evening, alex. 250 days, just unbelievable this is where we are. thank you, my friend, as always. so i want to start with a story that in any other universe would have absolutely nothing to do with politics or anything even approximating controversy. the kind of news we all used to read or hear and accept. but in the post-trump era, this kind of news has become a sort of conservative litmus test with potentially disastrous consequences for the health and the well being of thousands and thousands of americans. i am talking about bird flu. i know. stay with me here. if you have been following the news recently, you may have seen that the u.s. is currently dealing with an outbreak of bird flu. bird flu has spread to at least 80 cattle herds across over five states. and because of that outbreak, the fda, the food and drug administration, has issued guidance for how to stay safe and avoid exposure, including warning americans against drinking raw milk. that s because raw milk has the potential to spread animal borne diseases from one species to another. this is pretty straight forward, noncontroversial scientific advice, don t drink raw milk. it s noncontroversial except if you are a conservative who follows the influential, pro-trump youth organization turning points usa. milk is good for you, but here s what the american dairy farmers association or whatever isn t going to tell you is that that pasture rised milk crap, you might as well be drinking water. it does nothing. it s not healthy. ideally, you need to be drinking raw milk. that was alex clark a turning point usa host, and one of the chief proponents of drinking raw milk. miss clark is such a raw milk enthusiast she tells her followers to drink raw milk while pregnant, something that you absolutely not do under any circumstances. and in response to the fda s warning about drinking raw milk during a bird flu outbreak, alex clark told her nearly 200,000 followers on social media, f the fda, legalize raw milk. this issue so animates conservatives that turning point usa is currently selling $35 t-shirts on their website promoting raw milk. now, if this seems like an echo of the anti-vax, anti-fauci, anti-science movement embraced by a ton of conservatives and therefore put a lot of that put a lot of this country at risk, well that is because it is. it is precisely the kind of extreme, own the libs, reality be position that is a hall mark of turning point usa under charlie kirk. charlie kirk and turning point usa have been an influential part of maga land since donald trump was elected in 2016. in recent year, kirk and his organization have become more outspoken about their beliefs, including kirk s embrace of christian nationalism. in addition to running what appears to be a raw milk propaganda outfit, charlie kirk is also a supporter of something known as the seven mountains mandate a philosophy that calls for conservative christians to take over the government. and kirk has started speaking openly about how he wants donald trump to be the champion of that cause. finally, we have a president that understands the seven mountains of cultural influence. finally we have a president that understands the significance of standing, yes, i m going to use a term, in solidarity with the grassroots activists of our country. across the republican party, christian conservatives are becoming more and more emboldened about making america a christian nation under trump, even as trump himself continues to exhibit some very unchristian behavior on a near daily basis. this was donald trump a week ago at a campaign event inside a phoenix mega church. so they come up with this order i won t say it because i don t like using the word [ bleep ] in front of these beautiful children, so i won t say it. i will not say it. but this thing allows millions of people bleep [ bleep ] donald trump swearing in a house of god and then getting the crowd to swear with him in front of children. we ve seen the same thing from trump s allies. here was rudy giuliani speaking at the pro-trump christian reawaken tour just last week. i ve got two prosecutors, fani the i m sorry. fani willis. fani. it s not fanny, and i m not calling her fani. i could drop the part if she d quit and go away. classy. all of this is part of trump s unspoken agreement with the christian far right. they let trump and his allies break the rules and be vulgar and be blasphemous with the expectation that they will refashion american life according to their christian values. may not be a bad bet either. here was trump just this week speaking to a conservative christian organization that believes all abortion is, quote, child sacrifice. you re going to make a comeback like just about no other group. i know what s happening. i know where you re coming from and where you re going. and i ll be with you side by side. you re going to make a comeback and i ll be with you side by side. even as donald trump refuses to give straight answers about where he stands on things like a national abortion ban or contraception, conservative christian groups understand what trump will do for them. it s not that much of a mystery. and part of their confidence here that an extreme christian nationalist agenda is within their grasp, part of their confidence is because these groups don t have to rely on just trump alone. they can count on trump s most powerful ally in the fight for christian dominion, the conservative majority of on the united states supreme court. just this week we heard supreme court justice samuel alito tell a progressive activist that he believes we need to return america to a place of godliness. as elizabeth and lisa write in a new analysis for the new york time, while justice alito is hardly openly championing these views, he is embracing language and symbolism that line up with a much broader movement pushing back against the declining power of christianity as a majority religion in america. the movement s rise has been evident across the country since mr. trump lost re-election in 2020. justice alito and his fellow conservative justices have already delivered for christian right with their dobbs decision, striking down roe v. wade, and soon they will have a chance to do so again. the supreme court is about to rule on two major cases of considerable significance to the christian right. one will determine whether access to the most common form of abortion in this country is significantly restricted or not and another will determine whether doctors in emergency rooms can deny pregnant women medically necessary abortions. how the court rules on these issues could tell us just how much power the christian nationalist movement has gained in this country and how close they are to victory. joining me now are lisa, the national political correspondent for the new york times , she is also the author of the fall of roe: the rise of new america, and with me is mark joseph stern, senior writer who covers the courts and law at slater mag sooeven. thank you both for joining me. lisa, let me start with the piece you have out today in the times. an array of conservative, including anti-abortion activists, church leader, and conservative state legislators has openly embraced the idea that american democracy needs to be grounded in christian values and guarded against the rise of secular culture. i don t think it s an exaggeration to suggest that strain of conservatism now seems to dominate the supreme court as well. do you think that s far off? look, part of what we document in our book, the fall of roe and the rise of a new america, is that latter part of the title, the rise of a new america. what that is about is the radicalization of conservative christians. and we ve seen some of that cooling out of these tapes from the court, but you know, i wanted to draw your viewers attention to another story today, which was that the southern baptist convention, which represents the largest protestant denomination in the country, 13 million church goer, came out and said they oppose ivf. this is a fairly radical statement for that group, and we re seeing this return to these christian conservative cultural values from the churches all the way up to alito s statements at the court. so i do think what we re watching is this shift in american power. we don t know where it s going to go, but we have a template for success for this movement, and that, of course, is the fall of roe. and how that network of conservative christian activists and lawyers were able to take down that legal precedent may be a way that they can then move on to tackle these other things they are opposed to like, as we learned today, ivf. yeah, i mean, i do when we talk about shifting the window, moving the goal post on the field, it feels like the activists on the far right are signalling to the alitos of the world, this is where we re at, see if you get here. mark, i want to talk about alito s evolution here, because he wasn t always either this explicit or radicalized when he joined the court. can you talk about his progression to where he is now? yeah, i think a crude but accurate term to describe alito is maga pilled. during donald trump s rise and presidency, alito really let his christian nationalist flag fly and xan to embrace not only the rhetoric but also the substance of this far right christian supremacy and this idea that christianity is rooted in the constitution, that we are a christian nation, and that courts have some kind of obligation to protect and, indeed, elevate christianity above not just other religions but above secular society. and he went on a little bit of a talking tour earlier this decade where he decried the new moral code of secularism that promoted reproductive freedom and lgbtq equality and said that it was an existential threat to christianity. and all of this is reflected very much in his decisions, decisions like one a few years ago where he tried