parts of the park are closed as officials there try to figure why it happened on thursday, officials there try to figure why it happened on thursday, july 7, 2011. captions paid for by nbc-universal television welcome to today on this thursday morning. i m ann curry. i m david gregory in for matt today. a lot of anticipation this morning. orlando, florida, that s where casey anthony s sentencing hearing is being held this morning. she faces up to four years in prison for lying to investigators. given the nearly three years she been behind bars, some legal experts believe anthony could be sentenced a time already served and could walk free. the latest of a live report straight ahead. and george and cindy anthony s attorney speaks out for a live interview. jaycee dugard lived in con stand fear. she was held by phillip and nancy garrido. now she s opened up in her own words and why she never tried to escape. important health news. why are a growing number of older women now suffering from eating disorders. one woman is sharing her emotional story with us this morning. the final day of the canadian leg of prince william and catherine s tour, then on to california. live with them for the latest stop with more on the a-list celebrities waiting to greet the royal couple in los angeles. let s begin with this morning s sentencing of casey anthony. kerry sanders is outside orlando. good morning. good morning, ann. casey anthony may have spend her last night in jail. we believe she s in the courthouse now brought here as a sole inmate in a jailhouse van early this morning. she s spent two years, nine months in jail. the judge could decide that s a sufficient amount of time for the conviction that she s been handed down by the jury. however, it may not be so easy because 15 of the months that she spent in jail were already applied to an older conviction for check fraud. reporter: casey anthony heads back to court today acquitted for murder for one simple reason the prosecution failed to prove its case. juror number three spoke to abc news. if you re going to charge someone, don t you know how they killed someone, where, when, why, how not guilty doesn t mean nen. justice for caylee! reporter: despite the outrage, the jury was well aware this was a death penalty case. in our country, you have to prove it. looks bad, smells bad, i get that. if it s someone else s wrong and i get that wrong and i kill someone else, i can t live with that. casey anthony was found guilty of four misdemeanor counts of lying to law enforcement officers. remember her first recorded interrogation when she told the detectives a nanny named zany had taken caylee. everything you told me is a lie. not everything i told you. pretty much, including where caylee is right now. i don t know where she is. sure you do. reporter: the judge i want all of you bright-eyed and bushy tailed. could sentence her to four years in jail or let her walk free figuring the two years and nine months she s held in jail have been enough. this is lying about a missing child that mobilized an entire community of law enforcement, cost millions of dollars in searching for a missing child that s already dead. that s a big lie. reporter: on wednesday, casey s parents, cindy and george left home again with nothing to say publicly. the anthony family has received death threats. while outside of the courthouse, mike estherly put a sign in her window that reads baby killer . how can she be free after she killed her baby. reporter: most protesters are venting anger, there s always a possibility one could act out, targeting tanthony family, including casey when she s released or the 12 jurors. some of them will be vetted and found out and people will know who they are and they re terrified of that coming out. it s unclear when casey is released either today or ever if she ll earn money off of her notoriety. to that end, the state has filed a motion to tax her if she is earning any profits after this. there is a law in florida that allows the prosecution to recover the costs from the investigation and the prosecution and those costs easily exceed $1 million. kerry sanders, kerry, interesting point. mark lipman is george and cindy anthony s attorney. good morning to you. good morning, ms. curry. do george and cindy anthony want their daughter release? i can t discuss what they want because of attorney/client privilege but i ll be there today. what do you think of the relationship they ll have with her moving forward? we hoped to meet with ms. baez yesterday but he was out of the state. as far as his client is concerned, i can t discuss what she wants. do they think that casey is innocent? well, they as they said, the jury decided what they felt and what they thought and they have to go by what the jury thinks. i can t give my own opinion because it s a reflection of what they think. we ll have to remain silent on that for right now. how did they react to the statement that casey wants more children? i believe that s from a letter from a while ago. it s something we haven t discussed. i couldn t tell you either way. but either way, everyone needs to move on and try to rebuild their lives from this. can you describe their emotions since the verdict? it s one that s still sinking in. if you can imagine one losing your grand daughter, and, two, three years of a living hell of going through depositions, searches, trials, just the tribulations these people have faced just from the outside has been enormous and something that no one could expect to be able to go through with the grace and dignity they ve got to be able to keep going. is there anger, especially given the defense claims? certainly, there is anger as to the claims to sexual molestation. and there s anger as to the claims that my client george anthony had anything to do with the movement of kay lcaleigh s . they had to defend their client. i know those things were baseless. meantime, the multiple death threats that we re hearing about, can you characterize them, the intensity, and how much fear your kleins have as a result of it? well, i d like to thank the orange county sheriff s office for taking care of my clients so well. yesterday i saw thaw mowned police surrounding the area as well. some of them are valid, some of them are just people e-mailing their feelings saying i hope you re all dead. but from there, if it s coming from nebraska, i don t necessarily consider it as a major level threat. if it s someone in orlando, we have to have concern. on this broadcast yesterday, jeff ashton said there s enough to file a perjury case against cindy. had she reacted what is your reaction to that? i m a worst case scenario type of attorney. we re prepared if we decide to charge her with perjury to defend her vigorously. my client maintains she did the searches. it would cause a lot of additional issues nobody wants to face. if the state deems it necessary to file, we ll be there. but i m hoping and praying they don t do it. listen, thank you so much for joining us this morning. thanks very much. now here s david. washington in the debate over raising the federal debt ceiling from keeping the united states on defaulting on its loans for the first time ever. president obama is summoning the two sides for a summit decision. you ll be there. good morning. good morning, david. there s new signs of openness. the president is talking about a larger package of spending cuts and medicare spending. you signaled to openness for raising revenues. do you think there s room for a deal here. yesterday, david, i said it was in response to the president s demands that we not hold up a deal based on any objections to plugging corporate loopholes and he specifically talked about corporate jet owners. my response to him that s not why talks have stalled here in this town. why talks have stalled why i left the so-called biden talks had to do with the fact of a fundamental disagreement that we shouldn t raise taxes right now. you know and i know that it s counterintuitive in a sputtering economy to raise taxes when we need to get people back to work. raing tax rates is one thing. you re opposed to that. are you willing to consider raising revenues through closing loopholes and other deductions to bring money in to the federal treasury? what i said first of all, preferences, special loopholes in the code are never good for overall growth. we do need to simplify the code. yes, i would like to see the rates brought down. in response to the isolated question of whether we re holding up something about corporate jet owners is not true. if that s such a priority for the president, what we would like to see is offsetting tax cuts somewhere