the justice department can appeal the decision. a spokesman telling the ap, it's currently being reviewed by attorneys. for his part, president obama who campaigned on the repeal of don't ask, don't tell has left it up to congress to overturn the policy. the house passing a measure to repeal the policy in may. that legislation currently stalled in the senate. harry reid telling the "wall street journal" the majority leader would bring the bill to the floor before midterm elections if he could get past objections from john mccain. the mccain stating this is another example of activist judges usurping the law of the people. this should be a decision for congress and the president, not appointed, unelected judges after congress and the president received the pentagon report on this issue. joining me now is as promised lieutenant dan choi former iraq war combat veteran who was discharged under dadt, currently on the advisory board, a member of that, of the american foundation for equal rights and an outspoken critic of don't ask, don't tell.

this ruling. was there anything about the judges 'tis department's rather weak defense in this case? as you say, no witnesses, not much of an argument. was there anything you think tipped their hand about whether or not they might make a decision here to not appeal? >> i don't know. that's certainly the speculation and the guessing game we're all participating in right now. it does put the administration and the justice department in a rather awkward position right now. the president -- the pentagon have all said -- well, the pentagon is studying how to implement repeal of this law. the president has publicly stated he wants to repeal it. that it harms national security. and he's directed his pentagon to study this. the house has voted upon it. the senate should vote upon it this month, hopefully. and yet the justice department now has the un -- the unenviable position of having to defend this law. so it will be interesting to see how the administration and the justice department responds to this, if they let the decision stand, if they appeal it, it's rather interesting. >> this point, they don't have to appeal.
