testimony. that's really when we zoom in, that's what the purpose is of this hearing. the prosecution wants to bring in these things insofar as they tend to show his falsity, his pattern of false statements. so that's what they want to bring in. really strateically they really want to back up the dump truck and bring in all the bad evidence that they can about donald trump. and that's not limited to trump as defendant. this has long been the strategy of state prosecutors, federal prosecutors, they always want to bring in bad character evidence because it's so devastatingly effective. that's why we have a rule and we have so many rules at the federal and state level that really limit how much of this comes in and leave it to the judge. in almost every case where this happens you really can't have a blueprint. it's a judgment call because it's a balancing test. and the judge is ultimately going to balance how prejudicial this is against how valuable it is as evidence, what's called the probative effect included with its relevance. but every judge has to balance that out, and there's really no

let's bring in lisa rubin. can we get back to the stipulation he made on the court document. what was he saying there, and what does the court document saying? >> he's saying in that document he's agreeing not to contest the elements of a defamation claim but he's limiting those agreements not to contest solely to that civil case. that was deeply unsatisfying to the judge who's overseeing that defamation case, and she ordered giuliani to submit a second stipulation clarifying what he was admitting or not, and to what extent he was trying to reserve defenses for himself. ruby freeman and moss have a response due to that on august 25th. i was just looking at the docket for that case. but his response to our colleague, vaughn hillyard, that he's lying by saying that rudy has admitted the falsity of those statements is itself a blatant mischaracterization of what he has admitted to. he is trying to limit his costs

account was using that function. i would be looking at a number of things, like who is he having direct messages with? is it people who are responding to his tweets? are some of those people who showed up and attacked the capitol on january 6th? are some of them people who threaten election workers or election officials in these states, particularly the states where the pressure campaign was put on. what was he saying to them, if he was having those direct messages? the direct messages also could reveal intent. could it reveal knowledge? consciousness of guilt. it is possibly that he was direct messaging people in his own circle and it is possible that some of those might acknowledge some of the falsity of the things he was tweeting. we just don't know, but i certainly know i would be interested if i were jack smith in seeing those. the other things, it is easier to guess what he was getting at. the ip addresses and locations when the account was being used. jack smith needs to know who all had access and was able to post tweets on that account.

evidence of the known falsity. i think that's a term maybe we learned from the dominion case. but this idea they knew there weren't dead people that voted. there's a mark meadows text that we've learned about where he's writing to eric hershman, my son found 12 obituaries and six other possibles depending on the voter role accuracy. hershman writes, "that sounds more like it. maybe he can help rudy giuliani write the other 10,000." meadows in what i find a haunting lol. we're talking about ending democracy, ending the peaceful transfer of power and he says lol about the delta between how many dead people voted and how many rudy was saying. i mean, they knew it was all b.s. and the lives that were destroyed and altered forever will never be the same. the trauma that shaye moss and ruby freeman experienced was a story that the committee told. but there were many people that will never want to be election workers, will never want to volunteer as poll workers, and a lot of that happened in georgia.