else. at the end of the day, the republicans are not going to support leader, you want offsetting tax cuts. that doesn t get you anywhere. the democrats have to cut spending, that s a cut. you ll do some kind of revenue increase as long as it s cut somewhere else, it doesn t get you anywhere, does it? what this is about is we re trying to demonstrate the public we re going to stop spending we don t have. right now, we re borrowing 40% of every dollar we spend. no family, no business can get away with doing that. we re saying significant spending cuts to trillions of dollars to programs that affect billions of people. these are not easy cuts. but the duty is to go back to the people who put us here and say we re going to change this system. we re going to get the fiscal house in order so people at home can get back to work. oh here s the issue, if the white house, if the democrats are willing to cut the trillions of dollars what you wanted in spending cuts, what is the republican party prepared to do in this negotiation that is hard. it is very hard, i think, to first of all sit here and say yes we re going to increase the credit limit of the country when we ve got over $14 trillion in debt right now. but, i think all of us believe that america pays its bills just like every family business is expected to. so we look at this as a situation where we can come together and rally around transit dollars and spending cuts as well as reforms to the system, then we can go forward and begin to get the fiscal house in order. this is not easy for anyone to do, david. and i m hopeful we can get this done so we can begin to grow the economy again. all right, talk to the white house today. we ll be watching. eric cantor, thank you very much. thank you, david. thank you. parts of yellowstone national park are closed as they investigate a rare bear attack. a man was mauled to death as he hiked with his wife. george, good morning. good morning, ann. rangers say most of yellowstone s major attractions are open this morning as they investigate the fatal bear attack. no one has been killed by a bear inside yellowstone in a quarter of a century, though bear attacks claimed two lives outside of the park last year. rangers are warning people if they see a grizzly to keep their distance, to travel in groups, and along back country trails, to carry pepper spray to ward off the animals. the attack occurred near this area of yellowstone near canyon village. a man and his wife were hiking when they spotted the grizzly and began to back away. at some point they then saw that the baerp was coming at them. the husband told the wife that she should run. the bear attacked the man and he was fatally jurped. the area of the attack has been placed offlimits for now. they believe it was a female defending her cubs. if that was the case, the bear and her cubs have been left alone. park officials would not release the name of the couples. after mauling the man, the bear went after his wife who was lying down, playing dead. she was wearing a backpack of sorts, a day pack, grabbed her in some fashion, lifted her up off of the ground and dropped her. and then ran off. the grizzly population in and around yellowstone has grown in recent years to more than 600. so bear sightings are miles an hour frequent and visitors are being cautioned to be extra individual la vigilant. have the planned hike, we get the information from the ranger as to where the safest place to be, approach it that way, or a specific campground. i would not hike one or two people in a back trail. yellowstone is a popular place with 3 million visitors a year. bear attacks are still relatively rare. the safest bets is to stay with the crowd as the bears tend to shy away from large groups of people. while rangers believe it was a case of a mother bear defending her cubs, they continue to investigate to rule out the possibility this was an unprovoked attack by a rogue animal. ann? no way. will people buy the book? yes. reporter: whatever casey anthony decides, there s money to be made. there s going to be a bidding war, let s not kid ourselves. $750 million on a book deal, most are saying they ll take her. reporter: it s called the biggest courtroom shockers since o.j. simpson. not guilty. reporter: he walked free and wrote a book if i did it. could casey anthony do the same? she s arguably the world s most famous woman today. everyone wants to hear what s happened, everyone wants to hear from her. if she admits it, it s double jeopardy, it s over. reporter: casey gave a hint of what she might do. she wrote hundreds of pages of letters to a jailhouse friend, fellow inmate, robin adams. those letters with turned over to authorities. in one letter, casey wrote, i always wanted to adopt a baby or a child from another country. she told her friend, let s make a deal, we get pregnant together. in another letter she wrote, i need a vacation, i was thinking costa rica. she even wrote about being famous, saying men call her hot and sexy, gag me, she wrote. is this what celebrities have to deal with? right now some say casey anthony is more of a villain than a starlet in the public eye where she goes from here is all up to her. casey anthony will never be able to sell herself as a sympathetic figure to most americans. disgusted by you, curious about you. she doesn t have to be liked or sympathetic to make money. in those jailhouse letters, casey anthony said, when she got out, she was going to get a makeover and go blond or red. she can t wait to sit on a comfy couch and watch reruns. the first movie she wants to watch, dumb and dumber. jones legal commentator. samantha guthrie is a legal consultant. how are you? good morning. savannah, what s the actual procedure? it depends on florida. but in most cases, there can be testimony. the judge is going to be considering her background, the severity of the crimes. and the judge will be able to take into account the fact that what she lied about, the fact that they re misdemeanor charges were quite serious indeed. faces up to four years. she served three years in jail. now she had a fraud conviction and she was sentenced to time served on that. i don t think the judge would apply the time served you don t get to double bill in terms of time served. while it s possible she ll be let out today, i don t think it s necessarily true she ll be let out today. that s true. what are the factors that the judge will be weighing given time served and let her go. the impact on law enforcement and the resources used on law enforcement because of her lies and the long-term effect of her lies. a child died. we ll never know what absolutely happened to that child. it was directly attributable to these lies that law enforcement was not able to accurately investigate. what about the costs? kerry sanders mentioned they ve got legal papers, the prosecution does to put her on the hook for that. does she have to reach a certain threshold on what she s trying to learn. there could be an attachment to anything she earned. you remember back all those years to the o.j. simpson civil trial what could happen is not only could there be a lawsuit to recover the costs, there could be a fine attached to the sentence today. she may get a minimal amount of time left since she s done so much in time served. a huge fine. if she s smacked with $1.5 million fine that she has to pay back, that would be attached to any future earnings. talking about o.j. simpson and she did face that wrongful death suit after the acquittal. he became a pariah that s convicted of other crimes. what did she face in that way. fame and notoriety. she seems to be heading toward notoriety. it s a different kind of justice. she appears at this moment to be one of the most hated women in america. she has no family support system to speak of. you can t imagine she s going to move home, not just because everybody would know she s there but her family relationships appear to be in tatters because of the defense strategies that were pursued accusing her father, brother, and mother. she faces a hard road ahead, the cost of investigation and prosecution. if the judge did that, he would hold a hearing later to determine how much it is. but, yeah, she could be dogged by this kind of thing for the rest of her life. star, tell me something else that was sticking out for me is that as much outrage as there may be on the part of this little girl, which is justified, the reality is this government has to prove the case. absolutely. if the government can t bring a good prosecution, it shouldn t get conviction. it happen in the simpson case, it happened here in a tough circumstantial case and it didn