there is more to this story than being reported. we will tell you the truth of the matter. also ahead tonight, laura ingraham on why bowe bergdahl's attorney is not in love with the factor and dennis miller on joe biden possibly running for president. caution, you are about to enter the no spin zone. the factor begins right now. ♪ ♪ hi, i'm bill o'reilly, thanks for watching us tonight. donald trump vs. who jorge ramos. that is the subject of this evening's talking points memo. yesterday jorge ramos disrupted a press conference held by donald trump. the the media has not, has not reported this story honestly but talking points will this evening. it all began when mr. ramos jumped the line and began asking mr. trump about his immigration policy when he had not been called upon. trump had ramos removed. correctly saying that he had no right to ask his questions without being recognized. it is every political candidate's right to regulate q and a sessions and if they don't chaos will ensue. that's what happened with mr. ramos. that being said, if trump was avoiding ramos, the anchorman does have a right to ambush him, to try to get some answers to his questions. but that is a last resort. donald trump is suing univision over it dropping his miss universe pageant so obviously he is not a fan. however, ramos was admitted to the press conference. now, i believe jorge, had he been more patient, would have gotten his answers from trump because donald does not usually avoid confrontation as we all know. it looked like mr. ramos grandstanded the situation, hoping to generate publicity for himself. that's what it looked like. again, he should have waited his turn. a few minutes after he. few minutes he brought him back. >> somebody on the other side of the border, a woman is getting ready to have a baby. crosses the border one day. has the baby, all of a sudden for the next 80 years, hopefully longer, but for the next 80 years we have to take care of the baby. >> deporting babies. >> excuse me, some of the greatest legal scholars and i know some the television scholars agree with you but some of the great legal scholars agree that that's not true. that if you come across. >> excuse me deporting babies. >> no, i am answering. if you come across for one day, one day, and you have a baby, now the baby is going to be an american citizen. it's going to be tested. okay? >> so the question is how are you going to build on 1900 miles wall? >> >> very easy, i'm a builder. that's easy. i build buildings that are. -- can can i tell you what's more complicated? what's more complicated is building a building that's 90 stories tall. >> isn't it a waste of time and money. >> by saying the border wall is a waste of time and money as mr. ramos did at the end of that sound bite, he is editorializing. not simply probing for answers. that's the key. jorge ramos has now become an advocate for people who enter the u.s.a. illegally. and that has superseded his job as a journalist. he is a man who wants amnesty for illegal aliens and not only that he doesn't really want to stop illegal border crossings. a case can be made that mr. ramos is an open-border guy, certainly a far left position. so let me ask you a question. what's the difference between jorge ramos on immigration and black lives matter on race? what's the difference? both are advocating policies from a distinct political point of view. now, that's allowed in america. howhowever, when an anchorman does it, that becomes a problem. we have been trying to get jorge ramos on this program for months, especially after the kate steinle murder in san francisco allegedly by an illegal alien felon who been deported five times. mr. ramos would not speak to me about that. he hid under his desk. isn't it interesting that when events like kate steinle's murder occur can, the pro-illegal alien crowd disappears or deflects the security issue. i have a very simple question for you, who jorge, do you support kate's law? you can email me the answer since you won't appear on the factor. after the trump deal last night, we asked mr. ramos to, again, appear. no luck. now, donald trump usually takes tough questions as you have seen here over the past few months. you may disagree with his position on illegal immigration and talking points has challenged it. but when you have a guy like ramos who disappears after the steinle murder, and a guy like trump who stands up, that's a pretty stark comparison, is it not? think about it. jorge ramos is the most influential hispanic anchorman in the u.s.a. and mr. ramos is an amnesty guy. so how could he possibly report the immigration issue fairly? how? the answer is he can't. it's not possible. jorge ramos went to iowa to try to debate and embarrass donald trump not to get answers for his audience. if mr. ramos wants to be a commentator like me, that's fine. if univision and fusion are putting the man up as an objective purveyor of news coverage, that's fraud. so let's recap. trump was right to control his press conference. ramos has a right to ask his questions if they will not be considered. he has the option of ambushing any candidate. however, that should be a last resort. talking points believes ramos has become a zealot. advocating far left positions that most americans reject. to be fair, trump is advocating a hard right position on immigration and specifics are hard to get from him. but he does show up to address the questions. those who despise trump are trying to use the ramos i want as another example of his immaturity and hostility with those whom he disagrees. but if you step back, if you step back and look at it objectively, who is really being upfront with the american people? an anchorman who has become a political activist or a candidate who states his case and takes the heat? you make the call. and that's the memo. next on the rundown, reaction, then a brutal murder on live tv in virginia. we have the inside story on why a reporter and a cameraman were shot dead this morning. the factor is coming right back. when heartburn comes creeping up on you. fight back with relief