guests coming up at 9:30. back to you at the desk. >> thanks, tucker. new this morning, a 9-year- old maryland boy who was the subject of an amber alert has been found. >> police located sylvia garcia and her son wilbur garcia at an airport in reno, nevada. authorities believe garcia abducted her son yesterday morning. she has been arrested and wilbur is safe. overnight prince george's county police found garcia's car in our area. it was at a building in bladensburg, maryland. garcia did not have custody of wilbur. fairfax county police are looking for a man who sexually assaulted a woman while she was walking in burke wednesday night. investigators say the suspect grabbed the woman on commonwealth boulevard and dragged her into a wooded area. the man threatened the woman with a weapon and then assaulted her. so far, police only have a vague description of her attacker. the american soldier blamed for a shooting spree in afghanistan has hired a legal defense team. two military lawyers and two civilian once. clara simmons is in the studio with more. >> reporter: good morning. we're just learning as well that afghan president karzai is quote at the end of the rope with the u.s. saying the u.s. is not cooperating in the investigation with them. this situation obviously is getting really tense. and meanwhile, we're starting to get little more insight into what was happening with this soldier leading up to the shooting. the soldier's attorney says he met with the accused man and met with the family. high profile seattle attorney john henry brown says the day before the massacre, his 38- year-old client stood next to a friend as that soldier's leg was blown off. brown also says the soldier and his family were upset over a fourth unexpected deployment. >> he and the family were told that his tours in the middle east were over. and then literally overnight, changed. >> reporter: some reports alcohol or marital problems may have been involved in the slaughter that killed afghan civilians. brown dispute the claims. >> a lot of love in the marriage. a lot of love and respect. two children. and i don't have any indication that alcohol was a factor. >> reporter: the u.s. defense attorney wrapped up a day visit to the country thursday where he discussed the u.s. timetable for withdrawal for the afghan president hamid karzai. karzai told panetta he wants the forces out of rural areas immediately and a full security transfer to afghan forces should happen next year and instead of 2014. panetta made clear the u.s. has no intention of changing the plans. >> we're on the right path. i'm convinced of that. the key right now is to stick to that path. if we do anything precipitous to back away from that, i think that, in my mind, would -- could very well jeopardize our mission. now, we are also learning from the pentagon that the accused soldier will be flown to the federal prison at leven worth, kansas. the biggest maximum security prison. possibly as early as today. but defense officials say the move does not mean any formal charges will be announced soon. also, the afghan taliban cut off peace talks with the u.s. a state department spokesperson says the u.s. is prepared to continue the talks after things start to calm down and we hope they do so soon. it is becoming a very tense situation over there. >> undoubtedly. sara, thank you. north korea is announcing controversial plans to blast a satellite into space next month to mark what it says is the 100- year anniversary of the country's founder kim ill sung. but the united states says the plan launch violates a deal the u.s. has with north korea. secretary of state hillary clinton calls it, quote, highly provocative. in our other top story, the army private accused of leaking classified documents to wikileaks is charged with helping terrorists. the military had already charged bradley manning with 22 counts, including aiding the enemy. now, prosecutors say which enemy, and publicly identify it as al qaeda. meanwhile, his lawyer is asking the judge to dismiss the case because he says the government bungled the case by not turning over all documents to the defense. fox 5 has learned dc council chairman kwame brown has joined a growing list of council members that received subpoenas. a federal grand jury is investigate are investigating the relationship elected leaders may have had with jeffrey thompson, a city contractor who has contributed hundreds of thousands of dollars to local campaigns. council members phil mendleson, and jack evans and evet alexander all say they received subpoenas as well. police are working to solve a series of anti-gay hate crimes in the district. three attacks over the course of two days this week. the victims were either gay or transdepender. one of the victims was shot. one was assaulted and robbed. and the third beaten. two of them are still in the hospital recovering. police say they're committed to getting the suspects off the street. they don't believe the crimes are related. >> two metro workers accused of stealing money from fare card machines have reportedly worked out a