what happened? inside the delaware courtroom earlier, abruptly changed his plants is only surviving son, hunter biden was convicted on all three felony gun charges just that he was facing today. hours later, hunter biden was standing on the tarmac, as you can see here, to greet his father when marine one landed in delaware it was striking to see the two of them embrace for the first time since that guilty verdict came down. in his only comment so far on the matter, president biden said, in part in his statement i am the president, but i am also a dad because he also praised his son for overcoming a battle with drug addiction. but this conviction also comes in the middle of a presidential election. there was also a message tonight and biden statement regarding his role as president he said that he will accept the outcome of this case, that he does accepted and they also respect the judicial process, seeming to reiterate a promise that he made last week that he won t part in. hunter biden but as biden balances both being an english parent and president in-between the verdict and that we re union that you just saw there on the tarmac. he also gave a speech on gun safety in washington it s time once again, do what i did when i was a senator, ban assault weapons before that speech, that was preplanned. i should note before the verdict came down this morning, it was in the delaware courtroom where the jury s decision on hunter biden was unanimous, guilty but notably three jurors told cnn after that they question whether or not these charges should have been brought at all a fourth, that was known to only us as juror number ten, said no politics were at play when they were deliberating their decision pressure, inviting never really even came in to play for me. you kinda put that out of your mind. politics was not even spoken about the first family was not even spoken about. it was all it was all about hunter and of course, as we know it, as far from over for hunter biden, he is facing sentencing on the gun conviction that is going to come at the height of the general presidential election and another potentially even more serious trial on tax charges. this fall. few people know more about the personal toll that this is taken on president biden than my source tonight. evan owls knows is one of the country s foremost biden biographers and a cnn contributor. he is the author of joe biden, their life, the run and what matters now and having joins me now, i mean, there s basically no precedent for what we are seeing right now. a president s a sitting president s immediate family member has never been convicted on any kind of crime while they were in office. and i just wonder what you make of it, what stood out to you have how president biden reacted today? yeah, it is something extraordinary to see. i mean, he is balancing these two distinct roles as father and as president and on some level, this combination of private life and public life has been at the center of his relationship with hunter since hunter was a baby after all you remember, of course, his mother was killed in that car accident when he was a toddler, joe biden at that point was between being elected and being sworn into the senate his hunters entire life has been in some ways straddling the struggles, the privileges, the choices, the risks that come with that. and i think of this tonight is a moment in some ways, it s part of this long arc, this really sort of epic american political story. yeah. i mean, the family seemed surprised when this came down today. it did it happened relatively quickly. hunter biden himself is not even at the courthouse today and you saw them them rushing back in there and including the first lady, jill biden. but after we didn t see any of this anguish or they re real response in front of the cameras. at least we saw the embracing the tarmac what do you think it s like behind closed doors and wilmington tonight? yeah. they ve got abundant experience of tragedy on some level, and tragedy is not to be exculpatory here when nobody and least of all, joe biden is saying that hunter biden didn t make choices that lead to this result. but they have also learned over the years about how you get through this. they turn inward. they have this. it s not a coincidence that they re going to wilmington for this. that s sort of the ancestral homeland and they go there and they meet as a family. they have these traditions of these family meetings and the line that you often hear in politics from biden is that through pain you have to find purpose. it can sound like it s a line, except that for him, it is at the core of how he gets through this. and i can tell you that is no question what he is telling the other members of his family that if we re going to get through this part of our purpose is to demonstrate that nobody is above the law that a president does not interfere in the activity because of the court that a jury can still find its way to a result even in a time of intense partisanship, you ve spent a lot of time with biden. i and his family as you are writing your book, did you ever think that you d see a day like today? i ll be frank. no, i think when i first started interviewing joe biden back in 2014, a decade ago, beau biden was alive. it was actually kind of a hopeful moment in the course of his treatment. they thought that they might have had some good news. and in so many ways, this story, the one we are inhabiting today is the result of beau biden s death in 2015. it was like a bomb that went off in that family and i have to say one of the things we learned from this trial and it really was a revelation even to people who know the family well was the depth to which the impact of addiction rippled all the way through hallie biden, as we heard, of course, also ended up involved with crack cocaine. it was just a a period of his life and i think as as political observers, we study president s not only because it helps us understand the choices they in make the pressures that they re under. but it s also a reflection of ourselves, of our country and our time and what this family was going through between 2015 and 2021 and all toya all the way up to today is in itself a very american story as someone who studies biden. i mean, what is it? what did you take away from? they already had this pre-planned event on gun safety at the white house, which i think a lot of people were thinking to themselves. i mean, the timing here is unbelievable, but he came out, he didn t give the full speech. she actually was going to talk about a new gun restrictions that the doj has enacted what that has resulted in. he did not he spoke about it more broadly. his speech that had been previously planned, but he didn t seem to give anything away. i don t want i saw that speech. yeah, not a word. i think there s a way that he has drawn this bright line between what s happening with the family and what s happening in politics. and it can almost look, i think a little awkward because people are expecting him to talk about this thing in his life. but he is so concerned that it will be turned into a talking point by his opponent that i think he s almost going out of his way not to talk about well, i wonder how, how does a way on him when he hears three jurors who told cnn obviously they voted. this was unanimous. they voted to convict, but they were asking themselves if this would have been brought it all had he not been a hunter biden. that s been a fact for awhile. i mean, joe biden is said to have told people around him that he knows that had he not continued on in politics, that his son might not be facing the charges that must really weigh on it. i think to tap that i think it s a very heavy burden and look the joe biden s decision to be in public life as long as he has has added to the pressure on hunter biden, joe biden has always known for a long time that the gene of addiction, which is in this family is in hunter biden his life and by staying in politics, by being is exposed as they are in some ways, it has put pressures on hunter biden, and i do think that weighs on the president. and obviously officers coming in the middle of the election year, we will talk in a second about how republicans are handling this. but how does biden handle this at the debate? i don t think anyone thinks it s gonna have a huge impact on the election, but we ll see, but how does he handle it for the debate trump, who of course, at the last debate brought up a hunter biden. i think in the broader sense, there is a way in which this adds to the psychic load of what he is contending with. i mean, if you think about the middle please do you think about the us and now of course, within his own family, actually though as a pro, as a political matter and in the debate that s actually an area where joe biden knows how to handle this. you remember in 2020 there was a moment when he essentially telegraph very clearly back-off. i love my son and actually, and the data in the campaign was clear about this. that was a moment that americans responded to. i think there is some piece of the public that says we want to see not only that president, but also that dad. yeah. everyone else and it s great to have you on this. thank you for joining us. pleasure. of course, as i mentioned, the fallout from this verdict is already happening in a fast and furious way from capitol hill all the way to mar-a-lago. tonight, joining us here also, andrew mccabe, the former fbi deputy director and cnn senior law enforcement analyst, ashley allison, scene and political commentator and the former coalitions director for the 2020 biden campaign. and also david urban, cnn, senior political commentator and former trump campaign adviser. so we really got the entire gamut here. and andrew mccabe. but let me start with you because we did hear from the special counsel, david weiss today, someone we have not heard from very often in this case, he came out and spoke after the guilty verdict no one in this country is above the law everyone must be accountable for their actions. even this defendant however hunter biden, should be no more accountable than any other citizen convicted of this same conduct obviously, andrew mccabe, a hunter biden s legal team has made clear they re going to challenge this, but this is not the end of the legal exposure. legal troubles front or biden. he s got another case pending this november or this fall yeah katelyn, he s not out of the woods by a long shot. the case that he has coming up in september on the tax charges very serious case, and it s one that on its own brings the threat of much more extensive potential jail time. now, of course, they ll go into that case, having already been convicted of another felony, so he s no longer considered a first-time offender in the resolution of the tax case, which could make his penalties if he s convicted even more intense okay. so you do believe age or became that it would it could impact the outcome of the case potentially yeah, there s no question. he goes into that case now is having been recently convicted of another totally unrelated offense. so that s not a good thing for him. i think it was interesting that weiss made those comments about the fact that hunter biden should not be held more accountable than anybody else there s no question that this the trial was conducted in the way you would expect to see any criminal trial conducted. the prosecutors had an overwhelming amount of evidence. their case went in very smoothly. the defense had a very, very limited range of motion to work with here, trying to get the jury to basically thread the eye of a needle and focus on the fact that hunter allegedly wasn t taking drugs the day he bought the gun that was kind of a hail mary pass and obviously didn t work for them. all of that aside, despite the validity of this jury verdict, i think mr. weiss is going to have some really tough questions to answer in the long run about the broader decisions that he made along this path. why he offered such a favorable plea deal that he then walked away from and wouldn t give back to the defendant once when he asked her that initially. so there s a lot of questions about why hunter biden was held to this standard. maybe prosecuted in a way that most other defendants who might be who were allegedly involved in similar conduct would not have been held to the same standard. those questions are still i think hanging out there for me. yeah, weiss, it we don t often see a case like this broad as we ve noted and looked at the historical context david, can we talk about how the trump campaign responded to this day? because obviously republicans talk about hunter biden a lot, but this i noticed this today with the trump campaign where they first released a version of the state of a statement on what happened criticizing biden, criticizing his family, essentially saying that hunter biden should have been charged with with other things. but at the end, on the initial statement, they said, quote, as for hunter, we wish him well, in his recovery and legal affairs okay. but then they retracted that and put out another one striking that last line and no longer