>> fox as admitted to telling lies about dominion that caused damage to our company, employees, and the customers that we serve. nothing can ever make up for that. >> there's that piece, leah. i want to you weigh in on that, and also the damage that has been done to our democracy. >> so, two aspects one is i think it's slightly overstated to say fox acknowledged the lies. all fox did was acknowledge the court's finding that their statements were false, and i think that people want the kind of accountability of fox admitting that the big lie was just that, a lie, would have offered, and it's not clear that that's going to come that being said, what this lawsuit and the settlement does is gives some accountability and compensation to dominion, but dominion was just one of the entities that was harmed, entities like fox fuelling the big lie in addition to the employees of the company and, you know, the people who invest in the company, the country more
broadly was injured, including election workers who were singled out by president trump as well as commentators. and those people, as well as our democracy more generally are not going get anything from this settlement, even though i hope that pricing in the cost of lying to a business model will deter other companies from engaging in similar behavior. >> i will hang my hat on that hope nick, it has not been reported if this is in the final agreement, with you "the new york times" reporting yesterday that dominion would only take a settlement if it included fox issuing them an apology. do you think that might be in the agreement? >> i'm not sure if it is and it doesn't make a difference. what really matters is they've acknowledged that they have lied and all the lies -- a whole series of lies found by the court in its summary judgment motion were correct that they lied, and that's the most important part. >> take me through leah's point, which is they haven't acknowledged they've lied. >> they have they admitted what's there were lies they acknowledged what the judge
were hoping that this would transform -- this would save us all, right i don't think that that happened, but for the dominion investors, they made a fortune off this, and part of the reason why is there was a fear on fox's end of punitive damages. katie mention add a moment ago a potential master looking at discovery issues, but i think there's also potential that the jury was going to award some measure of punitive damages. it's a significant message i'm not quite as bullish as nick is as the impact on fox, but i think it definitely sends a message and ultimately at the end of the day, corporations do react to cost. they do react to incentives and disincentives that are placed on them and i do agree with nick that this does provide a strong disensentive for fox in the future it will have some impact. >> leah, i want to you take a listen to what the dominion ceo said outside fox.
dominion has legal actions they're going to be bringing in the future as well so i don't think this is the end, and i do think it's a significant development. >> leah, i am following this as a journalist s that different than following it as a lawyer and legal expert. what is it that i am missing >> i'm not sure we're really missing anything again, the most significant aspect of this settlement is just the size of the settlement and the hope that it makes lying in such a clear and brazen way expensive for fox to do in the future the settlement was two-thirds of fox's income and you would hope that that is enough to cause fox to rethink in the future a business decision where they essentially said we're worried we're going to lose viewers if we stop covering and fuelling the big lie. and now, you know, the next time they're faced with a similar decision they'll have to say, and is that worth handing over two-thirds of our net profits from a previous year that's to say nothing from the lawsuits they face from other