to let pharmacists deny plan b to patients to whom it was prescribed. not, you know, any kind of actual abortion drug but just plan b. and decisions like hobby lobby where he s allowed corporations to restrict employee s access to birth control. and these abortion cases, most notably dobbs as lisa documented, sam alito was always going to be the man to write that opinion overruling roe v. wade. in the coming days and weeks, we re going to get these decisions on abortion, especially involving the abortion pill. and i think alito is quite likely to stick his neck out in that decision and write about how he believes medication abortion is unlawful under existing federal law, under the comstock act of 1873. this is a radicalized justice, very much maximizing his impact by staking out the positions that activists in the grassroots want him to take, legitimizing them and shifting the window and eventually, he hope, transforming them into the law of the land. yeah, i mean, it s quite obvious that the dna of the christian conservative warrior class has imprinted itself upon the supreme court, but lisa, when we talk about the relationship in politics between, for example, donald trump and his pro-maga coalition and the conservative christian warrior class, i wond every if trumpism hasn t imprinted on them. i m thinking about those two pieces of sound where donald trump is in a church, a big church, and the call and response is the word bs. it s a family program, so i m not going to say the actual word. and rudy giuliani is calling taney willis, the d.a. the fulton county, one of the most vulgar things you can call a woman, with distinct racist undertones. this seems to be a new brand of, i guess, christianity, if you want to call it that, in the age of trump. yeah, look, the church has changed politics. but politics has changed the church too. and church, especially conservative evangelical and catholic church, have grown so much more political. as we show in our book the fall of roe, they made this deal with president trump. he promised them in 2016 in iowa christianity will have power, and conservative christians jumped on the trump train, and it ended up being a bullet train for them. they got three justices on the supreme court, and the deal was set. and now they ve been with him for eight years, and it doesn t for conservative christians, they re with him. he can moderate his tone on abortion, say he wouldn t sign a 15-week federal ban, and they re still probably going to stick with him. they are fully bought in and part of this maga movement, and the two are operating together. now, you know, donald trump is in a different position, because the politics of abortion have changed so radically. he senses the toxicity there, which is why you ve seen him come out and say it should be returned to the state, that he supports exceptions for rape, incest, and life of the mother, so that dance has gotten more complicated for him politically, but there s not a sense that he s worried about losing this group that s really become a central core of his movement and his base of support. well, yeah, and i i mean, one wonder where is the guardrails are in any of it. i mean, the republican party has effectively pledged fealty to everything trump represents, christian warrior class and all, and then on the supreme court, mark, how much of a counterweight is someone like john roberts of brett kavanaugh, does the attempt at counterweighing happen on the supreme court? they are a very feeble counterweight when they choose to be one at all. all three of trump s appointees generally vote in lock step with what the republican party wants. trump has, of course, taken over the party, so it is very much his court. and i think it s really disturbing, especially, to look at some of these decisions that do involve extreme circumstances of tragic medical mishaps where wrim in dire of need of abortion, right, this is one of the big cases this term. states are saying these women cannot get abortions that they have to get sepsis, they have to begin hemorrhaging, they have to be dying before they can get abortions. well, republican politicians lined up to agree with those laws and to support those laws of the supreme court you had a ton of republican state attorneys general and republican governors lining up to say we do think woman should be forced to the brink of death before they can get emergency abortions. i think the supreme court will likely agree with them and continue to force these women into these horrible circumstances. and trump is savvy enough not to say anything at it, because he knows he s got his foot soldiers in the judiciary doing the work for him. he s got his guys on the bench who are ready to uphold the most draconian abortion bans imaginable, and he doesn t have to say anything. and just by remaining silent and not speaking out and condemning these ban, he knows he can keep the christian right very much on his side. and that is the whole genius of the strategy behind capturing the courts. you get these justices and judges on the bench for decades, they will do your bidding, they will uphold your extreme law, they will uphold your draconian policies, and most voter, unfortunately, don t draw those lines between the judges and the presidents that appointed them and the parties those presidents belong to, so they get away with this stuff. that s the story of trumpism in the judiciary. a stop the steal movement and neither was my wife. she did not fly it to associate herself with that or any other group. but audio of martha-ann alito released this week by undercover progressive activist lauren windsor paints a decidedly different picture of mrs. alito s flag collection and why she flew them. you know what i want. i want a sacred heart of jesus flag, because i have to look across the lagoon at the pride flag for the next month. exactly. and he s like, oh, please don t put up flag. i said, i won t do it, because i m deferring to you. but when you are free of this nonsense, i m putting it up, and i m going to send them a message every day. maybe every week i ll be changing the flags. they ll be all kinds. i made a flag in my head. this is how i satisfy myself. i made a flag. it s white and has yellow and orange flames around it. and in the mid sl the word vergagna. in italian it means shame. joining me now is emily, the former neighbor of supreme court justice samuel alito. emily, thank you for joining us tonight. i m eager to hear your reaction to this audio that was released. and we played that specific clip there because it really sounds like mrs. alito is intentional when she flies these flags and that there is absolutely a political point of view she is trying to communicate. what did you make of that audio? absolutely. well, fist of all, thank you so much for having me tonight. it s a pleasure to be here. and to hear her talk about the flags in that way just solidifies what we all know is that they re meant to display a particular message. she mentions the being upset by the pride flag and wanting to fly a sacred heart of jesus flag. well, that flag specifically means anti-lgbtq, anti-pride, so it s very clear what she s doing with the flag. and that just proves us all right that in his statement he s lying where he says we didn t have any reasoning behind it. we don t know what it mean, et cetera. yeah, well, she wasn t trying to be part of a movement or group. i think that that s definitely questionable given fact that she s absolutely flying these flags in response to certain groups. yes, yes. emily, i got to ask you, because she s so animated when she talks about this flag she d like to make that says vergogna, which means shame in italian, it brought back to mind your account of the alitos, according to the new york times , when mrs. alito confronted you, you said something like how dare you behave this way. you ve been harassing us over signs. you represent the highest court in the land. shame on you. the concept of shame really seems to animate her, and i wonder if you could talk more about your interaction with her when the word shame and the concept of shame was discussed. yes. well, that so that interaction, the one that happened on february 15th, the one that they re using as an excuse for why they flew the upside down american flag, which we know doesn t make sense because the flag was up weeks before that. what do i make of it? it s just it was such an intense interaction, and it was about the third time that this has happened, each time escalating more and more. and yeah, i meant it, shame on you for behaving this way. because you do represent the highest court in the land. and that was more intended towards him who was there as well and did not step in. can you talk a little bit about the relationship between the alitos, as you saw it. i mean, he was present for some of these interactions, if you want to call that, and i was there s part of the undercover interview or the undercover audio that we heard where martha-ann alito talks about her plan for gaining seeking justice for all that has befallen her and her husband. let s take a listen to that sound. it s okay because if they come back to me, i ll get them. i m going to be liberated, and i m going to get them. what do you mean by get them? there s a five-year defamation statute of limitations. i don t know who you mean. the media. so martha-ann alito has a plan here. she s mapped it out, five-year statute of limitations for defamation. the question is, is that justice alito s plan? and that begs the question, what is the relationship between these two people, to you think what she says is tacitly endorsed by him, or is that overestimating, you know, her import in terms of a family strategy? yes. you know, i don t think it s for me or anybody else to say that or to pass any judgement on their relationship. all i witnessed was her, you know, behaving in that way