starting right now, the freeway will close at 11:00 p.m. all of this started when a driver crashed into utility pole cutting power to thousands of people. here's pictures of the down power lines. besides throwing people into the dark the crash also started a fire that threatened homes in the oakland hills. quite intense for some time. here's a map of the freeway closure. 5 80 eastbound is shutting down the seminary. westbound at golf link road and highway 13 shutting down at carson. we have temperature coverage on all of this for you tonight. thomas is live with the fire itself but we begin with amma live with the freeway closure. amma? >>reporter: yes dan. we took 5 80 east an got off at the edwards exit. that's where we are. we went up the hill where the fire was. and it provides us great vantage point over 5 80 and again sky 7 we have up as well so sky 7 hd can give you a live look at the entire stretch that's going to be shut down. it was supposed to happen at 9:00 o'clock but they have pushed it back 2 hours. pg&e made the call since they are waiting for more equipment. here's what happens as soon as she shut the freeway down. >> work is expected to take between half hour to an hour. what will be happening is our folks will be walking across the freeway with two deenergy lines and they will then cinch it up and set it into place. so that business is all back to normal. >>reporter: i asked how dangerous that job was. she says that's what the workers are trained to do most dangerous part getting across the freeway which of course is why chp closing it down at 1 11:00. 5 80 between seminary and gulf link at highway 13 at carson.so do keep that in mind if planning to head out on the stretch of 5 80 tonight. this is 7 news. >> thanks very much. now again all of this began with fire above the oakland hills. started with a car crash. you can see how close the fire got to houses for a time. happened on mountain boulevard near keller avenue. the crash that hit the power pole. and the map that shows you exactly where this happened. 7 news reporter thomas is live near that spot tonight. thomas. >> this afternoon crash and fair knocked out power to about 6700 pg&e customers and burned up about 2 acres of hillside. pg&e says that all the customers power has been restored and the chp says as you related that all this began when a woman lost control of her car and hit a power pole on mountain boulevard at about 40 miles an hour. this car started series of events that led to 3 alarm fire response and mutual aid. woman driver smashed into this power pole on mountain boulevard a little before 1:40 p.m. the car broke the pole in half. severed a street light. portion smashed through the windshield steering wheel and stopped inches from her chest. gary field and another man pulled the woman to safety and away from the power lines. >> helped her grabbed the purse and set her down. >>reporter: she's still in the passenger seat. field then saw the car had started a fire. >> at the time the fire was already raging. going very fast. up the hill and spreading. >>reporter: fire soared up the hill. third alarm threatened 3 homes above mountain boulevard. 81-year-old chambers was one of 20 people evacuated as the flames came near. >> they knocked on the door. they were knocking for me to whoever was in the thousands come on out. when i opened the door all could i see was white smoke everywhere. it was so scary. all around me. >>reporter: fire came inches from 3 homes before the more than 100 firefighters on hand knocked it down. >> obviously in the oakland hills fire storms streets didn't stop. today the fire we had l gully at the bottom. street at the top and street on the right. so we didn't have a natural break for the fire which we were able to figure out where the fire was going. >>reporter: now as you can see behind me pg&e crew still working on restoring power and also repairing that utility pole. oakland police tell us the woman in the car who they have not identified at high land hospital with cuts and bruises but otherwise in stable condition. fire officials warn people that this weekend fire danger will be high in the oakland hills. reporting live in oakland, abc 7 news. l talk a little bit about the fire danger that we are facing this weekend. spencer is following that of course very closely for us. spencer. >> we have a combination of wind getting stronger and humidity getting lower combination raises the risk of fire. current wind gust, gusty at sfo at 43 miles per hour. gust at half moon bay up to 25 miles per hour. 30 miles per hour gust right now at fairfield an up north at santa rosa. so breezy to wind all around the bay area all day long. we have a wind advisory in effect tomorrow from 8:00 o'clock in the morning to continue the okay at night and straight in delta and good portion of the central valley. winds out of the north northwest gust to go 45 miles per hour and the result is that we have red flag warning in effect for high fire danger from sacramento valley to northern san joaquin valley and delta and portion of central sierra including lake tahoe area. this morning in effect 11:00 o'clock tomorrow morning and 10:00 o'clock tomorrow night for fire conditions. humidity 10 to 15 percent which is very, very low. fortunately we don't have a heat wave coming our way but it is warming up. i'll give you a lack at the 7 day forecast in just a few minutes. >> okay spencer thank you. see you shortly. we were overhead after a fire late today in hayward broke out at business that makes lift um battery. fire contained to the lab at the battery company. chemical called tl caught fire in a bucket. all employee evacuation ateed. nobody was hurt. >> moving on to other matters. tonight messerly lost a bid to get his record cleared. state appeals court upheld messerly involuntary manslaughter conviction in the shooting death of oscar grant in 2009. bart police officer at the time messerly shot unarmed grant claiming he accidentally used revolver instead of the taser. messerly serveed about a year of 2 year sentence. he wanted to clear his record to get another job in law enforcement. but state appeal court denied. that. >> judge in los angeles rules that there is enough evidence to try 2 men for the attack object giants fan brian stowe after last year season opener outside dodger stadium. carlos was in court for the judge's decision. >>reporter: sanchez sat in the courtroom and wouldn't look at his sister as he testified against him. >> i don't believe that marvin was drunk. i believe my brother was. >>reporter: she was initially booked for being an accessory to the crime since she drove the car from dodger stadium. she agreed to crop rate