarded that flight, after they checked the flight manifest, who was on board, his name popped up. >> that's the information that i received from my sources. so when you think about it, it really was developing very, very quickly yesterday. the excellent investigation that the authorities did led to this alert, where they tried to pick him up. it's hard to find somebody immediately, typically if they don't want to be found. it does take some time. luckily this procedure is in place so that we know who's going to be leaving the country and this is a procedure that has been used successfully in the past to stop somebody from leaving the country. bill: i understand, but it's a very important piece of information here, michael. based on the authorities you've talked to, were they hot on his trail for 48 hours or was it just a last-2nd decision where they caught the guy, matched the name, and said don't leave the ground? >> my information only goes to the point where the informs was transferred from the passenger manifest to the airport, which case the plane was told to come back to the gate itself. it seems to me, just from things that i've learned over the last couple of years, that you wouldn't necessarily want to wait until the very last second, something might have happened, but this is the procedure that is done with the customs borders agency. bill: all right michael, declaring victory today? >> this is only the -- this is part of an ongoing investigation. this is obviously something that's going to take a lot of investigation. there's a lot of material out there. remember, they've got the pathfinder, they have now the car at the airport airport, they've got his home, they're going to see who else was involved. he's saying he was by himself, so did he talk to anybody. if so, they're looking at other connections. we saw a connection between hasan and abdulmutallab, the christmas day bomber in the context that they had the same connection with the yemeni cleric. they're looking at something in that regard. they're looking at who the person spoke to, how he got the motivation, how he chose times square at the time, and how he learned to put this device together in this car. bill: thank you for coming on today, keep working on your sources, we'll let you back on tv. and you also mentioned, this is breaking on the wires, reuters is reporting that he acted alone, he told police that, anyway, that he acted alone, he denies ties to radical groups in his native country, pakistan. george pataki is up later today, we're going to talk to a number of sources throughout new york city, new york state and washington to get to the bottom of what's happening today. michael bal boneie, here in new york, former homeland security adviser for the state of new york, thank you. >> thank you bill. juliet: of course, the fact that the suv did not blow up on saturday night only prevented -- not only prevented loss of life, it provided investigators a trove of evidence. car bombs usually leave behind little forensic information but the fed got the vin number as you heard david lee miller report off the engine, that helped them track down the suv's old owner, they've been able to check for dna, fingerprints, things like that. at this point we don't know what evidence has been found but whatever it is it will likely help investigators and prosecutors. bill: also we're told from the white house now, awaiting word that could come any moment now, reacting to the arrest, the latest we get, anyway, president obama found out moments after shahzhad was taken into custody at jfk at md night, informed by deputy adviser john brennan sometime between midnight and 1:00 a.m., brennan briefed the president six times yesterday we're told and we now know for the flight to the gulf coast on sunday afternoon, this was topic a on board air force one from the white house. juliet: a lot of you are following this development on your computers, through the brand new iphone app. if you want to see the latest information on today's arrest, just log on to foxnews.com,/, slide show, take a look at all the images, get the latest developments, all of that online. turning now to the macive effort to stop more oil from pouring into the gulf, new concerns now that the spill could disrupt shipping lanes at the mouth of the mississippi river, but there is also some positive news. crews say they're using an underwater vehicle to pump chemicals into the oil, help to go break it up before it rises to the surface. results said to be encouraging. that's good news. but the approach, still being evaluated. trace gallagher is live in venice, louisiana. trace? >> reporter: juliet, the experts are saying if there's a time to pounds on this thing, now is the time. the temperatures are rising, the winds are calming down, and the water is flat, and this is an ideal time, the experts say, to get those booms out and start surrounding this oil slick. i want to show you an interesting picture. this is the latest satellite image coming from nasa, and it's kind of unique because it shows that the oil slick is actually getting smaller. a previous satellite picture had the slick at about 3400 square miles. this one has it at roughly 2000 square miles. now, that's not as good as it sounds, because experts are saying that means likely that a lot of that oil has gone beneath the water, so you have the slick on top, and there's these billowing clouds of oil beneath the surface. but it could also mean those dispersants you were talking about, the chemicals that are used to break up the oil and dissolve the oil, are actually having some effect. now, bp is saying that containment dome that we have talked about so much over the past couple of days could be ready to put in the water sometime in the next 48 hours, we're talking about a four story, 65-ton structure that they'll actually drop down 5000 feet below the surface. they'll do it using cameras and gps, to try and cap that well, and then when they get it down there, hopefully, capping one of the three leak, they'll extend about a mile's worth of hoses to the top and