and him not stepping in. and what i really just want to point out is that there s no way that he didn t know those flags were flying at his house. and in those same recordings, in his own words he is unable to be impartial. he says that there are two sides and one side must win and he s basically saying that he sits on one side and he says that he can t negotiate with the other side. he can t split the difference, as he put it. and that is a giant red flag. and at this point, we ve moved past the idea of him just recusing and we ve reached the point in the general consensus that it must be removal at this point. i think we re a ways from that, but i do, i mean, i have to ask you, because this is a woman who verbally there were verbal confrontations, i believe she spat at your car at one point. yeah. there s a point in this audio where she says i m german from germany, my heritage is german, you come after me, i m going to give it back to you. in the context of these interactions with her, how did you hear that part of the audio? i think as most people who heard it it was absolutely chilling. and terrifying that people in such a high position of power are saying such threatening and scary things. now, i can t presume to know what she meant by that, but i think a lot of people are assuming kind of the same things. and none of it is good. and we really need to do something to hold this court accountable. this is mostly about his inability to be impartial, and that is his bare minimum job description, and he has said on tape that he can t do that. emily baden, at the center of a that president biden s own son was convicted yesterday of three gun felony charges brought by the federal government in a case that was heard by a trump-appointed judge and decided upon by a jury of biden s peers, but that didn t stop them. this afternoon house republicans fanned the flame of a weaponized government conspiracy by voting to hold attorney general merrick garland in contempt of congress. the alleged reason for the contempt vote was the justice department s refusal to comply with a congressional subpoena to hand over audio tapes of an interview president biden did with special counsel robert hur. now, to be clear, the justice department has already released a full transcript of that interview, and officials argue that releasing the audio could endanger future investigations. but refusing to comply with a congressional subpoena, hmm, republicans managed to be outraged about that despite the fact that multiple republicans, including congressman jim jordan, who is leading the fight here against merrick garland, multiple republicans have literally defied congressional subpoenas themselves. when speaker of the house mike johnson was asked about that hypocrisy today, this was his response. you talk about apples to oranges, there couldn t be a more clear contrast between that and what we re talking about here. hmm, joining me now is dan pfeiffer, former senior advisor to president obama and cohost of pod save america. thank you for being here. i don t know, is it an apples to oranges comparison or an apples to apples comparison. it seems pretty apples to apples to me. you have members of congress, someone refusing to comply with a subpoena from congress, so yeah, it s apples to apples. the reality is that the headline merrick garland held in contempt of congress is a big, juicy headline for republicans to make hay over. and i wonder how you think democrats and people interested in preserving, i don t know, some shred of democracy, can answer that with a fairly nuanced discussion about subpoenas and why the hur audio would not make sense for future prosecutions. i don t think we have to get into the details of that. that s the conversation they want us to have. the conversation they don t want to have is why republican plans would do nothing to lower prices or higher wages. what they are planning on doing is how they can pass a tax cut for corporations and the wealthy. it will add $3 trillion to the deficit. they re trying to distract from the things that matter to people and their own popular agenda. we sdroebt to play that game as democrats. let me follow up on that, that gets to the central question of this entire campaign as it concerns joe biden, which is how much should he be talking about the sort of institutional threats posed by donald trump, institutional threats to our system of justice, to our democracy, to the voting system, and how much should he talk about, what you say, the bread and butter issue, the economy, inflation, et cetera, you seem to be landing quite clearly in camp b, don t focus on the institutional threats, is that fair? there s no such thing as a single-issue campaign for president. right. it s about a lot. now, it is very clear that most voters by pretty large margins say the economy and inflation are the single most important issue that s going to decide their vote. it s also true that three quarters of voters say that the they are unhappy with the economy and that donald trump has a big advantage on the economy. we have to narrow that gap. that doesn t mean we shouldn t talk about abortion and freedom and the threats that donald trump has. because what ties together donald trump s positions where he wants to cut social security, medicare, cut taxes for the wealthy, repeal the affordable care act, repeal abortion, is maga extremism. that s how i think we should frame it. i do wonder where you think the most movable voters are, right? because the economic stuff is plain to see. it s not a mystery, right? inflation is coming down. the joblessness rate, all of it, and it hasn t sunk in. whereas, i m not necessarily arguing for this, but the polling that we got, i think it was this week, an ap/norc poll, approval of donald trump s conviction nationwide, 15% of republicans approve of his conviction. those seem like the ghost of nikki haley s supporters. and i wonder if you think, you know, given freshness of this story and the fact that people are responding to it, whether there s to blunt about it, gold in them there hills for the democrats and the biden campaign. oh, sure. this is the anti-donald trump coalition is the biggest political coalition in america. but it s very diverse, right? you have voters who are biden voters who are upset about the economy. you have people who are biden voters who are upset about what s happening in gaza. you have trump voter who is may be upset former trump voters. so you have a lot of messages to a lot of people. what we know is there is a sufficient group of people who are deeply concerned about the idea i know this sounds crazy but deeply concerned idea that we should not have a convicted felon as president of the united states. i hope the president takes advantage of this during the debate in two weeks and brings it up. we have to make a full throated, proud, unafraid case against donald trump. that s going to talk about raising prices and cutting taxes for rich people, the threat he poses to freedoms like abortion, contraception, and the threat he poses to all of our freedoms because of the way he wants to govern what he did to try to pull the wool over voter s eyes in 2016 whshgs he got caught for and convicted for, tells a story about the kind of president donald trump would be and we shouldn t shy away from that. given the things we talk about, you know donald trump s going to bring up, well, we think he would bring up hunter biden. there s another trial in california, i believe, in september. should biden be talking about that? playbook suggests this is an opportunity to show empathy and connect with people who have faced hardship that in their own lives and families. what do you think about that? well, this is obviously deeply personal and deeply painful situation for the president, right? he had this is it s obvious every time he s ever been forced to talk about it. in all of the reporting you read, this is something that s very hard for him, of course it is. all this tragedy in his family, dealing with addiction, having to witness the president wraps his remarks on crime without a single mention of the growing immigrant crime crisis happening in this country right now. you re seeing since joe biden took office crime skyrocket. wouldn t we love to have a statistic where crime is down 67%? ours is only going in one direction. if you listen to donald trump or conservative politicians and conservative media like fox news, you probably think we are in the middle of a massive crime wave. we are not. this week we got new fbi crime statistics showing that in the fist quarter of this year, crime is yet again down across the board. overall violent crime down 15% from last year. murders down 26%. by every national metric, crime is down. regardless of the facts here, fox is still going big on crime. the organization media matters counted 304 reports about crime on fox in just the first two months of this year alone. the last time the fbi released crime data, back in march, crime data that again showed another drop in crime across the board, fox gave that data approximately two minutes of air time in the first two weeks after the data came out. fox only mentioned the declining crime rate seven times in those two week, and one of those mentions was this one. new data from the fbi claims that the u.s. crime rate is dropping. let s look at this graph while i stab you. given how much elected republicans and national conservative media are pushing the narrative of a staggering crime wave despite the facts, it sort of makes sense that republicans believe there is a rise in crime when really there isn t. but the thing is, it s not just republicans who believe that. recent polling from gallup shows that 77% of all americans believe there is more crime in the u.s. today than there was a year ago. despite, again, the opposite being true. crime went down this year and crime went down