t do the job. our job in television or newspapers to not give people unreasonable expectationings. it s really the public s reaction to the verdict. if you listen to the juror last night, i watched that. the juror made it very clear they re not sure that this woman was even involved in their that baby s disappearance and death. that said to you, the prosecution s statement was wholly rejected. not just well, maybe we didn t tie all of the knots. they rejected the prosecution theory. could you, on a legal matter, she talked about the jailhouse letters she wanted to adopt, she may want to be a parent. is there anything legally that makes that a difficult road for her? this is disgusting, disgraceful, it could become endemic. it s not just one newspaper group. they ve all been at it. so appalled, murder victims, terrorist victims who had their phones tapped is quite disgraceful. it reached the top of the government over recent allegations and convictions of cell phone hacking in 2005 involving celebrities and the royal house hold. sienna miller was a victim, and hugh grant. the popular targets of the news of the world hacking was kate middleton, mick jagger, eric clap ton, now perhaps a new low, police suspect that the paper hacked into the voice mail of 13-year-old millie dower whose abduction and murder horrified britain in 2002 while she was still missing. now it gives her family false hope she was still alive. there are no words to describe how awful this was. it may attempted to tap phones close to the family of madeline mccann. and the terrorist bombings, those families are learning they may have been hacked. we were in a dark place. they cannot be allowed to get away with what they ve done. the prosecution of the paper and the top executives. rupert murdoch is calling the allegations deplorabldeplorable unacceptable, and it will again cooperate with the police. the reporter who served time released a statement saying there was relentless pressure, a aa constant demand for results. for an outraged british public, there is simply no excuse. interestingly enough, in america, we don t have this kind of journalism yet. hopefully the american taste level is still such that it agrees this is just a bridge too far. it s that check and balance on everything else, then the very fabric of our democracy could be put at risk. several big advertisers are pulling out of the newspaper. along come more allegations that the paper may have paid police for information. ann? what s causing older women to have this problem and where can they go for help? a mother of two will share her story coming up. also, it feels like the right time of year to plan a vacation. we ll give you advice this morning. travel and leisure s new list of the best in travel. and the top airlines to get you there. got it all covered. we both need a vacation. we re going to work on that. before we get to anything, though. let s get a check of the news. natalie is at the newsdesk this morning. good morning, natalie. good morning, ann, david. good morning again, everyone. a florida judge sentences casey anthony for lying to police. on tuesday, a jury found anthony not guilty of murdering her 2-year-old daughter, caylee. anthony faces four years in prison, but the attorney wants her sentence to time already served and released. president obama is meeting with congressional leaders at the white house today hoping to break a budget stalemate. the republicans refused to raise the nation s borrowing limit, unless democrats agreed to deep spending cuts. treasury secretary geithner has warned that the u.s. will start to default on debt payments next month unless there s an agreement. u.s. homeland security is now investigating a possible new terrorism technique being developed by al qaeda. nbc s justice correspondent pete williams joins us now from washington. pete, good morning. nothing here to indicate a plot in the works. officials picked up intelligence indicating terrorists overseas are talking about trying this as a way to smuggle a bomb on to a plane. the u.s. has notified overseas airlines and airports that al qaeda terrorists in yemen are talking about it as a way to evade airport security. there s been recent information that indicates the terrorists interest in using this kind of technique, to defeat on multiple layers of defense. terrorists onboard a plane would inject a chemical detonator to the part of the body where the device is planted telling screeners they had to carry a syringe because they had surgery or they can use a radio detonator set off by cell phone. it would not be easy to carry out such a plan. you don t know how the explosive would react in the body, how the impact would be in effect because of the body. and you don t know what effect it would have on the individual other than being in the body. not a lot of testing you can do in advance. reporter: even so, airports overseas with flights to the u.s. have been urged to increase security with physical patdowns, checks of chemicals, more extensive questioning of their reasons for travel and use of small body scanners in the small number of airports that have them. officials say there s no single screening technology that could pick up an implants explosive, so they re depending on the combination of security checks in place at airports now, natalie? investigators say they found evidence inside fujit a s house, blood on the floor of his garage near bungee cords, bloody clothes and sneakers stuff in a crawl space, along with dirt matching the marshy area where lauren s body was discovered. in court, he pled not guilty as the prosecutors laid out the crime. a very strong case of premeditated murder, and potentially extreme atrocity and cruelty. at one point, lauren and her accused killer was so close. in your life she interviewed his father for a school project posted on youtube. a life so full of promise cut so short while another may be falling apart. yes, my daughter is gone. but fornate nate s family, ther tremendous loss too. it s going to go on for a long time. fujita is in jail this morning held without bail. police still don t have a motive they don t know what made him snap. fujita s lawyer declined to comment because of respect for her family. good morning to both of you. good morning. let me start with both of you. what do we know at this point about nathanael fujita? we don t know anything. we haven t heard anyone speaking about him or his relationship with lauren. it s about power of control. it s not so much of a dating violence, relationship violence. if this had been a couple that was a little older, we might have seen this happen in a family where a woman is divorcing her husband and she ends up murdered. what is that control dynamic that is somehow unique. well, what we re talking about is a personality disorder. somebody who it s a level of psychopathy, borderline personality disorder, everything is about you, not about the other person. a real ego problem. so when somebody turns you down, walks away, you re not ready for that, you cannot take that hit to your ego. and unportnafortunately, this w probably seen before. this just did not pop up. it s been a three-year relationship. he exerted more and more power. for what i want to warn young women, does the young man respect you, does he care about your feelings. does he let you make decisions on your own or is it about him. if you decide you don t want to cater to him anymore, he cannot take that. you hear something about this. it s so awesome. a part of what makes it awful is we re talking about teenagers, new at love, immature, when does it cross over to become the path we re describing. it s about violence. we all have the potential to commit a violent act. was he depressed. did he have a previous history or thought about suicide, personality factors, i believe, with the control impulsiveness, he s a teenager, teenage brains are impulsive and don t have enough emotional and behavior control until sometimes the age of 25 and social situational factors. if they had broken up or she had left him, it could have been a rage and he snapped. you ll hear in this case which happens to be true, no criminal record by fujita. star athlete and all of the rest. that leads you to this question where is this coming from? i wanted to. i was ready. i m 41 years old. and it was just time. i was tired. a cascade of traumatic events in mid life is a trigger for women with eating disorders in women over 30. i didn t realize i still had a eating disorder. a recently divorced mom of two and struggling small business owner, eating or not eating was the one thing she could control. i was losing hair, my gums were