>> before the debate we were talking about if his numbers go down after the debate is he probably going to kick himself for not going. >> absolutely. there is no doubt his absence on that stage has had an effect. a poll taken before the debate found that 68% of trump supporters or primary voters who have already made up their minds to support trump in the primary wanted him there on that debate stage. i also like to look at the betting markets as an indication of how people are feeling in real time. and immediately after the debate, you saw desantis spike up a bit and you saw trump and vivek ramaswamy fall. so, again, this is in real time, voters taking out their frustration on the former president for how they see it as taking for granted their vote by refusing to show up, to what is basically a courtesy that you are supposed to perform for voters. >> steve: right. when you look in the detail, mike pence increased his midwest support from 4 to 13. donald trump saw his midwest

going to be a winner on appeal. it's definitely going to be up for debate. >> i agree. judges have very wide discretion when it comes to setting trial dates. i believe donald trump will appeal this eventually. it's cutting it close. a case with 12 million pages of documents go to trial in seven months. so rationale that the doj offered that the judge agreed which think don't cut it. for example, one of the things doj argued and the judge agreed he has sort of known this was a possibility for a year or so, going back to january 6th trials. that's not the way it works in our system. you are not on notice as a criminal defendant until an indictment drops. that's the purpose of an indictment. you can't just say, you kind of should have known there was something floating out in the ether. i agree with caroline. one the rationales is we, the prosecutors, gave you this handy guide, that's nice. that's a sweet courtesy. guess what? it's up to the defense lawyer to

action suit, the list goes on and on. a two-parter. we know the judges are communicating out of necessity. when are you going? okay, i won't go then. scheduling these trials. also, on the defense side, how do you navigate this? oh, by the way, while your client is trying to run for president of the united states. >> yeah, good questions. very hard to do. on the first part of your question, willie, there is no sort of supreme air traffic controller. there is no one person in charge of calendaring all of these cases. it makes sense to me that the judges would talk at least as a courtesy to one another, to let one another other what they're thinking and how they're planning to schedule matters. it's almost impossible that all four of these criminal cases will be tried before the election next year. i can't sort of conceive of a way that that happens, but i think one or two of them can be tried before the november election. that seems to be what judge

the next segment. broadly about something that david mentioned about -- one of you mentioned about it this trial, versus not just the other federal trial, but state trials, i found it very interesting that evan reported that this judge today, tanya chutkan, said that she called the judge in new york to coordinate, to make sure that there was no conflict there. >> i think it it's a courtesy i terms of her reaching out. she didn't have to do it. we would all be curious what it took place in that conversation, but i think the interest of the federal case from her perspective has to come first, particularly as it relates to the new york case. you know, the new york case is very, very different. it's not related to the functioning of democracy. it was this personal behavior that took place prior to when he was even president. so it's just very, very

worst sense of that word. dehumanizes people. sometimes treats people like animals. they should not be treated that way. and yet that is sometimes the way the world is seen in the lens of state court because a deal with difficult circumstances of humanity. to that extent it might be a more rough-and-tumble world than state in state court. they don't put up with a lot of nonsense. i think that there is a possibility that we may see fani willis take a tough line, and the judge take a tough line. i will tell you what, the thing that surprised me and i appreciated was the strategic decision by fani willis to say, i have issued arrest warrants, but i'm gonna give you a little courtesy. if you show up within the next two weeks, i won't execute them. you can turn yourself in. there was such a smart move. we don't do it in federal court. we call and say hello, would it be convenient for you to bring your client in sometime next two days? and we let them call the shots. this was a very shrewd move, i think, because she correctly

show up, usually you don't have a bond. you have to wait overnight in the fulton county jail. you are given about the next day after your first appearance hearing. those are the cases, or that's what i used to preside over when i used to sit out here as a judge. then hopefully, you are granted a bond. if you are a defendant and then you are processed out. but it usually takes several hours if not a day or so to get a defendant processed out. >> mark meadows is one of trump's former chief of staff who surrendered. he was trying to push this. he has a hearing on monday, he's trying to get it move from state court, a federal court. and he was essentially arguing, i shouldn't have to meet that deadline from tomorrow. and they push back on that saying, fani willis argument when she responded saying i've already given you two weeks as a courtesy. that's the role of defended that we get. and that's accurate. so for those who have the

but i'm gonna give you a little courtesy. if you show up in the next two weeks, i won't execute them. you can come in turn yourself in. that was such a smart move, and i'll tell you what, we don't do it in federal court. colin say, would it be convenient for you to bring your client in? sometimes the next few days? and let the clients call the shots. this was a shrewd move i think because she correctly anticipated that trump or some of these other defendants were trying to jerk around and slow things down just as we saw mark meadows do and jeffrey clark to. and the judge wouldn't have any of it. it may be that we see this tougher stance in state court and we have seen in federal court. >> yeah, it's hard to imagine fani willis is gonna let trump slide on stuff. but that does beg the question, what's the punishment? having said that, chris, what we're seeing here -- is ellis prosecutor who has or ducks in a row by all outside accounts. she's ready for whatever comes, whether that's a speedy trial motion. or a hearing that mark meadows has on monday. and it gets to this idea,