the year before. we are in the opposite of a crime wave. so what gives? why do so many americans think that crime is up? well, there are probably a lot of reasons, but there is one reason that does not get enough attention, local news. in 2019, one of seattle s local tv news stations, komo news, put out this documentary entitled seattle is dying. it depicts seattle as a city in decline because of rampant crime and homelessness. the seattle times newspaper was quick to refute the documentary s assertion that seattle was dying, pointing out that both property crime and violent crime have been dropping in seattle for decades, and komo news isn t some independent, whacky outlet, it is part of the sinclair broadcast network, a network of nearly 200 local tv stations. as the washington post put it, sinclair s recipe for tv news is crime, homelessness, and illegal drugs. journalist anne nelson told the washington post , sinclair plays up crime stories in a way that is disproportionate to their statistical presence. or as david told the post, it s a fox news wannabe. that s their model a political tool rather than a journalistic platform. but unlike what people hear from fox news or donald trump, viewers may not necessarily have their radars up when it comes to information they are attention anchors at dozens of local tv news stations who have been reading the same controversial script about president joe biden based on a widely criticized wall street journal article. have a source. so they did not really address that. i think they are unhappy with the fact their tactics are being exposed. this is a problem they have had in the past of sending these very biased scripts to all of their affiliates and having them read them verbatim. can you talk about when you say they were forced to read these. sinclair as part of its defense says giving out scripts is common practice to affiliates and basically there is nothing to see here. from your reporting, what you understand about the pressure, if any, these local anchors are given to read this stuff verbatim? this is been well-established that sinclair, which has 186 affiliates it owns or controls, sends must runs segments that are produced out of their national office. actually after trump was elected in 2016 they hired one of his spokespeople, boris epshteyn as their national correspondent and then would have him do commentary which they required all of these stations to run. so it is true, there are affiliates that have relationships with different services. cnn operates one. there are a bunch of different ones. they will send along scripts, but that is something optional for them to do. this is the corporate parent requiring these affiliates which have all sorts of branding, abc, nbc, everybody, locks, and really pushing very hard right content in a way that is not transparent. the owner of sinclair broadcasting is a gentleman named david smith. he also purchased the baltimore sun not that long ago and i want to read for viewers who are unfamiliar with what has happened. the union representing the newspaper sternal essay monday that the articles do not meet standards. including a one-sided story about immigration policies and an op-ed by the co-owner likening the transgender movement to a cancer. in addition journalists say stories under their names have been changed without their permission and they have been reusing reporting from one of the 185 local tv stations owned by the sinclair broadcast group. this is a feedback loop, it sounds like. what do you know if the editorial practices under david smith? i think he has established himself as a right-wing operative. he has given hundreds of thousands of dollars to right- wing groups and famously he met with donald trump in 2016. jared kushner helped cut a deal where they would get access in exchange for not fact checking. david smith himself said we are here to deliver your message, so it is a very partisan operator, but he is really pulling the strings behind local affiliate neck works affiliate networks just wrapping up an interview with a probation officer. this is a first never in american history has a former president had to sit down with a probation officer well, because a former president has never been convicted of a crime. but here we are. this meeting was mandatory for trump as he is now a convicted felon in the state of new york. trump answering questions from his home and mar-a-lago. now, according to a source, the question answers lasted about half an hour and trump was asked we understand some of the basic questions that other convinced it did felons must answer those questions for regular felon would include questions about family background, financial status, living situation, and crucially, it chance for the defendant in this case trump to say why he thinks he deserves a so one of my more details of how that probation interview went as we ve described before, many questions could be asked of certainly about trump s background, his financial history, has he abused drugs or alcohol in the past? it s certainly not much ground covered in a 30 minutes, but of course, we re talking about a defendant like the former president here. now what happens next the defense it s her attorney, todd blanche, his team. they re going to submit a sentence recommendation to the judge. the probation officer, who conducted this interview is going to conduct. it s going to compile hello report. and these are just two elements that are gonna be factored into judge juan merchan s decision when he makes that sentencing done, which of course we know the days next month in july 11, aaron, are i brynn? thank you very much. in new york outside the courthouse, michael jacobson and our team join me here. michael, let me start with you because you are the former new york city correction and probation commissioner. so when need homes now doing that now. so what s your take of what happened today? we ve been obviously probation or regular probation officer assigned to the case, but it sounds like the commissioner herself was in the room as well as the general counsel will certainly expected someone more than just a probation officer to be in that interview. i mean, it s so unusual for 1,000 reasons. most of them obvious but just the fact that it was remote. and that trump s attorney was there. those are two very odd things in enough themselves. so given all that, it certainly made sense that you would want someone other than the probation officer it certainly makes sense to me for the general counsel to be there the sort of equivalent of trump s attorney on the probation? and the commissioner runs the agencies. so i think she thought it was appropriate that she was there. now, i know these can often go up to 90 minutes or two. i then go longer. this went less than 30, and obviously this isn t a case where the judge needs to be reminded about the details of the defendant or anything like that as would be the case in normal situations. but what do you think they got out of it? well, it s just the beginning of what can be a pretty long and sometimes intrusive process. so you shouldn t take too much that it was just a a first polite interview. probation officer has wide berth here to get into, as you said alcohol and drug use. talking to pass as victims can examine trump s behavior in terms of the violation of the gag order revisit the finding that he sexually assaulted jean carroll. all that is open, fodder for a pre-sentence investigation. they wanted to sort of paint a broad picture. so this was the start of something at certainly not the end, which is important thing, right? it s not as if this is done and then we wait a month, right, terry, this is this is a part of it, but you ve watched the judge so closely in that room, judge, that trump had referred to looking like an angel, but he was really the devil was the way trump put it but a judge who his demeanor was always positive, serious, he never never betrayed any sort of emotion how much weight do you think he will give this report, this interview that s the report that s going to come out of the interview that michael s talking about. i think he s going to take it very seriously, but like you said, aaron, he knows this defendant, he knows trump. he saw him every the day he saw trump violate the gag order ten times and he imposed the fine for that. and i think he s going to really want to see whether there is remorse and he s going to take what s been going on in las vegas, the rally, what he s saying and all of the things that he saying now really don t show remorse. and i think that is going to have an impact. i m not saying he s going to incarcerate him, but i do think as to whether it s probation or house arrest or community service he s going to go with something that s a little more serious. so mark the way that it was described, brynn reporting, the way that trump handled himself today was that he was polite and respectful and accommodating to the probation officer. and the obviously the commissioner in the general counsel, who were also present for the new york parole commission. i m sorry, probation commission. but this is the first time of foreign presidents ever been in a situation like this. mark, you ve been in situations like this hundreds of times with clients. so does the judge already have his mind made up when you hear a accommodating, polite and respectful. does that mean anything considering what trump says about this, judge? pretty much daily i think it was a pragmatic approach that he should be respectful to probation officer interviewing him. i ve never had general counsel show up at the hundreds that i ve ever been on. i ve also never had the commission shouldn t have department of corrections show up. so obviously, everyone s looking at this very, very carefully. but aaron, as we talked about last week, i do think that this judge as most judges who sat through the