so smooth and fast. tums smoothies starts dissolving the instant it touches your tongue. and neutralizes stomach acid at the source. tum-tum-tum-tum-tums smoothies, only from tums. excuse me, uh, is that anything like, uh,ce and repair. cars.com's new feature called service and repair? do you want to give amnesty to all the illegal aliens already here. >> no, mr. o'reilly. you and i have talked about it several times. you had a very good five point proposal that congress seemed to overlook. let them buy the ticket to the bus, let them pay their fines, commit no crimes, apply, create a process which, if you listen to mr. trump, he is forecreating the process. mr. trump is more pro-immigration reform than any of the republicans or democrats. >> that's interesting that you say that. >> i'm not saying i'm with him but i'm just telling you. >> okay how about a wall? >> i'm not surprised. >> i'm going to andrea now. sorry. >> he is not down the middle news anchor. he is an opinion journalist. he went there to disrupt. you know what he did? he proved trump's point? trump didn't want to sit down with him at univision because he knows he is not going to get a fair shake. he needs to take some lessons from watters how to do it. he went there to be disruptive he went to prove trump's point, you got a bias against me. hispanic media has been unfair to mr. trump and jorge ramos is exhibit a. >> he is also a very powerful man. >> i agree with her by the way. >> what is univision and fusion doing? >> no. >> i have got to tell you, francisco, if trump could be president, trust me, he would be president. >> wait until he announces howard stern for vice president. >> he likes the action. people have to understand he likes the action. but there is a bigger issue here because hispanic americans don't like donald trump now. the polls say that pretty -- even though he disputes it and the polls are pretty clear. most of hispanic americans have a negative opinion. and it's driven by jorge ramos who is not being honest with the folks. >> no, no, no, mr. o'reilly. jorge ramos' viewership are not united states citizens. is he speaking to the spanish speaking population. >> that's a big time in miami and houston and los angeles. you know, he is is the most powerful hispanic anchorman and he is not being upfront. he is not. >> he might be, but he is not influencing u.s. votes. >> which is an even bigger reason why trump shouldn't sit down with him. >> he should sit down with him. >> i disagree, i used to be a former press secretary, bill, and i would not advise if i were mr. trump's secretary for him to sit down in an interview where he knows the person interviewing him is going to be openly hostile. >> it doesn't matter. if it's a live interview on a neutral site which is the only way he should do it? >> why. he can sit down with other outlets. why give access which is the one thing ramos needs and wants. >> wait a minute, francisco, i will tell you why. he can do just what i did. i love andrea here, there is no one that i would rather have here. >> his loving ois -- i can sense it. >> i would school jorge ramos. you are swell francisco but you just hold on for a minute. >> kate's law. all right, jorge, indicate's law, do you want kids coming back six times and killing young women? is that what you want? that's what you got. how is jorge going to answer that? trump should do the same thing i do. that's why you should sit down with him. >> i think trump gives unprecedented access to outlets that might not necessarily be friendly. he sits down with nbc, cbs, all of them. he is not going to give access to someone though basically took opportunity to give sill sill low question about immigration. >> last word, francisco, make it smart. >> mr. o'reilly, mr. trump has no intention of becoming president. he is going to buy a president. if we listen to what he says, he says he will create a process whereby undocumented folks go back to their country and come back legally. the question needs to turn around, give him a microphone tell him how will you do it? i'm in on. he told you about the wall. if you think you can pay for it, pay for it. >> specifics are always good for every political candidate. very good debate. thank you, guys. directly ahead, viewer warning, awful murder in virginia. tv reporter, photographer shot dead during a live shot this morning. we will have the inside story about why this happened. and, later, miller on his two best friends, joe biden and slald vlad putin upcoming. unresolved problem segment tonight, another gruesome murder, this one played out live television. this morning in monette that virginia, alison parker reported for wdbjtv. doing a live shot as she does many mornings. sudden isenly a gunman approached and murdered misparker along with 27-year-old cameraman adam ward. >> we are saying tourism. we want the people ha come here to say that was. [gunshots] [screams] oh my god. >> it is my very, very sad duty to report alison and adam died this morning shortly after 6:45 when the shots rang out. >> police say 41-year-old vester lee flanagan who worked as a reporter at the tv station calling himself bryce williams is the killer. later in the day, after a chase with police, he killed himself. joining us now from roanoke, virginia jeffrey marks, the president and general manager of wdbj. first of all our condolences to everybody suffering because of this horrific murder. now, tell us about flanagan. how long did he work for you? was he a problem? and is there any motive in what he did? >> well, he worked for us for about a year in 2012 and 2013. he was not well suited to the role, let's say. his reporting work was not up to our expectations and he had trouble fitting in and working with people, frankly. and so we thought it would be good if he didn't work for us anymore. and we let him go early you in 2013. >> now,. >> after that he filed a complaint with the equal opportunity employment commission claiming various discriminatory and harassing acts, none of which had any connection to the truth but and equal employment opportunity commission