>> well, shannon, the videoe vi covers two separate scenes, but at first, the first scene, the video kind of picks up right before terry nichols was pulled over for recklessthe this driving. the thing is , we don't see an,y ifidence of reckless driving or erratic driving. and if police officers somehow fear that terry nichols is posing a threat,a the officers appear to violate common protocothreatrs appeal, a protect themselves and asknd nichols to exit the vehicle. instead, they go right t up to the car . they pull him outdiatel y and immediately try to push hm to the ground in the process. nichols is apparently pepperd wh sprayed with some of the sprayso getting into the eyes of the officers on scene, and they either tase him or trysc a taset . works.nclear if the taser actually worked. and here's an what the attempted arrest sounded like. >> watch this. as you don't get all the great ones now. all right.>> okay, rachel , go back. not no, you guys are really doing a lot right now. you decide to go home.o ho >>me they hold him down. and then finally, terry nicholse gets loose and he runs away. they ce officers give chase, but they cannot catch him. then several minutes go byy befe before another police unit spots and catches nicholsofficeo officers from the first scene, then proceed to the secondscenen d thscene. at told thahat point, we're told that terry nichols is onlyt about a half a mile from his ena home. but the police encounter at the second scene is captured by both body cam video can and memphis police departmentphs video from a mounted camera a on a light pole. d camera ou can see where offic throw terry nichols to the n two officersd grabbed nichols arms and put b them behind his back and begine punchinghi him. h another officer is kicking him.. he is clearly unable this point ev to defend himself. and even when he's finally wheon back on the ground, you can still see officers going uofpg and kicking him. it's hard to make out whatre nis terry nichols is saying, but wei know for sure that he's askingld for help and apparently calling for his mom. >> listen, you know, yeah, the body camera video is veryy e damaging. rayou see here the pull videohe shows a wide screen perspective of exactly pole vide what police doing and how bad the threed minute beating was. how bahaveand then there's the f issue, shannon, which is thatin while nichols is on the ground ,you can see police officersicet just standing around. there's no urgency in getting not just tdical help, . and at this point, it's not just the five officers, because if you take a wider look, youe r can see there are eight ,eight, nine , maybe 10 people on scened and nobody appears to be scrambling for bottom line.o it's harted to tell what initiah threat that waers to police thae justified the initial response secor really what promptediniti the beating at the second scene. terry nichols is six foone.t three , weighs roughly one hundred and forty five pounds with no criminal history. y 145 poundsthand aside from th police officers that i'veof spoken to sai'vey the memphis officer not only broke the law, poey violated numerous police policies, which tendss to indicate, excuse me, a lackto of trainin ag and or a lack ofkf supervision. >> jennifer. all right, trace, thank youcovee very much. we'll see you for more coveraget throughout the night.hat an and on fox news at night. thank you, trace. we go now live to memphis, where fox news seniorsteve harr correspondent steve harrigan is standing by . okay, steve ig, you've beenh may through many of these situations tonight. what can you tell us about? the protest? terry nichols family has pleaded for them to beichols' fy peaceful. >> what ar peae you seeing? peal we have seen peaceful protests,r but certainly some annoying ainlprotest, especially for a lt of truckers as well. they're just beginning to move s . about three hundred protesters o managed to block this interstate. fifty five for about two or thrs three hours. a small grou. p really just lining the roads and blocking trucks, blocking traffic. a lot of people trying to get home, a lot of truckers trying their bu to do their business. they were chantingsi, take our lives, we take your money. that was the rationale foror the the blockage. they sarchust starte away now. so after aboutta a three to marr takeover of a section of se the highway traffic, once againe again beginning to move. it beginning to mov he here. viole it hasn't been violent, but they have made their presence felt. they've stayed out of midtownan. and the police kept their distance. it looks likike e a decision was made by the police just to let t them chant, yell themselves out and control a section of the highway for a few hoursfe time. shannon, back to you. >> all right, steve , thank you very much. if you'll stic>>k around with ul through this hour, we'll come back to you. >> joining me now, howardyou. safir, former new york city m police commissioner. >> all right, commissioner, ifvs you've watched these videos, it's excruciating. it, s excrucia your watching a y being victimized by people