bleeding, broken bones, lost the period for three years. i didn t care. what mattered was the scale. the body you have now, do you like it? i m learned to. learning in treatment three days a week in the treatment center. i m excited i m getting my hunger cues back. she designed a program specifically for women over 35 plus. after seeing an increase of 42% in patients that age. they re more sensitive to these sorts of issues and more likely to ask a woman who s older what s going on with your eating or you look like you ve lost weight or i m worried about you. 51-year-old colleen tried to meet her mid life anorexia but she s here to decide if she needs to be hospitalized again. i have a daughter who s older. she s 19. so there s a definite she s more aware. so that makes it hard. the stakes are high. the medical complications of eating disorders get more severe over time. and as they interface with the aging body, we have more to worry about as clinicians who are concerned about these folks. experts say, it can be a lifelong journey back to health. and for carrie, it s one day at a time. what do you want other women to know. that recovery is possible and that it s so much better than living with the disease. dr. nancy and carrie are joining us this morning. good morning. hi. carrie, your daughter called you on it? my daughter called me on it. we were talking about it during the segment one time she looked at me and she said, mom, you have a eating disorder. i looked at her, i said you re 10 years old, how do you know what that is? and it hit me, i m emulating it for her. your love of her helped to change. yes. you also had a eating disorder when you were younger in school. absolutely. nancy, how often when we have the eating disorders when we re younger, do we have them when we re older. you talk to someone in her 20s she battled this, she would say, i deal with it every day, i think about it every day. it not something where one day, boom, you ve taken the antibiotics and you re cured. it s in your brain and you have to push it back. i think the mid life issues, the divorce, losing a child, some trigger is about control. the heart of most eating disorders is this need to control and the rest of your world is chaotic. what explains, then, knowing that why we ve seen this steep increase? well, one thing we re in suspense about is whether or not there will be witnesses at this sentencing hearing, whether the lawyers will simply make their arguments. judge perry has the option to sentence her to up to four years in prison, that s one year for each count of making a false statement to police. as you mentioned, david, she has already served nearly three years in jail. but subtract from that that she was convicted, pleaded guilty to some check fraud charges sentenced to time served for that in january of 2010. so the clock is really ticking from january of 2010 on her time served. so i calculated about 18 months or so that she could be credited with. so i don t think it s all together certain that she walks out of prison today. and the judge can take into account the subject matter. what she lied about. this is a misdemeanor count. it s a first degree misdemeanor. she lied about something as serious as you can get. the scene outside of the courtroom. and people will find because this case has generated so much emotion. so i wonder, having watched this judge over the course of this trial and some have said that they favored one side versus the other, what do you think he might is likely to be thinking about today. he s a tough judge. sentence remember the young man sentenced to six days in jail and as judge perry put it $400 in a fine because he flipped the bird to one of the participants. he believes in decorum and procedure. and i can see he might want to do a consecutive sentence based on the fact that the basics of her liying to law enforcement my be the reason we ll never know what happened to baby caylee. kerry sanders have been covering this story from the beginning. one aspect you reported on earlier today is the costs associated for the search because of anthony s lies and the prosecution would like to recoup that money. they have a state law on their side. it s not been employed very often. the cost of the investigation of the prosecution exceeds a million dollars. and we assumed, a tremendous amount of time among the sheriff s department here, the fbi, experts from around the world, and then, of course, the prosecuting team jeff ashton and linda drain verdict who have worked exclusively on this case. the costs are tremendous. the state law allows and the motion has been filed to essentially tax directly to casey anthony to recoup some of the costs. this is a girl who had no visible sort of source of income beginning at the earliest stages of this case, but coming out, she may find that she has value and as we see the judge is coming to the courtroom. so let s go there. okay. case number 2008-06-state of florida versus casey marie anthony. okay, let the record reflect that the defendant is present along with counsel for the defendant, the state attorney. both sides ready to proceed? yes, sir. i believe so, your honor. mr. mason, before we proceed to sentencing, mr. baez, you had asked me to reserve ruling on your motion for mistrial? yes, your honor. okay. that takes care of that. the defendant, casey anthony is before the court for sentencing on counts four, five, and six providing false information to a law enforcement officer. mr. baez, do you know of any legal cause why we should not proceed to sentencing at this time, sir? four, five, six, and seven, your honor. and seven. the only legal cause that we have would be the previously filed no other cause you couldn t proceed to sentencing. would the state care at this time to present any matters relative toing ing aggravation? not on that issue, your honor, no. state care to present any issues at this time concerning any other matter? your honor, yesterday i filed a motion to tax special cost of investigation and prosecution and to reserve jurisdiction. the only reason i would bring it up prior to the actual sentencing has to do with the jurisdiction of the court once sentence is imposed, if defense counsel intends to appeal, the misdemeanor conviction, then this court would not be able to entertain a later hearing until that matter is resolved as it relates to cost of the investigation. if, in fact, that is their intent, what we would ask is that the court bifurcate the sentencing hearing proceeding to the matters of punishment first, the issue of cost of investigation is not intended to be punitive. and i believe can be handled at a later point in time in a bifurcated type of proceeding that would not divest the court of immediate jurisdiction to handle this matter so that this can be closed as expeditiously as possible. that s the only thing i wanted to bring up at this time. mr. baez? mr. mason? i do not object to the bifurcated process but have not presented invoices or any accounting as of yet that we will be reviewing and challenging as appropriate. so she asked for 60 days and i have no problem with that. okay. the court will retain jurisdiction to deal with the issue of cost of prosecution and another cost, i guess, pursuant to chapter 938. that s the statute that you ll seek in those costs. it is, your honor. okay. mr. mason, litigation? you may proceed, sir. we ask however a legal argument for double jeopardy. go ahead. all right. may it please the court. good morning. good morning, your honor. the first sentencing we respectfully request the court to address the violation of double jeopardy issue with respect to counts five, six, and seven because all four statements arose in the july 16 interview between the detective and ms. anthony, all four counts of providing false information were one continuous criminal act with a single intent. as such, each false statement separately charged violates double jeopardy and must be reduced to one conviction based on one oh kurin course of condu. hamilton state, 6:34, that s the florida second dca case from 2006, the defendant was convicted of 15 counts of using a computer to seduce a child. at issue was whether counts five and six among other things arose from a single criminal episode. they articulated the test to determine whether the offenses arose from a single criminal episode. in that test, the court articulated that let me stop you for a second yes, your honor. i don t seem to have the benefit of what you said you provided the court. i apologize, your honor. i gave that to the clerk and i should have instructed that you needed to have that. okay. okay, go ahead. thank