threw it out. >> all right. so he was a disgruntled employee that you fired. he issued a manifesto of some kind that said he was a gay black man who was attacked racially through remarks by the young woman who was killed, your reporter. did you ever hear about anything like that before today? >> not about her specifically. i don't recall any connection specifically between adam and alison and and mr. flanagan. but he did have complaints that people would say things that he took as racial comments. it was completely without foundation. our hr people investigated it our employees stood up and said no, this is not what happened at all. this is flanagan looking for or perceiving slight where they didn't exist. >> it was some time after you fired him that he decided to turn violent. in that time period where he was gone from the station, was there any interaction between flanagan and ms. parker? >> not that we know of. the only interactions with him came on those rare occasions when somebody would run into him at the grocery store and then to my understanding there were just no confrontations. we thought that, you know, we had dealt with it at the time. we had handled it humanely, and that when the eeoc charge was dropped, and shortly thereafter there was no more communication that i recall. >> did anybody say to you, mr. marks today, is there any working theory why he would pick these two individuals, i mean, i don't get it. alison parker is a nice reporter. she is a nice woman. everybody says so. adam ward, young cameraman, i worked in scranton, pennsylvania, you know, that's like your station. people are -- work hard. most of them get along. i mean, why we target these two individuals for this heinous crime so long after you let him go? is there any workable theory there? >> well, there may be one at law enforcement. but i'm not law enforcement. i'm spending the day concerned about my employees. you know, i teach young journalists and what i teach them is, you know, two things about the people you cover. one is what they say, and two is what they do. you do not know what they think or they feel. and when we get into that, we are trying to be mind readers. he you have no idea what motivated him any more than i know what motivated the shooter and in the theater or in the school or in the army base. we just cannot get into the minds of these people. and frankly, it's not in my interest to do it. that's what law enforcement and the courts are about. >> final question. small station, close news room. everybody knows everybody. how are you guys going to deal with this going forward? >> we are going to deal with it somebody asked me well, how do you reconcile being the center of the story with having to cover it? i say you don't. you just have to get out there and do your job. and if you are cry not guilty commercial breaks, that's what you are doing. and that's what our people are doing. it's going to take a long time for this to heal if it ever does. we will always be the television station where these two people were shot and killed. and you just deal with it we have a room full of professionals. people have been here 30 years or more. people who are fairly he knew to the business. they are working closely together and learning from each other today. that's all you can do is press forward, take the mountain, and do a lot of praying. >> our prayers are with you, mr. marks, and your staff and all who have been affected by this terrible murder. and i know it's a very difficult day for you, sir. and i appreciate you will coming on and talking to the country and the world about what happened there. thank you very much. plenty more ahead as the factor moves along this evening. did you know that bowe bergdahl's lawyer, angry with fox news, laura ingraham will tell us why. also, dennis miller on his two best pals, putin and biden, things could get raucous, we hope you stay tuned to those reports. truth serum segment tonight. politicians given to charity as we recently reported bill and hillary clinton gave a lot of money to charity. about 11% of their multi-million-dollar income. problem is almost all of that money was given to the clinton foundation or another clinton charity, which benefits the clintons themselves. as well as people who truly need help, you have to be fair. so we asked our truth serum investigators to come up some other data with other people running for president. with with us is shannon bream. begin with you, who has put forth charitable giving so far. >> we have the tax returns for carly fiorina and jeb bush going back several years. they show us if you look at the amount they are taking for charitable deduction, carly fiorina was 13.4%. that's a pretty good chunk. jeb bush 1.5%, but his folks say, listen, they contributed a lot more since then and they say he raises a lot of money for other groups outside of this, including education, the bush family fund, and others. they say he has done millions in fundraising for them and that should count. >> all right. so mr. bush 1.5% though, and he earned more than $7 million in 2013. these are the tax returns we are citing here. that's not a lot. but it's not a lot for biden either who is historically very parcimonious word of the day. what's his deal. >> coming in less than 2% in charitable giving there is a lot made in 2008 when he was part of the ticket running with president obama. they went back and looked at his record and found he gave an average of $369 a year. he got a lot of heat for that. >> biden made 338, 884 as vice president. he doesn't have a lot of money. he does not like al gore before him has not given a lot of money to charity. what about bernie sanders who wants all of our stuff. how much does he give to charity? >> he comes in at 4%. he is giving over $8,000 off a sal riff just over 200 now. a higher number from him had. of course we have the clintons you mentioned almost 11%, we're talking over $3 million. but, 1.8 million of that went to the clinton foundation, which does, in some ways benefit the family itself. >> right. okay. so the rest of the republican