plea deal now. court records in alexandria show plea hearings are scheduled monday for horace mcdade of bowie and john hail of woodbridge. the two men were arrested in january. prosecutors say they used the stolen coins to buy hundreds of thousands of dollars in lottery tickets. i do believe that gentleman's name is haily. >> that's what i think, too. a man involved in a horrific accident is now speaking out. he was dragged for blocks by a metro bus. his injuries were severe. >> he claims metro is to blame but says he is not getting what he deserves. fox 5 wisdom martin has the story. >> january 4, 2007. the day john evans will never forget. the day his life changed forever. >> it was a thursday. it was a real warm day. about 70, 75. >> that day, evans was on his motorcycle. riding to southeast dc to see his god brother. >> as traffic came to a standstill, a car was turning to homeland security. >> the car in front stopped and caused him to hit the car and a witness told me what happened. >> he later recognized meleing in front of the car to the -- meleing in front of the car to the right side bumper and a bus was coming around and he was able to tell that it ran him over. >> he was underneath a metro bus and trapped and dragged for five blocks. >> he tried to stop the bus. >> evans was rushed to prince george's hospital and later a hospital in baltimore. he barely survived but the damage to his body, his entire genital area had to be reconstructed. >> i wore a colostomy bag for three years. >> severe nerve damage in his leg. knee and foot damage. doctors initially wanted to amputate his leg from the knee down but managed to save him. >> you land in the hospital bed, you're crying because of the pain. >> he sued metro, after years of pain and suffering and litigation, last summer, metro offered him a settlement. the amount? $250,000. >> i didn't take the money because $250,000, you know, my medical bills, like i said, are lose to a million dollars. how do i pay a million dollars back? >> evans still has a jacket and boot he was wearing that night as a reminder of how close he came to death. meanwhile, he has filed paperwork to take metro back to court. >> i'm hoping that maybe they will come forward and say hey, we recognize that we did make an error. and it is a thing that if you didn't hurt me, why would you offer me $250,000? >> john evans is also looking for a new attorney. metro says they can't comment on pending litigation. we will let you know what happens next. a birth control debate in arizona. women in that state who want to be reimbursed for contraceptive drugs through their health plans may soon have to prove that they're taking it for anything but preventing pregnancy. for example, proof of a medical reason, such as acne. a bill nearing passage would allow all employers to opt out of providing birth control coverage for religious or moral reasons. in the race for the republican nomination, rick santorum is campaigning in puerto rico, ahead of sunday's primary contest there. meanwhile, many experts suggest time is running out on newt gingrich's campaign. he is hoping for a win in louisiana's primary. scheduled for a week from tomorrow. but mitt romney leads in the latest polls, ahead of the big illinois primary. set for next tuesday. and president obama's campaign is releasing a 17 minute mini documentary, touting the president as a determined figure who confronted the economic downturn. the road least traveled is narrated by tom hanks and describes how the president handled a series of crises with tough decisions. the documentary was made by davis guggenheim who directed the al gore movie about global warming called an inconvenient truth. coming up, strong storms ripped through michigan. we will take a look at ya know? cancel the gym membership. bring on the pork chops and the hot fudge. fantastic. are you done sweetie? yea [ male announcer ] fiber beyond recognition. fiber one. making headlines this morning. crews will examine damage in michigan today. where severe storms damaged more than 100 homes and destroyed 13. there are reports of at least three tornadoes. fortunately, no serious injuries were reported. the federal government says starting this fall, schools do not have to give kids so-called pink slime for lunch. it is letting them opt out of the filler that the meat industry calls lean finely textured beef. there has been a lot of it in meat but not necessarily on the label and contains ammonia but experts say it is not a matter of safety. >> the question isn't necessarily of safety. it is more of nutrition. and what you want to have in your food. if you're making something for yourself in your kitchen, you're not going to use ammonium chloride gas to prepare your food. you're just not. >> the meat industry experts say the only way to know for sure if pink slime is in the meat you're buying is to ask the grocer or spend more money for organic. you will soon be able to donate your hotel reward points to wounded veterans and their relatives. today the maryland senator ben cardin and congressman dutch rupersberger