with police and not being charged. after she received today she cried outside the courtroom. >> last two days has been is difficult and emotional situation for her being called to testify fwm 2 people she loves. >>reporter: the defense claims that numerous witness couldn't really identify these suspects as the ones who beat brian stowe. they say there were a number of incidents that day at the stadium. >> a bunch of giants fans and dodger fans yelling profanity at each other. getting into scuffle. getting into altercation. and the question is ultimately l is it this particular group. >>reporter: pros cawtor earlier brought up a reported jail house conversation between the 2 suspects. many sf sap chez is accused oven hansment alleging he caused great bodily injury to stowe but the judge dropped that against norwood mrichlt norwood started out as being the ultimate peace maker in this matter. i think things got out of hand. he probably lost control mr. sanchez but remains that ultimately he took part maybe less culpable in the actual attack. >>reporter: brian stow family post add note on facebook saying thank you and they trust the justice system will prevail in the end. he faces 11 years in prison. norwood faces nine years in prison but if brian stowe dies then the 2 suspects could be charged with second degree murder. reporting from los angeles, abc 7 news. there is a in novato, wayne friedman 7 news. >> what a story. driver was trapped for almost 2 hours inside a water truck in remote napa county canyon this mornin morning. happened near ross road and state road 128 south of saint helena 8:30 in the morning. construction worker called emergency services when he heard the driver yelling for help. he suffered moderate injuries. in san francisco crew rescued a man who fell and got trapped under a muni streetcar. accident happened on market at 7th street. witnesses say the man may have gone over or may through a railing to catch the streetcar then fell. officials say his injuries are not life threatening. then this. driver who led police on chase through contra costa county is in custody. pursuit began after officers spotted the truck that they believe was stolen last night. driver eventually ran over a spike strip. officers laid out on interstate 6 80 puncturing the tires. that's why you saw all the sparks. all right. >> go back and talk to the worst economic records in the country. is that true? political reporter mark matthe matthews tonight with the fact check. >> ad begins saying the president approved the message then blast mitt romney years as governor of massachusetts claiming that he presided over one of the worst economic records in the country. >> when mitt romney was governor massachusetts lost 4 40,000 manufacturing jobs. rate twice the national averag average. fell to 47 in job creation. fourth from the bottom. >>reporter: fact check. that's misleading. massachusetts did lose 40,000 jobs under romney but it lost even more the year before he took office. under romney massachusetts didn't fall to 47 it climbed up from 50. by the time he left massachusetts was ranked 28. >> instead of hiring workers from his own state romney out sourceed call center jobs to india >>reporter: fact not. not exactly. what romney did was veto a measure that would have prevented the state from doing business with a contractor who was relocating state customer service calls to india. democrat control the legislature could have over ridden romney veto but didn't. veto was supported by leading newspapers as a savings to taxpayers. >> he cut taxes for millionaire like himself while raising them on the middle class. >>reporter: fact check that's only partially true. romney didn't cut taxes for millionaire. he opposed a plan to impose a capitol gains tax retroactively. insisted on delaying that tax hike for eight months. as for resisting taxes on the middle class, he imposed a number of fee but none of them targeted middle income workers. he also proposed cutting the state income tax three times. now that would have cut taxes for all taxpayers but the state democratic legislature wouldn't go along. >> so now when mitt romney talks about what he would do as president. >> i know what it takes to create jobs. >> remember we have heard it all before i know how jobs are created. row many any economic. it didn't violence the photo posted on facebook syrian children pleading with president obama daughters for help. people continue to bury their dead. and also to protest the massacres. what seems to be emerging according to sources is a process of ethnic cleansing wheby population considered disloyal to president assad are moved out so that he can consolidate control in what might become a divided syria. and in the mean time these sources say assad has no intention of abiding by the cease fire plan if he does they say it would mean the end of him and his regime. abc news, new york. three days after the and his administration however says it may appeal today's ruling. supporters of proposition 29 the 1 dollar cigarette tax hold out hope tonight the measure appeared to be headed for defeat tuesday but the gap is narrowing as more late ballot are tabulated. now losing by roughly 40,000 votes. election officials say roughly 3 quarters of a million votes many absentee ballot are still being counted. it would raise millions of there are for cancer research. secretary of state in california says he does not expect an official tally until july. so we have to wait and see. >> tragedy in california park. federal investigators are trying to figure out why 9 horses and mules died. the death of the animal happened at remote pasture in the politics national wild life refuge. we have the story from fresno. >> there were 17 horses and mule ins a pasture similar to this in the politicsly national wild life refuge. park service says of that group 7 mules and 2 horses did not have access to water. >> it's literally like lasting several members of your family. these animals were a vital part of our operation. really part of our team. our staff is heart broken. >>reporter: she wouldn't say how long the animals had gone out hydration only that they had spent the winter there and were about to be transferred back to the sequoia and king canyon national park. >> we can not conduct our operation without them. this is really a tragic loss for the national park service. >>reporter: park service staff used the horses and mule to carry equipment and supplies to get to the back country as 97 percent of the park are wilderness areas. but when the weather gets cold only a few horses and mules remain at sequoia and king canyon. the rest spend the winter at picksly. >> we don't need all