you, your honor. this test requires a court to look to whether there was a separation of time, place, or circumstances between the crimes because the factors are objective criteria, utilized to determine whether there are distinct and independent criminal acts, or whether there s one continuous criminal act with a single criminal intent. the court went on to say that the facial and temporal aspects of the crime, looking at that criteria, a court can ascertain whether the defendant has time to pause, reflect, or form a new criminal intent between the occurrences. your honor, in finding that counts five and six in the hamel case were a violation of double jeopardy, the court pointed to the fact that there was no temporal break in the conversation or change in circumstances to warrant separate charges with the conversation in question spans several hours. similar, your honor, the false statements ms. anthony made to the detective occurred in the course of a single interview on july 16, 2008. the interview was one continuous conversation and similarly, there were no temporal breaks or other objective criteria that would suggest that the defendant had time to pause, reflect, and reflect a new criminal intent as required so as not to run afoul of double jeopardy. we provided the court with two other cases, the case that is 5.11 southern second 401 out of the fifth dca. that s a 1987 case and we provided the court with burkeview case. that s a 1985 case. it s our assertion that the hamel case is similar in that it touches on the temporal aspects that are present in this case. however, the decision the double jeopardy was envoked when the defendant was convicted of five incidents of leaving one scene because there were five people in particular who were left at the scene of an accident. burke, on the other hand, is a case that invoked the double jeopardy where there were three convictions of a defendant based on one transaction of three altered bills and those con vices were charged separately, however, they were found to be one act, double jeopardy was violated in this case. your honor, in order to avoid a legal sentence, we respectfully request that the court sentence ms. anthony for one occurrence, one count of providing false information to a law enforcement officer. we reassert that there s an issue of materiality in these charges and should be read into the statute as legislative intent. thank you very much. just a second. let s look at count four. yes, sir. yes, your honor. of providing false information to a law enforcement officer? yes, sir. specifically, what is alleged in count four? could want four alleges specifically that on the 16th day of july, 2008 of that in violation of the statute 837.055, there was a knowing and willful violation giving false information to yuri melic, a law enforcement officer. that specific allegation was that casey marie anthony suggested she was employed at universal studios. however, it arose during the july 16, 2008 interview, as the every other charge, your honor. as a result of her telling the police that she was employed at universal studios, did the police have to take any resulting action with their investigation? they certainly did, however, however, if we were to charge her, we have to charge her for the crime and the crime here arose out of all four incidents were a part of this same continuing act, even though there were several false statements. count five alleges she violated that statute by doing what? that during that same interview on the 16th of july that ms. anthony identified the person as zanaida fernandez gonzalez and suggested to the detective that she left her child with this woman. and did that require a separate and distinct act on behalf of law enforcement to investigate? it did, your honor, however i would assert that the reaction based on the violation isn t how we measure this. how we measure if there was one instance, one particular criminal act that wasn t broken up temporally, we look not at the resulting conduct of the police department, what we look at is the conduct of ms. anthony and the temporal aspects of her statements as required under this hamel decision. and count six? yes, your honor? what was she alleged to have done in count six? during the same interview on the 16th, which detective melic on the 16th day of july, 2008, the allegation and the conviction is based on ms. anthony informing detective melic that she identified a jeffrey michael hawkens and juliet lewis and told them of the disappearance of her child. we assert there s a materiality issue related to this particular charge and assert this is out of the same instance of conduct. and count seven? count seven, your honor. this is the same interview we ve been discussing with the detective and this allegation is based on ms. anthony asserting that she received a phone call from caylee marie anthony. just a second since you just provided these cases yes, sir. to me. let me read them right quick and see if i have any additional questions. yes, sir. before i hear from the state of florida. so, explain exactly what we re seeing the judge have to decide. the judge heard an argument from the defense attorney because all four of the lies in which casey anthony was convicted came out of the same police interview on july 16, 2008, it s the same transaction. and that for her to be charged and sentenced and convicted on four different counts on the police interview violates the double jeopardy clause in our constitution that says a person can t be tried twice for the same crime. the judge wants to read some of the legal cases that she cited to make sure that whatever he does is consistent with the precedent. he doesn t want to sentence her and see that conviction or sentence overturned by a higher court. you can see what the purpose is. the defense attorney wants to diminish the ability of the judge to sentence her consecutively. so, instead of her facing a total of four years, she d be facing one year. as you look at the four instances that she was employed from where she wasn t that the zanny the nanny existed, that she told two people of the abduction, and there was a false phone call from caylee, the judge asked questions to elicit information on what the law enforcement had to do as a result of each one of those lies. if law enforcement had to respond differently for each one of the lies, there were ramifications for separate lies. that s the argument that would be made for consecutive sentencing. one of the things that we heard separately before the judge decided to read the opinions was this business of the cost. the next question. we ll listen to the judge. are you saying that ms. anthony did not have time to pause, reflect, and form a new intent for each of those four separate acts? yes, your honor. as the test is articulated under the hamel decision, there has to be some separation of time, place, or circumstances. in this, there was one single interview. you can t say there s a time or place in the time required to not invoke double jeopardy. thank you. thank you, your honor. response from the state of florida? like the court, i was only provided with this motion this morning. i believe under their case law as well as case law under the state supreme court specifically valdez i did not bring copies of found 10.67, the florida supreme court 37- 37 third 1068 67 florida supreme court and anderson, 1032, 309. these are not the these are not single acts. these are different core conduct. it s our condition that there is a temporal break between each of the lies. and there are several, not just the ones charged, but that these lies occurred over the course of three separate statements. the fact they all occurred on july 16, 2008 should be of no consequence. the court through the course of pretrial hearings as well as the trial knows that ms. anthony gave statements at approximately 1:00 a.m., 4:00 a.m., and 1:00 p.m. on july 16 of 2008. each of the lies are material to the issues that were investigated by the sheriff s office. as a result of the lies, each were intended to mislead law enforcement and send them, as ms. anthony herself at the end of the final statement indicated, on a wild goose chase. they are not degree variance of the same crime and are not a single criminal act. most of the time when we re not dealing with multiple punishments for a single act, what we re dealing with whether or not a single act can be broken up to episodes. we typically see this in sexual battery cases where there are multiple sex acts performed on a single victim at the same time. and then the issue is whether or not there is a break between the various types of