a defendant not a says that one of his two criminal defense lawyers say they cannot be president and for that day for the hearing, special prosecutor jack smith strongly object to the delay, pointing out that the court is already ruled that walt not as local florida lawyer, quote, must be ready to adequately represent the party at anytime. jack smith's team attacked attorney stanley woodward's claim that he could not meaningfully participate in the hearing, even if his schedule allowed, because he has not yet obtained the security clearance. jack smith's team pointed out in their filing today, quote, as of this writing, mr. woodward has yet to complete his form sf-86, which is necessary for him to receive both an interim clearance and final adjudication, despite having been put in contact with a litigation security group on june 12th, some three and a half weeks ago. jack smith's filing also points out that a security clearance is not necessary to participate in the hearing.
partnership with the saudi-backed liv golf. this comes as pga officials are set to testify tomorrow on that very topic to a key senate subcommittee. this just into cnn. pushback to the pushback in trump's classified documents case. special counsel jack smith is accusing the trump aide and co-defendant walt. here to walk us through, what is going on? >> well, they want to delay a hearing that is currently scheduled for friday. and we know in this case, timing is a real point of tension between the two sides. the special counsel jack smith said he wants to have a, quote, speedy trial. he wants to move this along as quickly as possible. former president trump and his associate have every incentive to want to delay this until at least after the election. that happens in ways both large and small. this may feel incremental.
the classified documents case has finally been arraigned after two unsuccessful tries. joining me now is jeffrey sloan, partner at stump hauser collides an, hour it's lowman, in the former united states attorney for the southern district of florida. jeff, thanks for being back on the show. we had you before the arraignment happened of donald trump. we saw that go down, we saw walt now does the failed attempts at arraignment evasion, and his counsel. what's immediately next on the evasion. friday is the pretrial conference in aligning with the government's motion for continuance, so the motion for continuance as well as deadlines for the procedures that everybody has been talking about. it is going to be discussed at this hearing on friday. >> so when you say that the government is moving to continue, are we talking about moving to continue to a december trial day? >> because we knew that aileen cannon, the judge in this case had originally said in august
council on board. you have to defendants in this particular indictment. donald trump and walt now into. is there a possibility that they get severed in some, way and get tried separately, because nauta doesn't have classified documents drama going on. nauta just as obstruction, false statements, et cetera. he doesn't deal with more classified documents complications under cepa as donald trump, right? >> you would think in a normal situation at somebody like nauta would want to have a separate trial because he is not charged with the counts one through 31. he is charged with obstruction, he is charged with lying to federal agents and things like that. he is not charge of the classified documents aspect of the case so in a normal situation a defendant like nadia would want to be separated, or maybe not, i don't know. but he is not really tanned central to the classified documents portion of the case the way the former president's. >> they're actually pretty tied
recordings, video, dna, all that kind of high tech stuff that is just become standard process in courts and juries, they wonder, where is this stuff? there used to. it so it's helpful to the government, the government loves this kind of evidence, but of course, they need to fill in all of the other gaps, and those gaps are mostly in the area of intent. who knew what, and why did they do it? >> danny, i remember reading when this officially filed in court and we saw the long document from jack smith that built this narrative, and it was the prosecution document, i think it's important for people to understand that, about what exactly donald trump and walt now to are being charged with and why. there are text messages that we saw, there is walt nauta going in to meet voluntarily meet with lawyers with the justice department, saying that he did not know about any other boxes.
as a matter of fact, we still see him staffing donald trump as a personal -- the judge has instructed the tonight to discuss the case. we will leave it to our viewers to decide if they think donald trump can exercise that level of restraint. they believe that there is any possibility of walt not finding a deal here or is he going to fight this on the instructions of donald trump? p? >> you never know. but the defendants that you are absolutely certain set i will never ever take a deal with their had in their hand asking for a deal as the trial date approaches and so it is always a possibility. but i think is best option for a deal has come and gone. if he wanted to cooperate, he had the opportunity to provide value before the government amassed all this other evidence from other sources. you are, go six months ago, i think his ability to cooperate now has been greatly diminished. i'm sure if he came forward and set up a plea deal, the government would listen, because you might have more information that he can shed
and what may be -- >> to be clear, i think the most interesting parts of the death of david remain blacked out, redacted, out of public view. but we did learn a couple of things from the release of the official details, namely, just that investigators have amassed quite a bit of evidence by the site they reflect search. mainly, that surveillance footage that you mentioned, which shows pretty clearly one of trump's aides, walt nauta, moving boxes in and out of the storage room. we've known for a while that walt has been the focus of this investigation, and we've seen from the indictment of him and trump path, you, now he was moving boxes. he was accused of lying to investigators about the moving of boxes, but with this newly-released affidavit or nearly unseal portions of the affidavit show it is that investigators had already collected all of that evidence before the august 2020 to search. >> so, we know that attorney
to be trump's strategy with a sort of healthy side dose of delay tactics. >> it's a gamble to say the least. katie, according to the search warrant documents, walt is nauta on tape moving the boxes. what do you think jack smith and the prosecutors want from him now? or are these just the consequences that he faced for lying to them it is voluntary interview? >> oh, katie, i think you're muted. it even happens to pulitzer prize, winners y'all. >> it's certainly being charged with lying is a consequence for lying to prosecutors so it's not surprised but i think what receding is in the newly unredacted court documents is that they saw him move boxes into a storage room in 50 of them but not the same number of
