>> i cannot see i am. the only surprise here is she lasted this long. someone who cannot unequivocably condemn calls for genocide has no business being at the helm of a tax payer supported university plus she clearly did not know her own student code of conduct. i looked up the student handbook at mit, you penn and harvard all explicitly banned religious discrimination. for her not to know that and for her also to not understand title vi of the civil rights act banning discrimination based on national origin, i believe that lack of knowledge is extremely disqualifying. jon: it was really congresswoman elise who elicited some of the most damaging statements or non- statements from these college presidents wouldn't you say? to her question there's also a congressman who asked these college presidents what have you done to hold people accountable for the anti-semitism on your campus who has been a punished question mccue has been fired the absolute was absolute crickets is why the most awkward things i heard a long time and their silence was deafening. jon: why do you suppose it was so hard for them to condemn anti-semitism? >> these colleges are stuck between iraq and hard place. i would like to believe everyone knows in their heart condemning anti-semitism is a one 100% the correct thing to do. but many of these colleges also taken money from foreign sources when the biggest donors or contributors being qatar is patently anti- israel which gives safe harbor to the hamas leaders. the qatar money coming in is a big deal because by law universities need to report their foreign funding. but historically in many of them have not and there's some of the biggest offenders in terms of noncompliance but i believe money talks and unfortunately's college presidents have a allowd their campus cultures to be shaped by places that are patently anti-semitic. jon: they called on the ivy league for a reason. they have ivy colored walls and columns beautiful campuses you say they're getting a lot of money from middle eastern arabic countries that hate israel? >> absolute that is one 100% correct. while federal law places no limit on the amount of foreign funding a college or university can take in, the rules are the colleges need to be transparent about how much money they are getting and where it is coming from. former secretary devos i had the privilege of serving under at the department of ed uncovered billions and billions of dollars of fun reported foreign funding. the law is there it just does not have teeth there is a new law called the deterrent act just past the house last week that stringently reporting requirements as real penalties for schools who do not comply. jon: will be talking later in the hour with congressman dan we had him on last week he is a congressman from pennsylvania we are going to get his take on all of this. but it is interesting -- met it was like when you watch the statement put out on social media it was obviously in a teleprompter. it was obviously rehearsed and filled it with a passion but that passion seemed to fall a little flat after the performance in front of congress. >> it was clearly not heartfelt it was obviously damage control. i believe the public and upenn students see right through that. i was reading something earlier today how college campuses across the country jewish students feel unsafe they feel like they are not being protected. that feeling is rational but at the same time these pro- hamas students felt unsupported. if you are in the streets cheerleading for terror and calling for genocide, i would hope you feel unsupported by your college. that should be the bare minimum. these schools need to do more than issue he's half-baked pr statements. >> it is the argument about free speech. they're trying to hide behind a cover free speech has to be tolerated. how do you answer that? how you slice and dice that? >> it's awful convenient these college leaders seem to discover free speech when it's easy for them to try and defend the pro- hamas students. were they called for free speech when conservatives are being censored? he had that sweetheart deal, hunter did that was going to whitewash his record. but now he is looking at not only this indictment but the gun charge indictment. what has changed? >> nothing, absolutely nothing. it's a great question though. remember this was a spiked case it made this was a case that was going to be declined from prosecution. the tax case and the gun case and went to the sweetheart deal that jonathan turley reference. i don't know the judge was in the case asking reasonable questions i think the deal could have been salvage their still would've been to misdemeanors and diversion for the gun charge if he had just not linked his double jeopardy clause to the diversion agreement. which had never been done before. and just accepted the deal and any exposure he might have had going forward. this would always be over. he has nine counts in cali california. he's got a handful of delaware for the gun charges he's not going to get 17 years for the tax charges. he is looking at time. he certainly looking at his freedom being abridged. but as far as the facts, as far as the law, nothing has changed. >> what does this affect the man who occupies the oval office? we heard from jonathan turley earlier. i want to read part of an op-ed he wrote in the hill today. he writes on the false narratives being banned about is there is no proof the influence peddling biden's son and brothers have benefited the president himself. that he says is utter nonsense. i thought repeatedly found benefits to family members far more modest than the millions in this case cannot constitute bribery for a politician. do you agree with that?