will announce the first partners for the hotels for heroes program. national hotel changes marriott and wyndham and americinn have agreed to participate. they are calling on the rest of the hotel industry to join the program by memorial day. check out the latest pain at the pump. the national average for a gallon of regular is $3.82. but in dc, we're paying about $4.03. in maryland, it is $3.85. in virginia, it is $3.73. it is a big day for gadget loves. the new i-pad hit the shelves. on sale. crowds are gathering in apple stores across the nation. especially any hugh is live in georgetown where people have been waiting all night long. right, any? >> that's right, allison. we got here around 7:30. and the doors opened at 8:00. we talked to people who were here as early as 3:30, 5:30, it is crazy. they're trying to get their hands on the third generation i- pad, that is being released today. and there are differences. the new i-pad three is a slight upgrade from the 2. a better camera and 4g capability and we talked to the techies and average joes this morning that were here as early as 3:30 a.m. >> because it is new. it is new. i have no other excuse. and i won't try to make one up. it is a new apple product. i love apple products. i have every i-phone, ever i- pod, it is what they count on. they factor me in to their annual meetings. >> i had the one and the two. i waited in line last year for the two. which i actually sold mine yesterday to a friend but it is not as crazy as it was last year. maybe because everybody i guess wanted to keep their second one. it is not that big of a difference. >> now, something interesting, as we talked to a guy minutes after he bought his i-pad three, and he rolled up here at 7:45, into the door at 8:00 and walked out within minutes with the new product and i kind of feel bad for those who had to be here at 3:30. it is quite the hype. we should also mention there was a small protest organized by change.org and these protesters are demanding to stop the problems in china, where the bulk of apple products are manufactured, including the i-pad, and demonstrations are going on here, at the apple store in georgetown, as well as new york city and san francisco. personally, i have the i-pad two, and i don't know that i would buy the i-pad 3. he will wait a little bit. and see if it lives up to the hype before i spend $500. back to you in the studio. >> thank you very much. if you have kids, grand kids, or if you're an uncle or aunt, chances are are you've been to a g-rated movie. right? this grandmother write, i am a grandma with seven kids ranging in age from three to 11. i took them to see a g-rated movie, happened to be alvin and the chipmunks and the previews came on after we were seated and they were loud with adult material and very scary movies. i found myself covering the children's faces with my coat. i don't know what to do about this. i have not taken them to a movie since that day. why do they have to she scary and sexy previews before a g- rated movie? whom shoe i contact? what should i do? >> i have seen more than my share of g-rated movies with my kids and i have noticed some of the previews have you tilting your head, how can they show all of this, isn't this content screened for the younger audiences but i didn't know the answer for that. but i thought, we have kevin mccarthy in every week to talk about what is new and hot at the movies and i reviewed on our friend chip, and kevin mccarthy with 106.7 the fan, joining us by phone. are you there? >> allison, how are you? >> thank you so much for this. i know you're a busy man but is inned this myself. and -- but i noticed this myself and this grandma wants a little help. was she imagining this and a little older and doesn't agree with the content or has it changed? >> no, it has definitely chained. it is interesting, i've been to g-rated movies and i've seen the same thing. the reason for it is basically before a movie start, generally about six trailers. and two of those trailers are picked out by the studio who is rereleasing the movie. so for example, if you see lorax, universal pictures would pick out two trailer ares. the other four are -- trailers. the other four are picked out by the theaters themselves. if they're seeing a trailer that was not -- that had, you know, a questionable content or content not for kids for that movie they're seeing that is based on the theater's approval and putting the trail trailer in there. i talked to a move movie mom and she writes extensively on the subject. and she believes it is unacceptable. there is a contact called nato online.org. the national association of theater owners. and if you complain to them about the content you're seeing in these trailers, they will go back to theaters and make sure that that does not happen. because again, it is four trailers that are happening, besides the two that the studio picks. >> and you're talking about like it would be riegle and amc, not just like the ones that i go to, in say, you know, silver spring. it would be the whole company that is that theater, right?
