we do not know what is going to happen next, how he's going to behave, and what this will do to the campaign in the future. will there be a trial before the election? we don't even know the answer to that. >> yeah, we don't. elliott, i do want to take a little bit of a turn here before i let you go and ask you about trump's classified documents probe. we've heard from the vice president. he has said that their process for the white house going through to declassify materials, he doesn't have any knowledge of any broad-based directive from the president. that really flies in the face of what trump has said. i wonder if you think that causes problems for trump. >> it doesn't cause any legal problems for trump because, whether the documents were unclassified really doesn't matter based on the things he was charged with. he was charged with mishandling defense information and obstruction of justice. it doesn't matter if those documents are classified or declassified. what it does is it pokes holes in the former president's credibility. he made a statement that sort of
>> right. well, one of the things that the trump team did was they showed a graphic in which they stacked up all of the documents and compared it to the height of the statute of liberty. and they pointed out that the former president has all of this material to go through to prepare for trial. that's the reason why they asked for a trial in 2026. the jack smith team, the prosecution here, the justice department says that you're misleading the court. they said that the discovery is going to be laid out in a way for the former president and his team to be able to go through it very, very quickly and very clearly, pushing back clearly, brianna, against this idea that the former president doesn't have time to prepare for trial. >> yeah. all right, we'll see how that all plays out. evan, thank you so much. and "outfront" now, former deputy assistant attorney general elliot williams, and also anthony michael kreis, a law professor at georgia state university, who has been following the fulton county case closely. and also gloria borger, cnn's chief political analyst. elliott, i want to start with
northern northern. it's gonna be atlanta division. the biggest problem for jury selection would really just be cherokee county. the rest of that metro atlanta area is not trump country still. we know that mark meadows case has been a sign of an obama appointee. if you're trump, the only reason you want to get a federal court, if you think you can get one of your appointees, now that we know that's not gonna happen, i'm wondering if you'll still pursue it. >> in terms of scheduling, assuming this stage is not real, the federal case, the january 6th case goes first, when do you think it would actually go to trial? >> i don't think there's a chance it goes before the election. this is a case that goes after the election. back to the jury selection, there have been cases we had one in south georgia, where they expanded to the whole district. so, because they needed that, if you think about just the hyper emotion and the partisanship that involved in this case, they are going to have to, this will be a jury selection like no other. there are feelings that are polarized, that we like we've never seen. >> elliott, asked about this, this threat we just learned about to the judge in this case. the same color made a threat to representative sheila jackson lee. and i think to all people, if i
president's family, taking politics aside. if you take the name from hunter biden to joe smith, you would say, you know what? that's not really fair. >> that's right. those things do happen to p people, but it is a great stress on them. that's why i believe that the attorney general should have made a firmer decision a long time ago. five years is enough time. wrap it up. if you can't wrap it up, you need to tell me what the solution is. they a debacle in terms of managing this case. >> it is clearly something that's been extremely bumpy. is it wishful thinking, elliott, that the hunter biden legal team thinks this special investigation will stay narrow on issues like the tax charge, not paying his taxes on time, and pretty much nothing else? maybe the diverted gun charge?
extraordinarily aggressive ask by the team at doj. first of all, what doj has asked for is a trial date starting in early january with jury selection to start in mid december. that means the trump team would have about four months to get ready for tile. it's virtually unheard you have to have any conspiracy trial go anywhere near that quickly. at a minimum, a case like that in a federal system would typically take a year to a year and a half. on the back end, as paula noted, even if this tay two to three months to try in january, they'll run right into and perhaps over the current march start date for the hush money trial scheduled here in new york. so something has to gift one way or another. >> yeah, something has to give clearly. elliott, it's interesting, the iowa caucuses as you know are scheduled for january 15th. is that something the judge will