trial before sentencing, have most of their mind made up 90% or so. this is not going to, i think move the needle very much because everyone knows who don t trump is. everyone knows about the facts of the case, which really interesting is whether or not they took this opportunity to give a written statement or a verbal statement of his position. i m almost surprised if he didn t just because of who he is, although i tell my clients never to give a written or verbal statement at this stage wait until you get in front of the judge all right. well, we ll see the mark. i want to ask you about one other thing here because it trump obviously was in this interview today means i m rudy giuliani, right? who was at the helm of this, his efforts to overturn state election results was he had his mug shot taken america county and arizona a process in phoenix after pleading not guilty to charges of trying to overturn the election, they re just looking at this picture and he s got a blue and a white star tie on. i tried to smile, i guess. i mean, mark, what s your reaction looking at that mug shot? it s insulting to the process to be honest, i remember rudy when i grew up in new york and all of that good stuff, america s mayor, like you mentioned, it s just sad that we re getting to the point where on the same day from a president, maybe a future president is getting your probation interview. and the former mayor of america is getting a mug shot taken heavy, said that he knows the respective should give the process he hasn t done it recently, but he knows and you don t smile, you don t look away from the camera. you give the respect even at the process of a mug shot, to respect the process that quite honestly, he was sworn to protect for decades and it s when will you say right? i mean, he s mocking it by the smile. it s not, not of a state of mind, it s a mocking. my goal when we talk of trump allies, it s actually very relevant here in the context of the probation conversation because florida governor ron desantis, they obviously were rivals for a time. they were allies, then rivals. and now here we are but desantis could actually be the one who oversees whatever sentence trump gets, right? right. so the way this works is a little known part of probation national e coli interstate compact. and if you re sentenced in a jurisdiction, but you happen to live in another jurisdiction, which is the case here, right. sentenced in new york lives in florida most of the time through the interstate compact, the supervision of that case will be done in a jurisdiction that the person lives in. so under normal circumstances, if he was sentenced to probation, they would make a request to be transferred to florida probation. right? those requests are normally fulfilled. i think this one there may be a little more of a discussion then they re normally is, but that agency is, as you say controlled by the governor and floor. so how he really has to check in or the way he s treated that would could potentially be the decision of governor to potentially the that compact gives wide berth to the receiving agency as they re called and the general rule is that agency treats this person as they do similar people there are no services, no similar people and it s a terrorist. what s the process here is my mega is point out this is the first step. it s a month from tomorrow that we re actually going to get the sentencing unless it s delayed. so the process here is what then trump s team files for what they think the sentence should be. and there s a whole lot of back-and-forth exactly what one of the things that the probation officer will be doing. they don t just have to interview some thinking interview family members. they can talk to prior victims if there were any victims in this case, it s victimless, so to speak, but they re going to be continuing to do their investigation. the judge is doing his research by the way, he is looking at how many similar people have had these types of charges and what has been their sentence. so he s doing that. and meanwhile, the attorneys obviously are working on their recommendations. now that the jury has it, we anticipate this is not going to take too long. however what we know is this, once he wanted we get a verdict from this hunter biden faces up to 25 years, possibly under there, members of that audience consuming those messages that may take action that looked to be preparing to take action and that s a very concerning to me. when you say looked to be preparing to take action, do you really believe that there is sort of i don t know how organized you would describe it as, but that there really are those preparations that stand back and stand, stand back and stand by i think we would be foolish not to take them at their word i think that absolutely there we saw kind of an evolution of tactics after january 6 and during the prosecution s that happened with the it was clearly against what his personal convictions were relative to the matter of choice send abortion. and so my feeling was okay, he s shown that he will put aside his personal convictions to judge and decide a case based on the facts presented in that case unfortunately, since he s gone to the supreme court, that s just seemed to have gone by the wayside. yeah. i mean, obviously i wrote that wrote that opinion in roe v. wade in the letter to congress about the flag, alito said his wife flew the upside down flag because she was greatly distressed. those were his words by disputes with a neighbor and explaining his wife s motivation to fly the flag. he wrote, quote, house on the street displayed a sign attacking her personally a man who was living in the house at the time trailed her all the way down the street and buried her in my presence using foul language, including what i regard as the violet epithet that can be addressed to a woman. now, i spoke to emily baden. she was the neighbor and the dispute she put up the sign alito refers to which he said didn t refer to mrs. alito at all her husband are now husband is demand and alito mentioned in the statement, but she by the way, was the one who used the epithet in alito s presence. it was not her husband, as he said, but i want to play for you, governor, specifically, something crucial. she told me about alitos claim about the flag i just want to emphasize that the interaction that happened on february 15th is the one that they re using as an excuse for why they flew the flag. and i really want to hammer home the fact that that happened on february 15, and their flag went up two or three weeks before that, at best, he s mistaken, but at worst he s just outright lying the flag was flying before the altercation that alito says was the reason that the flag was put up, right? that s what she lays out very clearly. he wrote his version of things, governor in a letter to congress you re not allowed to lie to congress or they re serious penalties to that should he address this contradiction? well, first of all, it gets very tired and you see these guys pulling their wives. i mean, khan really it besides it is disrespectful of the united states of america. that s america slag it s not if you have a controversy with your neighbor, you deal with it with your neighbor, call the police if you want, use the courts, he should know about that. but you don t fly the american flag upside down. and as you mentioned before, it s a very clear signal two people who were part of the insurrection, and then how does he explain the other flag at their, at their other home? i mean, is his wife just doing that without his knowing and without his caring. when you assume a role like such as the supreme court justice you have a certain standard. you set a message, you set a standard for the entire court. the court comes under scrutiny when this kind of thing happens as it has already anyway, for a couple of other issues and they re having and the lack of it seems standards while his wife, isabel, quite for my wife is fond of flying flags i am not. my wife was solely responsible yeah. you find that jarring really? yeah. come on. man up at least. and if your wife did it, you should have seen it when you walked in the door and said, that s got to come down and then make an apology. say that was all a mistake. but say she put it up upside down by mistake for pete s sakes, but you don t you don t ignore it. let it hang and let the other one fly as well. you deal with them immediately. you re held to a different level of it. this is just a basic thing. i don t care whether it s a supreme court justice or not. that is so disrespectful to the, to the american flag. i mean, he won t rigueur some january 6 related cases he did write an opinion in 2021, actually, for the supreme court about a flag outside boston city hall. and in it he said that anybody who is looking at it would conclude that all of those flags convey some message on the government s behalf. he wrote that he was saying, if you fly a flag outside the boston city hall, people are assumed that s the view of the boston city hall government. but yet when it comes to himself, he says, it s my wife s fall it is their real hypocrisy. there is one statement oh, absolutely. i think it s very clear the unfortunate thing is, no one seems to really care and it doesn t appear is if the chief justice is going to do anything about it i mean, they ve adopted supposedly standards of content of conduct, but they re going to be judging themselves and somebody inside they re gonna be looking at each other to say what s appropriate and clarence thomas is a whole another issue. so the court right now is not in the best odor, shall we say with the american people and the real tragedy here is that when the american people lose faith and the justice system, we re going to really dangerous place. and we shouldn t, we shouldn t be here. it s not a good place to be. we have to have faith in our