penetrations in those cases sufficient to convict for separate acts and indeed the case law suggests that there is a sufficient break where an individual does have the time to pause and reflect as the court has already inquired. given the fact that there were multiple statements over the course of 12 hours, it is the conditi position of the state of florida that these separate acts as separately alleged do not violate double jeopardy. okay. that was 37, third edition, what page? 1067. i do have a copy. this is the situation where an individual was charged with two different counts for one act of shooting. would the court like my copy? i want to, as we re waiting for this, ask the question that you were thinking about, david, the other discussion that s on the table, the discussion about the recouping of prosecution fees. where does the discussion so far that we ve heard leave us? the the prosecution wanted to make sure that the court could finish the punishment phase of the trial and not deal with the motion to recoup costs. if, in fact, there s going to be additional argument on that, whether or not it actually will impact it, it s going to be a fine, if you will, that will be leveed as a part of any punishment. they ve not gotten the invoices. there s a whole lot of information that is required before the court could rule on that motion. there isn t anything to preclude her from going off once she is released later today from getting a book deal, a movie deal. making money, essentially, after this case. there are laws for a convicted criminal defendant that would prohibit that person from profiting from the crime. but she in the eyes of the law is not guilty. she s got the convictions on the line for lying to police officers, the misdemeanor. it seems she can make money from it. but there will be plenty of people trying to seek to get that money back from her. by the way, she s indigent at the moment. but this statute the prosecutors are invoking here to recoup the costs of investigation said specifically these costs can be leveed on a criminal defendant notwithstanding their ability to pay. what we re seeing here, the judges are viewing a citation by the state, a press dept. we re in the legal thicket here which is about whether or not she can be sentenced on the four counts, whether it can be effectively rolled into one. whether she was premeditated for each count of lying in the course of one interview? that s right. the issue is did this interview with the police on july 16, 2008, constitute one transaction such that it s unfair to be charged, convicted, and sentenced on four counts. this is central to the proceeding we re watching today. if the judge determines no, the stand, he can potentially sentence her to a maximum of up to four years, one year maximum sentence on each count to be served consecutively. this is just a style question, i suppose. the judge is doing this realtime. i mean, he is he s deliberating and thinking in the presence of the courtroom and the attorneys here looking at these citations, not taking this under advisement as of yet. it looks like he s ready to move on. he wants to move on, but he doesn t want to open himself up to an appealable issue as it relates to a sentence. the real basic friendly statement on this is if one lie or is it four lies? if it s one lie, if he decides to go with the one lie idea, does it preclude more jail time? yes, she s definitely served in excess of a year. would you agree with that? the one year would be the maximum sentence and by any calculation of time served, she s served more than that. this essential. this is the difference whether she will have to walk free today or whether the judge can sentence her more time. i understand we have from burbank. let s listen to what the judge is saying. mr. mason, mr. baez, anything else you would like to say prior to the court imposing sentence? no, sir. does your client wish to say anything prior to the court imposing sentence? no, your honor. the court will make the following finding concerning the defense motion to bar imposition of sentence on these four distinct counts as violating double jeopardy. count four of the indictment alleged providing false information to a law enforcement officer basically dealt with the followi following conduct. it is alleged that the defendant was employed at universal studios in the year 2008. this information was given pursuant to an investigation for a missing persons report. that information caused law enforcement in following up on that statement to go to the universal studios to expend law enforcement resources to determine that, in fact, ms. anthony did not in fact work at universal studios. count five ms. anthony informed the authorities that she had left her child, caylee marie anthony, at the sawgrass apartments with a babysitter which caused law enforcement again as a result of a missing persons report to develop and follow various leads trying to locate this babysitter commonly known as zanny. count six again, dealt with the fact that she had informed two, quote, employees of universal studios, jeff hopkins and juliette lewis of the disappearance of caylee marie anthony. count seven indicated to law enforcement that she had received a call and spoke to caylee marie anthony on july 15, 2008 at approximately 12:00 p.m. thus causing law enforcement to devote extensive resources. as a result of those four separate and distinct lies, law enforcement expended a great deal of time, energy, and manpower looking for young caylee marie anthony. this search for her went on from july through december over several months trying to find caylee marie anthony four distinct separate lies. just as the jury spoke loud and clear on counts one, two, and three by their verdict, they also spoke loud and clear as to the remaining counts four, five, six, and seven. there being no legal cause shown why this court should not impose sentence and the court having previously adjudged you to be guilty of the crimes contained in counts four, five, six, and seven, i will sentence you to one year in the orange county jail, imposing a $1,000 fine on each count, all four counts to run consecutive to each other giving you credit for the time that you have previously served. mr. baez, mr. mason, we re going to spend some time this morning figuring out her credit for time served. and is going to take us probably about an hour to sort of sort it out because the previous sentences that she has been giv given, but with the good time and yang time, depending on the preliminary figures, sometime early august, maybe late july. but i can t say that until after i first determine time served and then the jail has to apply according to their figures the good time that she has gained in th this. so if you want to wait around or we can communicate that with you and if you have a different figure, then we can get that taken care of. i will reserve jurisdiction for 60 days to determine the cost of prosecution and investigation. tell me when you ll be ready? i have advised a minimum of 30, so any time after that would be acceptable. mr. mason? i have some time when they get around to providing and gathering their invoices so we can check the validity of those and essentially conduct an audit on it, so at least 30 days, depends on when she gets it to me. if she gets it to me on the 29th day, that s not going to be good. i believe i would not do that, mr. mason. they have indicated they can have all of the documentation within the time frame that i suggested. and then that should give mr. mason ample time to review the validity of the affidavits of the sheriff s office. well i ll need i m trying to give you a date now. the week of august 15, i will not be around. the week of the 22nd, i m involved in an evidentiary hearing on a 3851 case that s supposed to last three days. i have some time on the 25th and the 26th. depending how long you need, i can fit you in on the week of the 29th, but i would have to fit you in because i unfortunately am going to have to take over judge adam s division since he s leaving at the end of the month. again, the week of august first, i have to fit you in to that division s regular work. the week of august 9, the same proviso. except that friday. the judge belvin perry. she will not go home today. the question is how long she will stay in jail. she is now going to have to serve consecutively for all four of these counts. but ultimately, what does that mean? bottom line is, this judge maxed her out. he gave her the maximum penalty permitted by law. he said top amount of one year on each count to be served consecutively. however, he will give her credit for