>> a new way to get around and it's only here in the bay area. the fast and easy way to get a ride whenever you need one. good evening, i'm ken bastida. >> i'm dana king. >> with just a week to go until the election carly fiorina is in a hospital room and it's not clear when she is getting out. she has an infection connected to a surgery following her breast cancer, how common is this kind of medical trouble? linda yes looks into that. >> help me welcome the next senator of california, carly fiorina. >> >> reporter: at her campaign appearance five days ago carly fiorina was healthy and talking about recovering from breast cancer. >> last year at this time i was bald. i was completely bald and just finishing up radiation because last year i battled breast cancer. >> reporter: today she was hospitalised. she is being treated with antibiotics for an infection associated with reconstructive breast surgery she had in july. her campaign said "while this will impact her campaign schedule today, carly is upbeat, and her doctors expect her to make a quick and full recovery and be bang outen 6th on the campaign trail soon. it can happen to up to 30% of women. >> it's possible she could be discharged from the hospital tomorrow. get antibiotics at home, be on the campaign trail. >> she had to cancel two appearances, letting others stand in for her. >> we want carly to get better quick. >> analyst jail director says people admire a cancer survivor but her infection is a possible set back. >> in some ways she might get some sympathy from some segments of people who can identify what she is getting through but to other people there might be some concerns about whether the stress of the office of the u.s. senate might bring her illness into play again and again. >> joaquin county senator barbara boxer's campaign said we wish her a speedy recovery and hope she is able to return to her normal schedule soon. that could be tough because there is one more week left on the campaign trail. >> her health is more important. >> absolutely. are you getting tired of all the nasty campaign ads? well don't count on any of them going away before election day. jerry brown and meg whitman sat down. they were asked if they would ease up on these ads for the last week of the campaign. here is what they said. >> let's be clear about it. if she takes her negative ads off i'll take mine off. no question. >> i want to make sure people really understand. >> both were in long beach appearing at the women's conference hosted by first lady maria shriver and arnold schwarzenegger. >> i've got a great ad. it starts off with meg whitman saying "i moved to california 30 years ago because it's such a great place with all this opportunity." then the ad says"and who was governor?" that's all. >> yeah, it's gonna go that way until tuesday. no way out. today's event was likely the last time whitman and brown will faceoff before election day. a huge crowd turned out tonight to remember the napa state hospital employee who authorities say was killed by a patient with a violent past. robert liles shows us what brought that vigil to an abrupt end. san we're gonna have to get back to that story a little later in the broadcast. well they didn't move to san jose and they don't want to live in san jose, but soon, hundreds of people may soon be forced to do just that. kiet do on the neighborhood san jose is now closer to annexing. >> we want ammo. >> reporter: they have come all the way to city hall to deliver a message. it's not you, it's them. >> this is nothing personal against san jose, be very clear about that. this is about the right fit for our neighborhood. >> reporter: about 100 people came to demonstrate against theirth annexation of their island. >> please ease please simplify my life and the life of all these people and help us stay in the community where we are grounded. >> reporter: the this map shows cambrian 36 in white bordered by campbell to the west in pink and san jose the east in yellow. because san jose surrounds it on three sides the law allows them to annex the land without a vote. >> so you're taking that chunk of 36 and anecking it makes sense. >> it makes sense. >> reporter: but they'll not go without a fight. >> we don't get to determine our future, you do. please be good neighbors and release us. >> cambrian 36 which has named themselves campbell village says 911 response times will suffer, property values will go down. >> if we did not believe strongly to our core this was the right thing for our neighborhood our passion, our conviction, would have sputtered out years ago. >> reporter: why not make an exception in this case and let them go to campbell. >> consistency in our laws is important. that all people be treated equally under the laws and ordinances. >> reporter: the vote came down 1 hour ago 7-3 in favor of beginning the annexation process. the final final vote takes place on december 7th. the council could change its mind by then but that will very likely not happen. so this could be the beginning of the end for cambrian 36. >> san jose population goes up. thanks kiet. we were going to go back to a story from robert liles about a hospital worker killed in napa. >> reporter: some 300 hospital workers walked side by side to the main entrance, each one dropping a glass stone, a silent prayer for could