justices we have to assume that they are going to judge cases based on those facts before them in that case. and to have this kind and that scares me. because i feel like for those of us doing the work, in the streets every day defending people s freedoms, if trump wins again, what we are facing is no dissent. and with no dissent we cannot challenge any of it. but, if he wins again there is no surprises about who donald trump is. in 2016 you can make the argument. people don t realize who he is. remember, he had all these people like no, no, you don t realize what you are in for. america knows exactly what they re in for. you say no. you know, there seems to be a lot of delusion. we hear a lot about the trump era was great, the trump administration was great. as if coven just did not happen. as if there was some reason why those last two years just don t count against his record. i don t remember covid but i definitely remember infrastructure week. infrastructure week was every week. i feel like trump is the most selfish person in the world, and everything revolves around me personally. every political issue comes back to me, myself. this woman asked him, this reporter asked him, katie from alabama wants to know what is your relationship with god? and he said i do very well with the evangelicals. that is not the question you were asked! and biden, to me, seems very outward. he is thinking about others. how can i help other people? think about the key moment of his life, losing a major chunk of his family in one horrific moment, as a relatively young man. who learned empathy, and to think about others and the importance of family. and this other person, who every bad characteristic we don t want our children to have, he has. i think what you said, you know, what is the question being asked and what are we trying to answer as instructed to what the biden campaign, i believe, should be trying to do? framing this even beyond needing to pay attention to the newsday today. more choice between extremism and not. i just wonder why we are not generally describing trump more as an extremist. forget about, again, let s not forget about the issues, people on the ground doing good work. when it comes to what are we expecting out of this, do you want someone who feels like they are attacking every institution, who is, again, do we need to recite the litany of felons and felonies? let s just talk about not being that. okay, but here is possibly why i think this is playing out. because, though they shouldn t be, president biden is focusing voters on democracy and on freedom. and these are fundamentally important things, but somehow they get viewed as kind of lofty ideals, and trump goes straight to the gut and grievance. because people don t know what it is like not to have it. i lived in russia for six years. they didn t understand democracy. they didn t know what it was like to not be, sort of the possibility of randomly being arrested and otherwise having appeal. but can i just go back to the beginning of the show? did all that stuff in this montage happened just this week? and there is 151 days, which means 21 weeks if my math is right. i m wondering if i have the stamina to make it through this, if this is just one week s worth of stuff. i really think this is going to be rather a dramatic, caustic, and i think biden is going to have to really bring home what is the absence of democracy, which is a very tough thing, whereas trump has only to say look, we can do all these things, everything can be great, and full of wall is not a sinitic and thing people think about. trump is a great salesman for his diseased ideas. biden has not yet shown himself to be a great salesman of his ideals, of what he has done. and there is a very significant and real and honest critique of biden from the left. that he has not done enough on what is going on in gaza. and there are a lot of people who would be democrats otherwise who will not support him because of that. i hear you. what s the conversation to have with that voter about what former president trump will do with the situation in gaza? was it not nikki haley a few weeks ago, when she went over there and said it is the job? you know, what lizz said about the margins is important. don t think about the potential, the imaginary hypothetical biden trump voter. i don t think that person really exist. there are a couple, but not many. there is a lot. know, the election is going to be about can trump get people who will say it is either trump or stay home? and can biden get people who say it is either biden or i stay home? the election is going to be won on those margins. and biden does have this significant issue, that a lot of people. there is agoing around on it tiktok . i don t know if using it. tiktok, home of misinformation central. we can talk about tiktok later. but they asked with man, gun to your head, would you vote for biden or trump? and he said the gun would go off . it is a meme that has been shared by people who are saying i will not go with any of them. this is my point about extremism or not. biden should also be as popular as the field broadly. do you want trump or anybody else? we are at a point where trump is not just specifically dystopian in the ways that we may remember or not, based on our experience during the pandemic. he is also just clearly against the will of all is the concept. so i think the question of democracy is how do you make this a tangible, scarier thing? because currently i think talking about democracy as a concept is a little pie-in-the- sky. the thing about democracy dying in darkness did not really work as a slogan for the washington post. it this week, with the remembrance of d-day, it was not just the stark contrast between president biden and donald trump. it was also between donald trump and ronald reagan. ronald reagan gave one of the most important speeches of his presidency in normandy. he stood against russian aggression, he stood with his nato allies. so isn t there question to ask of all republican voters, where has your party gone? because the current gop and what donald trump represents bears almost no resemblance to ronald reagan. correct. it is why you saw joe biden looking almost like reagan and referencing him while he was in france this week. i mean, i am just not going to go down that path, because i am somebody who doesn t have friends who are alive because of ronald reagan. so when i think about waxing back to the people who laid the foundations for this evolution, trump did not come to us in a vacuum. trump came to us because people laid foundations for hatred and bigotry and sexism. and i feel like i don t want to go back to the party that i could recognize of ronald reagan. but what i do want to say is people that we are leaving out of this conversation are the voters. i am constantly saying to people the election is not the end game. it is the starting game. you get the democracy you want and you get the democracy you participate in. and who do you want to fight? that is my whole thing. who do you want to fight? do you want to fight a madman? or do you want to fight somebody who might listen to you where you can get the needle move? because these other people. i do not think the election is going to be won by biden if he is taking democracy his issue. i think it has to be the economy. all of our polling shows people are most concerned about inflation, most concerned about jobs, most concerned about the economy. democracy should be like the sprinkles you get with the ice cream cone, if the ice cancun is the economy. but without a functioning democracy you can throw your economy out the window. that the economy is always the number one issue. finish your thought. i was just going to say that if he does not win it on the record that he is running on which is a strong one. which is a pretty strong one , and a vision of the future, i don t think he wins it by saying i am the democracy guy and that guy isn t. we are talking two different languages as far as the folks who may vote for biden and the folks who may vote for trump. i mean, this is not about issues at all. this is about personality. this is about who you believe. and the people on the right, like joy reed talks about earth one and earth two. the people on the right live on earth two. and we can sit here and believe the nothing that you believe is factual. we can go on and on. january 6, climate change, the election, the trial. but they are affirmed in their miss belief constantly, and they think we don t know what is reality. this is why i feel like the whole felonies thing should and hopefully does cut through to a silent majority, not to evoke reaganism s, but a silent majority of people who are like i am in earth one resident that i am just not that proud of it. it is, for me, a bridge too far, when we have a convicted felon surrounded by felons being again in the white house. i feel like i just want to simplify it down to do you want the felony guy or anyone else? that is a great question. donald trump wanted more than his face, wouldn t he be doing everything possible to court the nikki haley voter? he disrespected nikki haley in every possible way and still she endorsed him. if she actually wanted to win, it wouldn t he say she is my running mate, let s go for the gold? he hasn t, instead it is president biden who is putting together a coalition to try to go to for those voters and risking losing progressive voters in the mix. i wonder when we say nikki haley voter, i would wonder if they were not so psyched about nikki haley, or if they were just like i don t want trump. i am not like everything about nikki haley is just awesome. people weren t saying that. i feel like him going for that voter after he saw emma we saw the numbers after iowa. was it 28% of those people who said if nikki haley is not the nominee i could possibly vote for biden? i think when trump doesn