time served. now, it s unclear, apparently, even to the judge, how long she ll remain in jail because he s not sure how much credit for time served to give her. he has to calculate good time behavior. in florida, they serve 85% of a sentence. it s referred to game time behavior, i m not sure what that is for the state to say. can we back up one step. the four separate and distinct lies. we watched that for the better part of a half hour. the judge said, look, every time she lied in one interview, it sent them on a goose chase, it cost money and time. it s what the state wants to recoup some of the money lost because of that investigation. it have a long-term impact on the second part of this, which is the bifurcated hearing on the motion. it was established that law enforcement had to go to extreme measures on multiple occasions because of the multiple layers of lies. that will be helpful to it was clear that the that her attorney, casey anthony s attorney was having to explain to her that she was not going to go and look of disappointment. but what i m understanding is she could still be free based on the mathematical calculations in a matter of weeks. late july, early august. not going to be any longer than that. the court came in with the mindset of how many days she had left. but they don t know what the department of corrections have calculated. we look add casey anthony s case and no doubt, she understands, savannah, this is being carried nationally. her advisors and her lawyers have advised her of that. she looks withdrawn, for sure. but she was acquitted and now may not completely understand, but it could amount to a matter of weeks before she s actually free. it s true. but don t you think we ve seen a total change in demeanor since she first let down, literally let her hair down for the occasion today, looking chipper and chatting and smiling with her attorneys and now it s donning on her that she will not be released from prison today. i think the judge indicated he thought based on his own calculation, she could be out as early as july or late august. but because of the florida statute, they have to calculate how much good time she s served. a month, that s it. you thought she was going to go home. she was dressed to go home. the hair is down for the first time. she s got a much more casual look for her. a little bit of makeup on the cheeks, a little bit of lipstick. she thought she was going to go home. looking at some of the shots that we saw just recently, george and cindy, her parents, stone faced, watching all of this. raises the question of what home is after all of what has happen in this trial in the course of this defense strategy ultimately for the successful defense strategy. she accused her father of molestation, accused him of covering up an accidental death. suggested the mother was responsible for the accidental drowning and her brother molested her. there is a lot of damage here to say nothing but the loss of that little girl. i would not be surprised if she s welcomed back to that family. why do you say that? [ male announcer ] hey, there s oreo creme under that fudge! oreo fudge cremes. indescribably good. we re back now with more of the sentencing of casey anthony. we re joined by savannah guthrie and legal commentator, star jones as well now as the prosecutor, the lead prosecutor in the o.j. simpson trial, marcia clark, author of guilt by association. thank you so much for joining us. i wonder watching the events this morning unfold what perspective your experience of the o.j. simpson trial might give us this morning. well, in this case, of course, casey anthony was convicted of misdemeanor counts. but we re considering this largely a loss. the count was the homicide count. when i heard the verdict, i was shocked, completely stunned, and this one did take me completely by surprise after all of this time, you think i couldn t be surprised by anything, but this did it. i really did think she would be convicted of some kind of homicide count, not necessarily first degree, but some homicide account. not to overdue the simpson case, it s a reminder of the test that every government faces, every prosecutor faces in a tough circumstantial case, you ve got a high bar, it s that the jury is heart sick by the decision. they can t get to the extra place believing that she killed her, even though a lot of things look bad. that s true, david, and beyond a reasonable doubt is a high standard. i do believe the prosecutors met that standard. it s a circumstantial case, but i remind you most of the cases we file are. circumstantial cases are stronger than direct evidence cases. such as an eyewitness saying i saw this guy rob that guy. by the time the defense attorney gets done asking about the lighting conditions, how far away, where he stood, was he wearing a gun, were you wearing glasses, you no longer believe a robbery occurred let alone this guy did it. with this case, you have many different pieces of evidence that have to be taken together as a fabric. if you analyze each piece separately, take it apart, you can dismiss each piece separately. the problem is in the aggregate, all of the key pieces together show the guilt. the lies, the duct tape over the mouth, the smell of the decomposing body in the car. the fact that the body was dumped minutes away from the house, the chloroform search, if you put it together in the course of 31 days of lives, you have a compelling circumstantial case. that said, how do you think, marsha, this would influence the possibility that many people are taking about casey anthony stands to make a considerable amount of money from book deals, movie deals, and other sources. what s your take on this? well, that is the talk now. i m not so sure about that. i have to say, i ve given it some thought. the public outcry in this case is fairly uniform. she does not have a big supportive crowd out there. there are some out there who believe that she was not proven guilty, that the case was too weak. but these cases are not rabid casey anthony fans either. and i don t know if you heard about this, but a pornography company apparently offered her a spot on a video and has now since rescinded that offer in view of public outcry about this not guilty verdict. the publishers have their fingers on the point as well and look at the fact that perhaps people in large part are going to vote by not buying anything that she puts out. there will be a few that are interested and have a macabre interest in what she might say. but let me remind everybody everybody interested in this book, it s highly unlikely, this is one of the times you can say never, she s not going to say you might want to hear. she s not going to confess, she s not going to make startling revelations worth buying her book. i would say she s not going to make a great deal of money. kerry sanders in florida, in orlando. he s covered this from the beginning. i wonder again on a point that we discussed a couple of times this morning, the judge sounded pretty sympathetic to the state this morning with regard to their attempt to recoup some of the costs related to the lies that led to a goose chase on the part of investigators going after this investigation? well, remember, the judge here is an elected judge. and so he is well aware of his standing in the community. and the taxpayers are already complaining even before the verdict here about how expensive this trial and this investigation was. it has not been calculated, but we know it s in the millions. the the church group that came in here, texas equusearch calculated it cost them more than $100,000 to coordinate the volunteers in the community when it feels believed that caylee was perhaps alive and somewhere in the community. the costs are going to be a big issue. and i think what s interesting is you talk about that offer made to casey, what they re attempting to do is put everything in motion and in place so that if she begins to make money from her notoriety, that they ll be able to get some of that money. casey anthony has been hit by the irs by a tax lien of $68,000. that is because she didn t pay the taxes that she owed on what we believe is a $200,000 payment that was made to her and her attorney by abc news when this first broke in trying to get some sort of interview or something like that. and so there has been already some substantial amounts of money that have been paid. and so it has been discussed in terms of just media experts weighing in. there could even be the possibility of some sort of lebron james event where she answered questions or a pay-per-view. there s a lot of ideas floating around there. what we re looking at