worker donna gross. but just as the crowd, state police blew out the candles,en raging them. >> they are trying to keep us under wraps. it's not a secret. >> reporter: cops told cbs5 our cameras had to go at the request of the family but when i pressed them on the statement -- >> reporter: when the were you advised they did not want the candles here. >> they turned their back. >> a lot of people got -- they are afraid to talk. >> reporter: what made them afraid? what happened? >> umm, i think the, you know, my opinion is the police presence right now. >> reporter: wilfred sanchez desoto says breaking up the vigil was the message from the hospital to the employees to keep their mouth shut about jeff will let massey, the patient accused of strangling her to death friday night, stealing $2 and a pack of chewing gum. one patient says sky techs are often attacked by patients. >> they didn't go by me boom on me like that. >> reporter: he had been transferred here for slicing a woman's throat ear to ear. he has been violent his entire stay. why was he granted a pass to roam for up to 2 hours unattended? >> i don't think the hospital is equipped at this time. >> reporter: is that putting your safety at risk? >> i believe it is. >> reporter: in napa, robert liles, cbs5. >> reporter: checking overtime other bay area headlines, a hail of gunfire left some people wounded. they fired as many as 60 shots and people think both men were targeted. so far tonight no arrests. the family of a truck driver who died last year when his big rig runed off the s curve has filed a lawsuit against caltrans. while it is made for cars they say caltrans and its subcontractors didn't put up adequate warning signs to alert drivers of the new roadway. they said the trucker's speed and a shifting load was to blame. no comment from cal tran. and the traditional world series bet is on. gavin newsom and the mayor of arlington, texas, have agreed that the losing city's mayor will travel to the winner's hometown for a day of community service wearing the winning team's jersey. san francisco office throwing in some dungenesse crab, sourdough bread and average ore steamed beer while arlington, if they lose, with will accepted us some barbecue. >> giants will take on the rangers in game 1 of the world series. tonight the vips are in town and the party has started. joe vasquez was in golden gate park where they threw a big gala. huh joe. >> i tried to use my world series media badge, they wouldn't let me anywhere near it. but that's it. that's the academy of science and, tonight, well this is the world series premier party thrown by the giants. about an hour ato look at this they lit up the night sky with fireworks. bruce bochy was here but we're told the players were resting up for the game tomorrow. among them, a guy who was unemployed not too long ago, tonight i talked to cody ross and his wife. he is a cinderella story in baseball cleats. >> i'm really proud of my husband. >> reporter: giants fans meet summer ross. she is new to the bay area, just moved here with cody, her husband, in august. you know, cody cody cody in an impossible playoff run he has crowned up one big home run after another. saturday night cody ross was named mvp of the national league series. >> he has always had a smile on his face. >> reporter: she says she is not surprised her husband did so well. >> he proved to everybody what i already new and what the family already new and that is so satisfying it almost makes me want to cry because he deserves it. and -- >> reporter: they have been together 10 years, 6 of those married, two kids later they are living the dream. a dream almost dashed one valentines day about eight years ago when he bought her a gift bag and a balloon and a rock. but not that kind of rock. >> i was so excited and when i went to open the bag he said "oh honey, that's just a weight to hold down the balloons," so -- >> what was in there? there is a hot new appeal for that. uber cab. just enter your credit card online, get your text message confirmation, then any time you need a cab simply click the green button and uber cab find you and sends you a prepaid car in minutes. >> be my guest. >> and it's not just any car. >> it's another way that, you know, you find travel reservations through orbit, on demand quality car service through uber. >> he launched uber cab just a few months ago but in a city rife with controversy his success has been overshadowed bite this. a cease and desist order by the public utilities commission and the nta. neither would speak on camera citing legal orders but according to papers it is all in the name. uber cab says it's a taxi cab company operating without a proper permit. so they dropped the name. >> what we are is an intermediate areay between clients and licensed professional preliminary oh drivers who are in fact regulated by the puc. >> reporter: but they also take issue with uber's fees, $8 a start and $4.90 per mile which they say looks a lot more like a cab than a limo, and cabbies agree. >> that's what they said in the newspaper, they are going to take care of the cab and say uber. same thing for us, they are stealing our fares, our business. >> reporter: but uber cab -- i mean uber contracted drivers say not so fast. >> you know, you cannot compare apple to orange. how is that competition?