t go out and try to expand his base he never has. but let me finish. why is even doing that? that should be the sign to everybody, he is not trying to expand past due. he is not looking at a world for you. can i do some reporting here with lizz ? i might be messing up the order of your show here. but when roe was first overturned we saw abortion rise up to the top of issues. since then we have seen it fall down. and i know the democrats are making a big deal of the abortion issue. do you think it is something that motivates voters? i don t think it is going to be democracy, and i am wondering if it is going to be abortion as something that trumps the economy, for lack of a better term, and becomes a real motivating issue. well, i am the right person to ask. no, no, only because you might not know this, i am on the ground all the time talking to people. and this is where democrats are actually making a mistake. i do think abortion, abortion polls better than politicians. in these ballot initiatives we are seeing in over a dozen states were initiated by the people, not by politicians. by the people. people who held their abortion stories to themselves for years, saw this as a time, and this isn t a couple people. you have to get 200, 500 in florida, 900,000 validated signatures to get it on the ballot. the question is will people vote for biden and the initiative, what we saw in kansas, the very first one, that people voted overwhelmingly for their abortion initiative and still voted for some of the people who created the laws in the first place. what? so, what we should carefully be looking at is these initiatives, i think, are going to greatly help down ballot. they are going to help senate races and places that will be surprising. congressional races. and will people say i am going to vote for everybody but biden? that is the question somebody needs to answer. we can do that in the next poll. we can ask about that. please do. the president took pretty aggressive action on immigration this week. it has been a vulnerability for him. republicans are going to say it is too little too late. how do you think it is going to play out? and just to be clear, republicans have done nothing on immigration, and thanks to donald trump, blotch doing anything legislative. this is how the republican party has shifted the overton window in their direction. we talked about the border, and about immigration. immigration is not a central issue in american life. it is not the source of crime, it is not changing the economy. republicans have made it this central issue. and people believe it. whether it actually is an issue in daily life are not is somewhat irrelevant, because republicans have been successful in convincing the american people. that s what i m saying, they have made us think about it when it is not as important as they wanted to be. i think this is the frustration for anybody who is not trump, joe biden specifically. your running election campaign, and administration based on it, i think, a practical execution of hopefully reasonable and increasingly moderated policies, and donald trump is running on vibes. it is a vibes based campaign. and the question, fundamentally, returns to turnout. vibes is too polite award for a period anger, resentment, ancient nightmares awake into the bloodstream of people who feel like they re being threatened by non-threats. i m sorry, i have a different view on this. i want to see the person advising biden on the politics of immigration fired. i think he has been behind the curve on this. he has let the republicans take this to a place where it shouldn t go. from a narrative perspective, but not a policy perspective. what have they done on the policy front? from a narrative perspective, if he is doing what he is doing now, why couldn t he have done that months ago? okay, fine. but hold on. you can argue with when he did it, but now he is doing it. now he is doing it. what have republicans done? nothing. they have objected to a deal that was apparently done that was agreed to, but the second thing i wanted say they want to continue to set this up as a problem. the second thing i want to say is there are some issues where you want to take on the lack of facts and the misdirection had on. this issue of immigration, i think, should be one that should be approached with much more sympathy for the people who are afraid and scared, and i think rather than head on white, which people? the immigrants? the people in montana who are worried about people crossing the border in xcode. you don t make it to montana. never make it to montana. so we should worry about what people in montana and west virginia should think about it? we already do. this is what is motivating them. and i think there is a way to address this in a way that is more understanding and less in- your-face. more understanding of what white people in montana think? exactly. here s why, because they vote. i don t think steve is saying because they are white. hold on a second. i don t think it steve is saying that person in montana is right. i think what he is saying is they vote. at the very least you have to acknowledge who that person is, where they are, and speak to them. the issue has already coddled them immensely by wrapping them in this notion of the demonization, i mean, so many americans would think of immigration and think of somebody getting murdered by an immigrant. but that is not the core of our relationship with immigrants in this country. and the right has made it that. yes, but the most important word that you said right there is made. because they made it that. because they solidified this falsehood, you have to at least address it and try to start solving for them. and you understand how people are scared? but who is scared? white people? white people. but we are continuing to be asks to be sensitive to the fears of white people? that are not real fears. it does not matter if they are real fears. they vote. i guess it is my question. genuine human empathy is being considered anybody s peers. i think we are trying to do empathy but also cold calculus about getting their votes. we are trying to disabuse them of the lies and ways that damages them in terms of their sense of security and sense of self. but before we get back in, i just want to ask what does it take to coddle the abstract montana and that is afraid that someone in mexico is coming over to take their job? there is a community i know in wyoming. they had no people from south america. all of a sudden they had 12 people. this was a huge change for them, and everybody, all of a sudden they had to teach esl. great, and guess what? that town in montana or wyoming had jobs for those people. they absolutely did, and those people added to the jobs and there were not people to do the jobs they were doing. all that is good stuff. i am just saying the change, the challenge makes people uncomfortable. i am wondering before we take them head-on if there is a way to talk to them. in an understanding way. last point. this is bigger than the immigration. because this is the republican pattern. create a fear that is not real, pass legislation that only harms other people, then the fear stopped because it never existed. and they think they won. they have done it with abortion, they have done it with lgbtq, trans people. there s kids who are pooping and cat boxes in schools! no, there isn t. if they were kids pooping in cat boxes in schools, high school kids would have put it on instagram. so, to me, it is a microcosm of the playbook and how do we dismantle that playbook to stop having that fear, and stopping the bs around it? we have to go to commercial, but i don t actually think you and steve disagree. i don t. no, i am not prioritizing the feelings of white so we do disagree. but i think that all steve is trying to say here is these people and their fears, he is not saying let s appeal to them. but if we simply ignore it then we are sending this people into trump s arms. we can practically see the statue of liberty when we walk outside this building. we are supposed to be a nation that welcomes immigrants. i mean, none of us were born here, right? but now we have this very hateful, xenophobic approach to a certain kind of immigrant. it is disgusting, and the notion that we should kowtow to the fears that have been grading these people. i am not saying you are kowtowing to anything, but if you don t at least speak to that person you are sending them into the arms of donald trump and going wild are that these people voting for donald trump? because they are getting it to work. and i am not saying they should be coddled. i am saying shouldn t we at least acknowledge them and get a basis of truth back to the center? this is part of what we are talking about when the new york times does what is going on in the world? we ask trump voters. they don t care, we don t care what they think. we don t have to be constantly checking in with what they think. i also think it is the responsibility of white people to educate white people. it should not be placed on lichen brown people and immigrants. i would like to know what it would take to achieve the persuasion that immigrants are not so scary. i would like a practical proposal before i decide to sort of center the feelings of people who are fed lies. what if you didn t reject the fears? the corporate tax cuts are going to be on the table in 2025. if you end up supporting trump you are most likely to keep those corporate tax cuts and lower tax brackets, because, by the way, i don t think trump is going to address the deficit at all, either. the record shows that perhaps some of the fiscal spending had a part in the inflation, but it was more about supply shocks, the inability to get stuff into the country, the reduction in the ability to spend on services, so all this money to buy patio furniture and stuff like that, all of the sudden