wishing him well and then resending the statement all together. what do you make of that? well well, kaitlan, i like i like the first version better, right? obviously, nobody wants to see anybody languish in an addiction and spiral downward any more than they already have been. and is well chronicled on the laptop and is andrew pointed out correctly, september 5, hunter biden stands trial. again on these tax charges, which is what are much more serious, they re seven charges, i think three felonies and for misdemeanor charges, he is facing for not paying over $1,000,000.5 in taxes over a five-year period on $7,000,000 earned and so he s he s in for, some rough sledding ahead and two, your earlier get to evan s point earlier, it s going to be right in the middle of that campaign, september 5th. and it was kinda right when people are getting ramped up in campaign season. and that s gonna be weighing heavily on joe biden mind, he is not campaigning and it s going to be in the news every day is american goods are contemplating what they re gonna do. i don t think it s going to have a positive impact on who votes for whom, but people republicans are going to point back to the laptop and the 50 plus national security individuals who said the laptop was rushing russian interference camp the pain and it wasn t real. and in this case, the laptop with the fbi said laptop was real. israel could be so it s going to provide a bunch of fodder for the campaigns. for the republican campaign moving forward. yeah. i just wanted to when we ve had any of those officials who ve signed that letter, james clapper, brennan, we ve talked to them about putting their name on that and what not but ashley, in the sense of this of what we re hearing from republicans and then struggling to kind respond to this. some of them are saying that they believe that conviction is kind of dumb in the words of one of them. in other situations they ve been arguing there was this two-tiered system of justice, but, but i mean the president s son was just convicted by his justice department yeah. i mean, it s interesting to see republicans contort themselves in certain moments to make the story work for them. downtown was prosecuted. will the state a state-level charge not joe biden, they blamed joe biden now, hunter hunter biden. joe biden s son is prosecuted by the department of justice, who joe biden are president nominated attorney general, and they still are not satisfied i love i think at the end of the day, i agree with david in terms of there will be another case that hunter biden and involved in. and i do not think that these outcomes of the case particularly related to joe biden, son joe biden, like donald trump, but joe biden s son will be determined them on how voters actually the decide to vote in the fall. but what i do get allows an opportunity to do is to draw a contrast. yet again, on how the two 21 former president, one current president, who both our fathers approach the situation, talk about the situation, handled it with compassion or lack of compassion, handle it with honesty. and i think that will be in there ll be opportunity hey, this fall to see the state contrast how one side handles it versus the other. well, and we heard from the house speaker mike johnson on this listen to what he told manu raju today. david mr. speaker, you ve been saying two-tier system of justice for some time. here s the president sayyed being convicted on three counts as that undercut your it doesn t every case is different and clearly the evidence is overwhelming here i don t think that s the case and the trump trials and all the charges because it had been brought against that have been obviously brought for political purposes. a hunter biden is a separate instance okay. but david, is that really i mean, it does undercut the claims that it s a two tiered system what it does, it look, everyone s saying, look, two things can be true here, right? people are saying, oh, this wouldn t have been brought if hunter biden wasn t joe biden? in sun, but yet nobody is saying that same thing, right? except maybe for fareed zakaria, that nobody would have brought the case against donald trump if you weren t his name work donald trump so possibly both those things are true in this and these both cases, and i think that s what s getting republicans goats here. andrew mccabe, can i just get your thought on this? i mean, you were the deputy director vector of the fbi. how do you view this in the sense of, you the rule of law and justice system overall and how that is. but this new political weapon at the center of everything caitlin, i spent my entire professional life in it. the justice system in this country is not perfect. it s got a lot of flaws, but it is not two tiered. i have also seen that people who have outcomes, they don t like, generally don t like the system. and people who have favorable outcomes, they like it this politics aside, that s basically what shapes people s opinions i guess the speaker believes that his own judgments about the quality of evidence in each individual prosecution, which he admits they re all very different, his own judgment about those things should supersede the decisions of judges and juries. i disagree with that but i guess we ll just have to leave it there and i should note figure johnson was not actually in the courtroom. we were listening to all of that evidence, of course, andrey cave, ashley, i ll send david urban great to have you pushing through the primaries. people who cannot win general elections, but who pledged fealty to him. that s not a good way to build and grow a party without relationships still is ic as ever, we re also learning that another relationship may be on the verge of thawing out donald trump and senator mitch mcconnell will share the same air for the first time in nearly four years this week as after mcconnell confirmed to cnn today that he will be at that meeting, trump is having with senate republicans in washington on thursday. now this is so notable because donald trump and mitch mcconnell have not spoken since december of 2020 it was shortly before the january 6 attack on the capitol for which mcconnell, as we all remember, and that floor speech said trump was practically and morally responsible for what happened then of course four years later. and a remarkable turnaround, mcconnell announced in march that he will be voting for donald trump come november by source on all this tonight is former republican congressman adam kinzinger, who served on the january 6 congressional committee and gardens and just first off, what do you make of trump s upcoming meeting with senate republicans, but also the fact we don t know if they ll actually interact. it s not that big of a crown bit, but the donald trump in mitch mcconnell will be around each other for the first time in four years. well obviously the meeting itself isn t surprising. mitch mcconnell meeting with trump really isn t surprising. he s a political animal at his core. i mean, he s a he does some honorable things like the support for ukraine and stuff like that, but he s made it clear from the very beginning that he will support the republican nominee money i wish he wouldn t because, i mean, obviously, he could stay away. he could not say anything at all. and it s pretty obvious he s not going to be there in a number of years. so why not go out with the legacy? so it s too bad, but like i said, i m not surprised at all well, i mean, it s essentially the opposite of what we are hearing from paul ryan. he said is now voting for trump. he s going to write someone and he did that in 2020. so it s not a surprise. but this is what he said to neil cavuto about why he can t bring himself to vote for donald trump i think it really is just character at the another day and the fact that if you re willing to put yourself about the constitution and oath new or swear when you take office in federal office where there s president, remember? for congress, you swear an oath to the constitution. and if we re willing to suborn, it to yourself, i think that makes you unfit for office why do you think that other republicans more republicans who feel the same way, paul ryan does, don t say it i don t know when i wish they did. i mean, i look, there s reality that members of congress and former members of congress, particularly, or ones that are leaving don t want to make the party mad because they can go make a bunch of money lobbying after that. and so a lot of them stay quiet, which is why people asked me how can somebody that s leaving stays quiet? you don t want to tick off the party. i m very proud of paul ryan for saying that because he could have stayed silent. he could have not said anything, but he made a very clear, concise case for why he he s unqualified and on the point about the constitution law, caitlin when i swore in to congress, i did not take enough to my district. i didn t take an oath to the 700,000 people i represented. i took an oath to the constitution of the united states. that is the most important thing more than any issue. we re than any tax rate. the most important thing is, are we going to uphold these basic principles because democracy can t survive if you don t. so i think paul the speaker, made a very compelling case. he did it in front of an audience that didn t want to hear that. and i hope he says it more. it didn t talk about people though who are political animals that are interested in keeping their jobs on capitol hill. i mean, i think they look at this in a cynical way and say, okay, well, if i say what paul brian s out there saying, look at paul ryan, he s no longer in washington. he is no longer the house speaker. he left he s out why would i take that route if that s going to portend my fate? yeah. and let s look, it s true. you will be kicked out. the question is of conscience what is most important to you, a title, an identity. i mean, those are powerful things where you re conscience or your country, or the legacy that you leave. and so these people look at him, they ll look at, you know, liz cheney and i this is what a colt does by the way, it takes a few people that are out of line that don t swear fealty to the leader. they kick him out they politically execute them, and it sends a message to everybody else, don t get out of line. and that s why over the last eight years, we ve seen increasing, not just loyalty to trump but increasingly members of congress, for instance unwilling to go outside, criticized him for anything unwilling to go outside of what other whatever his daily orthodoxy is, which has nothing to do with conservatism and look, it s really just a question of conscience i m glad you said that about conservatism because this is what paul ryan s essential take was on what trump has done to the republican party. obviously, your lifelong republican, this is what he said also today i m a conservative republican. he is a populist. he s not a conservative. i want to see someone who s, who has fidelity to principles. i would prefer a party that is based on principles not personality or populism this populism is untethered to principles, but is that the future of the republican party mean that is the direction it seems to be moving in more and more look it depends how far in the future i think in a year, yet still that party i think if you fast forward ten years, i believe there s not going to be a person on this planet alive that will ever admit they support it and donald trump, because i think look, if he loses, obviously he s a loser once again. and that has a way of basically waking people up in a movement or in a political party, even if he wins, he s president for four years. very few presidents come out of that more popular than they went in america will be exhausted of him. and i i think the republican party will start to eat them up by the end of that. that s my optimistic view. but then somebody else could come along and run that same formula. and so who knows, but this is why people like paul ryan speaking out talking about being a conservative. but now being called a rhino, not because of what he believes but because he s not january 6, justice alito responded to that in a letter to congress saying that the response to that reporting, blaming his wife for putting those flags up tonight, their neighbor in the alitos house, emily baden, said that she believes that everything that has happened, everything new here on this audio proofs are right absolute horror if there s one thing that is the basic job description of a supreme court justice. it is to remain impartial and with the upside-down flag, with the appeal to heaven flag. samuel alito has shown that he is not impartial here tonight. the vernon jordan chair and civil rights at howard university law school. cheryl, an ipl and it s great to have you here. i should note, we ve heard the full recording. this is just what has been posted online that we can hear but from what we did here i wonder what stood out the most to you and all of this audio that is mostly about martha-ann alito, but also we re from justice alito himself as well yeah. katelyn, i am focused as well on the recording