baier. breaking tonight we are following two major stories the president's son defy as congressional subpoena to appear privately for a deposition about his business dealings. and leading off, the house has voted to formally initiate an impeachment investigation into president biden. senior congressional correspondent chad pergram is on capitol hill with what exactly this means. good evening, chad. >> chad: mike, good evening. first the house wanting information from the son. then the house turning to an investigation of dad. the house just voted to formalize an impeachment inquiry for president biden. the vote 221-212. the house could have been on firmer legal ground enforcing its subpoena for hunter biden to appear for a deposition today had the impeachment inquiry already been in place. instead, hunter biden skipped out. >> all we're trying to do is get the needed people who have been blocked or refused to cooperate to come in and testify under oath before congress. >> chad: the house lacked the votes to initiate the investigation for months, but moderates from swing districts finally climbed on board. democrats accuse their colleagues of a fishing expedition. >> i want to give james comer some credit because after 50,000 pages of depositions and secret hearings and closed hearings, i think if we give him enough time he is going to prove that hunter biden is joe biden's son. >> republicans say it would be malpractice not to investigate further. >> the democrats would have us simply turn a blind eye to mounting evidence of a family influence peddling scheme that inimplicates the president. >> chad: democrats contend want to foster narrative for 2024 as former president trump goes to trial. democrats also allege the g.o.p. is out for revenge. since they impeached the former president twice. >> this has never been about the truth this is about avenging donald trump. this is about undermining our democracy and influencing the 2024 election. >> a vote to bless the investigation is not the same as impeaching the president. also the house just voted to cob item anti-semitism on campus. the vote 303-126 with three voting present. mike? well, here's my answer. i am here hurnd defiant as he arrived outside the capitol building moments after he was due inside this room for a closed deposition under oath. his name tag visible. the chair empty. outside the president's son maintained he will only testify in a public hearing. >> republicans do not want an open process where americans can see their tactics. expose their baseless inquiry, or hear what i have to say. >> house republicans planned for the younger biden to arrive. instead they found themselves watching his comments on tv. >> this has been a 10-month investigation, a credible, transparent investigation that is produced a lot of troubling evidence. >> he is also facing two criminal indictments in federal court. speaking to congress on the record could jeopardize those legal battles as any comments on capitol hill could be used in court. house democrats defending hunter biden from republicans. >> why? because they wanted to conduct the deposition in a closed door interview so the public couldn't see it and so they could continue to cherry pick little pieces of evidence and distort and misrepresent. >> mike, house republicans said they are going to move forward with contempt proceedings. if it eventually passes the house to hold hunter biden in contempt of congress, it may land on the desk of u.s. attorney matthew braves here in washington, d.c. who is appointed by hunter's father, the president. >> mike: former president trump. >> david: mike, that's exactly right. the supreme court agreed to hear an appeal from a former police officer charged with obstruction. he is one of more than 300 defendants who have been charged with trying to disrupt the congressional certification of the 2020 election. that includes the former president who faces a march trial. march 4th and other election inteerns claims. the supreme court review of this all could actually put donald trump's march 4th trial date in jeopardy, mike? >> mike: we will follow it. david spunt on the hill. thanks a lot. donald trump's election interference case in washington is on hold tonight. the judge ruled today the proceedings will wait until mr. trump pursues his claims that he is immune from prosecution. the u.s. supreme court will decide whether to hear arguments on the matter. president biden's team is backing up a bit from yesterday's comments about israel's tactics against hamas terrorists. this comes amid a major shift in the president's handling of the legal problems involving his son. white house correspondent peter doocy has the story. good evening, peter. >> peter: ever being told president biden and hunter biden coordinated on a public statement. the wall that has been up between them to protect president biden has been breached as officials are telling us that president biden was familiar with what hunter was going to say before he popped up on capitol hill. >> if i called my dad and said "i am about to violate a congressional subpoena," he would probably say, "son, you shouldn't do that." was there any attempt by president biden to talk hunter out of it today? >> as officials cleaned up his comments to donors about international sport for israel, quote: they are starting to lose that support by the indiscriminate bombing that takes place. >> the president was expressing concerns again, as i said, about the civilian casualties that we have seen. >> peter: and about benjamin netanyahu, quote: he is a good friend but i think he has to change and with this government. this government in israel is making it very difficult for him to move. >> the president realizes that israel is a powerful, vibrant democracy and any change in the government is going to have to be determined by the israeli people. >> even though president biden said that israel was indiscuss victim natalie bombing gaza which would be a war crime, his team says he was not meaning to accuse them of committing war crimes. and that despite this recent criticism, the president remains a friend of israel. mike?