use those hoses to siphon out the oil that's been trapped inside the dome. we're also getting information from a company called elastic american marine that they're going to come out with their fire booms, beginning on thursday, and they're going to start burning some of this oil. what that means is they will round up some oil using a couple of bolts, they'll light it on -- a couple of boats, they'll light it on fire and they can burn 75,000 gallons per hour. if that burn starts, if the weather cooperates, they could, they could, begin chipping away at this thing sometime in the next couple of days, juliet. juliet: trace gallagher, live in venice, louisiana, thank you trace. bill: there are several breaking news with the terrorist, shahzhad, age 30, yanked off a dubai-bound plane last night. peter brooks, former governor george pataki, did shahzhad have any help or did he act alone and if he had help, where are they this morning? bill: his wife is there, young boy, daughter, we believe. pick it up in there. >> why is he going to dubai? i've been on the flight to dubai. once you get there, you can go anywhere in the middle east. that's the hub, all the airlines go there to other places 6789 -- that's number one. number two, none of these guys tend to act alone. who's he -- who's financing him? it's a bigger picture here. we need to know more, we need to have more intelligence, we needed more cameras in times square, we needed radiological devices that would detect radiation had it been a dirty bomb. we've asked for funding for new york city, the administration cut it. the other thing i'd like to know, has somebody read this guy his miranda rights, including the right to remain silent? >> maybe not america but i'd like to have one in times square. what if this had gone off, we'd have no information about the clues and who cares? nobody cares what you're wearing, what you're doing, unless you're doing something wrong, and after the fact, to be able to piece together who is this guy, who met him, what kind of a car did he drive, what other leads do we have, without that information, we'll never know. bill: ironically, we've been running this clip of the surveillance camera with the spot shot on that guy. >> wrong guy. bill: apparently so, apparently he had no connection. we were warned about that early on by the mayor and also the police commissioner here in new york city, and it doesn't look like he had any connection at all. so far the administration, how are they doing? only moments before graduation. and who is the suspect? bill: 23 minutes past the hour in new york city, we are looking at lower manhattan, we are awaiting a man to appear in court, faisal shahzhad, age 30rbgs had just returned from a five-month trip to pakistan and may have been heading back there last night when he was pulled off a plane, emirates plane bound for dubai, moments before takeoff. in a few moments we'll go live to bridgeport, connecticut, you've seen that shot, the fbi now sweeping his home for clues. back there live in minutes. juliet: this is just a horrible story. just days before graduation ceremony, may 23rd, it was supposed to be a lacrosse player on university of virginia women's team found dead in her off campus apartment, a fellow senior who once dated her is behind bars, on the university's highly touted men's lacrosse team, charged with first degree murder, the university of virginia campus, shocked. >> yeah, surprising. didn't expect someone to like be murdered across the street. it's usually calm here. >> it was quickly apparent to them that this young lady was the victim of something far worse. >> that was charlottesville police timothy vongo, he is now our guest. >> good morning. juliet: you were initially called to the apartment because a roomate i understand was concerned this young word, yeardley love, they were concerned about alcohol poisoning, when you arrived on the scene that all changed. tell us what happened. >> obviously, when the officers arrived on the scene, the body position had changed from the point that the roomate may have discovered her and we were able to see clearly obvious signs of physical injuries to her body, the officers on the scene immediately secured the crime scene, called for detectives and we began an immediate investigation which as you know resulted in the arrest of university of virginia lacrosse player. juliet: i want to get tom first but why weren't they able to tell it was something morning alcohol poisoningsing -- poisoning? was he under the covers? >> she was face down. i don't know how the roomate may have viewed her or what attempt she inspected the body. at the point we got there, emergency personnel were trying to revive her, the body was visibility to the officers on the scene, we had a chance to view the body from a different perspective than the roomate did. juliet: the high school lacrosse player, what has you convinced he's the kill sner. >> early on in the investigation he became the focus and within hours we secured an arrest warrant charging him with first degree murder. i obviously don't want to go into the facts or circumstances that led to his arrest, other than to suggest there was certainly probable cause to do so. we consulted with our commonwealth attorney in shore lotsville, the prosecuting attorney, as well as the magistrate that actually produced the charging document, so there was layers of oversight to those facts and circumstances to ensure that when those charges were brought that in fact probable cause did exist. juliet: we obviously don't want to impede the investigation but can you tell us was there a relationship that had been started up again, were they still involved together? >> that's what we don't know. obviously there was a path relationship. the history involving that relationship and the days preceding her death are very important and we need to learn as much about those days as we can, when the process of interviewing friends and teammates to try to get a better understanding for what the relationship was and what may have taken place in those preceding days