involving the justice himself. justice alito and the parts that i found most disturbing, probably the part that i find most concerning is when the reporter says that we need to return this country to godliness. and he says, yes, i agree with you. i find this to be a very shocking statement coming from a supreme court justice in a democracy like hours, which is not a democracy ruled by a particular religion you know, when john kennedy was asked whether as president his allegiance would be to the catholic church or to the constitution. he said, i swear an oath to the constitution. and that is what will guide my, thinking and my work. as president of the united states. i would ve expected justice alito or any justice on the supreme court to say the same and then similarly, i was very alarmed by his endorsement of the idea that it is impossible to compromise around a set of issues that people feel passionately about. the very nature of the judicial function on an appellate court like the supreme court, is to engage in compromise, to engage in conversation, to find a way towards an answer. justice alito is fond of citing brown versus board of education, which is indeed a magician important decision that changed american democracy. but it was born of compromise to get to a unanimous decision striking down separate but equal required months of work and wrangling. but but ultimately, the court created a unanimous decision because they understood the importance of coming before the country as one speaking to such a volatile issue and what justice alito essentially said was that he concedes he gives into the idea that there are simply things he cannot compromise on and that the two, what he calls the two sides cannot compromise on. and his framing of these decisions as well. winners and losers also suggests something that is, that i think is contrary to how we think about the judicial function. what does it say to you that we haven t heard from justice alito since these recordings were published? well, i d say a few things. kaitlan that i think we should be keeping our eye on. first of all, as, you know, senator durban is going to try to move forward. the senate ethics bill that he and senator whitehouse have put together that s obviously going to be a difficult thing to do, but he s determined to do to it. and when he was asked why he s doing this, pushes it because of the recordings. he said it is not because of the recordings and he said it was because of a financial disclosures and ethic statements. and i would remind everyone that justice thomas issued new disclosures, just a few weeks ago revealing trips from 2019. so quite late. and justice alito sought a 90 day extension, which he was granted so there may be other shoe to drop so we don t know. and i think that justice alito is not going to respond to every drip and drop of the revelations that are coming out. i think he responded last week around recusal from the case because that is imminent. yeah. but i don t think he intends to respond to each of these allegations. we saw him respond to that because they were asking him to recuse himself. he said he didn t fill he didn t think that it met the standard here. but cash you something else though because i m curious as we talk about this is i wonder what you would say to people who listen to this recording in their responses. well, i m uncomfortable or i m skeptical of this because it was someone posing as a conservative supporter or a sympathizer of what the alitos deal with. i wonder what you would say two people who raise questions about that when they listen to these audio recordings yeah. i mean if the questions are about the ethics of recording someone pretending that you are sympathetic to their cause. that is one set of questions that i think are actually not the focus of our concern. i think that the focus is that justice alito was speaking in an environment where he felt very comfortable. he was speaking unreservedly. he had a sounded as though he were speaking quite sincerely as did mrs. alito. and what was also interesting was that it confirmed much of the account that was given to us by the neighbor of the very disturbing account about what was happening winning between them in that community. and even that violates at least as i read it, the court s own code of conduct that they released in november last year in response to pressure that they were getting after the revelations of financial disclosures, many of us have criticized that code but that code does say that adjusted should require similar conduct by those subject to the justices control in terms of harassing behavior and conduct, simply saying it was my wife who hung the flag or it was my wife who was engaged in the altercation by their own standards is not enough so we learned a lot from that recording that i think is important, and we ll be watching closely for the other thing i will note is somebody cares, at least in the republican primary electorate, what kevin mccarthy has to say, he s not the speaker anymore. the idea that he could go on this revenge tour and somehow get revenge against these candidates. these voters care about donald trump. he runs a reply publican party, not kevin mccarthy. yeah, there was some funding that kevin mccarthy helped with with mazes challenger, but but that was pretty much it. but we re also projecting that the republican michael ruling is going to win that that special election in ohio s six congressional district. this obviously matters because right now republicans having teeny tiny majority in the house and heal help with that margin just to teeny tiny bit. yeah. yeah. he ll help in that. but really what s interesting to me there is the margin which is he s not winning by a whole heck of a lot of the margin i last checked around was about ten percentage points. and why that s important, it s trump won that district by nearly 30 points. this is just another example of democrats turning out and high numbers in these special elections democrats are highly engaged and that s the thing they re hoping for come november, right? that this highly engaged electorate that they re seeing in these special elections will translate come november and their voters were turnout and trump s voters perhaps won t. okay, so that s interesting. so he wanted the district by how much in 2020 trump won it by a little less than 30 percentage twice and now you re seeing how close that is in that race is exactly right, and that s something we ve seen throughout the special elections since roe v. wade was overturned as democrats been outperforming their 2020 basin and democrats are hoping that translates to 2024. but of course there ll be a much wider turnout in 2024. the question is, how much larger? well, that turned out, actually, yeah, and highly engaged voters important can i ask you? we re going to talk about a few of the other races were still waiting on some polls so close in nevada, cui talk about what is happening with george santos, your war, the associated press is reporting tonight that have now just been arrested here in the united states. we are told they re rounded up in los angeles, new york, and philadelphia on immigration charges and law enforcement sources tell cnn that they came in through the southern border, the us southern border, and they were screened by us officials, but apparently no red flags at the time investigators later discovered possible links to isis members overseas, which is what triggered this initial federal investigation. here tonight, danielle harvey and the former head of intelligence for the decent dc homeland security department, i mean, how concerning is it that homeland security officials and how worried are they after seeing this about potential terrorists, people with ties to isis exploiting the us southern border to enter the united states well, the good news is that the system worked, right? so let s just everyone take a deep breath. federal officials caught these individuals. they investigated them, they track them down. they have them in custody. so this is exactly how it s supposed to unfold. why didn t catch them when they entered is a whole different conversation. they will have to hear soon as the investigation goes through, it may be because of what we call trade craft. these individuals may have hidden their intention. they may be well coached. there may be a larger conspiracy at play. and if federal officials followed them that look at some of their communication, some of their activities, and deemed that they were a threat. so that s good news. they were caught the bad news is as christopher wray in an april and many cbp customs and border protection high-level officials have told members of congress and the public that they re concerned about terrorist and known as what we call k asts, known suspected terrorists, and people in the no fly list sneaking across the southern border because of the the volume of individuals that are coming and the number of countries are coming from. i mean, this is exactly what we ve heard from republican critics of the southern border and how it s being handled at this moment is a concern that this something like this could happen and the system not working yeah, it s always a concern, especially when we would call them up the gottaways. so if you look at if one in every hundred thousand individuals who get away is a known as suspected terrorists. you can have dozens or hundreds of individuals that could potentially threats and so this is a wake-up call to all

probation, to talk about the podcast because there are just so many things i want to see if you can answer and then of course there are things you might not want to answer. i would love it. i look workday for america s 93,900 probation officers. but, one of those probation officers had the least routine workday of that probation officers life today when that probation officer in new york city became the first probation officer in history to interview a former president of the united states. donald trump s first probation interview today is a standard and necessary part of determining what sentence donald trump should receive after a manhattan jury found him guilty of 34 felony charges of falsifying business records with criminal intent to violate new york election law and the 2016 presidential election. the probation department will use donald trump s responses to date to determine what sentence the probation department will recommend for defendant trump at his sentencing hearing on july 11th. in yet another demonstration of donald trump getting extra favorable treatment while he is complaining of being persecuted, judge merchan allowed donald trump s defense lawyer to attend the first probation meeting and allowed the meeting to take place virtually with donald trump in florida. special treatment for donald trump did not go unnoticed by the legal aid society, vermont defenders, new york county defender services and neighborhood defender services. they issued a joint statement saying all people convicted of crimes should be allowed counsel in their probation interview, not just billionaires. this is just another example of the two-tiered system of justice. presentencing interviews with probation officers influence sentencing and public defenders are deprived of joining their clients for these meetings. the option of joining these interviews virtually is typically not extended to the people we represent either. to ensure integrity and fairness, we call on nyc department of probation to ensure that all new yorkers, regardless of income, status or class, receive the same presentencing opportunities. nbc news is reporting that the interview lasted less than 30 minutes and that donald trump s probation officer is a woman. cnn is reporting that the commissioner for the new york city department of probation was present, along with general counsel for the department. joining our discussion now is martin horn, former commissioner of new york city s department of probation. thank you very much for joining us tonight. first of all, we want to get a sense of how unusual this was. we already have the sense that it was a bit unusual, but as to the presence of counsel and it being remote, you have these people representing other defendants, saying that is never available to us. that is correct. it is highly unusual. i think it is appropriate to make some accommodation and recognize the fact that when trump shows up his going to be accompanied by secret service. he s going to be accompanied by the press, and his presence might be disruptive, so the idea of doing the interview remotely doesn t trouble me that much. i think it is somewhat appropriate and certainly during covid, we made use of these remote kinds of interviews. i think you could make arguments both ways. the presence of counsel is highly unusual, and the presence of the commissioner is something i have never heard of in 40 years in this business. can you think of a reason for doing it if you are a commissioner at the time, would you do it? would you join that meeting? no. i cannot think of a reason to do it. i think it skews the interview. i think too many people in the room