DNA kits, Michael (not his real name) braces himself for what may follow: a message from one of his hitherto unknown offspring. Three decades ago, as a student at the University of Houston, Michael became a sperm donor; the clinic would “pull me out of retirement”, he says, every time a customer wanted to expand their family. So far, the 55-year-old knows of around 60 children (and a dozen grandchildren) he has sired in addition to the four teenagers he shares with his wife; he suspects the true number is closer to 100.

Dov Fox (University of San Diego: School of Law) has posted Reproducing Race in an Era of Reckoning (Minnesota Law Review, Forthcoming) on SSRN.  Here is the abstract:
What place should racial preferences have in the market for reproductive materials? Would-be parents might have all sorts of reasons for caring about the ostensible race of their future child. Maybe they hope others will see them as a family bound by biology; or they want to shore up the emotional ties they themselves ascribe to the physical resemblance many map onto racial features. For some people, their kid’s skin color can matter for its power to entrench cultural privilege; while for members of marginalized groups, it may be about preserving their kinship or community. Legal scholars like Patricia Williams, Dorothy Roberts, and most rigorously Camille Gear Rich condemn reproductive race-matching by those who need help from a donor or clinic to conceive. I argue it’s a mistake to single out whatever influence race has in choices by aspiring parents who enlist a third party or doctor to have kids. That’s because racial considerations are no less pervasive or contested in assisted procreation than they are in sex, dating, foster care, and adoption. In all of these, picking a partner, donor, child with race in mind risks sending a divisive message: that families should be separated by color, along with pernicious undertones that some races are better than others. I argue reasonable people can disagree about whether something like colorblindness is a social ideal worth aspiring to in the personal domain of family life. But my central reason for writing is more modest: If you forcefully resist any such role for race, don’t focus solely, as Rich does, on fertility medicine. Targeting the single, same-sex, and infertile people who rely on it to reproduce not only demeans the families they set out to make; it perpetuates their exclusion from those intimate relationships.