thati we trustctimiz to and have a duy to protect our communities. these men are facing charges. they were swiftly fired.swiftly they were wearing body cameras. that's how we get so much ofof this information. is it your sense that they feelu justified in the behavior thatrt they carried out? and what we witnesse theyd in these four tapes? >> i don't know ifd they feltn justified, but there's absolutely no justification for what they did. you know no justio, i will alwao first defender of police when they're accused of improperln t but from what i know in this case, these are five criminals and police uniforms assaulting a man who is committing a mino violation. so there's no excuse foro this. i mean, there's a lotht we don't know. as tracey pointee d out when werst video, t started that first video there, they're already rolling up officerse where a scen already i in there's already beenteon't some interaction. we don't know what led to that point. knoo that but later when they catc but there and then laterh , when they catch up with him, after he's run from them, there's such an enormous amount of response. i meanous, eight to 10 officers estimates at some point why that many to deal with one person? is a lo >> well, there's a lot that see on behind the scenes that the world doesn't get to see chief davis and her team downr d owin memphis did a great job. they briefed us three times this week. rcement all the law enforcement agencies around the country, major city chiefs,country, got t a briefing from the chief and her team giving us thef ande heads up so we can prepare she as she was also preparing for alspossible unrest in the t our community. >> so the timing of it, it'singf nobody cant choice. >> you know, nobody can pick. the right time. there' ths never a right time to give bad news to anybody.avim but chief davis, the team did a good job getting it outght. tonight. see so far , everyon everybody is staying calm. the messages got oute i calm.n t and we'll see how the rest off the weekend goes. we>> shay?th nnon: you and i have had this conversation, unfortunately, because there have been other casebeen oths like this and we r there will be cases like thi mst in the future. but we've talked about my latehe father was a law enforcement officer. there's nobody who hates a bad cop worse than a good cop because this now colors the ability for everybody a to getbility for a out there sao their jobs. when you've got a community,co when you've got peoplemmunity ao who have been hurt, who are wary of you and don't wantt want to cooperate with police, how much bad has this case donew for the good men ?s this case doand women in unifor? >> well, you've hit a very important point. and you know what?y import we have seenant here is another watershed moment, i'm afraid, in law enforcement. rodney king was a watershed moment. george floyd and nowmoment, wee this this debacle in memphis. as a police trainer, i spent spt many, many years as a trainer watching what unfolded here in memphis. was actually shocking to me. i saw horrible policing. i saw bad techniques.i sa i saw w out of control officersl no supervision, no leadership. >> and this is a recipe for what just took f place.e. there was there was just there was just it was a feedingt frenzy and it was it was policing at its worst. s policinow, i can tell you thit that from my sources in memphis, the rank and file realize that these individualsdu went wayal, way overboard and they support the the actions of the chief. c >> and that thathief not doesn't always happen. a >> so i'm proud of of the memphis officers recogni recognizing this this misconduct. bu t there's a lot of other here, s issues here, shannon, that we can go into reference their training reference, hiring reference. you know, there's a there's an. investigation needs to take place into the hiring practices that were taking place when thee these none of these cops have murdered more than two ore al three years on . so, yol u know, ifhire if we'red hired about the same time and you have it's a symptom. so it really needs to be to be addressed. that's coming down the roadip no that the memphis police leadership needs to take a looke at. >> yeah, and there are a number of investigations, state these igl, that will dig into these issues and clearly make suggestions about what shouldha come next, what to play, what benjamin crump, the attorney for the nichols familycrime,, sd about race and police culture. here's his take. >> racism and bias is the institutionalized police culture is not just the police culture. it's the justice system. this to n't see officers doing this to white citizens becausewh our court system has said that they value white life more than any other life. >> now, against that backdrop,, i thought it was interesting i that the police chienterf theren memphis, s.j davis, said sheall thinks this actually is not anre issue of race. what she said is it's about. human dignity. integrity and accountability and the duty to protect, our community. bilitycommissioner, what do youe of that part of the conversation?