is distracting and disruptive and not conducive to candor, so no. i definitely would not have done it and i don t think it should ve been done in this case. 30 minutes is the report we are getting. what do you make of that? sounds abbreviated to me. usually these things take at least an hour. the content of what this interview was supposed to cover, and what the court is supposed to address is spelled out very explicitly in state regulations and it goes on in some length that it covers a wide array of issues. i don t believe they could be addressed and half hour unless mr. trump just refused to discuss all of them, which was certainly his right to do. there is reporting that he did cooperate and answer all the questions. i m not sure whether that is completely true but i m assuming that. what do you think are the most important things they should have obtained in this discussion? the judge certainly knows the defendants. he does not need to know much more. i think the important question to be addressed here was aggravating or mitigating circumstances. this was an opportunity for the defendant to set forth mitigating circumstances, and for the probation officer on behalf of the people to set forth any aggravating circumstances, but perhaps most importantly is the question of whether, if this individual is not sent to prison, but is granted probation, is this an individual who is likely to accept the terms of that probation and the supervision of a probation officer? and, what with the terms of probation be, and what would that supervision be like? all i can speak to is the typical case and obviously this is not the typical case, but typically a probationer would be expected to report to the probation office periodically, certainly no less than monthly at first, to keep the probation officer apprised of his or her comings and goings, certainly not to engage in illegal activities, not to associate with individuals engaged in illegal activities, certainly not to miss use drugs and alcohol, to fulfill his or her financial obligations both to his or her dependents, but also any fines or restitution that has been ordered. what about associating with people who have been convicted of crimes, many people around donald trump has been convicted of crimes. historically this has been discouraged by probation agencies around the country. it has been liberalized somewhat recently but i think it is something the probation officer appropriately would discuss with the individual to determine whether it is the association that is occurring for a good reason or not. thank you very much for joining us tonight and sharing your expertise. this evening in florida, donald trump s favorite federal judge whom he appointed, denied trump s request to dismiss the case against him for violations of the espionage and act and illegal possession of classified documents. she wrote checks myths prosecution or other permitted by law, raise evidentiary challenges not appropriate at this juncture and/or do not require dismissal even if technically deficient so long as the jury is instructed appropriately and presented with adequate forms as to which defendants alleged conduct. judge cannon did grant trump request to strike one paragraph of the indictment about donald trump s alleged meeting with a representative of his political action committee believed to be his campaign adviser, susie wiles, and his golf club in bedminster, new jersey in 2021. the indictment says donald trump showed that person a classified map at that time. judge cannon said that because showing that map is not one of the charged crimes in the indictment, it is quote, not appropriate to include it in the indictment. in the ongoing scandal that is the united states supreme court, now there are tapes, thanks to lauren wednesday, winsor, who was interviewed by julie reid earlier this evening. lauren windsor is a progressive activist known to approach important republican people pretending to be an hour, making flattering comments than secretly recording their responses. she is a dues-paying member of the supreme court historical society, which has corrupted itself into an organization that allows right-wing supreme court influencers to comfortably influence right- wing supreme court justices at the annual dinner of that organization. last year at the supreme court historical society s annual dinner, lauren windsor made recordings of her chats with supreme court justices that even she found so uninteresting she did not publish them. this year was different. she got samuel alito to agree on tape to the goal of returning the country to quote, a place of godliness. is a catholic and as someone who like really cherishes my faith, i just don t know that we can negotiate with the left and the way that needs to happen for the polarization to end. i think it s a matter of like winning. i think you re probably right. one side or the other is going to win. i don t know. i mean, there can be a way of living together peacefully, but it s difficult you know because there are differences on fundamental things that really can t be compromised, so it s not like we re going to split the difference. that s what i m saying. i think that the solution really is like winning the moral argument, like people in this country who believe in god love got to keep fighting for that to return our country to a place of godliness. i agree with you. by contrast, chief justice roberts responded very differently. you don t think there s like a role for the court in like guiding us toward a more moral path? no. i think the role for the court is deciding the cases. that is for the people we elect. that s not for lawyers. i guess i believe the founders were godly, like were christians, and i think that we live in a christian nation and that our supreme court should be guiding us in that path. yeah, i don t know that we live in a christian nation. i know a lot of jewish and those muslim friends would say maybe not. let s not our job to do that. our job is to decide the cases as best we can. and samuel alito made his wife very much a public figure by blaming her publicly for flying flags supportive of the january 6 insurrection at the capital at their homes, you might expect mrs. alito to have little to say to strangers about flags. and you would be wrong. what you think they re coming after you? i mean like the whole like appeal to heaven flag was like right. the other thing is feminazis believe they should be in control. feminazis was a term coined by rush limbaugh. fox news had not even been invented yet and so samuel alito s wife is quoting material from rush limbaugh that is over 30 years old. that is how long she has apparently been listening and taking direction from the likes of rush limbaugh. you know what i want? i want a sacred heart of jesus like because i have to look across the lagoon at the flag. for the next month and he s like oh, please don t put up a flag. i said i will do it because i m deferring to you but when you are free of this nonsense, i am putting it up and i m going to send them a message every day, and every week i m changing the flags. this is how i satisfy myself. i made a flag into white and it is yellow and orange flames around it and is the word for shaman italian. andrew weissmann, msnbc legal analyst and co-author of the best-selling book, the trump indictments. andrew, this is quite an interesting window of sound into the thinking of senator alito and chief justice roberts. well, the description from both of them could not be more striking in terms of where the country is, and you know, we are hearing from a man who is the principal architect for the reversal after 50 years of roe versus wade. his thinking is in that decision is, i think, just this week as his thinking that was shown in the letter he submitted trying to justify the flag incident, and you also have this dichotomy because you have the chief justice saying what is of course the correct thing to say, and we are on the eve of getting a decision on presidential immunity and it is a real sort of blot on this country and the judicial system had to be so direct that you have justice alito and justice thomas sitting on decisions that is not the way the country is supposed to be operated. it s not the way the court is supposed to be operating and their conduct is reflected on these tapes but their conduct in many ways even without these tapes is something that is really besmirching a really important branch of government in this country that we are entitled to count on and it is very hard to have faith in the system when you have that kind of conduct in these types of tape recordings coming out. we also have in these tapes now something very close to proving that samuel alito supreme court justice lied, lied publicly about the flags and the reason for the flags being up because here is the person who he is blaming on the flags being up saying she wants to do these flags just because of the flags that other people have including the pride flag that somehow is oppressive to her. absolutely. there is nothing in there about a response and we know that even that story, the timing of that story did not make any sense in terms of what it was supposed to be in response to, as we have now heard with respect to the police report and the neighbor across the way, and so what is really amazing to me is that there is just zero accountability of the supreme court and that is where chief justice roberts is much as he may be a good man personally and obviously said the right things which you don t really get credit for that for saying the right thing because that is what is expected but that is where he is to blame for not taking stronger action and there are a number of things he can do that would put more pressure on two justices who are really not upholding their oath of office in a way that helps this country , whatever side you are on. if you saw this from a so- called liberal justice i think we would be just as outraged and of course you would hear just as much but rightly from the far right that it is not appropriate behavior. you know, i will speak for me and i think this applies to you. i spent most of my life finding it inconceivable that we would be doing a story about a supreme court justice lying and lying about something important in public that affects the integrity of the courts on decisions and i am now realizing in retrospect that the reason that was inconceivable was really the supreme court justices themselves who we grew up with, who could not possibly step in these things the way samuel alito and clarence thomas have, but especially a leader with the flags and his wife making his comments to a stranger about the flags that have become something far beyond controversial. the flags that they are flying that share the spirit of the january 6 insurrection, all of that just completely inconceivable not because of any ethics enforcement body, but simply before because who was actually serving on the supreme court, whether we agree with them or not during most of our lifetimes. i want to point out one other aspect of what he was hurt now on tape saying, which is that the christian nation should be brought more to be a christian nation and as a jewish-american, that is not what our country is about. there is an establishment clause that is supposed to separate our religious beliefs which everyone is entitled to their own, but it is not established by the government, and that principal is very much under attack right now with at least five, if not six justices, but hearing that from justice alito s mouth basically just rips off any sort of pretense as to what is going on, and it really tells you very much how dishonest the dobbs decision was that reversed roe versus wade, this idea of we are sending it back to the states. that is not what is going on. this was part of a religious fervor that was animating what was going on, and you have justice alito really just saying it out loud, whether you like the idea of the tape recordings happening in the way they were done is neither here nor there, because you know, there was nothing that prevented him from responding in a way that justice roberts responded, which was entirely correct. the tape to you at this time the honorable lester hunt, governor of wyoming. he set his sights on the u.s. senate and he won that race. a distinguished guest for the evening is the honorable lester c. hunt, the senator from wyoming. the most popular politician in his state. lester hunt, newly elected u.s. senator, he heads to washington to do what he has always done, to advocate for his constituents, the people of wyoming and also to try to do some good for the rest of the country. he is as poised as anyone could be for success in that job, but things are about to change for him radically. what he is about to encounter in washington will cost him his life. he will not live to see the end of even one term as a u.s. senator. joining us now is rachel maddow. you can get the first episode of ultra, completely forgotten figure, but the thing things went so badly for him very quickly after he got to washington that went i have tried to do in episode