one of the jurors has a toothache and needs to go to the dentist. we can all understand it. this is the scrutiny on these jurors and everybody knows little details of their life. there is a conversation about that. at the same time there is yet another juror who has expressed concerns about the media attention. they are unsure about serving and they are right now speaking with the juror in a separate room right now. martha, i get it. i understand it. a lot of coverage this weekend as people were dissecting everything they could. they don't have all the information, we don't have names but some of the jurors are concerned that their names will be revealed at some point or that friends, family, or foes will figure out who they are on the jury and make it impossible for them to feel safe doing so. >> it's difficult and why they have five alternates in the jury. sometimes they have as few as three. they may end up needing all five of the alternates part of the entire process and listen to

it's very unfair juror number nine returned to court today, worried about media attention. they went into private quarters with the judge along with attorneys from both sides. they had a conversation. they came out. juror number nine is remaining intact. we saw that court was going to go into recess at 2:00 p.m. instead of 12:30 now because of a dental emergency for one of the jurors. it was going to be from 2:00 p.m. because of passover. 2:00 p.m. recess tomorrow as well. 12:30 today. let me lay out what opening statements will look like. the prosecution will paint a story about the final days leading up to the november election, the desperation from the former president to win the election, the release of the "access hollywood" tape. they cannot submit the tape itself or play the tape for the jury, but they can submit the transcript as evidence. they're going to talk about david pecker approaching michael cohen talking about how stormy daniels is going to come forward

selected and between that and the time that the trial actually begins because, ordinarily, nothing happens during that time. but in this case, you have an example where a juror goes home, they start really thinking about their duty and what this is going to entail, they come back and say, you know what, i don't want to do this anymore. by the way, that's also something that happens from time to time. i've had it in organized crime cases. you have jurors who come up to the judge and say, i'll do anything. please, i do not want to be on this jury. i'm afraid. that's not obviously the same situation here, but you do have jurors who are going to have second thoughts. the question becomes, will six alternates will enough to cover this trial? i hope so. but if what we've seen so far, if that's the rate of loss of jurors, two before we even start the trial, that could be a real problem. that could lead to a mistrial, which in, i think, the defense's view, is a win. even though it doesn't mean you start the trial again in a year or something like that.