right now are just across the street from where i am right now, right across from where members of the community who gathered out here. 75 our 100 of them, one of them asked as the sentence was announced took some duct tape and put it across their mouth in silent protest. it s a double meaning. that s the duct tape that the prosecution said was used to kill little caylee. terrific intper spesktive. there s going to be a lot of emotions in this case. this is just the beginning. we ll be back with much more, this is today on nbc. people with a lot of emotion. a lot of passion and a lot of questions about when she s released ultimately, what she ll face as well. we ll address that. much more coming up. but first, your local news. 9:56 is your time. 28 degrees. starting to heat up. tom will have the summer forecast after the news. i m eun yang. thursday, july 7, 2011. police on the scene of a deadly pedestrian accident in landover in prince george s county. a woman killed walking across landover road around 5:30. the driver did stay on the scene. metro s board of directors will get a detailed report on repair efforts on broken escalators. right now more than 100 of metro s 588 escalators system wide are working. time to get a check on the forecast. meteorologist tom kiernan is in the storm center. hot and humid, later today low and mid 90s. now near 80. we have a likelihood of scattered afternoon and evening storms. and some of them could produce brief heavy downpours that could cause flooding. that s the story for friday and friday night. over the weekend, let s humid. the sunshine returns with highs near 90. first part of next week, humidity returns into the 90s on monday. could get storms tuesday. lower humidity back wednesday, thursday, highs in the 80s. how s the late morning traffic? the math? they could have done that math. i found it surprising watching it. she is sitting at the table and she looks incredibly disappointed that she wasn t getting out then and there. i found it surpriseding given what the penalty could have been on the more serious crimes. it was a death penalty case and now it s weeks or months or days. i said somebody please say what does home mean. the question is, what is home for her now they are putting her in a safe location. therefore more resources from the state are going to be used to protect her even though she is found not guilty. the prosecution and the state wants some money back for going on the wild goose chases and want casey anthony to have to pay for the lies she told. there should be accountability for that. the judge said he will decide that later as well. they are trying to pick days and stuff. i find the whole thing interesting. i m curious. so many people were upset with the jurors and questioning their intelligence, but there was one juror, juror number three spoke to the media. she changed a lot of people s ideas because she was very articulate and believable. what were the jurors thinking? we were saying this woman finally said it out loud. she made some sense. she did. let s listen. how did she die? if you are going to charge somebody with murder, don t you have to know how they killed someone or where, when, why, how? she said they sobbed because they knew in their minds many thought we are letting a guilty person go free. according to the letter of the law here s the thing. if i was a juror, i think and i wasn t, but from what i sense from it, there was within a shadow of a reasonable doubt, i think if you add up the details, it was reasonable doubt. even though it was circumstantial, every bit added up that she killed her daughter, but great system that we have. stack it up against anybody else s. i see the point. we don t know when and how she died. they agree on the day she died. in terms of cause of death and put casey anthony with her daughter. i don t believe she was drowned, hoda. you don t have the cause of death. they don t know how she died. anyway, that s the end of that saga. now we are going to see i like this judge. you may have gotten off the hook, but you are responsible for stuff and you are going to pay for it. the son of sam law which means if you are convicted of crimes, you can t profit from them. she was found not guilty. people should be held accountable. the state of florida is close to being bankrupt. whatever she makes for services, it should be paid back to the taxpayers. you got it. you and me are headed on a couple of planes we re got stuff to do. we are busy. we are going to fly to l.a. for jay leno. can t the man get anybody else on the show? divide them up and make it clear what is to be done is he going to die when he sees a list of things to do? that s a great police to start. when he sees the list. how do you think about approaching your husband? your toilet paper shouldn t be too soft. we re out of toilet paper again. fortunately, angel soft is an ideal balance of softness and strength. unlike other toilet paper that has just one ply, angel soft has two. and it s strong, yet gentle on your skin. angel soft an ideal balance of softness and strength . time for everyone has a story. tara and doug. tara wrote about her very brave husband. before we meet them both, let s give a listen to tara s wonderful letter. i can try to explain what it s like to be lucky enough to meet your hero. i am lucky enough to be married to mine. i met doug 17 years ago and he was 32 with stage four melanoma. our family and friends made it through together. three years later, the melanoma returned and he had a tumor on his brain and spleen. he said i want to come home during christmas and during that time he proposed and i couldn t think of another man in this world i would want to spend the rest of my life with. a few years later, cancer reentered our life. this time prostate cancer he never fell into a depression or any self-pity. doug is the type of guy that everyone adores. he is the most loyal and honest man i have ever met. he is quiet, strong, and to me he is proof that angels do walk among us on earth. the odds said he wasn t going to make it. every researcher and every medical professional said to get our affairs in order, doug came through. his sense of humor answered and his spirit lifted all of us when we needed it most. he inspired so many people and continues to do so and the amazing thing is he doesn t even realize it. the reason i want to introduce you to my silent hero is to inspire others and show that attitude and love can persevere. in any situation that life throws your way. doug showed me that life-changing experiences can be speed bumps. sometimes when you need to slow down enough to appreciate the small things in life that are truly important. i have no idea what i did to deserve him as my husband, but i thank got every day he is. i wonder why we picked that letter. so good to see you here with us what a love story by the way. the love you guys share, you had only known doug for two months and heard about the diagnosis. a lot of people would run. a lot of people would. tell me your reaction. it wasn t even an option. it was something i knew. he was part of my life and needed to be there for him and i needed him to be there for me. he was just i knew then and there i was going to be with him forever. you didn t know at the time how long forever may last. it didn t matter. i needed to be with him as long as i could. none of us know. six minutes, six months, 60 years. i wanted to be there. it s hard for anyone to hear a cancer diagnosis once. the idea of hearing it twice is difficult to handle and a third time is almost unimaginable to me. how did you continue to keep your spirits up and inspire people through that? with my wife supporting me all the way and friends and family, it wasn t that hard. it was easy. i had a lot to go on. did you ever feel i know i felt scared initially. were you fearful or did you think the first time, yes. scared. the second time with the brain, i didn t have any time. i had a seizure. didn t have much time. the prostate, scared again. tell us the state of your health now? everything is clean and cancer-free right now. check ups four or five times a year you recently found out another member of your family is facing cancer. we are going it take care of that too. we do this. you mentioned he is inspiring people he doesn t even realize he is inspiring. tell us about that. for instance, his doctors said you know something, that is part of the reason we get up and do this every day. he is walking around and healthy. we know that cancer is not an automatic death sentence. you are not a statistic until the game is finished. did you tell your husband you were writing the letter?