one is create the lost sense of possibility. he really did lose his life to the scandal i am writing about and working on in this podcast and it is a huge loss for the country because he did have a long, bright future ahead of him if everything leading up to his life and that moment was anything to go by and i feel like i have become really good at resurrecting old villains we had forgotten about from history, but lester hunt is one of the good guys that we need to unearth and remember his legacy, too, and the loss of him is something that went really wrong with extremism in american politics. it is something we should regret and remember and commemorate. yes, so he is a democrat getting elected in republican ohio wyoming, a difficult thing to do and impressive no matter when you hear that. he is kind of the jon tester of his time there in that situation. but, apparently very naove when he gets to washington in such a way, and i m speaking beyond what i know because all i know is episode one but clearly, he gets eaten up by washington, so this is a drama about more than him. so, what happens with him, and you will get there very quickly in the next couple of episodes, is that he is confronted in the senate with the first major thing he does in the senate. there is another senator who is in the opposite party, who is his opposite number and this other senator gets involved in a nazi propaganda campaign, this dirty false conspiracy theory tale that is designed to hurt the united states, and lester hunt realizes what this other senator is doing. he is repulsed by it in the come to loggerheads in the senate over this thing the other senator is trying to advance in part of the reason i wanted to do this story is learning that while that is happening, while there becoming mortal enemies in the united states senate, they also lived next door to one another, and their backyards back up onto one in each and others houses and how they have decided they re out to destroy each other, they can see how each other is living, and that only ratchets up the revulsion lester hunt has for this other senator and he just decides you know what? i m going to take the political risk. i ve got to stand up against a monster like this and he does and it is for the good of the country and cost him his life, but what he is fighting for, and the reason he is fighting against that foreign influence operation in washington and the low down dirty depth some people were willing to go to for political gain is an inspiration to me even though it cost him his life. so, the first season of ultra taught us about the poll that fascism had in the united states, the attraction it had for some people, how far they were willing to go to advance the cause of fascism here, and that is pre-world war ii and into world war ii, that story, and this takes us to a period after world war ii where it hasn t you make the point that those people, most of them tended to disappear after pearl harbor, but that did not mean they stop thinking what they were thinking. it also did not mean they went away in politics. one of the things you and i talked about a lot with season one is that it became kind of a forgotten story, the great sedition trial, all the americans who sort of worked with a nazi agent who wanted nazis to win world work two were defeated in the united states and that means we forgot their stories and we forgot them pretty quickly. when they were all kind of let go and didn t get prosecuted for it, not successfully prosecuted for it or in the case of members of congress, none of them were prosecuted at all, their story was mostly forgotten and those of them that stayed in public life kept being the same kind of people they were before, and so, for example, one of the characters in season two is a guy who was part of the silver shirts and linked to the german-american phone that was riding for charles conklin s publication. those are all entities we learned about an altar season one. in season two, he ends up being the subject of an international years long manhunt by the united states government. they believe him to not be just an american fascist, but an american fascist and a traitor and possibly a nuclear terrorist. so, it just gets worse when these people get away and he ends up involved with a republican senator who is a sitting senator in the united states senate, so when you let these folks get away with things, it is important you at least keep tabs on them to see where else they re going to turn up, because it s never good. so, how many episodes, rachel? eight. and those of us who want 16 or 24, what do we do? so, you tell stories in your show that are similar to this. they tend to be 20 to 25 minutes, something like that. each podcast episode is significantly longer than that. what is the difference for you as a storyteller in the way you approach the podcast as opposed to the way you approach the show? very good question. so, the podcast is basically a little book. or a tv show, like if you think about it if you put of the episode links together it ends up being something that i want to be able to hold your attention for about four or five hours. in order to hold your attention for that time, it has to be well told. we use a lot of archival audio, a lot of historical audio. finding the wyoming audio archives to get the sound of lester hunt s voice was an incredible odyssey and super fun, but the idea is that this is a single story arc that cannot be told in the course of a tv show. you need to stick with it for an eight-episode arc but by the time you get to the end of it, you should ve learned a whole nothing about american history and hopefully be propelled along the way by the dramatic interest in it, so that it sticks. i want these stories to be memorable. i m not just interested in these stories because they are not well known. i think they should be well known. like, we should all remember lester hunt. we should all remember there was an internationally wanted american fascist fugitive who was involved with the republican senator at the onset of the cold war. we should understand what happens when the great sedition trial in the united states and with all of those people getting away and all of those seditionist movements effectively getting away without ever being held criminally accountable for what they ve been charged with. i want those stories to be vernacular, to be part of the way we think about our history as americans in dealing with really strong, antidemocratic challenges, because we have a strong antidemocratic challenge right now so we should do what is in our armamentarium of options for how to respond to it and what has worked well in the past and what is not. and, the key to this kind of great drama is even if you don t care about democracy, and i don t understand you if you don t, but if you don t care about democracy, this is still great drama with great characters, perfectly told by america s friendliest voice to tell you scary things. the good news is, these scary things are kind of over, except there are big threads of them still with us now. rachel, by the way, an alternative name for altar that you could have considered it s more letters, but stuff lawrence o donnell doesn t know. that could be the title but it s hard to squeeze it into a small state space. i well, before we get to that i want to point out that compared to the opening where we talked about justice alito and the concern about the rule of law in this country, this is an example, as was the new york criminal trial, of the rule of law working for you see the courts function even when you re dealing with the former president or in this case, the son of the current president. i think they re focusing on intent. the proof here is very strong that there was possession of the gun. there is very strong evidence of the addiction hunter biden had, and the issue is, was healed she aware during the relative time periods when he signed the form that said essentially he was not an addict, did he believe that he, at that point, was an addict and also during the time he possessed of the gun, for about a two-week period, did he believe he was an addict? blackwell. thank you for joining us this morning. president biden begins the state visit portion of his trip to france. it starts with the welcome ceremony, which president biden is expected to depart for soon and then the ceremony will begin at the octave try-on. then there will be a parade, precession to the lose, a palace where biden, french president emmanuel macron will attend a working lunch and both leaders are expected to give statements to the press before macron welcomes the president. and the first lady to the famous musee d orsay for a statement dinner. the close ties between the u.s. and france will be on full display today as biden continues to push his message of saving democracy and freedom following his d-day anniversary speech friday cnn senior white house correspondent kayla tausche is live and paris this morning. hello, kayla. we are expecting to see the president at the moment for this welcome ceremony. a walk us through what we will see today well, hello, or should we say bones zhou are from paris, amara today after a point in few days in normandy, the red carpet is now being rolled out in paris where president biden and president macron will now engage in a series of events to deepen the collapse variation between the two countries on a number of fronts, you will see them momentarily arriving at the arctic triomphe with local school children standing by them, they will travel to the elysee palace where they will have a working lunch. the two liters there are expected to discuss two issues. in particular in great detail, the ongoing wars in gaza, where president macron crown has broken with president biden and the ongoing war in ukraine where president macron here in europe has taken something of a leadership position, trying to galvanize the rest of europe to spend more on their collective defenses to produce more, of manufacture, more domestic weapons. in their own countries rather then outsource them and potentially have depleted supplies if there is a potential that war moves past ukraine into europe that is going to be one of the discussions that the two liters have today. and how does support the war in ukraine for the long haul, they re going to be preparing essentially joint positions to go into the g77 but next week and the natives summit that will happen next month. we re also expecting them to discuss climate change, artificial intelligence, and other matters of commercial importance at that state dinner tonight, which has been moved to the elysee palace from the musee d orsay. we expect to luminaries from the business and diplomatic role to be on hand for president macron to fed president biden and a relationship that has deepened over the course of president biden s terms. the two leaders had a very high-profile falling out early in biden s term when he chose to essentially sign up with australia and the united kingdom to partner on the production of nuclear submarines for the indo-pacific where eight french contractor had previously been partnered to build some of those submarines. they were essentially excluded from that partnership and it took several months to bridge that rift now, after sharing a bond over several common goals, common themes, common ideals, the need to defend europe, the need to secure for europe, and the need to essentially protect the west and western ideology. they have grown much closer, but certainly president macron is keen to hear about president biden s prospects for reelection and whether as president biden has said, america is still back, amara i ll take, it kayla tausche, force there in paris. thank you very much, president biden commemorated the 80th anniversary of d-day with a speech in normandy. biden drew on the heroism of the us army rangers who scaled the cliffs of pointe-du-hoc on d-day in 1944 to urge americans to think for this either of the fight for democracy as a cause greater than themselves. and cautioned against isolationism not just to honor those who showed such a remarkable bravery on that day, june 6, 1944. it s listen to the echoes of their voices to hear them because they are summing us. and are summing us now. they ask us what will we do? they re not asking us to scale these cliffs, but they re asking us to stay true to what america stands for they re not asking us to give or risk our lives. but they are asking us to care for others and our country more than ourselves they re not asking us do their job they re asking us to do our job to protect freedom in our time, to defend democracy, to morning for being with us. so let s talk about that speech that we heard from biden up on that famed clifftop obviously, there was some echoes of reagan s address at that same location in 1984 we heard biden there make his case for america s leadership in the world, but he also had a political pitch for those of us here at home. what did you make of what he had to say though he did not mention trump specifically? yeah, he was never going to mention donald trump by name. that would be a