carroll, all that stuff, i mean, if he, if he goes on the stand, he's going to open a lot of that up, and i think the, the issue is whether or not it's sufficiently probative of his credibility for the prosecution to cross-examine him on it, and it probably will be. so it, you know, he's not somebody who should go -- >> on the witness stand. >> that being said, you know, he's, he's a narcissistic sociopath. he is impulsive, and he, if he feels, on a given day, that he had to do it, and he's, he could just, he could decide to do it and overrule his lawyers. but, you know, other times, he followed his lawyers advice. i mean, he followed his lawyers advice during the first e. jean carroll trial, basically not to show up. and then he showed up for the second one, and they couldn't contain himself in front of the

but other times he has followed his lawyer's advice. he followed their advice during the first e. jean carroll trial, basically not to show up. then he showed up for the second one and he couldn't contain himself. that cost him tens of millions of dollars because he basically behaved exactly as the plaintiff was describing him, as somebody who was remorseless, ready to say anything, who had contempt for the courts rulings and contempt for the truth. he acted out right in front of the jury. it is going to be a lot harder for him this time because this is a lot more. if this is about his own people testifying and describing things that he did, people who were there from david , we never heard from david packer. hope hicks, we never heard from him about this. he is going to have to sit here and listen to it. he is not going to enjoy himself.

bogus theory. >> march is coming soon. and before i let you both go, the e. jean carroll trial, which begins on tuesday, it's hard to keep track of all these things. great to have both of you. it's almost become an afterthought, but why, and, you should we not lose sight of this one specifically? >> well, this is an important example of donald trump not adhering to the rule of law. he was already found liable by a jury, and then proceeded to continue to defame e. jean carroll. and that is not just me saying it, that's the federal judge overseeing this, has found liability. so the case is going to be about the damages and needed to deter donald trump from continuing his defamation of e. jean carroll, who he has been found to have sexually assaulted and defamed. so, again, if you're thinking about who to vote for, you would think you might be

harmed another human being, and he does not want to. of course, he is trying to avoid it. now, he did not attend the first row of miss carroll. so, there is no reason that this judge, judge kaplan, should say, let's not the presses, let's hold off, and let you go attend a funeral, because you're not probably going to come anyway, and you have to establish a record of attendance. >> i will ask you to read a crystal ball and predict whether or not he will show up, though, consider the fact, as he said, he did not show for the first one. he did spend a tiny bit of time at the new york attorney general civil fraud trial, as we know. he could invoke this as an excuse that he had to go take care of melania, who nobody has seen. but do you think that he'll show for this one? >> well, he said he would show up in the first e. jean carroll trial, he did not. how to be a little surprised if he did here, for a couple of reasons. one, he knows that judge kaplan runs the courtroom with a tight set of controls. he knows that judge kaplan has

rape or. or did not know her or had never seen it before. he cannot question or attack her motives or the link that he had assaulted her. he cannot say that he was defending himself from a false accusation. he also cannot make reference to a wide range of other prejudicial, irrelevant or otherwise inadmissible matters that have featured prominently in his recent public statements about the case. joining us now is faith gay, former federal prosecutor for the eastern district of new york. faith, it's good to see you. i know that you have been following these cases very closely, as we all are. i am interested in knowing what you think about what just happened. 11th hour on the eve of a holiday weekend, literally right before trial is supposed to start on tuesday morning, trump tries to use the mother-in-law funeral tactic, which he tried in the new york attorney general civil fraud case the delay as well. do you think that that is a sign that trump knows that his goose is cooked when it comes to this other defamation suit? >> thanks katie for having me. when that happened with the civil suit, of course, guilt is established.

what we can control, as i said, is what we do with the agency that we have as voters, who hold donald trump accountable at the ballot box. again, i think what you will find here is that, the redemption will be that whatever happens to donald trump, in the criminal or civil trials, it will be because a jury of his peers made the decision. he will not get trump justice, which he would mete out with any of his opponents. he will get american justice, and then we had to do our own sense of justice, as i said, when we go to the ballot box. that's how we renew and write a new chapter for america. >> congressman eric swalwell, thank you for joining us tonight. >> my pleasure. >> appreciate. >> thank you. >> as soon as one trial ands, another one begins. such is life for defendant trump. next up is writer e. jean carroll's second defamation trial against trump, expected to begin on tuesday next week. after the judge shot down a hail mary last-minute attempt by donald trump to have that

he knows that judge kaplan has no problem speaking back to him or to his lawyers, not that judge kaplan is one sided or the other, but he is going to ensure that there is a fair trial, that these jurors are not intimidated, that they get a chance to hear the evidence. i don't think that there is any reason to doubt that trump is concerned about that. will he show up? he might make a cameo appearance, but given that, miss carroll's trial team has already said that they need some help in controlling mr. trump, so it won't be an upper, like in the a. g.'s case. my sense is that if he shows up, it will be in and out, and he's not going to get away with what he did in the a. g.case. >> so, let's talk about accountability though when it comes to this. donald trump continues to defame e. jean carroll, continues to claim he does not know who she is, and he says stuff like, i have absolutely no idea who this woman is, but i am going to go to it, that being the trial, and i am going to explain to i don't know who the hell she is. that in and of itself maybe is not defamation, but we do know

in the last trial, with miss carroll, the defamation by donald trump was clearly establish. the jury found, and we now have another jury, another democratic exercise endures figuring out how much it is that mr. trump defamed miss carroll, how much he hurt her by doing that, how he destroyed her life, how she has received threats, death threats, her reputation has been armed in a huge way. he knows that the limited piece of this case, what this jury will see is going to be a litany of ways he victimized and harms the life of miss carroll. because his guilt is already established, already clear that he defamed her. it's already clear that he lied about her, repeatedly. all that is left here is going to be a limited trial about how he victimized her. that is completely counter to his narrative of himself being victimized by the jury system.