that shot up and all of a sudden we had problems with some food distribution. and that has come off in a very big way. there has been extraordinary progress on the inflation rate but has not brought down the inflation level. and don t overstated, biden has plenty of very, very wealthy supporters. but you are right to point out how extraordinary it is that some of these folks, especially in tech land, are the ones who are out there saying i am going to vote for trump or support trump. and to read, for example, david sachs tweet today on the economy is just to be amazed that a guy with that much money . here s the thing. i get that inflation is difficult. these people who are now supporting donald trump have had extraordinary, extraordinary last few years. bill ackman this week, what is it announced? he is worth $8 million. think of everything president biden has done for electric vehicles. a huge win for elon musk. yet they are railing against this disastrous economy, when it has been a perfect one for them. i think, first off, taxes, let s start with that. and then get to realizing that for these guys, in silicon valley especially, shame feels like a market inefficiency. wait, hold on, if i don t have to care about the judgments of people who are paying attention to the news, maybe i can do the thing that donald trump offers uniquely, in my memory, of american presidents. which is the ability to dictate actual policy. the ability to get favors. i feel like this is the other part of the trump administration that goes underrated because we are talking about the bed of nails that is every single scandal. he is for sale. look at the adelson family. go down the risk of donors and what you get. if you are tech billionaire, ceo, philosopher, king. that is what these guys want to be. they know better. they may think trump is an idiot, and i think they do, but they also think they can puppeteer hemenway s, and they can help run the country. and that is something that joe biden does not offer them. the white house is for sale. and in some way, is this like re-creating putin s oligarchs, but here? you know, i have been listening to you, and i can t believe we are here, again. and a real chance that he might win. and something i ve read the criminologist talk about, the reason why jail does not work as a deterrent. because a lot of people do a stint in prison and they come out and they go oh, i can do that. now i m going to go back to the street, because that wasn t that bad. and for a lot of people they are like we survived trump. it wasn t that bad. covid does not count on his record, for some reason. and they are like we could do this again. and it doesn t make any sense. and i get a footnote to the oligarch story? a lot of those guys ended up exiled and dead. i don t know that all the people who are supporting trump understand the final end result of kleptocracy. okay, because you are asking for people to have something beyond short-term. it works for a little bit. but, see, we are talking about hugely successful masters of the universe who believe well, that will never happen to me. you know that is the way they all think. i think that is right. they re not thinking it through. i think they are also missing, getting back to the first conversation we had, the essential connection between democracy and free markets. what makes free markets work is the rule of law, and if the rule of law is something that is on the whim of the president you have a real problem with your free markets. lizz, let s talk about sort of these loud, influential voices were suddenly backing former president trump. why they would be doing it. i understand, inflation is a really difficult. you want to buy a house, rent an apartment, get any insurance, things are really difficult. but suddenly this group of people backing the former president, it does not really make sense from a policy perspective. why do you think it is happening? well, when you look at how many of them are feel adjacent, this is not my will house. but i d do see and have met and have been hit on by very, very, very rich and powerful men. and all those zeroes don t add inches, and somehow i think they do. and if that stays in the show i am proud of you. i promise you it will. because honestly, i don t have an answer. we are on life. is a family show until now. but honestly, what is the thing you are missing? what is the emotional thing you are missing? you are talking about the intellect of these individuals, and so much of it is about the performance of this analogy that trump offers, the ego. and if you have a massive ego, one of these masters of the universe, wall street, silicon valley, i completely understand why you rock with trump. because that ego seems to be like that is my guy, that s the guy want to be with. i am also just not convinced that they actually like him. that s correct, they don t. they think he is a puppet. i think that they are unbothered by the performance that trump does, which is a key, visceral distinction that i have with these people. but also, i think, what they want is power. trump offers them power. these guys right now believe they can purchase a bat phone into the oval office if donald trump wins. and it was funny, somebody on tv said to me the other day, yeah, but what if donald trump turns on them? what if he doesn t deliver than that? he might, though. and joe biden definitively will not. so they will roll the dice. i think we make a mistake in this country, that because you made a lot of money here you must be smart about things over here. we do it all the time on cnbc, and it is something that i disagree with. but like we will have a billionaire and asked him what he thinks about healthcare. and unless he made his billions in healthcare i am not really sure i care. it s a great point. it s interesting, but it is not essential. it is interesting as we talk , that the pronoun hymn has been used to bunch. because we ve been talking a bunch about men. and even when you said because they make money here they don t do it over there, when you think of somebody who is a billionaire, like the woman who invented spanks. sarah blakely. people are not going to sarah blakely, what do you think about what is going on over there? no. she did get knocked to the ground like that, and nobody cared. this is the other part of the story. sports are supposed to be fueled by hatred. by bad blood. by feuding. this is stuff that is great. part of the reason why i want to buy stock, business metaphor, buy stock in the nba is because people are actually invested in it emotionally, and that comes from having bad blood. the thing that is dystopian, lizz, which movie you can appreciate on this level, too. i love dystopian. yes, we are talking not so much about the story, and more about how everybody hates everybody else because they see themselves in it. and for me it becomes a culture war story, and when i say it is an endless forever war of a culture war story i mean it is because, in sports, we are still arguing about whether lebron james or michael jordan is better. we have been doing that for decades upon decades. some precincts have been reporting that it is jordan. but the point is this is not a thing that can be solved this positively by play. it is going to be, again, about how you feel. and being a minority group in a majority female, black sport that outside of that sport affords you advantages that track with the money and the attention and the privilege, it is like it is fair to object to all of this and it is fair to also say you are making too much of it, because isn t she just a basketball player? and this i will also say. i think it is also fair to say that caitlin clark knows the game that caitlin clark is in. caitlin clark is not saying anything. it is like taylor swift, when the whole taylor swift beyonce feud was happening, they were both like there ain t no feud. this happens in this sport. i just feel like caitlin clark is not screaming. there is a whole lot of pundits speaking, there is a whole lot of things. and what you said is real. the pundit point is important. because race is always a part of sports, we don t always talk about it, but it is always there. and not just what happens on the floor, but also because the vast majority of people who cover sports are white, and male , and generally they are covering, especially in basketball, covering a lot of black people. so, in this situation you see the white girl who is supposed to be the new star, who is changing everything, and she gets thrown to the ground by somebody. the white pundits especially are like oh my god, how could you do that to her? but it is not just about race. it is a lot about the fact that these sports analysts are men. as i have seen black sports analysts this week go on and on, shocked by this saying these girls out there are being mean girls to each other. in the same sports analysts watch football year after year, they watch rookies get the crap kicked out of them going that is on the game is played. but when it comes to women doing it they are like look at these mean girls up in here. and that is bull nonsense. and i agree with you. overwhelmingly it is not that the rest of the wnba is jealous and deceiving like this is a high school cafeteria over caitlin clark. but there are a couple of people who feel that way. if you were to tell me watch this clip of angel reese celebrating caitlin clark falling to the ground i can t convince you objectively that she is not taking some enjoyment. now, does that rise to the level of jealousy and mean girl stuff? i am not going to categorize it as such. but i believe in that he and bad blood can coexist. it is just a we over characterize it as this is a sport where this should not happen, all sports are fueled by this. this is my observation. i want to know if this is true. is less contact countenanced in the wnba than the nba?