big headline because that would be a qbi accused of politicizing this historic memorial to these fall heroes and the people who actually were successful in storming the beaches. and so he has to walk a fine line between reminding americans and the world of democracies challenges today it s one of the top issues on the ballot in terms of what people of both sides think without making it too political and he can t make his entire election pitch all about democracy, given that a lot of americans face more common concerns about pain for bills paying for food and gas. and so they re not going about their lives thinking about democracy all day long. what do you think the white house is hoping will come up today s state visit with the french president well i think, the white house wants to send a message that the u.s. and france are aligned totally on ukraine. tried to see if they can move the ball forward in getting piece in gaza and israel. and i think they want also remind americans of the problem progress that they ve accomplished in terms of pushing back russia from ukraine. they ve had they have rare. this is one of their top foreign policy victories. but it s still uncertain and trump has said he is kind of less in zelensky s corner and people on the right are very skeptical of having a very drawn-out war and it s taken a long time to get weapons back to ukraine. and so they ve had to they ve had some tough spots in terms of zelenskyy is aides were saying, hey, one speech in normandy is not going to to help us out too much. we need weapons, we need training for pilots. if you look, just over the past several months, of course, macron and biden have been aligned when it comes to foreign policy, when it comes to the big picture with ukraine and obviously trying to prevent putin from expanding his empire. and of course the war in israel. but macron has taken a different approach and the way he thinks the western world should defend ukraine and also the way that he has condemned israel more publicly. what will you be looking for when it comes to their joint statement? well, they usually work these things out, weighing advance and there s not gonna be that much daylight between the two liters on major themes, the u.s. france or are huge allies. but i m going to what s interesting is that macron s team wanted a press conference joint press conference with biden. they turned that down. there is issues about an logistical issues they ve also had disagreements about china, france, macron has been more warm towards president xi and france has wants to maintain their commercial relationship with china more than the u.s. and i expect that to be talked about a little bit in their joint statement and in their private meeting what about their political calculations as both leaders meet today, i mean, they re both suffering low approval ratings, right? so if you could just give us context on both their perspectives as they have this meeting well, most people don t vote based on foreign policy or a meeting with a foreign leader, not as many french americans who are looking at this relationship, but i think that macron and many european leaders are afraid about biden s political standing they don t want to deal with donald trump one more this, is someone who has said to vladimir putin, you can do whatever the hell you want. if those, if countries are not paying their nato dues and so that is something that is macron can t endorse biden, but he s giving him a bear hug during an election year and this is biden s only state visit abroad during the seizure. and so of course it has good timing. but europe is afraid that it s going to get abandoned by trump, who is going to be more isolationist if he wins reelection, what is significant that you have president biden on this state visit during a very busy election year, daniel 8:00 p.m. local time, he will be holding a press conference and the expectation is that he will announce his withdrawal. now, he his party is not part of the the ruling coalition led by netanyahu. he joined the israeli war cabinet after 7 october, really, is part, a, part of a unity government. however, he has had differences his with prime minister netanyahu for many months. now he has been pressing for some sort of end to the war in gaza. but netanyahu doesn t seem to be in a great hurry to do that. now, we understand, however, that both of them basically agreed that they don t want the creation of a palestinian state something that president biden has pushed for eventually. and neither of them is in favor of the palestinian 40 running gaza after the war. nonetheless guns has had better relations with the biden administration. then the prime minister netanyahu gantz has actually gone to washington in defiance of the wishes of the prime minister but the fact that his party is not part of the ruling coalition means that his departure isn t necessarily going to result in the fall of the netanyahu government. it may however mean that the extremists in his cabinet will have even more influence on the prime minister timur emmer up, victor been wiedemann thank you so much. within our scene and military analysts, kernel cedric latent and cnn political and national security analyst david sanger is also a new york times white house national security correspondent and the author of a new cold war s, china s rise, russia s invasion and america struggled to defend the west, gentlemen, welcome, good to see you, colonel, let me start with you and kind of put together the news that we got from the top with ben wiedemann. and this expected departure of benny gantz does his departure dramatically change the execution of the war by the idf? said that there could be more extremist who have louder voices within this coalition of netanyahu s. what does the war cabinet without gantz look like on the ground? well, good morning, victor. i think it looks less moderate and if you can use the term moderate in quotation marks because the way the idf has conducted this effort, it, this war effort in gaza, it s really doesn t look like it s a an operation if they re handling with kid gloves, they re using brute force tactics in many instances and ben described at the top of his port there are still very major operations going on. so in the short term, the departure of the potential departure of defense minister against will not change those operations. and in fact, it could basically exacerbate debate the tensions that are already very high between the civilian population in gaza and the idf. so i think these are the kinds of things that we have to look for. i think that against this departure may result in even less moderate approach. when it comes to the conduct of the war david, betty guys gave netanyahu and ultimatum. he wanted to hear the plan to get the hostages back to israel. and what is the plan for a post-war gaza if he didn t get that, he was out on june 8th. he s not getting that and we ll get to that a little later. but what s the white? get house view of this likely departure well, on one hand, they are completely in gantz s camp. here it s the white house that has been pressing for a plan not only a short-term plan on the military sayyed, but an end game plan here for how gaza would be administered, for how long israeli troops would remain, four, how do you define the defeat of hamas? because as we learned after 911, you never completely defeat a terror group. obviously new members joined and so forth. but you want to get to a zero point, which president biden thinks he israelis arad right now, where the terror group cannot launch another major attack which of course is just what the president said the other day. so gantz s had much more of a direct channel back-and-forth with the pentagon, with secretary, lloyd austin, the defense secretary certainly with jake sullivan, and national security adviser and his departure is actually going to make it a little bit harder for the administration to talk to the war cabinet there are accustomed to ganz. he used to run the military. they consider him to be somebody who thinks and military terms and it s going to leave them more dependent on talking to netanyahu. kernel weight and cnn has learned that the cia is circulating a report that concludes a netanyahu is likely to defy the u.s. demand for the plan. the plan that benny gantz once as well about what happens after the war his belief is that he can avoid an exodus of military leaders, of members of the coalition if he speaks in vague terms here about what he wants to do next for in gaza how does that, if at all influence what the us does as it relates to military support, financial support for israel well, this is going to be very interesting question, victor, because it may not be the administration who wants to do this. the biden administration, but this could very well play into our hands of those elements in the us who do not want to support israel. there have been calls even from the nwa cp to stop arming israel, to stop weapons supply for israel. and if those kinds of efforts bear fruit, they could very well and create a big rift between israel and the united states. it was really be the first time in a long time that we ve actually seen a cutoff of arms from the us to israel. and i think it s a very distinct possibility, if netanyahu gets his way. and in essence kicks the can down the road forever and ever. and it does not come up with a plan and in essence says stalls everything so that he can not only maintain power, but keep the military operation alive for a very long time, a quickly david, how big of a threat politically is betty gods to netanyahu now outside of the war cabinet, if he does, it leaves a few months ago, we would ve said a significant one. israelis hold pretty highly for his opposition party but that has decreased some in the past couple of months. it ll be interesting to see if it comes back back now as he s operating from the outside, instead of the inside in some ways, he may be a bigger threat to netanyahu as an outsider. and thus more free to be a critic david sanger, kernel, cedric leighton. thank you thank again by cnn military analysts, kernel cedric leighton and cnn political and national security analyst david sanger. new york times, white house and national security correspondent, david, let me start with you. there will be a lot of pretty pictures today some fantastic champagne tonight in the meantime, in-between time, what s the work that is to be done well, i m the pomp and ceremony sayyed. no one does this like the french, the dinners, the whole look in the elite zai palace the parades you ll remember that it s when president trump, when he was still in office went to a military parade in france. that he came back insistent that the united states too big military parades in washington and his military had to talk him down from this. so you ll see a lot of great scenery on the substance, it has been as you suggested earlier, vector a bit of a testy relationship. it s started off badly when the united states went and behind francis back did a deal with australia for new nuclear submarines. and basically cut out in existing french relationship that didn t get it off to the start and they ve had different strategies on ukraine consistently with president macron only recently raising less suggestion that the west should be putting troops into ukraine, something the president opposes so you ll see a little bit of jiaqing on that. but i m sure they ll do their best to make her that doesn t come out. it s one reason there s no joint press conference and speaking of the pomp and circumstance, if you gentlemen will hold on for a bit as we take a listen to these live moments right now in paris and as we bring it back to the conversation with david saying or and curl, cedric late. and we also have nic robertson are international diplomatic editor are standing buy on the issue of substance. and i want to get to you, colonel leighton let s talk about ukraine, because obviously ukraine is top of mind for both president s as zelenskyy was there for the d-day commemorations. we saw that he had the meeting with president biden on friday where he thanked him for america s reversal on policy allowing us weapons to be used inside russia for counter attacks but of course, biden also apologizing for the delay in funding colonel, how important is it for president biden and macron to be in lockstep in strategy when it comes to crime because we ve seen some differences, right? i mean, macron has been, i guess bolder in his approach to ukraine wanting more direct military involvement by nato allies. what are your thoughts on his approach versus the us one of the great things about this is that as we watched the two presidents lay the wreath to add the tomb of the unknown soldier s in france, in paris let s be honest the way in which they re doing this together is kind of the way the country s really want to act in terms of ukraine now, when it comes to the actual fact of the matter, there on slightly different timetables. so it s not anything that can t be bridged but one of the things that the french have announced is that they are going to provide training in mirage 2000 jet fighters for the ukrainian armed forces and that is going to make a really big difference. in the war effort in terms of beefing up ukraine s air force that will be in conjunction with the team training that is already happening. i not only in the united states, but in denmark and there s also supposed to be a trading center in romania that is being set up with french health so these are the kinds of things that will be a part of the effort. now, in terms of artillery and air defenses, the french have provided and in the process of providing even more weaponry in that, in that area to the ukrainians the united states, of course, as also do this in the preponderance of military aid is still coming from the united states, but basically france is leading the european collision to support the ukrainian war effort and i think president mecole seize this as being really a very important bulwark that he s setting up an essence of buffer zone with ukraine at the center of this buffer between an expansionist, russia desire by russia to move forward to consolidate its power and in essence to challenge nato, france recognizes that any challenges to nato are really challenges to its sovereignty and instability to note, maintain its independence as a european power. but it also means that the french are willing to to some extent to shoulder more of a burden, at least in the political sense. now in the 5-methyl, since that s a different, a different issue nic robertson to you now, both of these men are watching the calendar and they know that the us is about five months out from that s not funnel election and the former president donald trump could possibly be in the oval office again, how much does that calendar and the potential for a change in leadership here in the us influence what is happening today, what will be decided and discuss today, and the urgency of any plans as it relates to the two major wars were watching and the rest. let me pause and we ll listen here to this moment i don t april a belt all right. the emmanuel macron s position today is a concern and it s a concern because of the recognition that president putin in russia will just exploit any tiny difference that he spots in the nato alliance in terms of positions, whether it s macrons forward leaning desire to put military trainers on the ground inside ukraine, united states reticence to do that compared to an even more potentially isolationist situation in the united states under donald trump, if he becomes president and carries out some of the things is indicated that he would do yeah. as the clock counts down on that because they re putin would not be looking at exploiting small differences. there would be, in essence, if that was to happen a major rupture in the nato-like alliance and the belief in countries like france and germany and the baltic states and the new members like finland and sweden is that putin would massively try to exploit what he would perceive as a weakened nato because it wouldn t have the united states support that the money going into ukraine and the weapons going into ukraine could be faltering. so the clock ticks. there is nothing i drew. these leaders are perhaps less that president macron can do and maybe more that president biden can do in terms of finding ways to win the narrative and win the election in november. but the calendar is against both man and there are no assurances today that president biden can really give him emmanuel macron or any other european leader that are going to assuage their fears that an isolationist, the united states could be a reality they re dealing with by this time next year, of course, emmanuel macron tried to have a strong and positive i m robust relationship with then-president trump. but even that, despite his best efforts, faltered along the way. so there s a real realization macron has dealt with a president trump and knows the realities of the difficulty of how that relationship could be. so it s hard to it s hard to know what precisely the nature of the conversation, but undoubtedly it s going to be a topic and undoubtedly macron would look to biden any assurance and reaffirmation. biden s come confidence that he is going to win the election but at the same time, we ve also saved macron aggressively push for a self-reliance self-determined europe, and less dependence on washington. i want to thank all you, to paris now, a cnn senior white house correspondent, kayla tausche president s biden macron are expected to hold in talks today of this working lunch. hit the high points. what will they be addressing in the meetings well, they re going to be a few a topics of discussion that will figure prominently. first how they can strengthen the nato alliance, how they can continue supporting ukraine, and how they can secure the indo-pacific with president macron not willing to be quite as hawkish towards china as president biden has been thus far, but there will be some cooperation it s a maritime cooperation that the two countries are set to announce. present macron is also expected to share his thoughts on how president biden is handling this situation in gaza where he has broken with the president s position of seeking a negotiated peace process to reach a two-state solution. macron has said that he his ready to recognize a palestinian state. and there has been frustration here in france over that civilian casualties and the humanitarian toll that s been exacted in gaza as israel has prosecuted its war against hamas the administration has said that president biden expects a frank and open discussion, one that s candid and expects it. there may be some areas of disagreement there, but despite those areas of disagreement, both on the handling of the situation in gaza, as well as a high-profile break between the two allies a few years ago, over a submarine partnership that france was excluded from administration. aides say that the allies have never been closer, that their relations kinship has not been weakened in any ways by those fractures. remember, state visits are reserved for only the closest of allies and the white house has taken note that france is the us is oldest ally, and certainly those leaders standing shoulder to shoulder on those issues projecting this image of strength and partnership to the world is one of the main goals of this state visit, this happening today. so that will be really the scope of this state visit. you mentioned the press statements that will be happening later this afternoon. there has been some frustration that when president macron visited the us for a state visit at the white house, there was a press conference that was conducted tween the two democracies with two questions from members of each country s press corps. that is not happening this week. there will be a press conference at the g7, but there will not be one. this at this visit, which has been a source of frustration for some diplomatic editor, nic robertson. and max boot, who was a senior fellow at the council on foreign relations and columnist for the washington post. max is the author of the new book reagan, his life and legend welcome to you all. max, let s start with you. and as a both leaders head eventually to this working lunch, talk to me about how you would characterize biden add macron s relationship? basically, there are political calculations at play as well. and then the bakr i should say, front of macron s mind he has to be thinking about the potential return of trump to the white house. i would say that presidents biden in macron have a very good relationship and as you say, i think a qur an is very happy to have joe biden in the white house rather than having to deal with placating donald trump, but i think the the anecdote that joe biden often tells us how that when he first came back into office and met with macron and he said, you know, america is back in macron and others said, but for how long and i think that s the shadow of trump hangs over all this. and of course, but even though biden and trump in macron do have a good the relationship they do have a lot of things that its costs including macron proposal to send french trainers into ukraine or is suggesting that they could be sent into ukraine, which is something that biden has expressed doubts about are or suggest that it s not a good idea. so i think there are things for them to hash over, but mainly i think this is just a wonderful moment of transatlantic unity to highlight how close the alliance is under biden angel greatly endangered or would be if trump were to come back into office? general hurtling as kayla mentioned, gaza and israel s war with hamas will certainly be something discuss today. there was the idf operation that. happened at a refugee camp that freed for israeli hostages some of the concerns here around the icc seeking an arrest warrant for netanyahu, while paris backs that washington called it outrageous the backing and supplying of weapons how significant are these differences on gaza, on support for israel between these two? well i ll try them with what max you said victor and that is they are certainly there are certainly a close relationship between president biden and president in a car but they do have some differences president macron has been very vocal in making pronouncements about different things. he is supported different things. then president biden has so well, their relationship is very close and they see democracy and the emotions of what is occurred over this last week as being similar, they do have some differences of opinion and i heard you earlier talking about the lunches and dinners. it will occur today, certainly, presidents and dignitaries du. a lot of eating and drinking further country but this is a time for them to hash out some of those disagreements, some of those differences of opinions, i think president biden has got to stay very succinctly what he believes should be happening in gaza and in ukraine, and how the nato-led clients should move forward. so that s what these dinners and lunches are all about outside the view of the kind of pomp and circumstances we saw this morning at the art to draw jennifer, i just want to follow up on that regarding these differences in and specifically on ukraine, we heard on friday, president biden apologize to velocity more zelenskyy about the delayed aid president biden obviously blamed for that but after mr. zelenskyy thanked the president for that decision to allow us arms to be used in a limited way to counter attacks inside russia. he added quote, there are some detail hells on the battlefield that you need to hear from us. i heard a bit of frustration there and zelensky s tone then, what do you think he s referring to? obviously he s referring to these restraints? well, what the presence, the once-key was likely talking about was the ukrainian targeting processes. amara president biden has specifically said that these long-range weapons should be used for an operational and tactical role. what does that mean? an operational or tactical deep strike using things like atacms and artillery pieces and potentially even jet fighters has to do with what can affect the front lines, what kinds of things are ready by russia to literally attack into the ukrainian defensive positions now, there s a difference of opinion in terms of military leaders saying what you have to do is not only du, deep strikes against those tactical targets, but what russia continues to do is push their forces further and further back from the front lines so that they are not under ukrainian attack capabilities. so that s what i think president zelenskyy is going hi to talk about how far inland can we hit? can we hit air bases that are launching some of the glide bombs? can we launch or can we attack missile launch sites so that some of our cities don t continue to come on your cat. the problem with all that is many of those russian launch sites and air bases are deep within russian territory and cause concerns from russia about attacks within their federation that could interfere with say, their nuclear defense strip, that they have put that forward saying, hey, our radars for nuclear and strategic defenses have been interfered with by ukraine. so we re saying that that is truly an attack on mother russia and this is what president biden wants to avoid primarily for the purpose of this war, not expanding into a greater european war with other nations involved you re watching the precession parade possession here along the song sally s a president s biden and macron are writing there together as indicated by the flags on the front of that vehicle we have max boot and lieutenant general hurtling with us mess. let me come to you and general hurtling says that this is the time to hash those things out. some of those differences. do you expect that there will be decisions that there will be resolutions to any of these differences today. or will they just be further discussions i m suspecting there will be further discussions, but i mean, i think these as mark hertling said, i mean, i think these kinds of discussions are very important because normally these discussions are conducted at the staff level or with foreign ministers. it s either good is very important to have the heads of state directly involved. and this is going to these kinds of occasions or the time when the heads of state have the most amount of time to spend with one another as mark hertling mentioned, there s gonna be a lot of lunches, a lot of dinners, a lot of ceremonial occasions. but while all that is going on, they can also have very substantive talks. and of course some of the stuff they re going to talk about is going to be the kind of stuff anybody talks about at lunch or dinner. it s going to be there s gonna be some polite chit chat, but i think they were also get to some of the nitty-gritty and try to hash these things out. but i think i think the big thing that a macron and other europeans are going to be looking for is something that biden really can t offer which is reassuring they want reassurance that the united states will stay committed in europe, that we will remain committed to the defense of europe. we will remain staunch and standing up for ukraine and opposing russian aggression. and of course, the best that biden can say is that s what i want to do, but i don t we have free and fair elections that america and if if i joe biden lose in november everybody knows that they could have we could have a very different policy come january 20 of next year. and so i think there is just there s gonna be a lot of hand-holding as well as a lot of hand-wringing about the outcome with the political process in the united states. and because president biden will not be able to give that reassurance that he will remain in office for another term. dig robertson to you standing by you to do expect president macron to be even more vocal, i guess more aggressive as the election, american election approaches as he has been pushing for the continent s self-reliance to take its own security collective defense more seriously absolutely. i think this is exactly the direction that europe is headed in now, because it recognizes that if not now, in the future, it may face those decisions are not every country has ready for it far from it. in fact, you have some real outliers in the european union right now, like viktor orban, the prime minister in hungry or robert fit. so the prime minister in slovakia who are both pro-putin, who are both against europe supporting or the european union financially militarily supporting ukraine this is sort of the headwinds in europe, at least that president macron faces course what he has been talking about in france has talked about for some time is a more united defense policy in europe where you become in the same way it s more similar to united states in terms of manufacturing armaments you only have a few fighter jets. you have the f 60 and you have the 15, you have the f35 in europe, there are many, many different arms manufacturers and they produce for their nations are a handful of nations within the european in union, a commonality of armament making, which is really the pressure that faces nato, right now. in terms of getting armaments in big enough quantities quickly to ukraine, that you can do this better by rationalizing a pan, europe p and defense industry. and of course, each country wants to have a big slice of that. but this is the direction that macron has encouraged european leaders to look at in the past. and one that would potentially where at the european union, which doesn t have a common defense minister, let said as ahead of foreign policy, your sip borrell at the moment, but it doesn t have a head of defense in the same way that that is something that nato does. but if united states didn t support nato in the way that it does today, then that would fall to the european union. so macron really has been a sort of a liter and a pusher for that within the within europe. and it s even his strongest partner, perhaps in the european union in this regard, would be germany, that their position is not the same as macrons. so it is an up hill struggle but it is something that absolutely they face and we heard this when president trump first came into office, if you go back those years, there was an emergency summit, european union leaders in mulcher, i believe it was and it was back then francois, along the french president and the german, the german chancellor, that then mac merkle, angular merkel, who were both saying, we need to sort ourselves out and be ready to be able to deal with an isolation is united states. so the conversations are well underway. all right. will idf, the israeli military also, the security agency saying it was a joint operation that happened in central gaza in the area of nuseirat. it was a significant operation which at this point we understand has left at least 45 killed on the ground. and hundreds injured according to our cnn producer, on the ground. but what it has also meant is that for israeli hostages have been rescued and they have been brought back to israel. now, according to the statement they say that they are in good medical condition. they have been taken to a medical centre near tel aviv to receive a treatments at this point, we have already seen video of one of the hostages you were just mentioned they re no money receiving a phone call from the israeli president, hertz. but there are four that have been released, so no or argon money, who as we remember, we did see her on the back of a motorbike being taken at the nova musical festival on october 7, that also under aid caused law for 27-year-old is a with this one bit of good news for the israelis. his problems, his issues with prime minister netanyahu have not been resolved oh, they have fundamental differences. they were political rivals in the past. so that doesn t change. but i think for now, he s it s not canceling, probably not canceling his announcement, but he s certainly is going to postpone it while is rarely a digest. this news, i months of intense warfare in the gaza strip keeping in mind, of course that what was much more successful at getting hostages released was that ceasefire in late november of last year where if i recall correctly, at least 40 hostages were released. so certainly what we ve seen since that very brief eight days cease fire that the military we operations have continued and have today had some success, but until now it hasn t really resulted in much other than, as i said, just seven hostages released. in the meantime, we ve had more than 36,000 palestinians have been killed we picked her. rafah continue you, this, this makes it very clear that operations across the gap gaza strip in these specifically the underground, subterranean facilities the tunnels that hamas has built underneath different infrastructure as what s been critical. so yeah, the intelligence is what drove this. i m sure this wasn t just stumbling upon four different hostages in two different locations. this has to be an intelligence driven operation, which he israeli military has been trying to do since the start of this campaign and max sent to you and what what does this mean for the hostage and ceasefire negotiations that are on going? also, knowing that benny gantz, a cabinet minister we ll now he postponed his announcement of resignation apparently due to the release of the rescue of these hostages does this increased pressure on netanyahu to bring more of the hostages home well, obviously it s very good news to get these hostages out. i mean, i think netanyahu has actually been fairly receptive to the latest ceasefire plan, which is being pushed by the biden administration in a coalition of other nations. i think the holdup right now is hamas. they re not agreeing to that plan because basically the hamas leadership thinks that seems to think that it doesn t matter how many palestinians are killed or how much that people of gaza suffer because there s longer as the hamas leadership in some of the fighters are secured here are these underground tunnels they can still hold out and essentially come out after the israeli military retreats. and i think they i wouldn t be unfortunately, i wouldn t be not optimistic about an immediate ceasefire coming because these negotiations have been going on for many months you d have not gone anywhere and i think for israel, they still face some very difficult issues. namely what happens in the months ahead they don t want to occupy the gaza strip, but then the question is who is going to bring security to that area what is the day after look like? and that s something where netanyahu has still refused to provide any kind of vision because it would be two political difficult, politically difficult for him because his coalition partners don t want any role for the palestinian authority and at the same time, there s very little support for actually having the idf occupy the gaza strip and so this doesn t really solve israel s intractable problems. unfortunately, i m sorry to say it doesn t mean that the offensive was going to wind down anytime soon general didn t answer the questions. it doesn t resolve any of those issues, but i wonder as we look at this video of hostages who are free and the celebration in the streets politically how much time does this by netanyahu relief from pressure both domestically with the pending against resignation and the pressure from the us and other allies around the world well, i don t think it s going to gain a whole lot of time internationally. victor, it certainly will gain some time domestically from mr. netanyahu because he has a lot of supporters in the israeli government. i d like to point out though one thing that our great report are, then we amend mentioned he said the last big tranche of hostages occurred after the cetacean abbas still cities several months ago, and there hasn t been that kind of released since then. yeah, i d like to point out though that israel has made the opera to hamas on multiple occasions to have ceasefire in exchange for hostage yes. and hamas continues to play with them on this. they will bring them right up to the doorstep of a ceasefire with the potential for release of hostages from both the palestinian camps and israel, but also the ones that they took on october the seventh. and then at the very end, just when there s hope, hamas dashes those hope i think that s what max was describing so it means it s going to mean a continuation of the operation. and there is certainly a disconnect between the biden administration and the netanyahu government in terms of what they should do, in terms of a ceasefire. and the three-phase plan that president biden pointed out that he was offering allegedly with mr. netanyahu is approval a few days ago. but i think as long as the hostages are still in captivity and hamas shows no interest in releasing them. remember these four that were kept, were recovered this morning alive. we re not given up by hamas. they were driven by intelligence operations by the israeli military. so i think you re going to see a continuation of that kind of intelligence. and plus, i d add that these hostages will also be able to add to that intelligence in terms of their type of treatment where they d been moved from the number of moves they ve made what locations are they putting their fellow hostages in? they may be able to add a lot of information and intelligence for the israeli military to go after some morehouse. it really is remarkable that they were able to rescue these hostages eight months after the war started on tovar seven max. if and when benny gantz announces his withdrawal from the emergency war cabinet he is a centrist. what kind of impact do you see that happening on netanyahu s government? do you expect? to see more of a hard line approach that s very hard to say. i m not sure that that much is going to change. i mean, benny gantz can lead, but it s not going to bring down the government the issue that could actually bring down the government is question of conscripting ultra ultra-orthodox men into the israeli military because some of the ultra religious parties in the the cabinet are completely opposed to that. and if the israeli supreme court gives the go ahead to conscript the ultra-orthodox, that could actually be a crisis that could bring down the government. i don t think that the benny gantz departure will bring down the cabinet. i mean, i think my it s a little bit hard to know exactly what goes on behind the doors of the war cabinet. my sense is that benny gantz is certainly more open than netanyahu has to the idea of having the palestinian authority play a role in governing gaza after the war. but i think honor has also been pretty much of a hardliner on rooting out hamas fighters, even at the cost of substantial numbers of palestinian civilians, deaths i m not sure he s diametrically opposed to netanyahu on, on a lot of issues. i mean, i think he certainly has a perception as being more of a moderate but he he s not, he s certainly not a dove i believe the conversation there max only imagine and we re witnessing house some, and, some of their celebrations. but i can only imagine how it must feel for the doctors there who are real professionals in helping these hostages come
